A heaiing will be held in this case before the Flo1ida Elections Commission on May 6,2014, at 8:30 am, or as soon thereafter as the parties can be heard, at the following location: Senate Office Building, Room S-110, 404 South Monroe Street, I allahassee, FL 32399.

This heaiing will be conducted pursuant to Section 106.25, Flotida Statutes, which governs your paiticipation as follows:

If you are the Respondent, you may attend the heating, and you or your attorney will have 5 minutes to present your case to the Commission. However, some cases (including those in which consent orders or recommendations fo1 no probable cause are being considered) may be decided by an en masse vote and, unless you request to be heard 01 the Commission requests that your case be considered separately on the day of the heating, your case will not be individually heatd

If you are the Complainant, you may attend the hearing, but you will not be permitted to address the Commission. When she requested an address update this time she was told had to do the update in the system The address was updated in the system on October 22, 2013 The amendment to the report was submitted under Political Committee on October 25, 2013"

I am writing to appeal the fine announced in the letter from the Division of Elections dated October 28, 2013, for the amount of $6, 150 00 ..

The address placed on the Political Committee DS-DE 5 was incorrectly showing the address of 11001 Danka Way North, Suite 2, St Petersburg, FL 33612 .. In August 2013, when our Treasurer Candace Magiera had not received her paperwork with PIN password and active account information, she contacted the Division of elections office and verbally communicated the correct mailing address to the clerk on the phone ..

The report was submitted in a timely manner October 10, 2013, but it was submitted under Florida Renal Coalition CCE. An amendment was required to update the report under Political Committee. Since Ms Magi era had not received her password, she called the office of Elections to have her password reset on October 22, 2013. When she went in the system, she noticed that the address had not been updated as she thought happened in August When she requested an address update this time she was told had to do the update in the system The addr·ess was updated in the system on October 22, 2013.

The amendment to the report was submitted under Political Committee on October 25, 2013.

Called T after talking to KRB about how to handle/report the 106,011(10),F .S , lobbyist expenditures listed in the 3/05/14 audit letter In a prior conversation on 3/14/14, Thad stated that the lobbyist was an expense of the association affiliated with the PC, not the PC She stated that there may be an argument that the expenditures were in fact made to influence the results of an election but that they do not want to make that argument at this time For now the PC just wants to fix the immediate problem

I told T that the lobbyist expenditures made by the PC can be repaid to the PC by the association. They would be reported as negative Exps the name listed would be the assocaition the purpose would be ''Reimbursment for Lobby Expenditures reported ___ " A letter of explanation should be sent in copying the audit letter and expalining how the expenditures originally occurred how they handled the situation and what report shows where it was corrected

T called re 3/05/14 audit letter We discussed S 106.011 (10), F S , and the need for the PC to respond in writing related to the expenditures to the lobbyist and their explanation as to how those were made to influence the results of an election She said she would be talking to the committee's attorney. We also generally discussed the reimbursement'linked OD and how to complete that. She was not on a computer I told her to refer to the help manual related to reimbursements and to call us if she had further questions once she was at a computer and working on the amendment(s)

Each political committee chairperson is required to provide the Division of Elections with confidential personal information that may be used to allow access in the event that the password is forgotten 01 lost When you enter the campaign account screen, there will be a drop down box where you pick a question (such as What is yow mother's maiden name.?) and supply an answer .. All passwords and answers to questions are stored as encrypted data and cannot be viewed by Division staff and given out over the phone .. Please notify the Division if yom credentials have been compromised ..

Timely Filing

All reports must be completed and filed through the EFS no later than midnight, Eastern Standard Time, of the due date Reports not filed by midnight of the due date are late filed and subject to the penalties in Section 106 .. 07(8), Florida Statutes In the event that the EFS is inoperable on the due date, the report will be accepted as timely filed if filed no later than midnight, Eastern Standard Time, of the first business day the EFS becomes operable No fine will be levied during the period the EFS was inoperable.

Any political committee failing to file a teport on the designated due date is su~ject to a fine of $50 per day for the first 3 days and, thereafter, $500 per day for each day, not to exceed 25% of the total receipts or expenditures, whichever is greater, for the period covered by the late 1eport However, for the rep01ts immediately preceding each primary and general election, the fine shall be $500 per day, not to exceed 25% of the total receipts or expenditures, whichever is greater, for the period covered by the late 1eport

Electronic Receipts

The pe1son submitting the report on the EFS will be issued an electronic receipt indicating and verifying the report was filed.. Section I 06 07(8)(b), F Jorida Statutes, requires that the filing officer immediately notify you of the failure to file a report

The first notice of the failure to file the above mentioned report was mailed, via regular mail, to the address on file with our office on October 14, 2013 As of this date, we do not show a record of receiving this report

If the report is not filed via the Division's electronic filing system within 14 days of receipt of this notice, this matter will be referred to the Florida Elections Commission for fllrther action Section 106 265( I), Florida Statutes, authorizes the Florida Elections Commission, upon finding a willful violation of Chapter 106, Florida Statutes, to impose a civil penalty up to $1,000 per count
