LARIMER COUNTY SHERIFFS OFFICE Narrative As Supervisor, Sheriff's Dispatch advised me to look at a suspicious circumstance case which was pending in the Red Feather Lakes area. This incident was an assist to the US Marshall Service at 600 Ramona Drive in Red Feather Lakes area. US Marshall DENNIS CONMAY spoke to me over the phone regarding the possible location of two homicide suspects from Illinois.
He told me that two homicide suspects by the names of MICHAEL SHALLERT and AFTON FERRIS from Benton, Illinois, were possibly in this cabin. This cabin belong ed to the male suspect SHALLERT's mother who lived in Cheyenne, Wyoming. CONMAY had reason to believe that the suspects were in the Larimer County area. CONMAY told me that this cabin had a broken window and a door that was open. I told him that I would send deputies to his location to meet with him and in the mean time I requested that he contact the owner to get permission to enter the cabin.
CONMAY called me shortly after that and told me he did receive permission and he and the other marshals did clear the cabin and did not find the suspects. Deputy HARRISON and Deputy WICKER then completed a burglary investigation with special emphasis on finding any evidence of the two suspects.
Newest Information Received from Marshalls
I then received a call from a female marshal from Denver whose name is unknown to me that other marshals were in the area of Fort Collins and believed they spotted the homicide suspect vehicle at the trailer park located at 517 East Trilby. This vehicle was actually a stolen vehicle from Benton, Illinois, that belonged to one of the victims. The Illinois plate that was on it previously now had Colorado plates and the Colorado plate was stolen from a truck parked at the Ramona Drive address in Red Feather Lakes.
Additionally, I learned from information received from witnesses from Windsor, Colorado, that these homicide suspects were there the previous evening and had possibly stolen an M44 assault rifle.
I immediately notified Lieutenants ROBERT COOK and MICHAEL BROOKS of the situation and requested for patrol deputies to respond to the general area of Trilby and College and to meet up with US Marshalls to coordinate the arrest of the suspects who were at as yet an unknown trailer number at the 517 East Trilby trailer park.
Further Information
All pertinent information was passed onto Command Staff and I set up an Incident Command location in the 300 block or West Trilby. The Larimer County Sheriff's Office SWAT was called out and a plan was put together to contact and capture the suspects.
I was then relieved of the Incident Command duties by Lieutenant COOK and given an assignment of Operations Commander for patrol officers. I directed patrol Deputies WICKER, WEBER, PASTECKI, KNUDSEN, HARRISON, WILSON and MARCINIAK to the area as well as SWAT members Corporal HERTZ and Deputy HART.
Contact teams were set up which included SWAT members and patrol officers. Eventually the suspects were contacted by SWAT members and were taken safely into custody.
Investigations
Sergeant JOHN FEYEN coordinated search warrants for the house and vehicle. Criminal Impact Unit members served the Search Warrant and collected evidence.
This ends my involvement in this case.

Information
I responded to 517 East Trilby Road to assist with the apprehension of a homicide suspect out of Illinois. Initially I was directed by Lieutenant MIKE BROOKS and Sergeant BILL HOWE to remain on the perimeter in the event the suspects were to take off in a vehicle. The suspects were eventually taken into custody and I was requested by Sergeant HOWE to respond to the trailer park to transport the male suspect to the Larimer County Detention Center.
Contact with Suspect
I arrived on scene and took the suspect into custody. Deputy BEN HESS had handcuffed the suspect. I switched out handcuffs with Deputy HESS and took possession of the suspect.

The suspect was identified as MICHAEL SCHALLERT, DOB: 120989.
Officer's Observations
Mr. SCHALLERT was subdued and quiet. He appeared to be despondent or depressed. I could smell the strong odor of an alcoholic beverage on his breath and his eyes were bloodshot.
Statements by SCHALLERT
While searching Mr. SCHALLERT and subsequently placing him in the back seat of my patrol vehicle he spontaneously made some statements. He said "I've committed enough crimes in the last few days." He said "We were going to kill ourselves." At the jail Mr. SCHALLERT stated he had consumed approximately two beers and smoked some "pot."
Property Confiscated
While searching Mr. SCHALLERT, I removed a set of keys, a credit card, four small white pills, two full-sized pieces of paper with handwriting, two lighters, and a bottle cap from his right pants pocket. I removed four small white pills, identical to the other ones, from his left pants pocket. All the property was turned over to our Investigations Unit on scene at 517 Trilby Road.
Clothing Confiscated
I assisted Investigator MIKE BYERS at the Larimer County Detention Center with the collection of Mr. SCHALLERT's clothing. I placed his jeans, two outer shirts, and a belt in one sack. I also collected his underwear and socks into a second sack. His shoes and hat were placed into a third sack. All items were turned over to Investigator BYERS.
Disposition of Subject
I transported Mr. SCHALLERT to the Larimer County Detention Center where he was booked in on the outstanding warrant from Illinois. The orig inal charge on the warrant was Possession of a Stolen Firearm. The warrant number was W09U4470.
Subject's Attitude
Mr. SCHALLERT was courteous and cooperative with me during the contact.

I was advised by units on scene that the female they had in custody, AFTON FERRIS, needed to be transported to the Larimer County Detention Center. FERRIS was already in handcuffs. I searched her incident to arrest and located two handwritten notes in her jeans pockets. Deputy WEBER photographed the notes before I left for the detention center. FERRIS was transported to the detention center without incident. Investigator BYERS asked me to collect FERRIS' clothing at the jail. I placed her clothing into three separate paper bags and transfered custody of the clothing to BYERS.
No further action taken.

On 102109 at 1948 hours, I responded to the area of 517 East Trilby in Fort Collins, Colorado to assist in setting up a perimeter for Red Swings in reference to the possible location of homicide suspects out of Illinois.
I sat in the 800 block of East Trilby waiting in case the suspects were to leave eastbound out of the area. I remained at that location
Containment
When the suspects were in custody, I was requested to park my department vehicle east of trailer #71 at the beginning of the cul-de-sac and not allow people in the area.
Search
At 0144 hours on 102209, I assisted other members of the Criminal Impact Unit and Investigations in conducting a search of trailer #71. I searched a portion of the living room and a bedroom that was on the northeast part of the trailer. I did not locate any evidence to be collected.
I remained on scene until the search warrant was complete.

Information
On 102109 at approximately 1900 hours I had been informed by Sergeant HOWE with the Larimer County Sheriff's Office that the United States Marshals had a possible location for two homicide suspects in Larimer County. They believed the two suspects were located at 517 East Trilby, Trailer #71. The suspects were described as a male and a female who had warrants for their arrests for a homicide that had occurred in Illinois. The Marshals had located the stolen Chevy Impala with stolen Colorado license plates attached to it at Trailer #71 .
Arrival on Scene
Upon my arrival in the area numerous unmarked United States Marshal's vehicles were located in the area. I positioned myself to the north of the trailer park, across Trilby.
At this point I assisted with perimeter security and being available in the event the individuals would leave the residence in a vehicle.
Arrest of Suspects
Member of the Larimer County Sheriff's Office SWAT Team arrested the individuals in front of Trailer #71 . The

LARIMER COUNTY SHERIFFS OFFICE Narrative two individuals were identified as MICHAEL SCHALLERT and AFTON FERRIS. Along with those two individuals were several other individuals associated with the trailer and had been seen coming and going from the trailer as surveillance was being conducted by other units. After the arrests I arrived in the area and assisted with security on individuals who had been detained in association with the arrest of SCHALLERT and FERRIS.
Search of Residence
Sergeant JOHN FEYEN who was on scene informed members of the Criminal Impact Unit that members of Investigations were obtaining a search warrant for Trailer #71 . We waited for the search warrant to be reviewed and signed to assist with the search of the residence. Upon being notified the search warrant had been signed by a judge, I assisted with the evidence collection while inside Trailer #71 . My task was to label the evidence and to log the evidence on to evidence sheets and an inventory and return to be returned to the courts upon the completion of the search warrant. While assisting with logging the evidence on the evidence log sheet, I observed Investigator NEWTON had recovered a located in the living room portion of the trailer.
The gray hooded sweatshirt's size made me believe it belonged to a female. I observed female blue jeans; which appeared to have large red blood stains on them and a pink female shirt which also appeared to have blood stains on it. Inside was also a pair of male blue jeans and a male shirt. Located inside the female black purse by Investigator NEWTON were two identification cards from the state of Wyoming identifying the male and female as MICHAEL SCHALLERT and AFTON FERRIS. Also located in the small black billfold was a social security card for SCHALLERT. I also had observed Sergeant SHELLHAMMER located .762 X 54 ammunition in a bedroom closet of the southeast bedroom.
A copy of the inventory was left in the kitchen at #71 .

On 102109 I and other investigators with the Larimer County Sheriff's Office Criminal Impact Unit responded to the location of 517 East Trilby near the area of unit #71 in Loveland, Colorado. I had been advised that agents with the U.S. Marshalls' Office had obtained information that possible homicide suspects, MICHAEL SCHALLERT and AFTON FERRIS were located at this location. I had been informed that the vehicle the two suspects were in possession of, described to me as being a tan Chevrolet Impala, was parked in front of this home.
Surveillance of Residence
I positioned myself to the southwest of the Trilby Trailer Park where I was in a position to observe the front porch area of trailer #71 . Through my binoculars I was able to see numerous individuals exit the trailer and stand on the elevated porch/deck area. It appeared that these individuals would come out to smoke and eventually retreat back into the residence.

Due to the radio traffic that I was monitoring, I was able to learn that both suspects were placed into custody.
While responding to the trailer #71 , I was requested to assist with an unidentified subject who had left trailer #71 just prior to the arrest of the suspects. This individual went to trailer #68. When I arrived, he was being placed into temporary custody until all individuals could be identified. The individual who had left trailer #71 and gone to trailer #68 was identified as TRAVIS WILLIAM DEINES, DOB: 021783.
In speaking with DEINES it was learned that he does live at trailer #68 and was previously "hanging" with the individuals in trailer #71 . After all individuals had been identified, DEINES was taken out of handcuffs and was eventually allowed to go back into his residence, trailer #68.
Description of Evidence on Suspect
Deputy TED WILSON with the Larimer County Sheriff's Office was escorting the suspect identified as MICHAEL SCHALLERT to his vehicle where he would be transported to the Larimer County Detention Center. I assisted Deputy WILSON when he arrived at his vehicle and was conducting an inventory of the property on SCHALLERT's person. That property consisted of a set of vehicle keys, a credit card not issued to SCHALLERT, eight small white pills, two lighters, a bottle cap, and some change along with two handwritten pieces of paper.
On one piece of paper, which was piece of 8" X 11" white paper folded in half, were several names and phone numbers of individuals as well as what appeared to be driving directions to an unknown location. The other full sheet of 8" X 11" paper was also folded and was handwritten on both sides. I quickly perused the handwritten letter to ascertain if it contained any evidence for the case in question and observed that the content of the letter referred to items such as "being sorry for what they had done" further advising that the possible victims had stolen items from the suspects and that no other choice was given to the suspects but to do what they had done. Towards the end of the handwritten letter it advised that they were sorry for what they had done and wished to be buried together. The note was signed by MICHAEL SCHALLERT.
The vehicle keys removed from SCHALLERT's pocket I then took over to the tan Impala to ascertain if the keys would fit that vehicle. A check through the driver's side door lock with the key was undetermined if it actually worked on the vehicle or not. I then placed the key in the ignition of the vehicle and was able to turn on all the accessory and interior lighting for the vehicle. I did not turn the key completely over in an effort to start the vehicle. I was able to determine that they key did in fact fit the Chevy Impala.
Consent Search of Vehicles
It was decided that the owners of the other vehicles parked in front of trailer #71 would be contacted to obtain a consent to search their vehicles. This was done in the belief that the suspects could have, without the owners' permission or otherwise have had access to their vehicles and may have left or deposited evidence that would be beneficial to the orig inal investigation. I contacted the other occupants of the trailer #71 to determine who owned the two vehicles parked in front of the residence. I learned that both WADIONI TOTOS and JANICE TYLER owned the two vehicles in question. I solicited and obtained written consent to search their vehicles and followed up with written consent signed by both registered owners of the vehicles. No items of evidentiary value was located in either vehicle.

Initial Information
On the evening of 102109 I learned through Sergeant HOWE that he was in contact with United States Marshals who were in the area of 517 East Trilby in Fort Collins. They were advising him that they were looking for two fug itives wanted in a homicide in Illinois. They believed these two fug itives, MICHAEL SCHALLERT and AFTON FERRIS, were at trailer 71 at 517 East Trilby.
When I got into the area I pulled onto the street to the north of this trailer park and met with agents of the United States Marshal's office. During this brief meeting I learned while listening to the Marshal's radio that an unknown person had just gotten into a vehicle from an unknown trailer in the area of 71 . This vehicle that was leaving was a white compact car. I then got in my vehicle and was able to get behind this white compact car on Trilby while turning southbound on College. Investigator JOSH SHELDON was in front of me and he initiated the traffic stop with this white vehicle. We came into contact with a female driver and male passenger and we learned that they had come from a neighboring trailer and were not involved. We then released them.
SWAT Call

LARIMER COUNTY SHERIFFS OFFICE Narrative Weapons and Tactics (SWAT) team was then paged out. As a member of this SWAT team I responded to the stag ing area and changed over into my SWAT equipment.
Arrest of Ms. FERRIS and Mr. SCHALLERT We then coordinated our efforts with the main entry team on the north side and began to make our approach. Before stepping out into the light the entry team deployed a flash sound diversionary device in order to avoid a shooting and in an attempt to keep them from going back inside the home. Part of the entry team cut off access to the home while Sergeant HARKIN and I moved in with the rest of the entry team and placed the two subjects at gunpoint. They were then taken into custody without further incident.
Search of Trailer 71
Once these subjects were taken into custody, I changed out of my SWAT equipment and later returned to the residence and waited with other investigators for a search warrant to trailer 71 to be signed. Once I learned that the search warrant had been signed, I went inside the home and began searching the front living room.
In the living room on the floor next to the couch which was on the south wall
Additionally in the purse I found a black identification holder. Inside of the identification holder there were Wyoming identifications for AFTON FERRIS and MICHAEL SCHALLERT as well as a social security card for MICHAEL SCHALLERT.

On 102109, I was paged to respond to the Larimer County Sheriff's Office to assist in preparing search warrants and collect evidence for a felony warrant arrest attempt to be executed at 517 East Trilby, unit #71, in Fort Collins, Colorado.
Arrival at the Sheriff's Office
Upon arrival at the Sheriff's Office, I was joined by Investigator RYAN ALBERTS. We had been provided information that MICHAEL SCHALLERT and AFTON FERRIS were currently at 517 East Trilby, unit #71 , in Fort Collins, Colorado. Information we had been provided indicated that both subjects had felony warrants for their arrest on weapons charges in connection with a homicide that occurred on 101809 in Franklin County, Illinois.
As we began preparing the search warrant, I was contacted by Sergeant FEYEN after learning that both subjects had been taken into custody at that address. Sergeant FEYEN requested that I respond to the Larimer County Detention Center with evidence bags to collect all of the clothing and property worn by both subjects as they were being booked into the Detention Center. At that point Deputy ALBERTS continued preparing the search warrant for the Trilby Road address while I responded to the Detention Center.

Briefing
I met with Lieutenant COOK and was told that a homicide suspect was believed to be at unit #71 in Trilby Mobile Home Park and was shown a set of photos of the suspect.
Observations
I was able to work into a position on the north side of unit #71 and observe the main door side and persons coming and going from the door on that side. While in position, I observed a white male that looked like the photos I had been shown earlier. He was wearing a black cowboy style hat and a red shirt. He was accompanied by a white female with blond hair and glasses. At one time the female was seen going through the car parked at the mobile home. She had gathered a white plastic trash bag from inside the mobile home and was placing items into the bag. I was unable to see what the items were. I later saw the male suspect place a white plastic trash bag into a trash container located on the north side of the landing to the front door.
Both the male and female suspects were arrested by the SWAT arrest team without incident. Other occupants were placed in temporary custody.

Initial Information
The Criminal Impact Unit from the Larimer County Sheriff's Office was requested to respond to 517 East Trilby Road in the area of trailer #71 to assist US Marshals and the swing shift to attempt to apprehend MICHAEL SCHALLERT, DOB: 121679, and AFTON DANIELLE FERRIS, DOB: 120989.
FERRIS and SCHALLERT were wanted subjects connected with a double homicide in West Frankfurt, Illinois.
Incident Command
Sergeant BILL HOWE was tasked with Incident Commander of this case. Sergeant HOWE requested at approximately 1948 hours that I meet up with a US Marshall task force member in the area of Kyle and Trilby Road. I moved my unmarked patrol vehicle from Kyle to a drive way off of Trilby and met up with US Marshall task force member and got in the passenger side of his Tahoe.
Sergeant HOWE requested that we take up a position of surveillance that we could observed the front door of trailer #71. We moved the vehicle to the far north road of the trailer park and parked in the northwest corner. I was on the passenger side of the vehicle and had a straight view of the front door of trailer #71 which faced west.
The light was on outside the trailer door and to the west of the trailer door was a shed. To the south of the shed which the shed partially blocked my view there was a sedan parked in the driveway.
At approximately 2130 hours, multiple subjects exited the trailer. The first subject I saw was a white or Hispanic Report Officer

LARIMER COUNTY SHERIFFS OFFICE Narrative male wearing a dark colored cowboy hat and a red shirt. Looking at the subject through binoculars it appeared to be wanted subject MICHAEL SCHALLERT.
Standing next to that subject was a blonde female approximately 5-foot 7-inches and 130 pounds. That subject also appeared to be AFTON FERRIS.
I continued to watch the subjects. They appeared to be smoking on the porch. A short time later, the group appeared to disperse. MICHAEL SCHALLERT went to the sedan and I could hear a car door open. AFTON FERRIS was also standing near the sedan. AFTON FERRIS then returned inside the trailer and came back out with a white garage bag. Both SCHALLERT and FERRIS appeared to be emptying things out of the vehicle and placing them in the garage bag.
SCHALLERT then placed the white garbage bag in a plastic garbage can which was located on the north side of the steps going into trailer #71.
Apprehension
A short time later, SWAT members approached both, and took both SCHALLERT and FERRIS into custody. SWAT members then had the rest of the subjects inside the trailer exit out and all were detained.
Vehicle Information
The plate on the vehicle that FERRIS and SCHALLERT were moving items from and placing into the garbage bag read 938SXH. The Vehicle Identification Number for that vehicle was 2G1WF52E239106659.
Search Warrant
Investigator ALBERTS from the Larimer County Sheriff's Office wrote a Search Warrant for 517 East Trilby #71. I was part of the search team on the Search Warrant. I was tasked with searching a large bedroom on the east side of the trailer. Also located inside brown paper

I assisted in this case initially as a radio operator for Sergeant HOWE at the command post. I relayed information at the command post as it was received. I also assisted by responding to 517 East Trilby #71 after the suspects were contacted and I then remained on scene in order to provide security, as well as a place to stay warm, for the five individuals who were not arrested. I obtained personal information from the five individuals and that information was turned over to Sergeant HOWE. I obtained the information from the RAINWATER brothers, TOTOS and Mr. and Mrs. TYLER. I asked the five individuals if they required medical attention and it was declined. I also assisted in tending to personal needs they required until their vehicles were clear and they were able to sit in them to keep warm until their home was turned back over to them. I was released from the scene by Sergeant HOWE and this ended my involvement in this incident.

Initial information
On 102109 Sergeant HOWE was in contact with the United States Marshall's Office reference two homicide suspects who may be in Larimer County. The suspects were identified as MICHAEL SCHALLERT and AFTON FERRIS. Both were suspected in a double homicide that occurred on 101809 in Illinois, and believed to be armed with a pistol and a high powered rifle. The Marshall's had intelligence that both suspects are possibly at 517 East Trilby unit #71 in Fort Collins. Several LCSO units responded to that area and set up a perimeter, trying to positively identify the suspects.
SWAT Deployment
On 102109 at approximately 1958 hours the Larimer County Sheriff's Office SWAT team was deployed to the above location to assist in the arrest of SCHALLERT and FERRIS. as time went on both suspects were positively identified as being in the drive way of unit #71. Several team members staged East of the residence and deployed as a contact/arrest team. Due to the high probability that the suspects may be armed or have the ability to arm themselves quickly, I deployed a noise flash diversionary device on the arrest teams approach. The diversonary device was deployed approximately 25-30 feet from the suspects. SCHALLERT and FERRIS were safely taken into custody and later transported to LCDC. Several other occupants of #71 were contacted and interviewed.
This ended my involvement in the case.

I assisted in the apprehension of two wanted persons, MICHAEL SCHALLERT and AFTON FERRIS, as part of the Larimer County Sheriff's Office SWAT team.
On 102109 at approximately 2000 hours, I received a SWAT page to respond to a staging area at 320 West Trilby Road for a SWAT deployment to arrest two homicide suspects at 517 East Trilby Road #71 .
Information was aired from various surveillance units that homicide suspect MICHAEL SCHALLERT was standing outside the residence with a female on the west side. A clothing description was aired for SCHALLERT stating he was wearing a red shirt and a brown cowboy hat. Other team members and I rounded the northwest corner of the residence. I observed a male wearing a red shirt and a brown cowboy hat standing next to a sedan parked in the driveway with a female sitting in the passenger seat.
A Flash Sound Diversionary Device was deployed upon our approach, and I began g iving the male commands after it went off. I instructed the male to turn around and interlace his fingers behind his head. The male did so and I grabbed his hands, moving him backwards away from the female and the vehicle. I continued to walk the male away from the residence until we were behind another parked vehicle slightly to the south. At that time, I placed handcuffs on the male's wrists behind his back and checked them for proper tightness. I had the male sit on the ground until he could be contacted by investigators. The male was later positively identified as MICHAEL SCHALLERT.
While I was securing SCHALLERT, other team members were contacting others persons inside Unit #71 . Upon seeing this, SCHALLERT stated that they "have nothing to do with this" and they "don't know anything about it." I did not ask SCHALLERT what he meant by these statements.
I later assisted the team in clearing the residence. This ends my involvement with this case.

On 102109 at 1955 hours, I was notified via SWAT pager to respond to the area of College Avenue and Trilby Road for an assist to the US Marshall's Office. I responded to the stag ing point and was told that two fug itives from Illinois were wanted in connection to a double homicide were believed to be at 517 East Trilby, #71. I was assigned to team leader WOODS' contact team.
While we were waiting for confirmation that the fug itives were in trailer #71 , Investigators informed us several people had exited the trailer and were walking around,
possibly towards my team. Investigator NEWTON and I went to a field and waited to see if anyone came through the field. We moved to the trailer south of #71 and were able to see people walking around the vehicle. It was determined the fugitives were standing outside the trailer and were alone.
Both fug itives were taken into custody without incident. Investigator NEWTON and I then went to a trailer
to the east and contacted a male that had left trailer #71 prior to making the arrest.
Once the scene was secure, it was turned over to investigations for further follow up. Deputy KNUDSEN and I escorted AFTON FERRIS to her patrol vehicle for transport. I saw Deputy KNUDSEN do a pat-down search prior to putting her in the patrol vehicle. This ends my involvement in the case.

Background Information
On Wednesday 102109 I received a page from the Larimer County Communications Center to respond to the area of Trilby and College as the U.S. Marshals Service was in the area attempting to locate and arrest two homicide suspects that they believed to be in Larimer County. While en route to the staging area I was informed that the two suspects, a MICHAEL SCHALLERT and AFTON FERRIS, were believed to be in the area of 517 East Trilby and were wanted for a homicide that occurred in Illinois. The parties were believed to be armed with a pistol as well as a high-powered rifle.
Arrival on Scene
Upon arrival on scene I met with Lieutenant ROBERT COOK who informed me of the circumstances surrounding the two suspects. Lieutenant COOK advised me that he believed that the suspects were at Unit #71 at 517 East Trilby. Lieutenant ROBERT COOK then gave me my assignment.
it was learned that both parties were at the residence and were traveling in and out of the residence. Based upon this information I gathered a team of SWAT members and we approached the residence.

LARIMER COUNTY SHERIFFS OFFICE Narrative to the trailer. Upon walking up to the trailer we did observe two subjects standing outside. Both parties were taken into custody. I then began giving commands to the occupants of trailer #71 at which time five people came out of the residence. I then asked for additional resources to handcuff and take the remaining people into custody. They were all taken into custody and turned over to Deputy MARCINIAK who stated he would record their names as to the parties that we had taken into custody.
Upon securing all of the occupants a protective sweep was done inside #71 . No other occupants were observed. We then left trailer #71 and turned the suspects over to the U.S. Marshals.
Officer's Notes
It should be noted that the other five occupants were un-handcuffed at that time and Deputy MARCINIAK gathered the necessary information for those parties. The only two parties that were not released were SCHALLERT and FERRIS. They were transported to the Larimer County Detention Center.

Initial Information
On 102209, I received a page to assist the Larimer County Sheriff's Office SWAT team and the United States Marshall's Office in the preparation of a search warrant. The information received was that a male and a female, identified as MICHAEL ANTHONY SCHALLERT (DOB: 121679) and AFTON D. FERRIS (DOB: 120989), were suspects in a homicide that had occurred in Franklin County, Illinois on October 18, 2009. These two suspects were believed to be with associates at a trailer located at 517 East Trilby Road, Unit #71 . I responded to the Larimer County Sheriff's Office with Investigator MIKE BYERS to prepare the search warrant.
Warrant Preparation
Using information relayed to me via phone by Sergeant JOHN FEYEN, NCIC/CCIC teletypes with information relating to active warrants for both SCHALLERT and FERRIS, stolen vehicle information on the vehicle both subjects were believed to be occupying, as well as information relayed to me by officers on scene, I prepared the warrant for the search of the residence located at 517 East Trilby Road, unit #71. The prepared warrant was presented to the Honorable Judge EDWARD STIRMAN through the e-warrant system set in place specifically for after hours warrants.

LARIMER COUNTY SHERIFFS OFFICE Narrative After the warrant was signed , I personally delivered a copy of the orig inal warrant to Sergeant FEYEN, who was among several other officers securing the residence in anticipation of the warrant. Deputy JOSH SHELDON prepared the Return of Search Warrant and Inventory and printed it on the back of the search warrant. Deputy SHELDON delivered the required return documents to the Court Clerk's Office.
The following day, Sergeant IAN STEWART prepared an Affidavit for Search Warrant in regards to the vehicle that SCHALLERT and FERRIS had driven to 517 East Trilby, unit #71 . I presented this warrant to the Honorable Judge CHRISTINE CARNEY, who subsequently reviewed and signed the warrant. I delivered this warrant to Sergeant FEYEN, who advised me that he would take care of filing the appropriate return documents with the court.

Case Overview
During the evening of Wednesday, 102109, I was informed that Federal agents were looking for two homicide suspects out of West Frankfort, Illinois. Initial information received was the suspects may be in a cabin in the Red Feather Lakes area, however, upon the arrival of the Federal agents the cabin appeared to have been broken into but no one was currently located within the cabin. A short while later we learned the wanted subjects had been located at 517 East Trilby, #71, Fort Collins, Colorado within unincorporated Larimer County.
It was believed the subjects were located at this residence due to past associations with the residents at 517 East Trilby, #71 . There was also a gray Chevy Impala parked in the driveway at this location. It had been reported that a gray Chevy Impala had been stolen from the victims of the homicide in West Frankfort, Illinois. Attached to the Chevy Impala was a Colorado license plate bearing Colorado registration 938SXH, expiring 12/09. This reg istration returns to a 2004 green Ford pickup truck registered out of Denver, Colorado. However, the cabin that had been broken into the previous night had a green Ford pickup truck parked in front of it, and it no longer had any Colorado registration attached to it. The individuals conducting surveillance on the structure prior to the apprehension of the individuals observed a male and a female matching the general descriptions provided by the US Marshal Service walking in and out of the trailer.

Following the apprehension of the two individuals from the residence at 517 East Trilby, #71 , at which time their identity was confirmed as the suspects out of West Frankfort, Illinois and further identified as a MICHAEL SCHALLERT, DOB: 121679, and AFTON FERRIS, DOB: 120989, I assisted Investigator RYAN ALBERTS with the search warrant for 517 East Trilby. Once this search warrant was completed, Investigator ALBERTS did have the search warrant signed. For further information, please see Investigator ALBERTS' supplemental report.
Evidence Recovered from 517 East Trilby Prior to the execution of the search warrant, I was told by Sergeant JOE SHELLHAMMER of the Larimer County Sheriff's Office that he had witnessed one of the subjects removing a white plastic garbage bag from the interior of the car and throwing it away in the trash receptacle just outside the front of 517 East Trilby, #71 . Once the search warrant was signed, I went to the trash receptacle and removed the white plastic bag.

Interviews by West Frankfort Police Department
On 102209, I made contact with Chief JEFF THARP and Captain MICHAEL DINN of the West Frankfort, Illinois Police Department. They had arrived at Denver International Airport in the early morning hours of 102209. I had spoken with them throughout the evening regarding the apprehension of the two individuals and the items found during the search. Chief THARP and Captain DINN arrived at the Larimer County Sheriff's Office to interview MICHAEL SCHALLERT and AFTON FERRIS.
I first assisted them in preparing the interview room for the interview. Videos were recorded onto DVDs for both video and audio recording and the clock was set up in the room, which would show continuous time of the interview. MICHAEL SCHALLERT and AFTON FERRIS were brought over individually from the Larimer County Detention Center. As they walked between the two buildings, no conversation ensued between officers or either suspect. They were immediately escorted upstairs to the video taped interview room where Chief THARP and Captain DINN began the interviews. Both SCHALLERT and FERRIS confessed to the homicides within a short period of time. I witnessed the interviews via a closed circuit television in an adjoining room. Copies of the DVDs were provided to Chief THARP and Captain DINN upon the completion of the interviews.
Additional Evidence from 517 East Trilby On 102209, I was contacted by the residents at 517 East Trilby, #71 . They informed me they had located items brought into their home by SCHALLERT and FERRIS. They stated they no longer wanted the items in the residence and requested that I pick them up.

LARIMER COUNTY SHERIFFS OFFICE Narrative I was contacted by Investigator BEERS from the Windsor, Colorado Police Department. He informed me they had been contacted by RYAN RAINWATER at 310 12th Street in Windsor, Colorado. RYAN RAINWATER was an associate of MICHAEL SCHALLERT and had allowed SCHALLERT and FERRIS to stay in his home the night before their apprehension. According to Windsor Police, Mr. RAINWATER contacted them and informed them that SCHALLERT and FERRIS left several articles of clothing at his home. He no longer wished to have these articles of clothing in his home as they may be related to the double homicide in Illinois. Windsor Police Department responded out to this location and took a report and recovered the items indicated by Mr. RAINWATER.

Search of Impala
A search warrant had been obtained for the gray Chevy Impala, which was impounded in the evidence bay at the Larimer County Sheriff's Office. This was the vehicle stolen from the homicide victims in West Frankfort, Illinois and driven by the suspects to Colorado. The initial request from the West Frankfort Police Department was that we process the vehicle and then eventually release it to them. However, the final decision was that they would come out and collect the vehicle on a car carrier, transport it back to West Frankfort, Illinois, and process it at that location.
However, upon speaking with Chief THARP regarding this, I told him it had been reported to the Windsor Police Department that Mr. RYAN RAINWATER had a long gun stolen from his home by either SCHALLERT or FERRIS. However, during their interviews, both SCHALLERT and FERRIS denied taking the weapon. They did admit to looking at it and considered taking it, however, finally opted not to. They told us they left the weapon in the corner of the garage in RAINWATER's home. I informed Chief THARP I had concerns about not doing a cursory search of the vehicle when there may be a weapon unsecured within the car. It was impossible to tell due to the amount of personal belong ings within the vehicle whether there was a long gun present in the car or not. Therefore, in the interest of public safety and after we obtained the search warrant, Chief THARP gave us permission to enter the

LARIMER COUNTY SHERIFFS OFFICE Narrative passenger and trunk compartments of the vehicle to search for a long gun. Criminolog ist DAN GILLIAM and I did look at the interior of the vehicle and moved items around, however, we were wearing gloves at the time we did the search for the long gun. No long gun was located.
Release of the Evidence
On Monday, 102609, I met with Captain JOHN PRUDENT and Investigator RON HOWARD of the West Frankfort, Illinois Police Department. They arrived the prior evening in a van towing a car carrier. Upon their arrival, I introduced myself and assisted them with the release of the evidence from Larimer County Sheriff's Office to the West Frankfort, Illinois Police Department. All items within our purview were then released to them at that time, delivered into the van or onto the car carrier, and transported back to West Frankfort, Illinois.
