Six of the Agreements are for $1.0 million with options to increase to not-to-exceed $3.0 million per Agreement within the same one-year term. The flooring and painting Agreements are for a maximum of $500,000 with no options to extend. The aggregate amount for the eight Agreements is $7.0 million with a maximum aggregate value of $19.0 million, if all options are executed. projects exceed the capability of ISO's in-house staff. There are insufficient in-houseresources to fulfill the current and anticipated County requirements for facilities repair andmaintenance. The eight recommended JOC Agreements are required to perform highpriority facilities work, and are required to replace previously approved JOCAgreements, which are reaching their one-year term limit.

The JOC program is a responsive and cost-effective resource to augment ISO's abilityto accomplish County requirements for facilities repair, deferred maintenance andrefurbishment services. The combination of JOC and County staff optimizes ISO'scapabilities to mobilize, stage and execute multiple projects in a compressed timeframe.

Since its inception, JOC has become a proven method for ISO to meet Countydepartment service level demands beyond what ISO's in-house staff can provide. In theaggregate, the recommended JOC Agreements will provide the County with a full rangeof construction type services, including the following:

In summary, the JOC program has proven to be a responsive and cost-effective resourceto augment ISO's ability to satisfy County department demands for facilities repair,deferred maintenance and refurbishment services over the past several years. The eightrecommended JOC Agreements will provide the additional resources required for timelyand effective completion of as-needed services.

Implementation of Strateaic Plan Goals:

The recommended JOC Agreements support the County's Strategic Plan Goals No.1 andNo.4 for Service Excellence and Fiscal Responsibility. More specifically, it aligns withthese strategies by effectively managing County resources and investing in the public

infrastructure.

FISCAL IMPACT/FINANCING:

Sufficient funds for the recommended JOC Agreements are included in ISO's Fiscal Year2002/03 budget. In all cases, ISO will only incur JOC expenditures to the extent that theyare offset through County department billings.

Individual JOC Agreements have a statutory limitation of $3.0 million with a one-year term.The County is only obligated to order a minimum of $25,000 in work with each contractor.There are department requests awaiting completion, which exceed the $25,000 thresholdfor the eight recommended JOC Agreements.

FACTS AND PROVISIONS/LEGAL REQUIREMENTS:

Your Board has approved JOC Agreements for ISO over the past several years. JOCAgreements are fixed fee unit price-based with indefinite quantities. The requestedAgreements meet all Federal, State and County contracting requirements. The JOCAgreements are not Proposition "A" contracts, due to their intermittent, as-neededstructure and, therefore, are not subject to the County's Living Wage Program. JOCContractors are required to pay prevailing wages. The JOC Agreements, including anyoptions exercised, will not exceed the statutory limits of $3.0 million and a term of oneyear, as specified in Section 20128.5 of the Public Contract Code.

The JOC Agreements allow the maximum utilization of the County's workforcewhenever such staff is available. The standard JOC Agreements require Contractors tooffer employment to qualified County employees on re-employment lists or who aretargeted for layoff, as well as qualified GAIN/GROW participants for employment

openings.

The jury service program language was made a part of the solicitation for the JOC projectsand is also included in the subsequent contracts. All of the eight proposed JOC contractorshave agreed to comply with the County jury service program.

The firms involved with the recommended contracts have agreed to maintain theirestablished compliance with the Child Support Compliance Program Certification requiredby the Child Support Services Department.

Although the Safe Haven Law is not in effect at this time, compliance language has beenincorporated into the contract and all contractors have agreed to comply with the law whenit becomes effective.

CONTRACTING PROCESS:

On June 5, 2002, an Invitation For Bids (IFB) was released for the proposed JOCAgreements. Notice of the IFB was posted on the LA County Bids website and in varioustrade publications. A pre-bid conference was held on June 20, 2002 to discuss biddingand project requirements. On July 10, 2002, responsive lowest bid contractors wereselected through an open competitive process without regard to race, creed, color orgender for each of the JOC contracts.

Contractors associated with JOC Agreements have historically subcontracted withCommunity Business Enterprise (CBE) firms, consistent with your Board's CBEparticipation goal, as reflected in quarterly reports provided to your offices. As specificwork and associated subcontractors are identified, data concerning the use of CBEsubcontractors will be collected, summarized and reported quarterly. The Los AngelesCounty Community Business Enterprises program summary information on each firm isprovided in Attachment B. Of the eight contracts recommended for award, five are beingawarded to certified CBEs.

ISO will initiate new JOC solicitations on an as-needed basis to support the needs of theCounty. As current Agreements near expiration, additional solicitations will be made andreturned to your Board for Agreement approvals.

IMPACT ON CURRENT SERVICES (OR PROJECTS):

There is no employee impact. These Agreements are intended to augment, but notreplace the County workforce and to ensure our ability to respond to emergency

requirements.

ENVIRONMENTAL IMPACT REPORTS:

California Environmental Quality Act (CEQA) requires public agency decision makers todocument and consider the environmental implications of their actions.

These JOC projects provide facilities repair, deferred maintenance and refurbishmentservices requested by County Departments, which are categorically exempt underCEQA.

Upon approval of the JOG Agreements by your Board, ISO will file all required Noticesof Exemption for each project as required by GEQA.

CONCLUSION:

Your approval of the recommendations will provide the resources necessary to providetimely services to ISO's County customers.
