NOTICE:
The Unit Operator gave notice to the Applicants that the Board would consider its disbursement petition at theDecember 18, 2012 hearing and considered whether to:
(1) Amend the Pooling Order to provide for the disbursement of funds on deposit in the EscrowAccount attributable to Tract(s) 1C, 1E, 1F identified in the attached petition.
(2) Delete the requirement that the Unit Operator place future royalties attributable to Tract(s) 1C, 1E, 1F relative tothe interests of the Applicants identified in the attached petition.
(3) Continue the escrow account under this docket number.

Applicant has certified and represented to the Board that:

On February 16, 2010 the Board approved the disbursement ot funds for unit FF-32. Monies were disbursed by theBoard. CNX discovered that funds were posted to unit FF34 instead of FF32 in error. The monies were moved to the
proper account and this disbursement directs how the $9,007.93 should be disbured to each individual as an exactdollar amount.

1. The Escrow Agent is ordered, to within ten (10) days of receipt of this executed order, disburse funds forthe unit and applicants detailed in Table 1 and 2.
2. The Escrow Agent is ordered to continue the Escrow Account for the Subject Drilling unit based on theattached Revised Exhibit E which replaces all prior Exhibit E's recorded for the Subject Drilling Unit.
CONCLUSION:
Therefore, the requested relief and all terms and provisions set forth above be and hereby are granted and IT IS SOORDERED.
APPEALS:

Appeals of this Order are governed by the provisions of the Code of Virginia g 45.1-361.9which provides that anyorder or decision of the Board may be appealed to the appropriate circuit court and that whenever a coal owner, coaloperator, gas owner, gas operator, or operator of a gas storage field certificated by the State Corporation Cornrnissionis a party in such action, the court shall hear such appeal de novo,

A petition for the disbursement of frunds from escrow regarding tracts 1C, 1E and 1F in exactdollar amounts to correct prior disbursement of $9007.93 posted to wrong account unit FF-32,New Garden District, Russell County, Virginia.

Va. Code Ann. g 45,1-361.1et seq., 4 VAC 25-160-140., and relevant Virginia Gas and Oil
Board Orders ("Board" ) heretofore promulgated pursuant to law.

On February 16, 2010 the Board approved the disbursement of funds for unit FF-32. Monieswere disbursed by the Board. CNX discovered that funds were posted to unit FF34 instead ofFF32 in error. The monies were moved to the proper account and this disbursement directs howthe $9,007.93 should be disbured to each individual as an exact dollar amount.
