IEC according to the anglo saxon acronym means International

Electrotechnical Commission.

IEC was founded in June 26, 1906 and currently has 69 participating

countries. IEC

standards are recognized in over 100 countries.

Although much older than WTO, IEC like, ISO and ITU, is an important

partner to WTO.

Via the TBT Agreement (Technical Barriers to Trade) IEC contributes to

decreasing barriers to trade from a technical point of view in the field of

electrotechnical product.

IEC and WTO

The WTO TBT (Technical Barriers to Trade Agreemen – sometimes referred to as the

Standards Code – aims to reduce impediments to trade resulting from differences between

national regulations and standards.

The TBT Agreement recognizes the important contribution that international standards and

conformity assessment systems can make to improving efficiency of production and

facilitating international trade. It also aims at the harmonization of standards on as wide a basis

as possible, encouraging all standardizing bodies to play as full a part as resources allow in the

preparation of international standards by the relevant international body, including the IEC and

ISO.

benefit from the new IEC RE CA System in addition to the current three,

namely IECEE, IECEx and IECQ.

A First Party Certification is conducted by a manufacturer of the product to be certified. The First party then

certifies it complies to various criteria that may be complete Standards

We are in the field of Self Declaration of Conformity when supported by evidences that can be testing again

partial or complete Standards.

Although there are many serious manufacturers whose results can be trusted some others bring suspicion on

their claims because of potential partiality.

A Second Party Certification is conducted by the buying party of a product.

It issues a document that Certifies that the product tested by the Second party complies to criteria set by the

Buyer itself.

Although there are many serious Second Parties whose results can be trusted some others raise suspicion of

potential favouritism and partiality

A Third Party Certification is conducted by a body that is neither the Manufacturer nor the Buyer and acts

independently of the two other parties to give a Certificate that can be considered as impartial. This impartiality is

resulting from various provisions that are taken by the Body.

The impartiality and the competence are attested by accreditors members of ILAC (International Laboratory

Accreditation Cooperation for laboratories) and IAF (International Forum for Accreditation. The IAF is the world

association of Conformity Assessment Accreditation Bodies) for Certifications Bodies.

In addition, all the bodies operating in IEC Systems for Conformity Assessments are Peer assessed. This applies

to all Certifications Bodies and Testing Laboratories ).

Peer-assessment allows to check compliance to the Rules of the systems and to their in depth competence.

Third party completed by accreditation and peer-assessment allows to achieve a high level of credibility

It is interesting to note that IEC that produces International Technical Standards, in the

Electrotechnic field, grounds its Conformity Assessment activities on Certification Standards that

are internationally set by ISO, one of the other partners of WTO.

Certification based on ISO System 1 relates to Type Testing Certification only.

Certification based on ISO System 5 relates to Type testing completed necessarily by Factory

Inspections.

This corresponds to the IECEx Equipment Certification Scheme.

This option a gives potentially access to the granting of a IEC Ex Mark through the IECEx Mark

Licensing System.

The Manufacturer decides the most appropriate «vehicle» to be used for marketing his products in

the Market place.

Membership of Full or Associate Member of IEC

Membership of the IECEx is open to any country in which there is a

Full or Associate Member National Committee of the IEC, as defined

in Article 4 of the Statutes of the IEC.

IECEx via CAB is currently implementing the general policy of IEC regarding access of Non-IEC member

country to International Certification Systems. As a consequence Membership of the IECEx is also

open to non-IEC member countries, subject to the concurrence of the IEC Executive Committee (ExCo)

regarding general IEC policy and satisfaction of the specific requirements for membership, as set out in

Annex D of IECEx 01 © IEC:2013(E) Specific Conditions for Bodies and Organizations domiciled in non-

IEC Member Countries to become members of an IEC System

-Use of IEC standards to grant “national marks”

Within the country test and assessment work carried out under the IEC System will be recognized as

the basis for national certification or approval by any existing or future national certification body(ies)

proposed for participation in the System or will be accepted directly by the country’s product approval

authorities.

53ASSOCIATE MEMBERSHIP

IEC Membership

Applicants should undertake to apply for at least associate membership of the IEC within a maximum of three

years after admission to a System.

If not already an Affiliate the applicant must be prepared to participate in the Affiliate Program until such time as

the applicant becomes a member of the IEC.

Countries suspended from the IEC may not be admitted to the IEC conformity assessment systems for a period of

three (3) years following their suspension.

-Well-established body, recognized at national level by the authorities and the market

Applicant member bodies from non-IEC member countries must demonstrate the existence of a body(ies)

operating a national certification or approval scheme recognized by the authorities and the market.

If no such body(ies) exist, applicants must provide details of regulatory or other arrangements providing for direct

acceptance of conformity assessment results.

54ASSOCIATE MEMBERSHIP

-ExCo decision on acceptability

The IEC General Secretary shall be informed by the System Secretariat of all applications (or possible applications,

where known by the System secretariat) from non-IEC member countries, in order that the IEC ExCo may take a

decision in principle as to their acceptability in terms of general IEC policy and any specific requirements with

respect to IEC membership, after receiving the General Secretary’s view on this.

The ExCo decision shall be conveyed to the System. The specific involvement of the IEC General Secretary in a

decision regarding acceptability, shows, definitely, the importance granted by the IEC community to the integration

in the IEC family of a Non-IEC membre.

One way to start the integration being the acceptation within a System.

Compliance with system membership requirements.

Applicants and associated certification bodies and testing laboratories must undertake to comply with all relevant

System rules and requirements, including payment of annual dues and sharing of costs as defined in the System

rules and varied by the System management committee.

It is essential that all bodies ( ExCB or ExTL) from a Non-IEC member be treated in all respects in a similar way to

IEC member Bodies. This is a pragmatic way to integrate the IECEx family

The overall responsibility for the operation of the IECEx is vested in

the ExMC, which is a Committee of the IEC and operates under the

authority of the CAB.

The CAB has delegated the management and overall operational

responsibility related to the IECEx to the ExMC.

The CAB supervises the ExMC and has the authority to disband the

ExMC and/or the IECEx Schemes (IEC Statutes Article 13). This

authority shall not be exercised without prior consultation between

the CAB and the ExMC Chairman.

Key Role of ExMC

The CMC shall decide on and/or endorse on items relating to Membership:

a) acceptance of Member Bodies of the IECEx,

b) acceptance, rejection and suspension of ExCBs and of testing laboratories (ExTLs),

c) questions related to membership of the IECEx.

d) Monitoring of acceptance of IECEx CoC in participating countries

a) to manage the IECEx in accordance with the Basic Rules and the Rules of Procedure of the IECEx;

Member Body, where at least one person shall represent the

interests of an ExCB or ExCBs and at least one person

should represent (manufacturing) industry interests

The responsibilities of the Board of Appeal are :

a) to recommend a solution to any dispute referred to it with

regard to the application of these basic rules,

b) to recommend actions to be taken against ExCBs and ExTLs

on complaints received regarding potential infringements to the

Rules that could compromise the credibility of the

IECExSchemes.

c) to report to the ExMC, for appropriate action, any

observations relating to the technical content of the standards

accepted for use in the IECEx and their applications, that has

become evident when investigating a dispute.

He is appointed for a period of five years by the CAB, on nomination by the ExMC and is

eligible for re-appointment without restriction.

The Executive Secretary is an employee of the IEC and a decision to appoint the Secretary

requires the prior consent of the IEC General Secretary.

The IECEx Chairman shall consult with the CAB Chairman and the IEC General Secretary

before a proposal is made to the CMC for the nomination of an Executive Secretary.

• to organize Workshops

• to make recommendations to the relevant technical committee or subcommittee of the IEC for

This is true for IEC Conformity Assessment Systems.

This is a significant part of their credibility.

Mutual Recognition Agreement

The IECEx is based on the principle of Mutual Recognition Agreement (reciprocal

acceptance) by its Members of test results for obtaining Certification or Approval at

National level.

MRAs are based on Peer-assessment.

Peer-Assessment is based on the concept that a larger and more diverse group of people will usually find more strong points, weaknesses and errors in an organisation and its performance.

This group, supported by appropriate procedures is able to make a more impartial evaluation of the organisation ability for conducting the work or achieving the level of performance required by the MRA.

By organisation it is, here, understood the ExCBs and the ExTLs operating for Ex Equipment Certification

80 IECEx Types of Peer Assessments

INITIAL ASSESSMENTS are required for all ExCBs, ExTLs upon joining the IECExEquipment Scheme.

A New Candidate ExCB, that wishes to become a member of the IECEx Equipment Scheme, is required to submit an application via the Member Body of the IECEx in the country where the candidate ExCB is located.

A New Candidate ExTL that wishes to become a member of the IECEx Equipment Scheme is required to submit an application through a Member Body in the IECEx. This candidate must be located in a participating country.
