    5, Arak Modernisafion Project

    5.1, As described in Section B of Annex I, an international parlnership composed

    of E3/EU+3 parlies and Iran. which may subsequently be enlarged to includemutually determined third countries will be established, o support and facilitatethe redesi,,n and rebuilding of the 1R-40 reactor at Arak into a modernised, not

    exceeding 20MWth, heavy-water moderated and cooled research reactor, basedon the agreed conceptual design (as attached to Annex I).

    5.2, han will take the leadership role as the owner and as the project manager, andhave responsibility for overall implementation of the Arak modernisalionproject. A Working Group composed of E3!EU+3 participants will beestablished to support and facilitate the redesigning and rebuilding of thereactor. An international partnership composed of lran and the Working Groupwould implement the Arak modernisation project, with E3iEU+3 participantsassuming responsibilities as described in Annex I. The Working Group couldbe enlarged to include other countries by consensus of the participants of the

    Working Group and Iran. E3!EU+3 participants and Iran wilt conclude anofficial document expressing their strong commitments to the Arakmodernisation project in advance of Implementation Day which would providean assured path forward to modernise the reactor and would define theresponsibilities assumed by the E3!EU+3 participants, especially in the keyareas such as redesign, design review and certification, reactor core

    manufacturing, fuel design, fabrication and supply, safety and security, spentfuel treatment or disposition, as well as concerning the supply: of materials,

    equipment, instrumenlation and control systems, and subsequently contractswould be concluded. The participanls of the Working Group will provideassistance needed by Iran for redesigning and rebuilding the reactor, consistentwith their respective national laws, in such a manner as to enable the safe andtimely construction and commissioning of the modernised reactor.

    5,3, han and the Working Group will cooperate to develop the fina! design of themodernised reactor and the design of the subsidiary laboratories to be carriedout by lran, and review conformity with international safety standards, suchthat the reactor can be licensed by lhe relevant h'anian regulatory authority forcommissioning and operation.

    week following receipl of such a request, except for consultations inaccordance with Section Q of Annex I and any other matter that the

    Coordinator and/or a JCPOA participant deem urgent, in which case themeeting will be convened as soon as possible and not later than three

    calendar days from receipt of the request.

    Meetings of the Joint Commission will be held in New YorL Vienna, orGeneva as appropriate. The host country should facilitate entry formalities

    for those attending such meetings.

    The Joint Commission may decide by consensus to invite observers to

    attend its meetings.

    Except as provided in Section 6 of this Annex which will be subject to theconfidentiality procedure of the UN, the work of the Joint Commission is

    Procurement Working Group will consider proposals according to thefollowing process:

    Upon receipt of a proposal, including all necessary supporting information,by a State seeking to engage in transfers and activities referenced inSection 6.1, the Coordinator will forward the proposal, through appropriatemeans, without delay to the Procurement Working Group and, when theproposal relates to items, material, equipment, goods and technologyintended to be used in nuclear activities authorized by the JCPOA. to the

    IAEA. The Procurement Working Group will have up to 30 working daysto consider and decide on the proposal.

    '"Necessary supporting information" for purposes of Section 6.4.1 means:

    (a) a description of the item: (b) the name, address, telephone number, andemail address of the exporting entity: (c) the name address, telephonenumber, and email address of the importing entity; (d) a statement of lheproposed end-use and end use location, along with an end-use certificationsigned by the AEOI or the appropriate authority of Iran attesting the statedend-use: (e) export license number if available: (f) contract date, ifavailable: and (g) details on transportation, if available: provided that ifany of the export license number, contract date, or details on transportationare not available as of the time of submittal of the proposal, suchinformation will be provided as soon as possible and in any event as

    condition of approval prior to shipment of the item.

    Each participant in the Procurement Working Group will have tocommunicate to the Coordinator. within 20 working days, whether itapproves or rejects the proposal. The timeline for consideration may beextended for an additional period of 10 working days at the request of aparticipant of the Procurement Working Group.

    The proposal will be recommended tk)r approval as soon as the Coordinatorreceives formal approvals from all the Procurement Working GroupParticipants or if, at the end of the 30 working day period, the Coordinatorhas received no disapprovals from any of the Procurement Working Group

    Annex B: Statement

    Statement

    China, France, Germany, the Russian Federalion, the United Kingdom, the UnitedStates, and the European Union have concluded with [ran a Joint ComprehensivePlan of Action (JCPOA) to reach a comprehensive, long-term and proper solution tothe Iranian nuclear issue. To improve transparency and create an atmosphereconducive to the full implementation of the JCPOA, China, France. Germany, HieRussian Federalion. the United Kingdom, the United Slates. and the EuropeanUnion have set forth below certain provisions. Their participation in the JCPOA iscontingent upon the United Nations Security Council adopting a new resolution thatwould, acting under Article 41 of the UN Charter: terminate resolutions !696(2006), t737 (2006), 1747 (2007), 1803 (2008). t835 (2008), 1929 (2010). and 2224(20!5): require States to comply with the provisions in this statement lk)r theirrespective durations: and facilitate, in cooperation wilh the Joint Commission
