ORDER DISMISSING COMPLAINT AS SATISFIED

THIS MATTER comes before the New Mexico Public Regulation Commission (the

“Commission”) upon the Joint Answer and Notice of Satisfaction of Complaint (the “Answer”),

filed by Public Service Company of New Mexico (“PNM”), Southwestern Public Service

Company (“SPS”), and El Paso Electric Company (“EPE”).

Whereupon, being duly informed,

THE COMMISSION FINDS AND CONCLUDES:

1. On July 26, 2021, Renewable Energy Industries Association of New Mexico

(REIA) filed its formal complaint (the “Complaint”) against PNM, SPS, and EPE (jointly, the

“Defendants”), commencing this matter.

2. In the Complaint, REIA states that it is “the trade association for 24 New Mexico

companies who are developers of solar distributed generation systems.” Multiple REIA members

plan to develop projects which will be community solar facilities.

3. In the Complaint, REIA alleges that the Defendants violated the Commission’s

Order Issuing Notice to Electric Utilities and Applicants Regarding Pending Applications for

Community Solar Interconnections During Rulemaking Proceeding, issued on June 15, 2021, in

Docket No. 21-00112-UT (the “June 15 Order”). The matter in which the June 15 Order was

issued is the Commission’s rulemaking docket for formulating rules to implement the Community

Solar Act, passed in the 2021 session of the Legislature, which is codified at NMSA 1978 § 62-

16B-1 et seq.

4. As described in the Complaint, the June 15 Order “directed the [Defendants] to

inform potential applicants for interconnection of a community solar facility that the

Commission’s existing interconnection rules shall remain in place and apply until amended, and

that an applicant’s place in a utilities’ interconnection queue will not affect selection of an

applicant’s community solar project.”

5. REIA alleges that the Defendants’ notices to applicants and potential applicants

violated the June 15 Order by each including a statement that the utility will not accept

interconnection applications from generators intending to be community solar projects at the

present time. REIA alleges that such statements have no basis in the June 15 Order and are

contrary to the order.

6. REIA further alleges that the statements violate regulations of the Federal Energy

Regulatory Commission (“FERC”) implementing the Public Utilities Regulatory Policies Act of

1978 (“PURPA”) requiring that utilities make interconnection with any “qualifying facility.” 18

C.F.R. § 292.303(c)(1). REIA alleges that “[p]rojects which may seek to become community solar

facilities under the New Mexico Community Solar Act are eligible to certify as PURPA qualifying

facilities.”

7. REIA further alleges that the Defendants’ statements are in violation of the

Commission’s rules for interconnection of generating facilities not to exceed 10 MW AC to the

public utility system at 17.9.568 NMAC (“Rule 568”). REIA alleges that Rule 568 is intended,

in part, to implement federal PURPA interconnection requirements. REIA states that Rule 568

provides that a customer desiring an interconnection must submit an application to the relevant

public utility and that “[f]ollowing submission of the interconnection application, the parties will

follow the procedures and time requirements described in the [interconnection] manual,” citing

17.9.568.9(A) NMAC.

8. REIA alleges that a utility is required to screen interconnection applications it

receives according to the criteria in Rule 568 and the Interconnection Manual that is incorporated

by reference into the rule, citing 17.9.568.9(A)(10) & (11) NMAC. REIA alleges that

interconnection of generators that comply with all requirements of the rule is mandatory, citing

17.9.568.13(A) NMAC (“A utility shall interconnect any interconnection customer that meets the

interconnection criteria set forth in this rule and in the manual”).

9. REIA argues that “the June 15 Order did not authorize the [Defendants] to decline

to accept interconnection applications from generators who may be intending to be community

solar facilities.” Instead, REIA argues, the June 15 Order “expressly advised the [Defendants] that

the current interconnection rules and the interconnection manual – which mandate timely

processing of interconnection requests – ‘remain in place’.”

10. REIA goes on to describe the Staff Report filed by Staff of the Utility Division of

the Commission (“Staff”) on July 14, 2021, in Docket No. 21-00112-UT. As described by REIA,

the Staff Report includes as an exhibit a collective form of notice reflecting the language in the

Defendants’ notices. REIA quotes the following statements from the collective form of notice,

underlining the statements to which REIA objects:

No NMPRC community solar rules are currently in place, and there are no rules

that authorize the processing of any community solar interconnection applications.

For this reason, utilities are not required to accept or record community solar

applications. However, EPE/PNM/SPS will process qualifying facility applications

that are not, or will not be associated with community solar programs according to

NMPRC Rule 17.9.568 NMAC.

Complaint, ¶ 20 (quoting Docket No. 21-00112-UT, Staff Report, July 14, 2021, Exhibit A at 2

(underlining added)).

11. REIA asks that the Commission order the Defendants to withdraw their

noncompliant forms of notice and to reissue notices that strike the language underlined above and

replace it with language assuring that all interconnection applications, regardless of planned

business model, will be accepted and processed in accordance with Rule 568. REIA also asks that

the Commission order Staff to withdraw the Staff Report.

12. On July 27, 2021, the Commission served the Complaint upon the Defendants along

with a Notice of Formal Complaint and Order Requiring Answer.

13. On August 16, 2021, the Defendants filed the Answer. In the Answer, the

Defendants provide notice to the Commission that the Complaint has been fully satisfied by

agreement between REIA and the Defendants. The Defendants ask the Commission to dismiss

the Complaint pursuant to 1.2.2.15(D) NMAC of the Commission’s Rules of Procedure, which

provides that, upon acceptance of a defendant’s offer of satisfaction by a complainant and notice

to the Commission, a complaint may be dismissed.

14. The Defendants state that they have reached an agreement with REIA that the

Complaint will be satisfied if the Defendants replace the Public Notice on their OATI/OASIS

websites with a form of notice that is identical to the current version with the exception that the

last paragraph from the Public Notice be stricken and replaced with the following:

No NMPRC community solar rules are currently in place. For this reason, utilities

will not accept or record applications to become a community solar facility whose

output the utility is legally obligated to acquire. It is also not known whether there

will be NMPRC interconnection rules specific to community solar facilities.

However, EPE/PNM/SPS will process valid interconnection customer applications

as they would irrespective of any community solar program. Acceptance,

processing, or approval of an interconnection customer application by

EPE/PNM/SPS is in no way indicative of subsequent interconnection customer

eligibility for any future community solar program under the rules that are yet to be

promulgated by the NMPRC. Customers applying for interconnection application

prior to the promulgation of such rules bear the risk that the NMPRC’s rules could

render the facility ineligible for the community solar program; or require filing of

a new interconnection application under the community solar rules to participate in

the program.

In addition to publishing the revised notice on their websites, the Defendants state that they will

send the revised notice to any interconnection customers to whom they previously sent the Public

Notice.

15. The Defendants state that counsel for REIA authorized the Defendants to state that

“Counsel for REIA agrees that the Complaint is satisfied with the utilities adopting the negotiated

language.”

16. The Commission has jurisdiction over this matter.

17. The Commission finds that the Complaint has been satisfied as per 1.2.2.15(D)

NMAC. Pursuant to that rule, the Commission, upon finding that the Complaint has been satisfied

as far as the complainant is concerned, now considers whether this proceeding should continue to

address any issues raised in the Complaint that involve a general matter of public interest. The

Commission finds that the issues raised in the Complaint do raise general matters of public interest,

but no further proceedings are needed to address the matters of public interest. The agreement

reached by the parties addresses the public interest by correcting the notices issued by the

Defendants. The Defendants’ notices indeed violate the June 15 Order in the manner described in

the Complaint.1 The revised language of the agreed-upon notices is consistent with the

requirements of the June 15 Order while also providing more detailed guidance to applicants and

potential applicants.

IT IS THEREFORE ORDERED:

A. The Complaint is DISMISSED as satisfied.

B. The Commission incorporates into this Order the agreements made by the

Defendants with regard to correcting their notices as these corrections serve not only the

satisfaction of the Complaint but also serve the public interest.

C. The Commission takes administrative notice of the record in Docket No. 21-00112-

UT to the extent that it is cited in the Complaint.

D. This Order is effective immediately.

E. A copy of this Order shall be served upon all persons listed on the attached

certificate of service via email, to the extent that email addresses are known, and if not known,

then by regular mail.

1 The Commission does not address REIA’s claims that the Defendants violated Commission rules and FERC regulations as the satisfaction of the Complaint has rendered any decision on those claims unnecessary to the outcome of this matter. The Commission does address the Defendants’ violation of the June 15 Order to clarify the scope of the June 15 Order.
