PART ONEGENERAL
1. Short Title
This Proclamation may be cited as the"Broadcasting Service Proclamation' No.533/2007" .
2. Definitions
In this Proclamation, unless the contextrequires otherwise:
1/ "radio wave" means a radio wave assigned tobroadcasting service in accordance with theradio regulations of the InternationalTelecommunication Union;
2/ "broadcasting servic'e" means a radio ortelevision transmisS'ion programconducted to educate, inform or entertainthe public;
3/ "licensee" means a person licensed inaccordance with this Proclamation, andincludes a person lawfully engaged inrendering broadcasting service before theenactment of this Proclamation;
4/ "program" means voice or visual oraudiovisual arrangement transmitted toinform, educate or entertain the public, oran all inclusive transmission program;
5/ "Advertisement" means a messagetransmitted to publicize and promotesales of goods and services;
6/ "election campaign advertisement"means a radio or television messageconveyed by a political organization orcandidate to publicize about himself andhis aspirations by paying or promising topay for.the announcement;
7/ "sponsored program" means a programthe transmission cost of which is paiddirectly or indirectly or the payment ofwhich is promised;
8/ "election period" means the periodbeginning from the official opening day ofa campaign until 48 hours before thestarting of voting day;

9/ "publicbroadcasting service" means a radio ortelevision transmission service established,for the purpose of educating, informing andentertaining the public, in. the federal or aregional state to which government budget isallocated in full or in part and is accountableto the Federal House of Peoples Represent-atives or to Regional Councils;
10/ "commercial broadcasting service"means a radio or television transmissionservice established for profit by a legalentity with the purpose of informing,educating or entertaining the public;
11/ "community broadcasting service" meansa non-profit radio or television transm-ission service established by the willandinterest of a community and Administeredand run by the community living in aspecific area or who possess a commoninterest;
12/ "political organization" means a groupingleg"allypromoting its political program;
13/ "applicant" means a person who fills andsubmits an application form to the Authority asindicated under Article 19(3) of thisProclamation;
14/ "regional state" means any of the regionalstates specified under Article 47(1) of theConstitution of the Federal DemocraticRepublic of Ethiopia and includes the AddisAbaba and Dire Dawa city administrations;
15/ "national transmission" means a broadca-sting 'service whose transm ission coversmore than one regional state;
16/ "regional transmission" means a broadca-sting service whose transmission islimited to one regional state only;
17/ "local transmission" means a broadcastingservice whose transmission is limited to onewereda or one municipalityonly;
18/ "national program" means a programprepared in Ethiopia by Ethiopians;
19/ "Ministry" and "Minister" means theMinistry and Minister of Information,respectively;

20/ "inspector" means a person assigned by theAuthority to supervise the proper observance,by licensees, of the ,provisions of thisProclamation and regulations and directivesissued hereunder;
21/ "person" means a physical or juridicalperson,
3. Scope of Application
This Proclamation shall be applicable togovernment, commercial and communitybroadcasting services established within Ethiopia.
PART TWOBroadcasting Authority
4. Establishment
1/ The Ethiopian Broadcasting.. Authority(hereinafter "the Authority") is hereby
. established as an autonomous federalagency having its own legal personality.
2/ The 'Authority shall be accountable to theMinistry.
5. Head Office
The Authority shall have its head office inAddis Ababa and may establish brartchoffices elsewhere as may be necessary.
6. Objectives
The objectives of the Authority shall be to ensurethe expansion of a high standard, prompt andreliable broadcasting service that can contribute topolitical, social and economic development and toregulate same.

7. Powers and Duties
The Authority shall have the powers andduties to:
1/ ensure that the broadcasting service isconducted in such a manner that contributesto the proper social, economic, political andcultural development of the country;

11, Meetings of the Board
1/ The Board shall meet once every month;provided, however, that it may conveneat any time when 'called by thechairperson.
2/ There shall be a quorum where morethan half of the members are present at ameeting of the Board.
3/ Decisions of the Board shall be passedby majority votes; in case of a tie, the
. chairperson shall have a casting vote.
4/ Without prejudice to the provisions of thisArticle, the board may adopt its own rulesof procedure.
12. Director General of the Authority
1/ The Director General of the Authority. shall be appointed by the Governmentupon recommendation by the Minister.
2/ The. Director General shall be the chiefexecutive of the Authority and, subject tothe general directives of the Board, shalldirect and administer the activities of theAuthority.
3/ Without limiting the generality of theprovisions of sub-article (2) of this Article,the Director General shall:
a) exercise the powers and duties of theAuthority stated under Article lof thisProclamation;
b) employ and administer employees ofthe Authority in accordance withdirectives to be approved by theGovernment following. the basicprinciples of the federal civil servicelaws;
c) prepare and submit to the Board thework program and budget of theAuthority, and implement same whenapproved by the appropriate organ;
d) effect expenditure in accordance withthe work program and budget of theAuthority;

e) represent the Authority in all itsdealings with third parties;
f) prepare and submit to the Board theactivity and financial reports of theAuthority;
g) perform such other duties as may beassigned to him by the Board.
4/ The Director General may delegate part of hispowers and duties to other officials andemployees of the Authority to the extentnecessary for the efficient performance of theactivities. of the Authority.

13. Deputy Director General of the Authority
1/ The Deputy Director General shall beappointed by the Government uponrecommendation by the Minister.
2/ The Deputy Director General shall,subject. to the directives of the Director

14. Budget

2/ Any public broadcasting service shall:
a) enhance the participation of the publicthrough the presentat~on of governmentpolicies and strategies as well asactivities related to development,democracy and good governance;
b) present programs which inform,educate and entertain the public;
c) present programs which reflect unityof peoples based on equality;
d) promote and enhance the culturesand artistic values of the public;
e) serve political parties operating inaccordance with the Constitution andthe electoral laws of the country onthe basis of fair and just treatment.
3/ Notwithstanding its profit-making object-tive, any commercial broadcastingservice shall:a) provide eq:ual treatment to any
community in its license area;
b) transmission. of its programs shallcover the whole area of its license;
c) include regional and national news inits programs.
d) Submit to r~gister the license givenby the authority to the Ministry ofTrade and Industry or to the RegionalTrade and Industry Bureau.
4/ .Any community broadcasting serviceshall:
a) carry out its activities based on the needs ofthe community regarding development,education and good governance;
b) promote and develop the language,culture and artistic value of thecommunity;
c) allow the participation of themembers of the community in thepreparation of its programs;

e) utilize the income derived fromdifferent sources for the operation ofthe broadcasting station;
f) provide community centered informativeand entertaining programs to promote theinformation culture and knowledge of the,community.
17. Categories of Broadcasting Service Licenses
1. Categories of broadcastinglicenses shall be the following:

television broadcasting
el Satellite broadcasing serviceprovided to customers for fee;

gl cable television broadcasting serviceprovided to c'ustomers for fee;
hI other broadcasting services to beprescribed by the Authority.
18. Requirement of License
1I No person may undertake broadcastingservice without obtaining a broadcastingservice license from the Authority.
21 A broadcasting service licensee may notoperate more than one broadcastingstation with one license.

19. Invitation to Applicants
11 The Authority shall invite applicants by a noticepublished in a newspaper having a wide circulationor communicated by other mass media.
2/ The notice shall disclose the category ofbroadcasting service for which the license isintended to be issued, the license area, theradio wave available, time and place ofsubmissiQn of the application, the license feeand other necessary information.
3/ A person who intends to obtain a license forbroadcasting service shall fill and submit theapplication form prepared by the Authoritywithin the time specified in the notice issuedin accordance with this Article.
4/ Notwithstanding the provisions of sub-articles (1)-(3) of this Article, an applicant fora public broadcasting and communitybroadcasting service license may apply at any
. time to the Authority.
20. Unacceptable Application
Any application may be rejected, without goinginto detail screening, if the applicant:
1/ fails to produce legal evidence to ascertain itsfinancial capacity and source of financing;
. 2/ fails to produce detail project proposal; or
3/ is a body that may not be entitled to a licenseas provided for' in Article 23 of thisProclamation.
21. Criteria for Issuance of License
1/ The Authority shall set criteria that enable icfoevaluate the capability of applicants.
2/ The criteria to be set by the Authority shallinclude the following:
a) the reliability and sufficiency of theapplicant's financial sources to run theserVlce~
b) the capability of equipments andtechnologies, listed in the applicant's projectproposal, to render the service; ",,----

c) the applicant's organizational capacity,knowledge and experience to render theserVIce;
d) the contents of the program submitted bythe applicant and social needs covered bythe program;
1/ The Authority shall, upon examining inaccordance with Articles 20 and 21 of thisProclamation, decide on the application submittedto it under Article 19(3) of this Proclamation.
2/ Where the Authority decides not to issue alicense, it shall communicate to the applicantthe reasons thereof.
3/, Any applicant who is denied a license may. appeal to the Board within 14 days from the
date of the decision. The Board shall give itsdecision within 20 days~Jrom receipt of theappeal. '
4/ An applicant whose application has been acceptedshall be issued with a certificate of license uponsigning a license agreement prepared by theAuthority to provide for the terms and condition 'ofthe license and upon payment of the requiredlicense fee.
23. Bodies not to be issued with Licenses
The following bodies, may not be issued withbroadcasting service licenses:
1/ a body that is not conferred with a legal,
personality;
2/ without prejudice to the provisions of otherlaws regarding foreign nationals of Ethiopianorigin, an organization:
a) not incorporated in Ethiopia; or

24. Validity Period of Broadcasting ServiceLicenses
The validity period of broadcasting servicelicenses shall be as follows:
. .,1/ where the transmission is at the national
level, 8 years for radio, 10 years fortelevision;
2/ where the transmission is limited to aregional state, 10 years for radio, 12years for television;
'3/ where the transmission is limited to locallevel, 12 years for radio, 14 years fortelevision;
4/ where the transmission is limited to DireDawa, 10 years for radio, 12 years fortelevision;
5/ where the transmission is limited to AddisAbaba and its surroundings, 6 years forradio and 8 years for television;
6/ for community broadcasting service 5years;
7/ for short-term community broadcastingservice not more than 1 year.

25. Renewal of License
1/ .The broadcasting service licensee shall filland submit the license rene.waIform preparedby the Authority not earlier than 1 year andnot later than 6 months before the expiry ofthe validity period of the license.
2/ Before renewing the license, theAuthority shall ascertain that the radiowave is not required for another purpose.
3/ The Authority shall ascertain that the servicerendered by the licensee during the validityperiod of license was acceptable to thecommunity and it had no records of repeatedcomplaints brought against it.
4/ The validity period of a renewed broadcastingservice license sh~1I be determined by theAuthority.
26. Expansion License
1/ . Any broadcasting service licensee shall obtainan expansion license from the Authority whenit intends to provide additional broadcastingservice, upgrade the capacity of the station orto make technological changes and upgradethe capacity of the transmitter.
2/ When a broadcasting service licenseerequests a new radio wave to cover othelareas outside of its license area, theAuthority shall, before granting theexpansion license, ascertain:
a) that the requested additional wave isnot held by another broadcastingservice; and
b) the need of the community of the areawhich the license is requested.
3/ When a broadcasting service licenseerequests a technological expansion license forthe radio wave licensed earlier, the Authoritysha!1 ascertain that the equipments proposedare- compatible with the expansion plan of theservice.
27. License and Annual Fee
1/ Any broadcasting' service licensee shall paylicense fee, annual fee and license renewalfee, as reviewed and determined from time totime by the Authority.

2/ Where the broadcasting service annual fee isnot paid within 60 days after the end of theGovernment fiscal year, a penalty of 5% shallbe added for each month of delay; provided,however, that the total am°l!nt of penalty shallnot exceed 50% of the license fee.
28. Suspension of License
1/ Without prejudice to Article 29 of thisProclamation, the Authority may suspenda broadcasting service license where thelicensee violates the provisions of thisProclamation.
2/ The decision of suspension made inac~ordance with sub-article (1) of this Articleshall be served to the licensee stating, inwriting, the reasons thereto and the effectivedate of the suspension.
3/ The licensee may, where it is aggrieved bythe suspension, submit its grievance to thej30ard within 14 days from the date of receiptof the suspension order. The Board shall giveits decision within 30 days from the date ofreceipt of the grievance.
29. Revocation of License
1/ A broadcasting service license may berevoked by the Authority on anyone of the.folloV\ling grounds:
a) where it is confirmed that the licenseehas failed to commence transmissionwithin one year from the date of obtainingthe license;
b) where it is confirmed that the licenseis obtained by fraudulent means;
c) where the broadcasting stationsuspends its transmission for morethan one month without good cause;
d) where a court orders the closure of. the station;
e) where the licensee, by its owninitiative, stops the service;
f) where the provisions of Article 30(4)of this Proclamation are violated;
g) where the licensee fails to discharge itsobligations under Article 27 of thisProclamation.

2/ Where a broadcasting service licensee isaggrieved by the decision of the Authority, itmay submit its grievance to the Board within14 days from the date of receipt of thedecision. The Board shall give its decisionwithin 30 days from submission of thegrievance.
3/ Where the Authority confirms the existence offorce majeure which hindered a broadcastingservice licensee from commencing trans-mission within the period referred to in sub-artic,le 1(a) of this Article, It may allowadditional time, not exceeding six months, forcommencement of the transmission.

30. General
1/ Any program to se transmitted shallreflect different and balanced viewpointsto serve the public at large.
2/ The accuracy of the content and sourceof any.program to be transmitted shall beascertained.
3/ Every news shall be impartial, accurateand balanced.
4/ Any program intended for transmissionmay not:
a) violate the dignity and personal liberty ofmankind or the rules of good behavior orundermine the be.lief of others;
b) commit a criminal offense against thesecurity of the State, theconstitut-ionally established governmentadministration or the defense force ofthe country;
c) maliciously accuse or defame indivi-duals, nation/nationalities, peoples ororganizations;
d) cause dissension among national-ities or instigate dissension amongpeoples; or
e) incite war.

31. Protecting the Well-being of Children
1/ radio or television transmission programs thatmay corrupt the outlook of children or harmtheir feelings and thinking Qr encourage themto undesirable behavior shall not betransmitted at hours during which childrennormally watch or listen to such programs.
2/ Children are presumed not to listen orwatch to radio or television transrnissionsfrom 11:00 o'clock in the evenings up to5:00 o'clock in the morning.

35. Allocation of Advertisement Period
Unt~ss it is an advertisement broadcastingstation, any broadcasting station shall notallqcate more than 20% of its dailytransmission or in a particular programmetime for advertisements.

36. Sponsored Program
1I The content and timetable of asponsored program shall not fall underthe influence of the sponsor. In particular,a sponsored program shall not agitatethe sale or hire of the sponsor's productsor services. '
21 Persons who produce or sell goods orrender services whose advertisement isprohibited by law shall not be sponsors.
31 Unless otherwise agreed between thesponsor and the station, othercommercial advertisements may not betransmitted by interrupting sponsoredprograms.
41 The name ofth.e sponsor shall beannounced at least at the beginning andend of every sponsored program.

41. Transmission of Emergencv Governmen1Statements
1/ Any broadcasting service licensee shaltransmit, free of charge, .emergency statem-ents given by the federal or a regional stategovernment due to the occurrence of arincident that endangers the constitutionaorder of the country, a natural disaster or arepidemic that threatens public health.
2/ Without prejudice to the provisions of subarticle (1) of this Article, the right of thEbroadcasting service licensee to demancpayment when transmitting other governmental statements shall be respected.
42. Duty to Respect the Right to Reply
1/ Any broadcasting service licensee sharespect the right of a person to give repl:concerning an issue when he alleges that,transmitted program has encroached on hiright or failed to be presented properly.
2/ The broadcasting service licensee shaclearly transmit the reply at a proportionc:and similar time.
43. Transmission of Election Period Statements
1/ Any broadcasting service licensee shaallocate free airtime for political organizationand candidates registered in accordance witthe relevant law, to publicize their objectiveand programs to the people or to transITstatements during election period. Thimplementation of this provision shall bdetermined by directives to be issued by thAuthority.

2/ Without prejudice to sub-article (1) of thArticle, any political organization ccandidate may transmitelectiocampaign advertisement.
3/ The fee to be charged for electiccampaign advertisement may not exceethe fee charged for commerciadvertisements.
4/ The political organization or candidaprovided with air time shall tresponsible for the legality of the progra,or statement transmitted.

46. Confiscation
The property of a person used for broadcastingshall, in addition to the principal penalty, beconfiscated if that person is found, in accordancewith the provisions of the relevant criminal law,guilty of violating the provision of Article 30(4) ofthis Proclamation.
47. Power to issue Regulations and Directives
The Council of Ministers and the Ministry may,respectively, issue regulations and directivesnecessary for the proper implementation of thisProclamation.

49. Applicability of Other taws
1/ Without prejudice to the provisions of thisProclamation, the relevant provisions of thePress Proclamation No. 34/1992, with theexception of Article 7 and 13 thereof, shall beapplicable to broadcasting services.
2/ No law shall, in so far as it is inconsistentwith the provisions of this Proclamation,be applicable to matters provided for bythis Proclamation.
50. Effective date
This Proclamation shall come in to force up orPublication in the Federal Negarit Gazeta.
