Payment Date and Payment, Default of PaymentPaymentofthecoursefeeispayableimmediatelyuponreceiptofinvoice.Wherepaymentisnotreceivedorlackingclearassignmenttoaparticipantpriortocommencementofthecourse,theEuropeanAcademyforTaxes,Economics&Lawmayrefusetherelevantparticipant’sparticipationinthatcourse.Thecoursefee,however,isstilldueimmedia-telyandcanbeclaimedaspartofadunningprocedureorlegalaction.InaccordancewithBGB§247(1),incaseofdefaultofpaymentwithinthestipulatedtimeperiod,defaultinterestonarrearsofatleast5%abovetheECBbaserateisdueandpayable.TheEuropeanAcademyforTaxes,Economics&Lawcanclaimhigherdamagefordelayifandwhereproven.Equally,theparticipantmayprovethatadamagehasnotoccurredorhashadlesseffectthanestimatedbytheEuropeanAcademyforTaxes,Economics&Law.
Paymentshallbemadebycashlessbanktransfer;cashorchequeswillnotbeaccepted.TheEuropeanAcademyforTaxes,Economics&Lawisnotliableforanylossofmeansofpayment.TheparticipantmayonlyoffsetsuchclaimsagainsttheEuropeanAcademyforTaxes,Economics&Law’sasareundisputed,legallyrecognizedorrecognizedinwritingbytheEuropeanAcademyforTaxes,Economics&Law.Therightofretentionisonlyacceptableinaccordancewithacounterclaimbasedonthesamecontract.
