Proposals may be referred to the Ministry of Human Resource Development only in case the Institute feels that it also requires specific clearance / inputs from the Ministry. The aforesaid O.M. clearly lays down guidelines regarding obtainingthe security clearance for holding conferences, procedures for obtaining visa forthe delegates, participants, etc. Henceforth, all the proposals related to thissubject may be processed in the IITs accordingly.

Proposals may be referred to the Ministry of Human ResourceDevelopment only in case the Institute feels that it also requires specificclearance / inputs from the Ministry.

i.~;/ 3 If the conference/seminar/workshop is sponsored by all NGO,if'i' the Mission would scrutinize the background of the NGO and grant

visa to the participants if the Nodal/l.ine Ministry concerned of theCentral! ,State Government has cleared/ approved theconference/seminar/workshop. If Mission concerned has any doubtabout the background of the sponsoring NGO, the matter may bereferred to MEA, MHA or the noc/al/Line Ministry for verification of thebackground of the NGO concerned .

4 Missions shall carefully examine the subject of theconferences/seminars/workshops and Visa shall not be issued torevents, which involve politically and/ 01' socially sensitive subjects.

(IJ) F)arlicipants of conterences/sern'nars/worksnops whoare required to visit 'Restricted' or 'Protected' areasin India, or areas affected by terrorism, militancy andextrem ism etc. viz. Ja ill III U &. Kashmir and the t'-JorihEastern States.

In the above cases, MEA will examine the proposal along with fV1H!\and grant clearance within four weeks. Clearance will be conveyed tothe Missions, nodal lVlir:1istry and organizers of the conference. Incase a Mission needs clarifications 'about the organizers, it can alsorefer the case to the nodal Ministry, as well as MEA and fV1HA .. Insuch cases, visas will be issued after the Mission 'receives requisiteclarifications.

6. Following procedure shall be observed for seeking priorsecurity clearance for the International conference/seminar/workshop(event) from the Ministry of Home Affairs:

(iii) No request shall be entertained directly from anyprivate organizer - be it an NGO or private institution.It is the nodal Ministry which is entrusted with theresponsibility to entertain the request from privateorganizers and to examine at their level as to whetherthe event requires prior security clearance from fV1HA.,having regard to subject, location and nationali yparameters listed above, If security clearance isrequired, the nodal ministry will forward the proposal toMHA for prior security clearance within the prescribedtime frame (as indicated above),

8. When the event is cleared, the 'Ministry of Home Affairs wouldinform the Missions·concerned accordinpiy and would authorise grantof visa in respect of. specific individuals. . Names of' foreign

participants would·be communicated to the Missions. No visas wouldbe authorised to any' individual who has not been specificallymentioned in the cornrnunrcatron from the Ministry of Home Affairs.

9. It may please be noted that in view of the revised procedure forgrant of -eGr-:-fer:eAC-Bvisa as explained above, clearance from theMinistry of Home Affairs for holding aneventfr.om security anglewould be required only in respect of cases cov.ered in para 5 aboveNo security clearance would be granted .by MHA for any event whichis not covered by para 5 above.

In the above case's; Ministry of External Affairs will examine -the proposal along with the Ministry of Home Affairs and grantclearance, within four weeks. Clearance will be conveyed to theMissions and organizers of the conference,

Whilesubmitting the proposals for security clearance to theMinistry of Home Affairs (Foreigners Division), the UniqueID (File no.) of the visa application in respect ofparticipants from Pakistan who have applied for visa at HelIslamabad may invariably be furnished along with theapplication. Clearance in respect of participants fromPakistan will be given by the Ministry of Home Affairs only'on line'.

In view of the revised procedure for grant of conference visa asexplained above, clearance from the Ministry of Home Affairs forholding an event from security angle would be required only in respectof cases covered above .. No security clearance would be granted byMHA for any event which is not covered above.

Q.4 What is the duration of the Conference visa?

Answer: Conference. visa will be issued for the duration of theconference and the tra'velling time. However, the delegates coming toattend conference etc. in India can combine tourism with attending theconference. Missions can, at their discretion, grant visas for the

.required period. Such visa shall not exceed maximum validity ofTourist Visa, i.e, 6 months subject to usual conditions 'applicable forgrant of the Tourist visa,

,Visas to participants covered in the categorIes mentioned inanswer to Q.2 will not be granted for a duration longer than that maybe specified by the Ministry of External Affairs and the Ministry ofHome Affairs or the minimum period required.

F.A.Q relating to Research Visa

1. Who is the competent authority to 'issue Research Visa?

i) All Indian MissionslPosts abroad have been delegatedpowers to issue Research visa

ii) Local FRROIFRO is c~mpe.tentto convert Student'S' visainto Research 'R' visa (except prior reference cases)subject to furnishing of 40c.Vm.~nt~jr90f of admission in aresearch programme and of adequatefinancial resources. Insuch cases, the conversion from 'S' into 'R' will be allowedonly if the foreigners has pursued a regular three yearsdegree course/Post Graduate course from a recognisedUniversity.

2. What Information/documents are required to be furnishedalongwith the applicant in the prescribed application form ?

period.c) Details of previous visits to India.d) Letter of admission and Certificate of Affiliation in original

from the recognised Indian University/Institution in token ofhaving secured admission for the research purpose.

f) In case the research proposal relates to the applicant's owncountry a brief synopsis (150 words) and justification fordoing research in India should also be submitted alongwiththe application. .

g) No columns in the application form must be left blank by theapplicant.

3. What is the duration of the Research visa ?

Visa will be issued for a period of three years or for the duration ofthe research project whichever is earlier. The total period of the visa willbe restricted to the duration of the project approved by theUniversity/Institute of affiliation or five years which ever is less. Ifrequired extension for.an additional period of not more than 06 months asthe last & final extension even after the completion of the project may-begiven to enable the research scholar to complete the [mal formalities ofthe research project.

4. Who is the competent authority for Extension of the visa?

FRROIFRO are competent to extend Research Visa of foreignresearch scholars staying in India subject to the production of:-

OCIIPIO Card does not entitle the card holder to do researchwork in India without special permission from the Ministry of HomeAffairs, Government of India. OCIIPIO card holders can carry outresearch in India after taking special permission from Ministry ofHome Affaris.

(6) A person coming on Project Visa will not be allowed to take upemployment in the same Indian company for a period of two yearsfrom the date of commissioning of the project. (8) In case the project/contract site falls In the Protected/RestrictedArea notified by the Government, the grant of Protected/RestrictedArea Permit should be inteqrated with the grant of Project Visa.In all such cases, prior clearance of the Ministry of Home Affairsshall be obtained by the, Indian Missions/Posts concerned forissue of Protected/Restricted Area Permit and for grant of visa.The details' of the foreign personnel must be furnished to theMinistry ofHorne Affairs (Foreigners Division) and to the StateGovernment concerned well in advance in electronic mode so thatadvance action can be taken for obtaining the requisite securityclearance.

(9) The foreigner coming on Project Visa will have to registerhimself/herself with the FRRO/FRO concerned within 14 days ofarrival if the validity of visa is for more than 180 days. If thevalidity of visa is for a period of 180 days or less, registrationwould not be required. .

(10) A biometric-based identification of the foreign personnel comingfor executing projects/contracts will be introduced (at appropriatestage).

Ans.: Yes.'; Sector specific ceilings on the maximum number ofProject Visas allowed for each project in Power and Steelsectors are given below:-

Power

(i) A block of two units may be considered as one project.

(ii) Where main plant equipment Boiler Turbine Generator (BTG)and its sub-systems are sourced from foreign OriginalEquipment Manufacturer (OEM), the maximum number offoreign personnel allowed may vary from ~O to 70.

---------Ojl) For an Engineering., Procurement and Construction (EP~)~ _project;' where main plant and equipment, its sub-systemsand full or part of the Balance of Plant (BOP) is sourcedfromforeign OEM, the maximum number of foreign personnelallowed may vary from 76 to 125. (v) Wherever, for a project, Flue Gas Desulphurization System(FGD) is also sourced from a foreign supplier,· an additionalnumber of 25 foreign personnel, is recommended. For aproject with larger numbers of units (more than two), theadditional number of foreign personnel would be as follows:

(iii) The total manpower requirements of the project should bedetermined at the stage of conceptualization of the project bythe sponsoring authority with a flow chart.

(iv) Foreign manpower requirement beyond the above limits maybe examined by a Standing Committee having members fromMinistries concerned.

(v) For the purpose of determining the capacity of the unit, itshould be the approved capacity as certified by the Ministryconcerned of the Government of India in respect of PSUs, Inrespect of Private sector Steel units, the basis of capacitymay be as per the financial disclosure statement of aScheduled Bank or RBI-approved Non"Banking FinancialCompany (NBFC) duly authenticated and certified.'

(vi) For ongoing projects with contractual obliqation, deploymentof foreign personnel may exceed the' gui~.~ljnes based onexamination by the Ministry of Labour & Employment on themerits of each case.

The Indian Missions can issue Project Visas up to the ceilingmentioned above without any reference to the Mi,nistry of Labour &
