It was 20 yearsago today...

Sergeant Pepper used to say!For those of you of a certain age you will know whothat it is. For those of you that do not get it, I willswiftly move on.

It was, in fact, 20 years ago this month (March) that Lawlors Property Servicesopened their doors for the first time in Woodford Bridge.

It is an amazing twist of fate that our 20th anniversary should also be markedby practically the same news of recession, repossession and job losses. However,to look on the bright side we opened in difficult trading conditions and survivedand flourished and even in the down-turn we can see some positive things thatcan come from these difficult times.

The good news is that first time buyers will have the best chance ever of gettingon the property ladder. Of course it means that deposits must be raised, but asthe banks start lending again and competition increases a balance will be struckbetween the huge deposits that are required at the moment and the ridiculousnon-deposit arrangement that existed before.

With prices at more modest levels and interest rates at historical lows thebalance is finally swinging in favour of the first time buyer.

In the previous recession of the late 80’s/early 90’s interest rates went throughthe roof and a number of people were forced to sell. Building societies routinelyrepossessed properties swiftly as the insurance industry picked up the ‘tab’ andthere was simply no incentive for the building societies to hold back. Thiscaused a wave of repossession throughout the Country. In contrast to thepresent position there is a greater understanding of the nature of debt andthere is must more help available to buyers who find themselves in theunfortunate position of being unable to financially cope.

Of course not everybody is in a financially difficult position and there are many,many buyers who have bided their time living in rented accommodation or witha strong equity position, and they are ready now to purchase if prices are morecompetitive.

The level of available property is significantly lower than one would expect atthis time of the year, as people come to terms with the current marketconditions. We find ourselves in the unusual position of having more buyersthan sellers, and urgently need fresh stock.

We have certainly experienced serious ups and downs over thelast 20 years at Lawlors Property Services and firmly

believe that the current downturn cannotlast. As ever, life goes on. So do not put

off that move waiting for a better time,your move is what you make it andthe best time is now!

In the current property market with the press reporting nothing but doom andgloom buyers can easily become disheartened about ever getting a foot on theproperty ladder. In more and more cases first time buyers are seeking theassistance of their parents in purchasing their first property. However, parentsoften raise concerns as to whether their money is protected and whether theywill ever get it back.

Whilst many parents are happy for their child to have the cash they are alsoconcerned that if their child has purchased a property jointly with their partner,what happens if they split up? Would the parents cash be protected? Wouldthe parents ever get the money back if they needed it?

Parents can protect their investment very easily by having a Declaration of Trustdrawn up. This is a legal document which sets out the contributions made bythe parties to the purchase and their intentions as to how the money should bedistributed once the property is sold. This will ensure that the parents get backthe money they invested for the purchase.

Similar Declarations of Trust can be used when friends or unmarried couplesare buying a property together particularly when they are contributing unequalamounts to the purchase price. Not only can the Declaration of Trust providefor the distribution of the sale proceeds it can also make provision forcircumstances where one party may want to sell the property and the otherdoes not.

When people invest money into buying a property they often find it difficult tothink anything would go wrong. The reality is, it often does. Unfortunatelybuyers can fall out with the co-purchasing friend or disagree about when theproperty should be sold.

The good news is that if you have purchased a property without a Declarationof Trust there is no need to worry! Declarations can be drawn up with theagreement of all parties at any time following the purchase.

A simple scenario would be:-Jim buys a property for £300,000. His mother lends him £75,000(25%) as a deposit and Jim obtains a mortgage for the balance ofthe price.

Jim lives in the property for 3 years and then sells for £330,000.

A Declaration of Trust can be prepared that will provide for hismother to receive either her original £75,000 back on completionof the sale or £82,500 being 25% of the sale price (the sameproportion that she contributed to the original purchase price).

Using the second option means that not only has motherhelped Jim onto the property ladder; she has also made a profitfrom her investment.

If you have owned your flat for at least two years, you generally have the right

to demand an extension to your lease of an additional ninety years, and the

ground rent reduced to nil. The price is determined by an independent tribunal,

and in the current climate, the price to be paid will be lower than in recent years

as it is related to the value of the flat. When it comes to selling or re-

mortgaging, frequently the process is interrupted and delayed by the need to

extend the term of the lease. Mortgage lenders tend to require at least sixty

years remaining, and some require more. It is much better to address the issue

now, before it becomes an issue, thereby avoiding the risk of endangering a

transaction because of delay.

If you and your fellow leaseholders in your block wish to buy the freehold of the

building, the freeholder cannot refuse to sell it as long as at least 50% of the

leaseholders wish to exercise this right. Again, the price is determined by an

independent tribunal, and the price will have decreased recently in this economic

climate. The advantages are numerous: you can stop paying ground rent, you

can extend your leases at no further cost, and you can collect ground rent from

other leaseholders who did not participate. Perhaps an even bigger benefit, in

certain circumstances, is that this will give you the right to control maintenance

and insurance matters, ensuring that you and your fellow leaseholders get

maximum value from your service charge payments.
