Notice of Hearing on ProposedAdministrative Regulations

A public hearing will be conducted at 10 a.m. Friday,November 9, in the SRS board room, sixth floor, DockingState Office Building, 915 S.W. Harrison, Topeka, to con-sider the adoption of amendments to an existing rule andregulation on a permanent basis effective January 1, 2008.Telephone conference is not available.

This 60-day notice of the public hearing shall constitutea public comment period for the proposed regulationchanges. All interested parties may submit written com-ments prior to the hearing to Susan McDonald, Office ofthe Chief Legal Counsel for SRS, Room 650-S, DockingState Office Building, 915 S.W. Harrison, Topeka, 66612.All interested parties will be given a reasonable oppor-tunity to present their views, but it may be necessary torequest each participant to limit any oral presentation tofive minutes. Copies of the regulation and the economicimpact statement may be obtained by contacting SusanMcDonald at (785) 296-1807.

Any individual with a disability may request accom-modation in order to participate in the public hearing andmay request the proposed regulation and economic im-pact statement in an accessible format. A summary of the proposed regulation and the eco-nomic impact follows:

Article 4.— FUNERAL ASSISTANCE PROGRAM30-4-98. Funeral assistance (FA) program. This regu-

lation is being amended to reflect changes in the stan-dards required to determine FA eligibility and the cor-responding benefit level. These changes will increase thestandard benefit level and raise the threshold for allow-able funeral-related expenses.

Federal Mandate: N/A.Economic Impact: The funeral assistance program has

budgeted expenditures of $816,000 for SFY’08. The case-load is projected to increase by 246 persons to a total of1,200.

Bearer of Cost: N/A.Affected Parties: This change will result in an increase

in the benefit level paid to eligible consumers thereby al-lowing for a reimbursement of $680 for any qualifyingbeneficiary as long as the base cost of the funeral doesnot exceed $2,500.

Notice of Available Grant Funding

Application materials for the State Wildlife Conserva-tion Grants (SWG) are now available from the KansasDepartment of Wildlife and Parks (KDWP). The SWG isa federal grant program, which is funded in part byCFDA 15.634 Fish and Wildlife Service, Department ofthe Interior, and administered in Kansas by the KansasDepartment of Wildlife and Parks. The priority of thisprogram is to fund projects that benefit nongame fish andwildlife. Federal regulations require that projects benefit‘‘species of greatest conservation need.’’ This may includelisted federal and state endangered and threatened spe-cies. The KDWP will distribute a portion of these fundsto other organizations through competitive subgrants. El-igible applicants are local governments, nonprofit cor-porations and educational institutions. All proposalsmust address the issues and strategies identified in theKansas Comprehensive Wildlife Plan to be eligible forfunding. The plan can be found at the following location:http://www.kdwp.state.ks.us/news/content/download/7904/40012/file/Kansas%20CWCPfinal10.pdf.

State Wildlife Grants may be used to finance eitherplanning or implementation grants. Planning grants re-quire that 25 percent of the project costs be matched withnonfederal funds, while implementation grants musthave a match of 50 percent. In-kind and cash match maybe used for this program. A total of $500,000 is availablefor grants.

The deadline for preliminary applications is October28. Final applications will be due November 30. Negotiations for Architectural Services

Notice is hereby given of the commencement of nego-tiations for architectural services for improvements toMcCray Hall on the Pittsburg State University campus inPittsburg. The facility was built in 1929 and is one of thelandmark buildings on campus. McCray Hall is a 4-story,31,996-square-foot facility located on the west end of themain campus ‘‘Oval’’ directly to the south of Russ Hall.Improvements will include but not be limited to: newwindows, new HVAC system for the building excludingthe Recital Hall (Recital Hall HVAC to be evaluated forcondition and controls), new tile roof and flashings, res-toration of the existing brick/limestone exterior, integra-tion of building controls with the central energy manage-ment system, correction of foundation settlement andpositive drainage, new electrical service and other utilityservice upgrades. No architectural contracts will be exe-cuted until funding is secured from the Board of Regentsin September. The project budget is $2,000,000. A pro-gram is available.

Notice is hereby given of the commencement of nego-tiations for ‘‘on-call’’ engineering services for hydrologicand hydraulic analysis and floodplain mapping for var-ious counties in Kansas. The Kansas Department of Ag-riculture, Division of Water Resources, wishes to contractfor the performance of field survey reconnaissance, hy-drologic and hydraulic analysis of streams that draingreater than 1 square mile using either approximate ordetailed methods, redelineation of effective detailed in-formation using updated topography, and digitization ofexisting floodplain data for stream stretches. This workwill be used to generate flood insurance study (FIS) dataand digital flood insurance rate maps (DFIRMs) for thearea. It is anticipated that approximately five counties inthe first year will be mapped through this on-call agree-ment.

Notice of Hearing on ProposedAdministrative Regulations

A public hearing will be conducted by the administra-tor of the Kansas Department of Credit Unions at 10 a.m.Tuesday, November 27, in the Kansas Department ofCredit Unions’ conference room, Suite B, American HomeLife Insurance Company Building, 400 S. Kansas Ave.,Topeka, to consider the approval and adoption of pro-posed administrative regulations by the Kansas Depart-ment of Credit Unions.

The proposed regulations that will be heard during thepublic hearing are as follows:

K.A.R. 121-2-1 is a revision of an earlier regulation thatdescribes the requirements for a credit union written con-tingency and business recovery plan.

K.A.R 121-3-1 is a revision of the credit union servicesorganization regulation. The revised regulation allowsfor additional organizational structures for credit unionservice organizations as per K.S.A. 2006 Supp. 17-2204a,as amended by L. 2007, ch. 71, sec.1.

K.A.R. 121-5-4 defines the meaning of terms relating toinsolvent and the requirements that exist for a credit un-ion to be declared insolvent.

K.A.R. 121-9-1 prescribes the requirements that mustexist for the administrator to approve a foreign credit un-ion to do business in Kansas.

K.A.R. 121-10-1 and 121-10-2 define terms and pre-scribe the audit reporting requirements for credit unionsby various asset sizes.

There will be minimal economic impact on govern-mental agencies, credit unions and the general public asa result of the proposed regulations.

This 60-day notice prior to the hearing shall constitutea public comment period for the purpose of receivingwritten public comments on the proposed administrativeregulations. A public hearing will be conducted at 1:30 p.m. Thurs-day, November 8, in the main conference room, KansasDepartment of Commerce, Suite 100, Curtis State OfficeBuilding, 1000 S.W. Jackson, Topeka, to consider theadoption of regulations administering portions of theKansas Energy Incentive Act, K.SA. 79-32,216 et seq.,which provides certain tax incentives to taxpayers whohave submitted an application to the Secretary of Com-merce, subject to approval by the Secretary of Commerce.

This 60-day notice of the public hearing shall constitutea public comment period for receiving written publiccomments on the proposed regulations. All interestedparties may submit written comments before the hearingto David D. Kerr, Secretary of Commerce, 1000 S.W. Jack-son, Suite 100, Topeka, 66612-1354. All interested partieswill be given a reasonable opportunity to present theirviews orally on these regulations during the hearing. K.A.R. 110-15-1. Definitions. This regulation defineskey terms in the regulations.

K.A.R. 110-15-2. Application; additional documenta-tion. This regulation notifies applicants of the documen-tation that must be provided to the Secretary of Com-merce in applying for approval for Kansas EnergyIncentive Act tax incentives.

K.A.R. 110-15-3. Secretary’s review and determina-tion. This regulation provides that after the secretary’sreview of an application for tax incentives, the secretaryshall make a determination whether to approve the ap-plication within 60 days of the submission of the infor-mation required by K.A.R. 110-15-2 by the applicant tothe secretary; the determination shall be mailed to eachtaxpayer identified on the application as having an own-ership interest in the project.

1-64-1. Delinquent status; penalties. (a)(1) A wire-less carrier or a VoIP provider shall be deemed to be indelinquent status by the secretary or the secretary’s dulyauthorized agent if the carrier’s or provider’s wireless en-hanced 911 local fees and return, pursuant to K.S.A. 12-5331 or K.S.A. 12-5357 and amendments thereto, are notreceived by the local collection point administrator within14 days after the due date.

(2) Any wireless carrier or VoIP provider may bedeemed to be in delinquent status by the secretary or thesecretary’s duly authorized agent if the carrier’s or pro-vider’s wireless enhanced 911 local fees and return, pur-suant to K.S.A. 12-5331 or K.S.A. 12-5357 and amend-ments thereto, are substantially inconsistent with eachother.

(b)(1) The local collection point administrator shall no-tify the secretary or the secretary’s duly authorized agentof any wireless carrier or VoIP provider that has not sub-mitted the carrier’s or provider’s wireless enhanced 911local fees or a return within 14 days of the due date orthat has submitted fees and a return that are substantiallyinconsistent with each other.

(2) If the secretary or the secretary’s duly authorizedagent determines that the carrier or provider is in delin-quent status, a penalty shall be assessed by written orderof the secretary or the secretary’s duly authorized agentagainst the wireless carrier or the VoIP provider. Thispenalty shall be either $50.00 or 10% of the wireless orVoIP enhanced 911 local fees due from that delinquentwireless carrier or VoIP provider to the local collectionpoint administrator for the corresponding month, which-ever is greater.

(3) Written notification of the penalty assessment, theviolation, and the wireless carrier’s or VoIP provider’sright to appeal to the secretary or the secretary’s dulyauthorized agent shall be issued to the wireless carrier orVoIP provider by the secretary or the secretary’s duly au-thorized agent. Each penalty payment shall be remitteddirectly to the secretary or the secretary’s duly authorizedagent.

(4) If a wireless carrier or VoIP provider remains indelinquent status for 30 days or more after the date onwhich the wireless or VoIP enhanced 911 local fees andreturn were due, interest shall begin accruing on the feesat an annual rate of 10%.

(c) As provided by K.S.A. 12-5325 and K.S.A. 12-5354and amendments thereto, any wireless carrier or VoIPprovider that is assessed a penalty may request a hearing.The request for hearing shall specify the reason or reasonsthe wireless carrier or VoIP provider denies being in vi-olation of the fee and return requirements pursuant toK.S.A. 12-5331 or K.S.A. 12-5357, and amendmentsthereto. Rules ap-plicable to this drawing are contained in K.A.R. 111-4-2586 through 111-4-2591, and K.A.R. 111-3-1, et seq. 111-4-2587. Definitions. (a) All definitions con-tained in the Kansas lottery act (K.S.A. 74-8701 et seq.) andlottery regulations are hereby incorporated by referenceand govern unless otherwise indicated.

(b) ‘‘Texas Hold ‘Em Second Chance Drawing (2008)’’means the act of drawing prizes conducted by the Kansaslottery at lottery headquarters in Topeka, Kansas, on thedate set forth in K.A.R. 111-4-2586, in which participantsare selected to win prizes as described in K.A.R. 111-4-2588.

(c) ‘‘Non-winning ticket’’ means any valid Kansas lot-tery ‘‘Texas Hold ‘Em’’ (game number 673) instant gamelottery ticket not eligible to win a prize under the rulesof that instant game.

(d) ‘‘Receptacle’’ or ‘‘drum’’ means a container inwhich non-winning Kansas instant game lottery ticketsare placed and from which the drawing entries aredrawn. Receptacles or drums may be sealable and shallbe capable of being mixed or rotated for the purpose ofensuring random distribution.

(e) ‘‘Bare arm technique’’ means a type of drawingwhere the person drawing the winning ticket from thereceptacle or drum wears a long-sleeved shirt with sleeverolled up above the elbow, a short-sleeved shirt (sleevenot extending past the elbow) or a no-sleeve shirt whichexposes the drawer’s bare arm and looks away from thedrawing drum or receptacle while drawing. (a) A total of two prize pack-ages shall be awarded at the ‘‘Texas Hold ‘Em SecondChance Drawing (2008).’’ The winner of a prize at thedrawing shall receive a prize package consisting of thefollowing: round-trip coach airfare for two as approvedby the lottery in its sole discretion; double occupancy ho-tel room for seven days and six nights at a hotel chosenby the lottery; round trip ground transfers; $1,000 cash;one entry into a ‘‘World Poker Tour’’ poker tournamentchosen by the winner from various tournaments selectedby the lottery and having a buy-in of $10,000 or less; twotickets to the final event of said tournament (or only oneticket if the winner advances to the final event as a par-ticipant); two poker merchandise packages selected bythe lottery; and mandatory state and federal withholdingtaxes.

(b) The following restrictions shall apply to each prizeawarded in this drawing:

(1) The Kansas lottery is not responsible for any lossescaused by delay or cancellation of any flights or tourna-ment events.

(2) The trip package is transferable one time but cannotbe redeemed for cash.

(3) The lottery shall choose and reserve all hotel rooms.(4) The lottery shall choose and provide transportation

(6) Any meals, drinks, gratuities, taxes, and other ex-penses that are not specifically mentioned are notincluded.

(7) All participants in ‘‘World Poker Tour’’ tourna-ments must be at least 21 years of age. If allowed by therules and regulations of a tournament, the winner maydesignate another person to play in the tournament.

(8) All trips and tournaments are subject to availability.(9) Winners and their guests under the age of 21 must

be accompanied by another person who is at least 21years of age in order to check into the hotel, unless oth-erwise provided by said hotel.

(10) Unless otherwise provided by the selected hotel,the winner shall be required to present a valid credit cardor post a cash deposit at the time of check-in;

(11) Unless otherwise provided by the rules and regu-lations of a casino, persons under the age of 21 are notallowed in casino gaming areas; and

(1) Obtain a valid ‘‘Texas Hold ‘Em’’ game number 673Kansas lottery instant lottery ticket.

(2) Determine if the ticket is a winning ticket in accord-ance with the rules of that instant game. If the ticket is awinning ticket, it is not eligible for the drawing and shallbe redeemed in accordance with the instant game rules.

(3) If the ticket is a valid non-winning ticket, the ticketis eligible for the drawing and the holder of the ticket mayuse it to enter the drawing.

(4) The holder of the non-winning ticket must completethe information form on the back of the ticket in a legiblemanner. Only one name shall appear on a non-winningticket entered.

(5) Players may deposit entries for this drawing intoany receptacle the Kansas lottery has specifically desig-nated for said purpose.

(6) Entries may also be mailed with proper postage to‘‘Texas Hold ‘Em Drawing, c/o Kansas Lottery, P. O. Box750980, Topeka, Kansas 66675-0980.’’ Mailed entries mustbe received by morning mail pickup on Tuesday, January

111-4-2590. Selection of winners. The followingprocess shall be used for the selection of winners in the‘‘Texas Hold ‘Em Second Chance Drawing (2008):’’

(a) Kansas lottery personnel shall pick up all mail con-taining ‘‘Texas Hold ‘Em Second Chance Drawing(2008)’’ tickets at the United States Post Office in Topeka,Kansas, with the final pickup at the Topeka post office inthe morning mail pickup on Tuesday, January 15, 2008.Following the morning mail pickup on said date, the en-velopes containing mailed entries will be transported tolottery headquarters and opened by lottery personnel. Allmailed entries and entries retained from any other loca-tions as specifically designated by the lottery shall also beplaced in the drawing receptacle or drum.

(b) The drawing shall be open to the public with lotterysecurity personnel present. The drawing shall be audioand video taped.

(c) At the drawing, lottery security personnel will bepresent with the person designated by the executive di-rector to perform the drawing. Prior to the drawing, if adrum is used, the drum shall be sealed and the contentsmixed by rotating the drum at least 10 times. If a recep-tacle other than a drum is used, the contents shall be thor-oughly mixed with a shovel or by other means prior tothe drawing.

(d) The designated individual shall then unseal thedrum, if a drum is used, and using the bare-arm tech-nique, while looking away, remove two entries, one at atime, from the receptacle or drum and mark them in orderdrawn: 1 and 2. The person whose name appears on eachentry shall be the winner of a prize package identified inthese rules, subject to validation by the lottery as set forthin these rules.

(e) After the two prize entries have been drawn, andthe entries have been verified as valid, two more entrieswill be drawn, one at a time. The last two entries drawnwill serve as alternate entries for the prize packages. The

alternate entries will be marked in order drawn: 1A and2A. The alternate entries will be used only if one or moreof the original prize winners cannot be located or is de-clared ineligible, or fails to present a fully-executed claimform to lottery headquarters by 5:00 p.m. of the thirtiethcalendar day following the drawing. The alternates willbe used, if necessary, in the order drawn. If an alternatewinner cannot be located, is declared ineligible, or failsto present a fully-executed claim form to lottery head-quarters by 5:00 p.m. of the thirtieth calendar day follow-ing the claim form being given or sent to the alternatewinner, the alternate winner process shall be repeated un-til the prize is properly claimed or until such time as noalternate winners remain, whichever occurs first.

(f) The Kansas lottery security official present shall re-view each ticket drawn to determine the validity of theentry into this drawing in accordance with these regula-tions. If it is a valid entry and the name is legible, theevent manager and the security person present shall re-cord the name of the winner and the prize won. Eachwinner shall be given or sent a prize claim form to becompleted and returned to the lottery within 30 calendardays of the drawing.

(g) If the entry is determined to be ineligible, it shall bediscarded by the security person present and another en-try drawn. This procedure will be repeated until validselections are obtained.

(h) Only non-winning ‘‘Texas Hold ‘Em’’ (game num-ber 673) instant tickets as defined by these rules are eli-gible for the drawing.

(i) All tickets remaining in the drum or receptacle afterthe winners and alternates have been selected in thedrawing, and all entries not received in compliance withthese rules, shall be destroyed pursuant to K.A.R. 111-3-34. 111-4-2591. Certification of drawing. (a) The‘‘Texas Hold ‘Em Second Chance Drawing (2008)’’ shallbe personally observed by a member of the Kansas lotterysecurity department and a member of the Kansas lotterymarketing department or other person or persons desig-nated by the executive director of the lottery (hereinafter‘‘event manager’’).

(b) Upon completion of the drawing, the security offi-cial and the event manager shall issue a report to the ex-ecutive director, certifying that the name of each prizewinner is correct, and that to the best of their knowledge

For wagers in the amount of $4, each of theprizes available shall be multiplied by a factor of two; forwagers in the amount of $6, each of the prizes availableshall be multiplied by a factor of three; for wagers in theamount of $8, each of the prizes available shall be mul-tiplied by a factor of four; and for wagers in the amountof $10, each of the prizes available shall be multiplied bya factor of five. In the event of a tie as described in K.A.R.111-7-197(e), the player shall be entitled to one free Kan-sas Hold ‘Em ticket in a wager amount equal to the wageramount of said winning ticket. The odds of winning re-main the same for all wager increments.
