Sub: Notification of Medical Authorities forissuing “Disabilities Certificates” forvarious kind of disabilities.

Ref: No.S-13020/6/2010-MS Dated:15-06-2010.

We, would like to draw your kind attention tothe above letter authorizing some specifiedMedical Hospitals/Institution ascertifying “MedicalAuthority” for the purpose of the disability of differentnature. That, the Hospitals / Institution mentionedin column (3) of your same letter are mostly in theCapitals of different States for in Metropolitancities, far away from important town/villageswhere from a patient face lot of troubles in availingthe facilities. For example in your above list not asingle Medical Institution has been included fromWest Bengal.

However, disabilities certificates are issuedfrom the Office of the Chairman Zonal MedicalBoard, North Bengal Medical College/Darjeelingand some other Medical College under theGovernment of West Bengal and so far thedisabilities certificates issued by the ZonalMedical Board are acceptable by the concernauthorities including Railways. So, you arerequested to please circulate an addendum toyour above circular that the said disabilitiescertificates issued by the Zonal Medical Board ofdifferent State Government are also valid for allpurpose.

Non-uniformity in Rly pension enemy ofdigitalisation’

13.8.2017-Nagpur : Railway pensioners fromcity attended a pro-gramme organized by NationalRailway Pensioners Association (NRPA), CentralRailway, at Association’s office in Ajni on Saturday.SC Maheshwari,Secretary General, BharatPensioners Samaj, New Delhi, was the keynotespeaker and chief guest of the programme. Theprogramme started with the pensionerswelcomeing Maheshwari. Maheshwari, in hisspeech, spoke about the modification in the 7thCPC (Central Pay Commission) recommen-dations. He said, “The first formulation recommen-ded by 7th CPC was found not feasible on accountof non-availability of records. However, after asurvey, it was found that 80% of the records wereavailable while 18 to 20% were not.” Which couldhave been reconstructed.

The question that comes to my mind is why80% of people are not taken into considerationand why they are being ignored, Maheshwari said.Further, he called non uniformity ,non digitalizationof pension payment order (PPO) as the biggestenemy of digitalization and revision of PPOs. Hesaid. Ïn railway, digitalization is not uniform.Different number of digits in PPO in differentrailway zone leads to variety of problems. Majorityof pensioners are unable to register on ‘ARPAN’& CSTE Portals, as these pension portal of Rlysas of now supports only a 12-digit PPO,”

Explaninig the power of internet, Maheshwarisaid, “Due to our age, we are unable to cometogether physically. However, we today have agreat platform of social media. We all should useit for our benefit and discuss our issues on it andput forth our opinions. If we use this mediumproperly and come to a common consensus, wecan make our voice heard.” While encouragingthe people to fight for their rights, he said,”Wepensioners are not a burden and we are notasking for anything more than what is ours. Weconstitute a sizable part of population and we

should believe in our vote power and not beg forour rights. We should rather fight for ourrights.”Topics like new rules regarding PPOs andgrievances on family pension were also brieflydiscussed on the occasion. O P Verma, workingpresident of NRPA, M K Kapse, Secretary of NRPAand MB Ghodeswar, retired cheif medical officerfrom Bhusawal who was also the guest of honour,also graced the event

It has been brought to our notice by our SatnaBranch that though 7th CPC benefits have beenextended to the employees of the State of MadhyaPradesh vide the State Govt order dated20.07.2017 but the 7th CPC benefits have not beenextended to the State Pensioners.

Sir, as earlier you had been extending the PayPanel benefits to pensioners, it is hard to believethat you will discriminate with those who havealways been standing with you.

Unless you extend a helping hand not only theMP State but the Pensioners of Chhatishgarh toowill suffer.

Brief on the meeting with JS & Directors

S.C. Maheshwari SG BPS accompanied byRameshwar Kumar Treasurer BPS met JointSecy DOP PW on 3.08.2017 in his office anddiscussed:

1)The case of specific category Rly Pensionersivth CPC scale 1400-2300 to corresponding VthCPC scale 5000-8000 to VIth CPC PB2 GP4200with reference to file notings of PV Vaidialingamthe then Financial Advisor Rly Board. Sh SanjivNarain Mathur J S DOP & PW was very receptive &cordial he patiently listened to SG BPS ,studiedall the documents put up in support. However, he

expressed his inability to intervene and advisedto pursue the issue with Rly authorities only.

2. Implementation of revision of pension ofpre 2016 Rly pensioners on notional pay basisthrough ‘ARPAN’ website and also the difficultiesbeing faced in registration on account of variedPPO Nos digital & non digital were explained. JSimmediately put SG BPS through to ARPANauthorities on his Mob phone. SG spoke to DyCAO W.Rly Mr Anand & to  Shri. Manoj Mankame(AFA-Pension Portal) .Both the officers dealingwith ‘ARPAN’ were explained difficulties beingfaced by old Rly pensioners in registering for CSTEand ‘ARPAN’ website www.arpan.railnet.gov.in &the implications of revising PPOs of last retireesfirst (i.e the youngest in age). They were requestedto revise the PPOs of first retirees first i.e.oldestfirst. Both officers assured to resolve thedifficulties soon.

After discussion with JS. SG BPS moved tothe Chamber of Director (PP) Shri Harjit Singhand discussed the BPS demands viz 1) GP 4600to all pre 2006 pensioners retired from pre revisedscale of 6500-10500 & 2) Extension of SCjudgment to all similarly placed pensioners (Withreference to BPS Letter No. SG/BPS/judg/benefit/17/1 dt.17.07.2017 to i)The Secretary, M/O FinanceDepartment of Expenditure ii) The Secretary (P),Department of Personnel & Training, & iii) TheJoint Secretary,GOI M/O Personnel, PG & Pension-DOP&PW)

With reference to item 1) The Director informedthat the file has been sent to DOE recommendingthe case. Regarding item 2) Though the Directorexpressed ignorance about the Judgementsrefered by BPS, he assured to get the details &the demand looked into. There after SG BPS metDirector (P) MS Seema Gupta and requested herto request Ministry of Rlys not to seek Service&LPD details from Rly Pensioners for PPOrevision as i) this is not in accordance with theprocedural order of DOE and ii) that FamilyPensioners & the Pensioners residing in remoteareas may not be able to provide the details askedfor. She assured to take up the matter &Subsequently issued OM 0.4/23/2017- P&PW (D)Dated 7thAugust, 2017 to all concerned. SG BPsalso paid curtsey visit to Director Ms SujasaChoudhry,Under Secretaries and the consultantspresenting them latest publications of BharatPensioners Samaj (BPS).

Sir,

Taking into account the pathetic conditionsprevailing in the contemporaneous society withdeteriorating human relations between parentsand children, even a single pie of pension amountprovides a valuable support to the pensioner inthe evening of his/her life .

Under these circumstances it is painfull thatBanks in the country require pensioners to keepa minimum balance of Rs 5000/-or 2000/- in theirpension accounts.

Kindly visualize, the plight of over 57 lac EPS95 pensioners who get a maximum pension ofjust Rs 3000/- a month , over 27 lac of them getpension of Rs 1000/ and less even those gettingRs 9000/- or more are living hand to mouthbecause of their old age problems & there beingno support from the younger lot of the family.

employees associations have to struggle hard toget their demands accepted by the BSNL and thePensioners are left at the mercy of DOT as theBSNL Management has no right to discuss/recommend pension revision for Pensioners. We,therefore, in the larger interest of the 1.5 lac BSNLPensioners submit a detailed note seeking theGovernment of India’s approval to extend thebenefit of 7th C.P.C. for BSNL Pensioners as well.We have submited the said note to the SecretaryDOT and your sympathetic and realistic look willhelp the BSNL Pensioners to get their legitimatedue benefit for Pension Revision after ten yearsat par with other Central Government Pensioners.

We also request your honour to give us sometime to meet you and explain our demands inperson with full justification.

(Government of India Enterprise) w.e.f. 01.10.2000and retired as BSNL Pensioners after theirabsorption in BSNL. The Govt. of India throughG.O.M. entered into agreement with the thenEmployees Associations and assured themGovernment Pension from Consolidated Fundand accordingly the Rule 37-A was incorporatedin CCS Pension Rules 1972 to implementassurance and agreement. As BSNL Pensionerswere accorded Central Government Pensionersstatus, all the recommendations of 6th C.P.C. weremade applicable to us except fitment formula forrevision for Pensions as the same wasimplemented according to Cabinet note for BSNLPensioners to implement the fitment formula asrecommended by 2nd P.R.C. for PSU employees.We are extended all the benefits asrecommended by the 6th C.P.C. for CentralGovernment Pensioners considering us as C.G.Pensioners and covering sanction/orders wereissued by the DOT/BSNL.

Now, the 3rd P.R.C.’s recommendations forPSU employees have been accepted by theCabinet and orders are already issued toimplement the same for the working employeesof PSUs. The recommendations does not containany recommendation for revision of Pension forits ex employees and BSNL has no provision forPension Revision of its Retirees. Recently, theDOT have issued directives to BSNL Managementthat it cannot take any decision where Pensionliability is attracted which will make the task ofBSNL Management very tuff as many if and butsare contained in the guideline issued by the DPE.The recommendations of 2nd P.R.C. thoughimplemented for working employees, the BSNLPensioners are still struggling after ten years toreap the benefit of the 2nd P.R.C. as the Cabinethas after prolonged time accorded its approvalfor BSNL Pensioners.

There is one lacuna in the system that all thePensioners Associations are extendedopportunity to represent their demands beforeC.P.C., the same methodology is absent in theP.R.Cs. are appointed only for the Executives andits recommendations are made applicable withmany if and buts for all PSUs and no uniformdirective is given. As a result thereof, the

The petitioner challenges the applicabilityof paragraph 5 of the Office Memorandum datedFebruary 11,2009 notified by the Department ofPension and Pensioners Welfare, concerningrevision of pension of pre- 2006 pensioners,wherein it has been stated that ‘Therefore, thebenefit of upgradation of post subsequent totheir retirement would not be admissible to thepre-2006 pensioners in this regard.’ Thepetitioner also seeks quashing of the orderdated February 10, 2016 whereby hisrepresentation for revised pension has beenrejected. Petitioner also prays for Mandamusdirecting the respondents to revise his pensionto ̀ 9375/- per month as given in the fitment tablein Government of India, Ministry of Personnel,W.P.(C) No.3035/2016 Page 2 of 18 PublicGrievance and Pension, Department ofPensioners Welfare Office Memorandum F.No.38/40/12-P&PW (A) dated January 28, 2013.

Operative part of Judgement

20. Per contra, the learned counsel for therespondents has adopted a rather strangestand in as much as i t has simply beensubmitted that the petitioner’s pension beingfixed at ‘8701/- per month was in order and hadbeen revised correctly as per the Off iceMemorandum dated January 28, 2013. It wasalso submitted that the recommendations asgiven by the Sixth Central Pay Commission wereimplemented from January 01, 2006 and thatthe revised/ upgraded pay scales were notapplicable for those pensioners who had retiredon or before December 31,2005 as per theOffice Memorandum dated February - 11,2009.

21. We need not delve too deep into the waterfor the reason that the issue at hand is quite

(a). Pensioners retired in the year 1986 i.e. inthe first year of operation of 4th CPC are alreadyin the 90th year of their lives with hardly anyresidual life left. Similarly pensioner retired in theyear 1995 have entered 81st year of their life. Theirlife spans with innumerable ailments may not betoo long and are being deprived of the timelybenefits of upward revision of pensions due toincorrect steps taken by officials at the helm ofaffairs. Pensions of these pensioners wererevised during implementation of recommen-dations of 5th CPC sometimes in 1997-98 andagain in 2008-09 consequent to recommen-dations of 6th CPC. This goes to prove that recordsare available;

(b) In addition a large number of pensionershave already sent copies of their PPOs and otherDocuments to their respective departments fromwhich they retired. These PPOs and documentscontains details such as Pay scale of the last postheld, Post from which retired, last pay drawn andother required details.

3. In view of the above facts, there seems tobe no wisdom in not commencing revision ofpensions of pre-2016 pensioners in Ascendingorder i.e. Older pensioners having retired first. Itseems that the decision start of revision ofpensions beginning from December,2005 is agame plan to show bogus progress by layinghands on latest records available.

Sir, this is being brought to your kind notice sothat injustice being done to older pensioners/family pensioners is stopped forthwith.

sum of ‘ 9375/- per month as has been claimedby him.

26. We would also note that the presentpetition would also need to be allowed in thelight of the recent Office Memorandum datedApri l 06,2016 wherein i t has beenunambiguously stated that ‘It has now beendecided that the revised consolidated pensionof pre-2006 pensioners shall not be lower than50% of the minimum of the pay in the Pay Bandand the grade pay (wherever applicable)corresponding to the pre revised pay scale asper fitment table without pro-rata reduction ofpension even if they had qualifying service ofless than 33 years at the time of retirement. Onthe same reasoning, the petitioner cannot bedenied the benefit of revised pension when therespondents themselves have adopted theaforenoted position.

27. Resultantly, the present petition isallowed. The order dated February 10, 2016 isquashed and OM dated February 11, 2009 tothe extent it states that the benefit of upgradationof post subsequent to the retirement would notbe admissible to the pre-2006 pensioners isquashed and a mandamus is issued to therespondents directing them to fix the pensionof the petitioner in sum of Rs. 9375/- per monthas given in the fitment table appended to theGovernment of India, Ministry of Personnel,Public Grievance and Pension, Department ofPensioners Welfare Office Memorandum F.No.38/40/12- W.P.(C) No.3035/2016 Page 18 of 18P&PW (A) dated 28.01.2013 with effect fromJanuary 01, 2006. The petitioner would also beentitled to arrears of the pension as would berefixed by the respondents. The needful be donewithin a period of two months, failing which thepetitioner would also be entitled to simpleinterest @ 9% per annum. There shall, however,be no order as to cost.

shallow. We also have the benefit of previousdecisions rendered by this court in Central Govt.SAG. and S.A. Khan’s (supra) case.

22. We are not inclined to accept the standtaken by the learned counsel for therespondents for the simple reason that a bareperusal of the fitment table appended along withthe Office Memorandum dated January 28, 2013itself would reveal that the pay of the petitionerhad to be fixed at ‘9375/- per month.

23. Further more, we are also inclined toaccept the submissions made by the learnedcounsel for the petitioner on parity of reasoninggiven in Central Government SAG andS.A.Khan’s case (supra), which have alreadybeen elaborated herein above.

24. It is apparent that the respondents havenot applied their mind while fixing the pensionof the petitioner at ‘8701/- per month and itseems that the respondents have placedreliance upon the Office Memorandum datedFebruary 11, 2009 and have placed the petitionerin the pay band S-12 but has not taken intoconsideration the subsequent upgradation ofthe post of Subedar Major which would placethe petitioner in pay Scale S-14, and needlessto state the pension would also have to berevised accordingly.

25. We would also note that reliance placedon the Office Memorandum dated February 11,2009 itself is misguided for the reason thatCentral Government SAG case was an appealagainst the order of Central AdministrativeTribunal dated November 01, 2011 wherein theTribunal had set aside the Memorandum datedFebruary 11, 2009. The decision rendered bythe Division Bench of this court was alsochallenged before the Supreme Court but thesame attained finality and quietus when thecurative petition was dismissed on April 30,2014. Needless to state the order datedFebruary 10, 2016 having been passedsubsequently, the respondents were duty boundto consider the case of the petitioner de horsthe Memorandum dated February 11, 2009 andhad the same been done, undoubtedly thepetitioner would stand entitled to pension in

This writ petition was placed before theRegistrar for effecting service on the respondent.In the minutes of the proceedings of 24.07.2012,the Registrar has noted that the petitioners havenot been able to effect service on the respondentfor a long time. On 09.04.2012, the learnedcounsel for the petitioner sought a final opportunityfor effecting service and had also made astatement that in case steps for effecting serviceon the respondent were not taken before the nextdate, he would not pursue the writ petition anyfurther. It is further noted in the minutes of24.07.2012 that the service has not yet beeneffected. Obviously, the learned counsel for thepetitioner did not take any steps. In thesecircumstances, the Registry has placed thismatter before us. We feel that when a counselmakes a statement, such as the one made above,he should be bound down to it. Consequently,since the steps have not been taken by the learnedcounsel for the petitioners, the writ petition isdismissed for non-prosecution.

1. In the present application, the applicant isseeking the benefit of DPP&W’s OM dated 14.7.95whereby with effect from 1.4.95 the benefit ofdearness allowance was made available togovernment servants covered under CCS(Pension) Rules, 1972 by an order of thePresident.

2. The applicant is also relying upon thejudgment of the Full Bench of this Tribunal dated15.10.99 in OA No. 459/97 with OA No. 460/97,Venkatram Rajagopalan v. Union of India wherebyit has been held that the Government servantcompleting age of superannuation on 31.3.95 andrelinquishing charge of his office in the afternoonof that day is deemed to have effectively retiredfrom service w.e.f. 1.4.95. In this background theapplicant claims recalculation of his DCRG byadding 97% of pay element towards the DA onthe basic pay and other ancilliary retiral benefits.

3. Respondents have contested thisapplication on the ground that as per Rule 35 ofCCS (Pension) Rules, a Government servantstands relinquished on the retirement date fixedand the same cannot be shifted or changed. It isfurther contended that after midnight deemingfixation of the date of retirement would not beapplicable to the applicant. It is further contendedthat relationship between master and servantends on 31.3.95 and as such the applicant cannotclaim any benefit regarding retiral benefits whichhave been made available to other Governmentservants with effect from 1.4.95.

4. We have carefully considered thecontentions and applied our mind to the same. Itis admitted that the applicant superannuated on31.3.1995 and stood relinquished on the sameday in the afternoon. The Full Bench (supra) in asimilar case has held as under:

“7. According to Rule 83(1) of the PensionRules, Pension becomes payable from the dateon which Government servant ceases to be borneon the establishment (emphasis given). AGovernment servant continues to be borne on theestablishment till midnight of the date ofsuperannuation. The decision of the HyderabadBench of this Tribunal in T. Krishna Murthy‘s case(supra) cannot be brushed aside by the learnedCounsel for the respondents. Retirement may bevoluntary or on superannuation. The principlesfor payment of pension will not vary on the basisof these distinctions. According to us, “afternoonof 31st March or forenoon of 1st of April meansone and the same thing and on this balance also

we see no reason to hold that the said case is notapplicable to the present cases. In short, we areof the view that in the present cases the effectivedate of retirement would be 01.04.1995 and not31.03.1995.

8. The decision of the Supreme Court in UOI v.P.N. Menon and Ors. CA No. 417 of 1987 andseveral other cases relied on by the learnedCounsel for the respondents in support of hiscontention need no attention, because they arenot exactly or remotedly on the point underconsideration. The OM dated 14.7.1995 is notchallenged in these cases and, therefore, theargument tried to be made with reference to cutoff date or financial, implications in these cases,is misplaced. A Government servant completingthe age of superannuation on 31.03.1995 andrelinquishing charge of his office in the afternoonof that day is deemed to have effectively a retiredfrom service with effect from 01.04.1995.”

5. As per law laid down by the Full Bench suprawe hold that the applicant has effectively retiredfrom service with effect from 1.4.95. In view of thefact that the applicant is deemed to have retiredon 1.4.95, the benefit of OM dated 14.7.95 (supra)would be made applicable to him for all purposes.We hold so accordingly.

6. In the result we allow this OA and direct therespondents to treat the applicant to have retiredwith effect from 1.4.95 and pay him the benefitsas enumerated in the OM dated 14.7.95. Thisexercise must be carried out within a period ofthree months from the date of receipt of a copy ofthis order. No costs.

be New formula for Salary hike?

Justice A K Mathur, chairman of the 7th PayCommission, had recommended that thegovernment should review the salary of centralgovernment employees every year rather thanforming new pay commission.

New Delhi, July 27: After implementing the

recommendations of 7th Pay Commission (7thCPC), the government is now mulling not toform any Pay Commission for increasingsalaries and allowances of central governmentemployees and pensioners in future. Justice AK Mathur, chairman of the 7th Pay Commission,had recommended that the government shouldreview the salary of central governmentemployees every year rather than forming newpay commission after the long period of tenyears. The government is considering thissuggestion and will take a policy decision inthis regard, said Finance Ministry sources.

While the central government employeeshave begun contemplating whether the 8th PayCommission bring them more rel ief, thegovernment seems in no mood to form any newcommission. A Finance Ministry official, whilespeaking to the Sen Times, had said that thegovernment may not form any new paycommission in future for increasing salaries ofcentral government employees

If not pay commission, then what will bethe new formula for salary hike?

“The government should review the salaryof central government employees every yearlooking into the data available to it and basedon the price index,” Justice AK Mathur, who ledthe 7th Pay Commission, told Indian Express.As per the recommendation of the 7th PayCommission, the pay matrix may be reviewedperiodically without waiting for the long periodof ten years. The salaries of central governmentemployees can be reviewed on the basis of theAykroyd formula which takes into considerationthe changes prices of the commodities thatconstitute a common man’s basket.

If the government adopts this formula, it neednot wait for ten years and form a paycommission to review salary and pension ofthe central government employees. This meansthe government need not wait for ten years andform a pay commission to review salary andpension of the central government employees.Any changes required regarding pay andallowances would be made consideringinflation after every year.

He has appealed thathousing-for-all should be there by 2022. “In thatperspective, EPFO is formulating a new credit-linked subsidy scheme for housing for the EPFsubscribers.” Under this scheme, he saidmembers can form a cooperative society andthey will be eligible to avail the scheme.

On providig health benefits to the workers,he said the ministry is considering a modelbenefit scheme for al l pensioners whocontribute to Employees’ State InsuranceCorporation (ESIC). He also said the ministryhas issued instructions to all field officers toensure that pension is credited into accountson the first working day of every month. Afterassurance from the minister, ParliamentaryAffairs Minister Ananth Kumar requestedPremchandram to withdraw his resolution whichthe RSP member did.

29.7.17 Minimum Wages Code set to enddisparity in salaries; know how

Minimum Wages Code, scheduledemployments, Code on Wages, minimum wages,central labour legislations, Payment of Wages Act,Payment of Bonus Act, agriculture labourer,NFLMW, Labour ministry, labour Acts, labour Actsin india. The proposed code will have a provisionfor setting up a committee which will set and revisethe minimum wages from time to time. ( PTI). Thegovernment is likely to do away with the existingconcept of scheduled employments under theCode on Wages, a move that will extend the benefitof obligatory minimum wages to all workers.Currently, minimum wages set by governmentsare applicable to only those who work in sectorsemploying 1,000 or more in the state concerned.Such scheduled sectors include 45 notified bythe Centre and 1,709 listed by the stategovernments. Official sources said that theremoval of restrictive criteria will help in bringingparity of wages among workers in differentindustries apart form universalising the principleof minimum wage. The proposed code, which willsubsume four existing central labour legislations— The Minimum Wages Act, 1948, The Paymentof Wages Act, 1936, The Payment of Bonus Act,1965 and The Equal Remuneration Act, 1976 —will have a provision for setting up a committeewhich will set and revise the minimum wagesfrom time to time. A source in the labour ministrysaid even for short duration of work, minimumwages will be applied and in such cases, it willbe calculated on hourly basis.

The minimum wages for one unskilledagriculture labourer in the central sphere is Rs300 per day while an unskilled person working inthe non-agriculture sector is entitled to get Rs 350a day. The minimum wages is calculated on thebasis of the workers’ daily consumption pattern(on the basis of field studies), taking intoconsideration the minimum 2,700 caloriesrequirement for a family of three. The requirementof 72 meters of cloth per year, fuel, lighting,education and medical need and old age needsof the worker is also taken into consideration.

In the code on wages, the government is alsodoing away with the variation in minimum wagesfrom sector to sector. The entire workingpopulation will be categorised on the basis of theirskills and not sector-wise. The minimum wagesin the states vary from state to state and in most ofthe cases is much lower than by the central sector.To bridge the gap and tide over its helplessness— as labour is in the concurrent list — the centreintroduced the concept of a national floor levelminimum wages (NFLMW) in 1991, but that alsofailed to make any cut since it is only suggestivein nature and has no statutory backing. TheNFLMW now stands at Rs 176 per day.

Labour ministry sources said with thepassage of labour code on wages, which mighttake more than six months since the Bill is likelyto be referred to a select committee after tablingin Parliament next week, the provision of theNFLMW will be subsumed and the ingredients ofcalculating minimum wage at present will alsobe changed. The ingredients in the basket forcalculating minimum wages in future are notknown, but even if the proposed committee usesthe present NFLMW, which is considered bareminimum, it will push the cost of labour. This willnot only affect competitiveness of trade andindustry, but also hit the ability of states to attractinvestments on the basis of lower wage rates.

The passage of the Code on Wages will bethe first among the four the present dispensationhas been looking at to unleash its long-pendinglabour reform initiative by amalgamating 44existing labour Acts into four codes — on wages,industrial relations, social security & safety andhealth & working conditions.

NEW DELHI: After coronary stents, thegovernment on Wednesday fixed a price rangefor knee implants from Rs 54,000 to Rs 1.14 lakh,nearly 70 per cent lower than most surgeriescurrently cost.With private hospitals reportedlycharging exorbitant rates, the government cappedthe maximum retail price of the knee implants, amove that will save patients an estimated Rs1,500 crore annually."Government will not remaina mute spectator and will not allow this illegaland unethical profiteering," Chemicals andFertilisers Minister Ananth Kumar told a newsbriefing. The price in case of specialised implantsfor cancer and tumour has been sharply cut to Rs1,13,950 from the current prices of Rs 4-9 lakh.There are 1.5 crore to 2 crore patients who requireknee implant surgery. Every year 1.2 lakh to 1.5lakh knee surgeries takes place in India,according to the government. It is estimated byWorld Health Organization (WHO) that by 2020,osteoarthritis is going to be the fourth largestcause of immobility globally, Kumar informed.

The government had in February slashed themaximum price of life-saving heart stentsimplants by up to 85 per cent by capping them atRs 7,260 for bare metal ones and Rs 29,600 fordrug eluting variety. Earlier, the average maximumretail price (MRP) for BMS was Rs 45,000 and forDES, it was Rs 1.21 lakh.Ananth Kumar saidtoday's decision comes a day after Prime MinisterNarendra Modi announced from the Red Fort onthe Independence Day that prices of knee surgery

would be brought down.Earlier this month, theNational Pharmaceutical Pricing Authority hadstated that the average trade margin onorthopaedic knee implants were found to be ashigh as 313 per cent.

"After cardiac stents, we have now decided tobring all kinds of knee implants under pricecontrol. In our country 1.5 to 2 crore people sufferfrom knee problems, who need healthassistance," Kumar said."The government will notbe a mute spectator to illegal and unethicalprofiteering," he added.

"Today across the country, private hospitalshave increased prices of knee implant surgeries.They are indulging in unethical profiteering. Tostop this and give relief to patients, we have takenthis decision," he said. The decision has beentaken keeping people's interest and healthsecurity of the nation into consideration, Kumarsaid. The minister warned of stringent actionagainst hospitals, importers, retailers if theycharged in excess of the MRP saying that thegovernment would recover excess profit from suchknee implants with 18 per cent interest and mayalso cancel licences of hospitals. Asked whetherindustry would be able to recover their costs underthe new prices, the minister said: "The MRP hasbeen fixed after taking into account the landedcost and there will be comfortable margins for theindustry."

Reacting to the development, medical deviceindustry body MTaI said MTaI is reviewing the orderfrom NPPA. Under the new price regime, the MRPof most widely used complete knee implant(Cobalt-Chromium) has been fixed at Rs 54,720plus GST, a reduction of 65 per cent from earlieraverage MRP of Rs 1,58,324. This particular typeof knee implant has around 80 per cent marketshare. The new MRP of special metal titaniumand oxidised zirconium has been fixed at Rs76,600 plus GST, down 69 per cent from anaverage rate of Rs 2,49,251 earlier. High flexibilityimplant will now cost Rs 56,490 plus GST, down69 per cent from average MRP of Rs 1,81,728earlier. Special metal and high flexibility kneeimplants account for another 17 per cent of themarket. Revision implants for second surgery,which patients normally need after 10 years, willnow cost Rs 1,13,950 plus, lower by 59 per centfrom average MRP of Rs 2,76,869. Lastly, the MRPof specialised implants for cancer and tumourhas been fixed at Rs 1,13,950 which used to bepriced around Rs 4-9 lakh.

1. Ministry of Health vide letter No.11011/11/2016-CGHS(P)/EHS, dated 9 January, 2017 hasrevised the rates of monthly contribution foravailing the CGHS facility. The pensioners alsohave to make contribution to avail medical facilityof CGHS. Pensioner have an option to get theirCGHS pensioner card by either making CGHScontribution on an annual basis (twelve month)or by making contribution for ten years for gettinga pensioner CGHS card with life time validity.

2. The similar scheme for retired railwayemployees is “Retired Employees LiberalizedHealth Scheme” (RELHS). The subscription rateof join RELHS were laid down, vide the letter underreference, to be equal to the last basic pay of theemployees.

3. To bring the policies in sync with MOHFW,Ministry of Railway has decided that in partialmodification to Board’s letter dated 23.10.1997,the rate of contribution to join RELHS shall be lastmonth’s basic Pay drawn or the subscription rateindicated at different levels (as per 7th CPC)enumerated in the table below, whichever is lower.

3. It has come to notice of this Ministry thatrailways have presumed that in terms of letterdated 2.2.2017 all the powers for sanction ofmedical advance/reimbursement lie with GeneralManagers only and that financial powers vestedwith AGMs/DRMs stand withdrawn.

4. Board’s letter date 02.02.2017 only seeksto enhance the powers of GMs to sanctionmedical advance/reimbursement from theexisting 5 lakhs to 10 lakhs. There is change indelegation below GMs power. It is, therefore,clarified that financial powers vested to AGMs/DRMs in terms of letter dated 24.09.2013 stillstand in vogue and they can exercise the financialpowers already delegated vide Board’s letterdated 24.09.2013 as usual subject to the laiddown instructions issued from time to time.

5. Further instances have also come to noticeof this Ministry that in cases where the totalestimate of the Hospital(s) is beyond financialdelegations vested with DRMs/AGMs/GMs,practice of grant of medical advance/reimbursement is being resorted to the limit offinancial limit vested with DRMs/AGMs/GMs andfor the remaining amount the papers are being

referred to this Ministry. It is, therefore, once againreiterated that DRMs AGMs/GMs can onlysanction/release medical advance in such caseswhere the Estimate of the Hospital(s) is withintheir respective delegated financial powers. Incase the estimate of the hospital(s) is beyondtheir respective delegated financial powers, thematter should be referred to the next appropriatelevel for further considerat ion and for grant ofmedical advance medical reimbursement. interms of extant instructionstions. Non adherencinstrutions for grant of medical advance/reimbursement or treating such advance /reimbursement as ’fait accompli cases” will notbe entertained.

Sub: Eligibility of divorced daughters for grantof family pension - clarification regarding.

Provision for grant of family pension to awidowed/divorced daughter beyond the age of 25years has been made vide OM dated 30.08.2004.This provision has been included in clause (iii) ofsub-rule 54 (6) of the CCS (Pension), Rules, 1972.

2. As indicated in Rule 54(8) of the CCS(Pension) Rules, 1972, the turn of unmarriedchildren below 25 years of age comes after thedeath or remarriage of their mother/father, i.e., thepensioner and his/her spouse. Thereafter, thefamily pension is payable to the disabled childrenfor life and then to the unmarried/widowed/divorced daughters above the age of 25 years.

3. It was clarified, vide this department OfficeMemorandum of even number, dated 11thSeptember, 2013, that the family pension ispayable to the children as they are considered tobe dependent on the Government servant/pensioner or his/her spouse. A child who is notearning equal to or more than the sum ofminimum family pension and dearness reliefthereon is considered to be dependent on his/her parents. Therefore, only those children whoare dependent and meet other conditions ofeligibility for family pension at the time of death ofthe Government servant or his/her spouse,whichever is later, are eligible for family pension.If two or more children are eligible for familypension at that time, family pension will be payableto each child on his/her turn provided he/she isstill eligible for family pension when the turncomes.

4. It was clarified that a daughter if eligible, asexplained in the preceding paragraph, may begranted family pension provided she fulfils alleligibility conditions at the time of death/ineligibilityof her parents and still on the date her turn toreceive family pension comes. Accordingly,divorced daughters who fulfil other conditions areeligible for family pension if a decree of divorcehad been issued by the competent court duringthe life time of at least one of the parents.

5. This department has been receivinggrievances from various quarters that the divorceproceedings are a long drawn procedure whichtake many years before attaining finality. Thereare many cases in which the divorce proceedingsof a daughter of a Government employee/pensioner had been instituted in the competentcourt during the life time of one or both of them butnone of them was alive by the time the decree ofdivorce was granted by the competent authority.

6. The matter has been examined in thisdepartment in consultation with Department ofExpenditure and it has been decided to grant familypension to a divorced daughter in such caseswhere the divorce proceedings had been filed ina competent court during the life-time of theemployee/pensioner or his/her spouse butdivorce took place after their death – provided theclaimant fulfils all other conditions for grant offamily pension under rule 54 of the CCS (Pension)Rules, 1972. In such cases, the family pensionwill commence from the date of divorce.

7. This issues with the concurrence of Ministryof Finance, Department of Expenditure, vide theirID No. 1(11)/EV/2017, dated 7th July, 2017.

Railway Board vide their letters quoted above,have issued instructions for revision of pensionsof pre-2016 pensioners/Family pensioners w.e.f1.01.16. In order to expedite the process ofrevision to these pensioners the action to betaken by the Personnel Department and AccountsDepartment is shown as under.

ROLE OF PERSONNEL DEPARTMENT:

1. The list of all live cases will be available inARPAN along with the detail of last pay drawnwhere available. In some of the cases last paymight have enhance due to re- fixation on accountof grant of MACP, back date of promotion etc.Thatsame will be adhered to with reference to servicerecords/settlement files/latest Vlth CPC revised

2. For those employees who have retired priorto 1/1/1986, notional pay fixation as already donein terms of Board’s letter dt. 10/2/1998 will betreated as pay as on 1/1/1986.

3. Similarly for those employees retired after1/1/1986, the notional pay fixation as applicableunder each intervening Pay Commission will bedone based on the formula for fixation of pay

Fixation of pay on notional basis in all caseswill be done up to the Level in 7th CPC ie. 1/1/2016. based on Settlement Records/ PPO’s/ payparticulars received from Accounts or from thepensioner/family pensioner. The notional pay sofixed will be vetted by Associate Finance (EG/ENG)as per the practice in vogue.

b. While fixing notional pay, element of DP/NPA/Running Allowance/Charge Allowance etc.involved if any etc, may be dealt with utmost careto avoid incorrect fixation of notional pay. The payfixation in successive Pay Commissions will bedone in the corresponding pay scales. as perrules.

c. 50% of the notional pay as on 1/1/2016 shallbe the revised pension and 30% of the notionalPay shall be revised family pension w.e.f.1/1/2016. Enhanced family pension @ 50% of thenotional Pay as on 1/1/2016 shall be payable tillthe period upto which family pension at enhancedrate is admissible, as per rules.

d. Affer vetting of Notional Pay , the AssociateAccounts (EG/ ENG ) may pass on the case( otherthan in cases where correction is required ) to theconcerned Pension section for issue of revisedPPO without referring back to PensionSanctioning Authority.

5.Pension Sanctioning Authority shall initiatethe proposal of revising the pension/Familypension in terms of Para 4 and 5 of Boards letterdt.22.05.2017. after receiving list of all live casesavailable in ARPAN alongwith the detail of lastpay (whenever available) due for revision underthe VII CPC.

g.The Pension Sanctioning Authority shallcheck with their records to verify the number ofcases due for revision, Since all the servicerecords/ details of the pensioners are availablewith the respective Pension Sanctioning Authorityfrom where they retired/died. PSA after dueverification of relevant records, shall start revisingthe pension in terms of Para 4& 5 of DOP & PWsOM. dt.12.05.2017 forthwith.

7. In cases where the records are not readilyavailable, the concerned HOD’s will ensureappropriate action for verification of such casesand ensure expeditious revision of pension asper the prescribed procedure. The relevant datamay be obtained from the retirees in the SampleApplication Form with Self Attested attachments..

8. For administrative convenience the revisionwork of the 6th CPC cases(Retirement/Deathduring 1/1/2016 to 31/12/2015) may be taken upfirst in descending order of cessation date asthere is no involvement of multi-stage pay fixationdata available with Railway is more or less fresh.However, references received from pensionersthrough Application/Grievances may be given toppriority irrespective of date of retirement/death.

9. A separate register will be opened forrecording all the cases where proposals havebeen sent to Accounts Department based on the

information available. As and when the PPO isissued, entry of the same shall also be made inthe register.

10. In cases where the Application are directlyreceived from the pensioners, entry shall be madein the register and pension will be revised(irrespective of their date of retirement and withoutwaiting for their turn) based on the informationprovided by the pensioner.

11.Pension Revision Sheet 7th CPCgenerated in ARPAN shall be signed by OS(PC/Settlement) as well as Sr. SO(EG/ENG)beforesubmission to pension Section for issue ofRevised PPO.

12.Submission of Application by thepensioners/Family Pensioner for revision ofpension though not mandatory, but for ensuringcorrect data entry on to the system and issue ofrevised PPO, pensioners may be persuaded tosubmit the information in the prescribed Formatalongwith supporting documents. Sufficient formsmay be kept ready with both Personnel andAccounts Deptts for providing the same topensioners or their representatives. However,efforts are being made to place Advertisments inleading News Papers inviting applications fromPre-2016 pensioners/family pensioners.

ROLE OF ACCOUNTS DEPARTMENTS:

A. Association Accounts (EG/ENG):

1. On receipt of proposal of notional fixationof pay under various Pay Commossions up to thelevel of 7th CPC shall be vetted by AssociateAccounts. Pension Revision Sheet 7th CPCshowing notional pay submitted to Accounts byPersonnel supported documents in support oflast pay drawn, shall be signed by the concernedSr. SO (EG/ENG) as a token of verification and willbe returned back to pension sanctioning authoritywith top priority.

2. In terms of Concordance Table issued videBoard’s letter No. 2016/F(E)III/1(1) dt. 11.07.2017necessary changes in ARPAN Module have beenmade to automate the fixation of Notional Pay.However vetting of Notional Pay by AssociateAccounts (EG/ENG) will continue as per existingpractice in vogue.

In addition ifrequired, training and hand holding session forthe users of both Personnel and Accounts shallalso be organized either at Divisional level or atHQ level on a suitable date.

The undersigned is directed to say that atpresent Constant Attendant Allowance (CAA) isgranted to pensioners who retired on disabilitypension under the CCS (Extraordinary Pension)

Rules 1939, with 100% disability (where theindividual is completely dependent on somebodyelse for day-to­day function). The ConstantAttendant Allowance is paid in addition to thedisability pension. The present rate of ConstantAttendant Allowance admissible is Rs.4500/- permonth.

2. Consequent upon the decision taken by theGovernment on the recommendations of the 7th

Central Pay Commission on Allowances,Government has accepted the recommendationof 7th Central Pay Commission to increase theConstant Attendant Allowance by a factor 1.5, i.e.to R.s.6750/- per month. Accordingly, sanction ofthe President is hereby conveyed forenhancement of the amount of Constant AttendantAllowance from the existing Rs.4500/- to Rs.6750/- per month.

3. These orders will take effect from01.07.2017.

With reference to the subject mentioned aboveand in continuation of this Department's OM ofeven number dated 07.09.2016 and 13.06.2017,detailed instructions are hereby being issued onthe application of the benefit on account ofbunching of stages while fixing the pay in therevised pay structure as a response to a large

including two fixed scales. The 6th pay structurebeing replaced by the 7th CPC recommended PayMatrix, thus, consists of 4 Pay Bands with 15 levelsof Grade Pay, along with 4 standalone scales,viz., HAG scale, HAG+ scale, Apex scale (fixed)and the scale of Cabinet Secretary (fixed).

5. While in the 5th CPC structure, the stagesin every pay scale were well defined, the stageswere not well defined in the 6th CPC structure.The pay was to be fixed in the running Pay Bandby rounding off to the next higher multiple of 10.Every multiple of 10 was a pay stage in the 6thCPC regime. However, all consecutive 10 rupeestages for any Grade Pay cannot be taken asconsecutive stages for the purpose of bunchingin reference to the 7th CPC recommendations asis also clear from the illustration contained in para5.1.37 of the 7th CPC Report. Based on theillustration contained in para 5.1.37 of the 7th CPCReport, Department of Expenditure’s OM. dated07.09.2016 provided that a difference of at least3%, the rate of annual increment, in the 6th CPCpay structure was essential for counting of twostages. The 6th CPC had replaced the system ofequidistant pay stages in a pay scale based onequal annual increments in the 5th CPC regimeby a system of annual increment of 3% on thesum of pay in the running pay band and the GradePay which was to be added to the running pay asincrement. Therefore, the pay stages in any givenGrade Pay were specific to an employee anddepended upon the initial fixation of pay in thatGrade Pay. As a result, the amount of incrementearned in the same Grade Pay would differ in thesame Pay Scale/ Grade Pay not only betweendifferent employees but also across years for thesame employee. To illustrate, an employee whosepay was fixed at Rs 46,100 in GP of 8700 in PB-4would have the first annual increment of Rs 1390which would be added to his running pay in thePay Band, another employee whose pay initiallywas fixed at Rs 46,400 in the same Grade Paywould have the first annual increment of Rs 1400.In such a scenario where the pay stages arespecific to the employee, it is not possible to arriveat universal pay stages for the purpose ofdetermining the extent of bunching. Therefore, forthe purpose of determining the extent of bunchingin a system of running pay bands, the consecutive

number of references received from Ministries/Departments.

2. The provisions giving effect to therecommendations of the 7th CPC on extendingthe benefit on account of bunching were notifiedvide DoE OM. dated 07.09.2016. Benefits onaccount of bunching have been extended duringthe initial fixation of pay in the revised pay structurewhile implementing the recommendations ofearlier CPCs also. Bunching occurs in the fixationof pay when the pay at two or more consecutivestages in a Pay Scale/ Grade Pay in the pre revisedscale get fixed at the same stage in thecorresponding Pay Scale/ Level in the revised paystructure.

3. The modalities of determining the extent ofbunching and the nature of benefits to be extendedon account thereof, based on therecommendations of the CPCs, have differedacross different Pay Commission periods. Whilethe 5th CPC recommended that benefits beextended when more than four stages getbunched, the 6th CPC recommended that benefitsbe extended when two or more stages getbunched. The fitment tables drawn by the 6th CPCand notified by the Government subsequentlyprovided for the benefit of bunching only whenmore than two stages were bunched. As regardsthe benefits to be extended on account ofbunching, the 5th CPC recommended benefit ofone increment for every four consecutive stagesbunched, the 6th CPC recommended benefit ofone increment for every two consecutive paystages bunched. For HAG scales, however,benefit of one increment was given at each of thepay stages in the 6th CPC pay structure.

4. In terms of the DOE OM. dated 07.09.2016based on the 7th CPC recommendations,bunching occurs when two or more stages getbunched and benefit of one increment is to begiven for every two stages bunched. Theseprovisions are to be applied while revising thepay from the 6th CPC regime to the 7th CPCregime. In the 6th CPC pay structure, about 35pay scales existing in the 5th CPC pay structurewere replaced by a system of running pay bandsrecommended by the 6th CPC. The 6th CPC paystructure consisted of 19 grades spread acrossfour distinct pay bands and 4 distinct scales

pay stages that need to be considered are thepay stages which are specific to the employee.

6. In the 5th CPC structure, the maximum andthe minimum of every pay scale were well defined.In the 6th CPC structure, Entry Pay was separatelynotified for most Grade Pay levels to govern theentry pay of direct recruits in that level. The pay ofthose moving from a lower grade to a higher oneon promotion was regulated in terms ofprovisions contained in Rule 13 of CCS (RP)Rules, 2008. As such, the Entry Pay notified for agiven Pay Scale/ Grade Pay is the effectiveminimum of that Grade Pay for direct recruits. Foran employee getting promoted, the sum of theminimum of the relevant Pay Band and the GradePay is the effective minimum pay. The 7th CPC, inits Report, has commented that this led to manysituations where direct recruits drew higher payas compared to personnel who reached that stagethrough promotion. Demands were received bythe 7th CPC from many staff associations andemployees for removal of this disparity which the7th CPC refers to as differential entry pay.

7. In the revised dispensation for pay fixationin the New Pay Structure as recommended by the7th CPC, direct recruits shall start at the minimumpay corresponding to the level to which recruitmentis made, which will be the first cell of each level.For those promoted from the previous level, thefixation of pay in the new level will depend on thepay they were already drawing in the previouslevel. The pay, however, cannot be less than thefirst stage of the relevant level. While enumeratingthe benefits of migrating to the new system atpara 5.1.47 of the 7th CPC Report, it has beenstated that ‘the issue of differential entry pay hasbeen resolved’. At para 5.1.36 of the 7th CPCReport it has also been mentioned thatrationalization has been done with utmost care toensure minimum bunching at most levels.Rationalization has been done by the 7th CPCthrough the Index of Rationalisation (IoR) whichhas been multiplied with the Entry Pay in the 6thCPC regime to arrive at the first cell of each level.With the Entry Pay along with IOR being used asthe determiner of the first cell, pay stages belowthe Entry Pay have been consciously brought upto the level of Entry Pay and its corresponding paystage in the revised pay structure. As a result, all

pay stages below the Entry Pay in any Level will,on re-fixation, converge to the first pay stage inthat level. As this convergence takes place onaccount of a conscious decision of the 7th CPCintrinsic to the architecture of the Pay Matrix byindicating the Entry Pay as the starting point ofeach Level, benefit on account of bunching cannotbe extended with reference to pay stages lowerthan the Entry Pay indicated by the 7th CPC forthat level in the Pay Matrix. Extending the benefit ofbunching with reference to pay stages below theentry pay will perpetuate the difference in pay onaccount of differential Entry Pay which wasaddressed by the 7th CPC.

8. Based on the above, it is clarified that thefollowing shall be kept in view while determiningthe extent of bunching as also the benefits to beextended on account of bunching at the time ofinitial fixation of pay in the 7th CPC pay structure:

(i) Benefit on account of bunching is to beextended when two or more stages get bunched.

(ii) Benefit of one increment is to be extendedon account of bunching of every two consecutivestages.

(iii) As stipulated in MoF OM dated 07.09.2016,a difference of 3% to be reckoned for determinationof consecutive pay stages, specific to eachemployee.

(iv) All pay stages lower than the Entry Pay inthe 6th CPC pay structure as indicated in the PayMatrix contained in the 7th CPC Report are not tobe taken into account for determining the extent ofbunching.

9. All Ministries/ Departments are advised toreview all cases wherein benefit on account ofbunching has been extended in terms of thisDepartment’s OM dated 07.09.2016 and to re-fixthe pay in terms of the instructions containedherein.

This Department vide O.M of even No. dated25.07.2017 has also emphasised upon allMinistries/Departments etc. to suo-moto proceedto process the revision cases immediately to avoiddelays in issuance of revised PPOs of pre-2016retirees and also send the status of revised casesas on 16.08.2017 in the prescribed proforma soas to reach this Department latest by 31.08.2017.

3. However, it has again come to the notice ofthis Department that some Ministries/Departments/Organizations are seekingapplications from pre-2016 pensioners/familypensioners for revision of their pension or askingthese pensioners to provide additionalinformation/documents including PPO, proof ofdate of birth, date of retirement, name of bank andaddress etc for the purpose of processing theircases for revision of pension.

4. The Ministries/Department are thereforerequested to sensitise the officials dealing withpension cases to suo-moto process the pensionrevision cases of pre-2016 pensioners/familypensioners forthwith based on details availablewith Head of Qffice/PAOs without insistingsubmission of any additional information ordocuments from them.

Itmay be noted that expeditious revision of Pensionrequires a close coordination between Personneland Accounts Departments. The CPO and PFAmay be asked to form joint groups by drafting stafffrom both the departments for expeditiousrevisions.

The status of revision of PPOs is beingreviewed by Department of Pension andPensioners’ Welfare, status of Revision Casesas on 16/8/2017 is to be sent by 21/8/2017. Inaddition, Secretary (Expenditure), Ministry ofFinance, vide his DO letter dated 27/7/2017, hasasked for a weekly report to be sent regardingprogress of revision of Pension Cases. It isrequested that necessary steps may kindly betaken to expedite the task of revision of theremaining cases. 2. It was observed that the pay fixed in 7th CPC pay structure as per the methodology laiddown in Board’s letter dated 02.08.2016 is coming out to be less than 14.29% increase of payprescribed by 7th CPC, in certain cases of Running Staff.

3. The matter was, therefore, examined in Board’s office in consultation with the Ministry ofFinance and it has now been decided that for fixation of pay for Running Staff category, in caseswhere the actual rise in pay at the time of initial fixation works out to be less than 14.29%, theinitial pay in such cases shall be fixed at the next higher cell of the relevant Level in the PayMatrix. Illustrations in this regard are enclosed as Annexure ‘A’.

4. It may be noted that there is no other change in the fixation methodology as circulated videRailway Board’s Letter No. PC-VII/2016/RSRP/2 dated02.08.2016 (RBE No.93/2016).

Sub: (i) Payment of arrears of pension in caseswhere valid nomination has not beenmade under the payment of arrears ofpension (Nomination) Rules, 1983;

(ii) Payment of arrears of family pension-regarding.

Attention is invited to provisions for paymentof Arrears of Pension under Regulation 90 ofPension Regulation Part-II (2008), which providethat after the death of the Armed Force Pensioner,all money payable to the pensioner on account ofpension due to the estate of a deceasedpensioner may be paid to the nominee of thedeceased Armed Forces Pensioner. In theabsence of any nomination made by the ArmedForces Pensioner, the arrears of his/her pensionare paid as per the "Will" if such a "Will" has beenmade by the deceased Armed Force Pensioner.In case neither nomination nor 'Will" has beenmade by the deceased Armed Forces Pensioner,the arrears of his/her pension are paid under theorders of the Pension Disbursing Authority to theheir without production of usual legal authority, ifthe gross amount of arrears of pension claimdoes not exceed Rs. 10,000=00, provided he isotherwise satisfied about the right of the claimant.If the gross amount of arrears of pension claimexceeds Rs. 10,000=00, the arrears of his/herpension are paid under the orders of PrincipalController of Defence Accounts (Pension) onexecution of an Indemnity Bond in Form IAFA-642duly stamped for the gross amount due forpayment with such sureties as may be deemednecessary and accepted on behalf of the“President by an officer duly authorized underArticle 299(i) of the Constitution. In case of anydoubt, payment is made only to the personproducing the legal authority.

2. Considering difficulties in obtaining the legalheir-ship-certificate it has been decided that inthe absence of nominee or any "Will" of thedeceased pensioner, the arrear of pension willbe paid as under.-

(i) Under the orders of the Pension DisbursingAuthority to the heir without production of legalauthority, if the gross amount of arrears of pensionclaim does not exceed Rs. 25,000/-, provided heis otherwise satisfied about the right of theclaimant.

(ii) If the gross amount of arrears of pensionclaims exceeds Rs 25,000/- but does not exceedRs. 2,50,000/-, under the orders of PrincipalController of Defence Accounts (Pension) onexecution of an Indemnity Bond in Form IAFA-642duly stamped for the gross amount due forpayment with such sureties as may be deemednecessary and accepted on behalf of thePresident by an officer duly authorized underarticle 299(i) of the Constitution.

(iii) In case of any doubt and also in caseswhere the amount of arrear exceeds Rs 2,50,000/-, payment shall be made only to the personproducing the legal authority.

3. Normally there should be two sureties bothof known financial ability. However, in case theamount of claim is less than Rs 75,000/- theauthority accepting the Indemnity Bond for and onbehalf of President of India should decide on themerits of each case whether to accept only onesurety instead of two. The obligor as well as thesureties executing the Indemnity Bond shouldhave attained majority so that the bond has legaleffect or force. The Bond is required to be acceptedon behalf of the President by an Officer dulyauthorized under Article 299(i) of Constitution.

4. This Ministry letter No. 1(16)/2009-D(Pen/Policy) dated 15.03.2010 stipulates that in theevent of death of a family pensioner, the right toreceive any arrears of family pension wouldautomatically pass on to the eligible member ofthe family next in line. The requirement ofsuccession certificate for payment of any arrearsoccurs only where there is no member in familywho is eligible to receive family pension after thedeath of the family pensioner. Therefore, it hasbeen decided that the provision of this letter willalso apply to the payment of arrears of familypension where no member of family is eligible toreceive family pension.

5. These orders will not be applicable In thecases where valid nomination exist under GOI,

The other conditionsfor grant of FMA shall continue to be in force.

2. Ex-Servicemen who retired on or after 01Apr 2003 have to-become member of ECHScompulsorily and are not eligible to draw FixedMedical Allowance. These orders applicable onlyin such cases, where the date of retirement isprior to 1.4.2003 and who had opted not to availmedical facilities at OPD of Armed ForcesHospitals/ MI rooms and are not members ofECHS.

3. These orders will take effect from01.07.2017.

4. All other conditions as laid down inGovernment of India letter No.1(1)/98-D(Pen/Sers)dated 15th June 1998 will continue to apply.

In view of the doubts raised, it is clarified thatno field in the format is mandatory except thosewhich are required to process the pension case.

Therefore, while it is advisable to provideAadhaar number and PAN number of thePensioners wherever available for better qualityof database, no case for 7th CPC pension revisionsshould be delayed for the want of Aadhaar numberand PAN number of the pensioners.

BPS PMES awards 2017 for affiliated Associations

Survival of pensioners’ organization is on performance.Good organization care more for therecognition by the masses they serve ( pensioners in our case) than the recognition by theGovernment. BPS has a history of learning from the past & to mould itself to the future requirement.Ithas been our endeavour to serve you better & it is this zeal that BPS wish its affiliates to progress& strengthen themselves .If you grow, BPS too will grow. Though often Secy Genl has beengiving you inputs through his writings & speeches being published in monthly magazine of ‘BharatPensioners Samaj’ but in today’s scenario of modern technology & management skills, upgradationof both i.e the Federation & the affiliates is necessary. BPS, therefore, is constantly in the processof adopting modern technology & managerial skills to provide better guidance, information, training& real-time support to its affiliates. We wish our affiliates also to keep them updated. Performanceoriented scheme of two awards of Rs.5000/- cash each with Trophies & 1 consolation cash prizeof Rs 3000 is in vogue for the last several years. The meeting was presided overby Dr Amrita Lal Chakraborty  General  Secy of the association & BPS VP (East Zone) whileaddressing the audience Dr. Amrita LalChakraborty raised the issue of non payment ofenhanced DA , Gratuity and leave salary to thosewho retired on 30th june. He pointed out that inspiteof the fact that the issue has been favourably andfinally decided vide WP (C) no 5376/2001 in caseof Kamla Gupta and WP 26506 of 2012 in case ofB. Chandra Shekhara Rao & others  GOI is notextending the benefit of judgement to similarlyplaced pensioners. S C Maheshwari  Secy  Genl BPS briefed the audience about the outcome of7th CPC and implementation of its recommen-dations, explained as to how social media can beused for the benefit of Pensioners and assuredthe house to take up the issue of extension ofbenefit of court judgements to similarly placedpensioners. In the end Secy Genl thanked themanagement & of the Association for havinginvited him to their office and listening to himpatiently.

TIRUCHIRAPPALLI CG Pens. Forum. - GBMwas held on 30.07.2017 at Srirangam presidedby Shri V V Ramanujam, who welcomed themembers and got approval of the minutes of thelast meeting. He informed the audience that dueto pursuance of BPS Govt has issuedconcordance tables indicating the fixation of thepension of pre 2016 pensioners through notionalpay method to avoid any delay or anymiscalculation. The same have been sent to allthe departments and CPA for early disbursementof increased pension along with arrears. TheForum placed their trust that the process will becompleted early. The Forum further hoped thatGovt. will revise the pension of the absorbees inPSUs, restoring their full pension, they are likelyto get arrears for 10 to 15 years. The Forum furtherelaborated and informed regarding the sanctionof FMA of Rs. 1000 against 500 wef 1.7.2017.Banks have been directed to record PPO No. inthe SB Book, BPS is now actively circulating thelatest orders and instructions to the membersthrough sms etc. Concluding, a resolution wasunanimously passed to donate Rs.1000/ to BPSBuilding Fund. Shri A K Chandershekhar Genl.Secy . proposed vote of thanks and meeting endedwith thanks to the chair.

VIJAYAWADA C & S Pensrs.Orgn. - Minutesof the Tri monthly GBM on 01.07.2017 presidedby the President Sri K Hanumantha Rao, whowelcomed the guests and members followed bytwo minutes silence in memory of member lateSri Panchapasam and paid heart feltcondolences. He informed the house about therelease of concordance tables for early fixationand payment of arrears to pensioners, the oldpensioners expected to be benefited but stressedto continue the struggle to fight for the due rights.Sri M Chandramouli Secy BPS spoke high aboutthe efforts by BPS to fight for resolving anomaliesbetween the new and old pensioners. House wasalso informed about raising of FMA to Rs. 1000.The meeting ended with light refreshment &voteof thanks to chair and singing of National Anthem.

& BPS Secy for EPS 95, Shri Parakash Pathak ,Sh Mohamad Yunus  and shri P N Pandey for thegrand success of EPS 95 Maha Samelan held atNagpur on 5.8.17 . Referring  to the recentstatement of Minister of Labour  & employment inLok Sabha promising to revamp EPS 95completely & to provide health care facilities toEPS-95 pensioners. SG cautioned that due careneed to be taken that all new  facilities after revamp are made applicable to old EPS-95 pensionersalso and that the demand for minimum Pensionof Rs. 9000/- per month and removal of ceiling ofpensionable salary be vigorously pursued  alongwith immediate implementation of  Bhagat SinghKoshiyari committee recommendations and fullrestoration of commuted portion of pension.Maheshwari emphasised the need to make GOVT& political parties understand that Pensioners toohave vote power, he also explained as to howsocial media can be effectively used for the benefitof pensioners. In the end  SG BPS S CMaheshwari thanked the management and theaudience for having invited him & listened to himpatiently.

Nellore Branch AICG Pen. Assn.- Monthlymeeting was held on 05.08.2017 presided byPresident Shri K Subrahmanya Reddy, who madeimportant announcements about raising of FMAfrom 500 to 1000 with effect from 01.07.2017 andissue of concordance Tables . He also explainedthe resolutions adopted in the 38th AGM of AIFPAon 21st and 22nd July, 2017. Further Vice Presidentraised the demand for revised FMA with effect from01.01.2016 instead of 01.07.2017. Meeting endedby singing the National Anthem.

Srirangam CG Pen. Forum - The forumspecifically pointed out anomaly in the CCS(Revised Pay Rules) 2008 between the entry scaleof various pay scales in Pay Bands 1 to 4 e.gLevel 8 entry pay shown as 18150 instead of Rs.18750. Forum desired that this anomaly need tobe sorted out.

Right to Privacy

In a landmark decision that will affect thelives of all Indians, the Supreme Court onThursday the 24.8.17 unanimously declaredthat  individual privacy is a “guaranteedfundamental right”. Key conclusions from thejudgment:

1. Life and personal liberty are inalienablerights. These are rights which are inseparablefrom a dignified human existence. The dignityof the individual, equality between humanbeings and the quest for l iberty are thefoundational pillars of the Indian Constitution;

2. Judicial recognition of the existence ofa constitutional right of privacy is not anexercise in the nature of amending theConstitution nor is the Court embarking on aconstitutional function of that nature which isentrusted to Parliament;

3.  Pr ivacy inc ludes at i ts core thepreservation of personal intimacies, thesanctity of family life, marriage, procreation,the home and sexual orientation. Privacy alsoconnotes a right to be left alone.

4. Personal choices governing a way oflife are intrinsic to privacy.

5. Privacy is not lost or surrenderedmerely because the individual is in a publicplace. Privacy attaches to the person since itis an essential facet of the dignity of thehuman being;

6. Technological change has given rise toconcerns which were not present sevendecades ago and the rapid growth oftechnology may render obsolescent manynot ions of the present . Hence theinterpretation of the Constitution must beres i l ient and f lex ib le to a l low futuregenerations to adapt its content bearing inmind its basic or essential features;

7. Like other rights which form part of thefundamental freedoms protected by Part III,including the right to life and personal libertyunder Article 21, privacy is not an absoluteright. A law which encroaches upon privacy

8. Privacy has both positive and negativecontent. The negative content restrains thestate from committing an intrusion upon thelife and personal liberty of a citizen. Its positivecontent imposes an obligation on the state totake all necessary measures to protect theprivacy of the individual.

9. The right of privacy is a fundamentalright. It is a right which protects the innersphere of the individual from interference fromboth State, and non-State actors and allowsthe individuals to make autonomous lifechoices.

10. The privacy of the home must protectthe family, marriage, procreation and sexualorientation which are all important aspects ofdignity.

11. ...in a country like ours which pridesitself on its diversity, privacy is one of the mostimportant rights to be protected both against

State and non-State actors and be recognizedas a fundamental right.

12. ...Right of privacy cannot be denied,even if there is a miniscule fraction of thepopulation which is affected. The majoritarianconcept does not apply to Constitutionalrights...

13. Let the right of privacy, an inherent right,be unequivocal ly a fundamenta l r ightembedded in part-III of the Constitution ofIndia, but subject to the restrictions specified,relatable to that part. This is the call of today.The old order changed yielding place to new
