Professor Laurence Boulle

Professor of Law, Bond University

Laurence Boulle is a Professor of Law at Bond University and in the University of the Witwatersrand, Johannesburg. He has published extensively in mediation and ADR, is past chair of NADRAC and is current chair of the Mediator Standards Board. He has been mediating since 1990 and is on the Panel of Conciliators for the International Centre for the Settlement of Investment Disputes.

Mark Brookes

Partner, Financial Lines, Carter Newell Lawyers

Mark is a partner in Carter Newell’s insurance team,

specialising in directors’ and officers’ liability and professional indemnity, having focused on those areas since qualifying as a solicitor in England 1994 and moving to Australia in 2000. The matters in which Mark is involved are primarily complex, high value multi-party disputes frequently involving mediation and sometimes trial. A significant proportion of Mark’s time is also spent advising clients on coverage and related policy drafting issues. Mark is an accredited mediator and holds joint Honours Bachelor of Arts in Law and Politics, and Diploma of Law.

Scott Falvey

Partner, McInnes Wilson Lawyers

Scott Falvey holds a Bachelor of Laws degree from Bond University and a Masters of Health and Medical Law from the University of Melbourne. Scott was admitted as a solicitor of the Supreme Court of Queensland in 1994. His current practice involves the representation of insurers in personal injury litigation throughout Queensland. He has a special interest in insurance litigation involving workplace injuries. Scott was appointed to the Queensland Law Society’s Accident Compensation Committee in 2000. He was elected to serve on the Council of the Queensland Law Society in 2002. Scott previously authored the Workers Compensation Law Manual (Queensland) with Gerry Mullins and Greg Senior.

Glenn Ferguson

Chair, WorkCover Queensland

Glenn is an experienced lawyer who has practised

personal injury law for over 20 years acting for both plaintiffs and defendants. His main area of focus is in the area of motor vehicle and work related claims. He also has a keen interest in medical negligence matters. He is a past president of the Law Council of Australia, the peak national body which represents the legal profession nationally and internationally, past president of LAWASIA, the Law association for Asia and the Pacific and a past president of the Queensland Law Society. He is also a senior counsellor with the Queensland Law Society and has previously chaired the professional standards committee. He is a founding fellow of the Australian Academy of Law, a fellow of the Australian Institute of Company Directors and a fellow of the Australia and New Zealand College of Notaries. He is Chair of WorkCover Queensland and Lexon Insurance, a Governor of the College of Law, member of the Federal Attorney Generals International Legal Services Advisory Council and the Immigration Ministers Advisory Board in relation to the regulation of migration agents.

Lorraine E J Gallagher

Partner, Wilson Elser Moskowitz Edelman & Dicker LLP

Lorraine Gallagher provides the full scope of product liability legal services to domestic and foreign manufacturers. A significant portion of Lorraine’s practice involves coordinating the defense of product liability claims on a national and international basis, including lawsuits brought in the United States, Asia, Europe and South America. She also has a concentration in admiralty matters and pharmaceutical issues and provides advice on insurance coverage issues. Lorraine’s practice extends beyond litigation. She has extensive experience assisting clients with regulatory issues before the Consumer Product Safety Commission (CPSC), National Highway Traffic Safety Administration (NHTSA) and Food and Drug Administration (FDA), including product recalls, warranties and warning requirements. Lorraine also has mediated and arbitrated a variety of commercial disputes between consumers, dealers, distributors and manufacturers.

Kevin Holyoak

Barrister, Bar Association of Queensland

Kevin Holyoak was admitted as a solicitor in 1988 and to the Bar in 1991. He specialises in all aspects of insurance law and related areas of common law, equity and statute, commercial law and trade practices law. Kevin regularly presents papers at Australian Insurance Law Association, QLS and Bar Association of Queensland professional development events.

David Lloyd

Claims Director, QBE 386, QBE European Operations

David commenced his insurance career in 1984 with General Accident London, in a role with a particular emphasis on liability claims. After a brief time as a broker, and a move to Australia, David returned to claims in 1992 with Michael Payne 386/683 in Melbourne. In 1994 David took on the responsibility of managing the syndicate’s Sydney office. David has worked with 386 through its various management guises of Michael Payne, Bob Wallace (RJW/386), David Constable (DAC/386) and now QBE 386 which is part of the QBE European Operations Global Casualty and PI division. David is actively involved in the insurance industry in Australia and is a member of AILA, APIG and is Vice President to NSW Claims Discussion Group. David has presented at the AILA National conference, Insurance Intensive 2005, and frequently presents to brokers clients and law firms.

Chris Loane

Manager, GI Motor Investigations, Fraud & Intelligence, Suncorp

Chris has an extensive background in the law and in investigations, having previously worked in the Queensland Courts and the Queensland Police for almost 20 years, where he served as an inspector from 1998. Chris has been both a barrister and a solicitor in private practice in Queensland since leaving the police in 2001. He holds a Master of Insurance from Deakin University, a Bachelor of Arts from Griffith University, Queensland Barristers Board Examinations with 2nd class Honours, Bar Practice Course at QUT, an Associate Diploma of Business Management and he has also undertaken a Diploma of Commercial Property Management. Chris is a Fellow of ANZIIF. In the past 4 years Chris has presented at numerous conferences including sessions at the International Association of Auto Theft Investigators (IAATI) seminar on Vehicle Theft Detection, Investigation & Prevention held in Perth in October 2009 and again in Brisbane in March 2010, and in Melbourne in March 2011.

Peter Munro

Barrister, Bar Association of Queensland and Mediator

Peter was admitted as a solicitor in 1975 and a barrister in 1987. He is a court appointed mediator and case appraiser for both the Supreme Court of Queensland and the District Courts. Since 2000 Peter has practised exclusively as a mediator participating in more than 3750 mediations in mostly personal injuries claims. Peter also has experience in mediating estate claims, partnership disputes, commercial disputes and Part 19 claims of Property Law Act 1974. Peter’s training includes a mediation training courses at the Queensland University of Technology and the Bond University.

Donna Niblock

Senior Underwriter, Crisis Management Solutions, Liberty International Underwriters

Donna joined LIU in 2008, bringing five years of crisis management insurance experience to her role of launching LIU’s crisis management product suite in the Asia Pacific. Her responsibilities include new business development and enhancement of the existing product suite. Donna has extensive underwriting experience in specialist insurance areas including Contaminated Products, Kidnap, Ransom, Extortion and Product Recall. Her insurance resume spans over ten years and includes four years in Commercial Property insurance with a leading Australian insurer followed by a similar period with an international insurer. Donna is a Senior Associate with ANZIIF.

Jay Pring

Managing Director, OBVIAM

Jay Pring is a respected digital marketing expert

with more than 18 years’ experience in digital and social media. He is Managing Director and founder of OBVIAM, an agency which works with such brands as Resilium, Samsung, Microsoft, Dell, Singtel and others to develop digital and social media marketing campaigns across the Asia Pacific region. His campaigns have resulted in hundreds of millions of dollars in revenue growth, as well as improved brand awareness in key markets. Jay began his career as a journalist before moving into digital production and marketing. He is a digital adviser to both federal and state governments and is a published author.

Edward Rawnsley

Executive Manager, Professional and Financial Risk Division, Suncorp

Edward has over 25 years’ experience in the industry, the last 20 specialising in professional risks. His experience spans across both the Australian and London markets. His previous roles include underwriting manager, schemes manager and senior broker. He has also had held senior roles in the area of reinsurance and risk. Suncorp is a major player in the professional risks market with income of approximately $165 million. Edward’s current responsibilities includes the management of Suncorp’s dedicated Professional and Financial Risks underwriting team and has ultimate responsibility for the portfolio’s performance.

Kelli Stallard

Partner and Head of Product Liability, DibbsBarker

Kelli is a Partner in the Insurance section of DibbsBarker and heads the product liability division. For over 25 years she has acted for insurers, corporations and government in the area of product liability, public liability and workers’ compensation. She is a past National President, Secretary and Queensland President of the Australian Insurance Law Association (AILA) and was a member of the National Board for over 10 years. In 2008 she was awarded lifetime membership. Since 1998 she has been a member of the Queensland Government Workplace Health and Safety Board. She is a trained mediator, an accredited personal injury specialist and a sustaining member of the Product Liability Advisory Council in the US.

Roy Watson

Independent Legal Consultant, USA

Roy is an in-house legal counsel with exceptional record of success in the management and resolution of product liability litigation, including class action and dealer litigation, for major manufacturers of motorcycles and off road vehicles, including All Terrain Vehicles, Golf Carts, Personal Watercraft and Boats. Prior to his current job as an independent legal consultant, he worked in the capacities of legal counsel of Kubota Tractor Corporation, USA and various roles including the general manager of the legal department of Yamaha Motor Corporation, USA for a collective period of 28 years.

David Williams

Partner, Forensic Services Australia BDO

David is the lead partner for BDO’s Forensic

Services division. He has 30 years’ experience as an accountant and before joining BDO was Director of the specialist valuation, litigation support and forensic accounting firm MPW Forensic. Prior to that, he worked in a variety of roles at Deloitte and Suncorp. David has a breadth of experience in many areas of professional practice across a wide range of industries with extensive specialist knowledge in the forensics field.

3.30 – 5pm Product liabilityThis presentation will focus firstly on product recall insurance including manufacturer’s obligations and loss control mitigation, limiting the potential spread of further injury arising from products with recent case studies. The session will incorporate presentations by two US presenters on:

• Product liability: International trends and typical US strategies to defend these claims; current trends in the US in product liability litigation; the strategies used for defending against claims; and how you can work proactively with clients to develop an overall product story to help in the defence of claims before the claims arise.

• Product liability experiences from in-house counsel perspective, with tips on how best to represent international clients.

• claims against institutions arising from bullying or abuse of children by other children • common challenges in historical abuse claims including indemnity issues,

The presenter will give us examples of where Twitter and Facebook are potentially dangerous traps for the unprepared, unwise, uninitiated or foolhardy. What we cannot ignore is the opportunity for business and the power of social and electronic media. The presenter will share from his vast experience, including acting for major organisations such as Microsoft, Dell, Vero Insurance and Samsung and helping companies achieve success through social media, be it for marketing, education or risk management.

Dinner

The Insurance Intensive dinner will be held in the Horizons room at Sheraton Mirage Resort & Spa, commencing at 7.00pm for a 7.30pm start. Dinner is included for two-day delegates and additional tickets can be purchased via the registration form or online at $145 per person (including GST) for members and $165 per person (including GST) for non-members. Dress for dinner is smart casual.

Close of earlybird registration (with accompanying payment) is 2 May 2013. Standard registration (with accompanying payment) must be received at least 48 working hours prior to the commencement of the Insurance Intensive, 21 May 2013.

Papers and presentations (where supplied by the presenter) will be distributed to delegates electronically 72 hours prior to the conference date. Papers and presentations (where supplied by the presenter) will also be provided to delegates on the day of the conference on a USB memory stick.

The Insurance Intensive attracts ten CPD points for both days – 6 CPD points for day one and 4 CPD points for day two. Please note that all three core compulsory subjects for 2013/14 CPD year are on offer within the program when attending for both days.
