SUBJECT: QUOTATION FOR ENGAGEMENT OF AGENCY ON CONTRACT

Sir/Madam,

ICMR-NITM intends to engage a registered agency for for Security

Services (24 hours watch & ward without arms). Agencies are requested to

submit detailed quotation in the prescribed format under two bid systems in

separate sealed covers i.e. Part I - Technical Bid and Part II - Commercial

Bid. Both these sealed covers should then be kept in a bigger

cover which should also be sealed & duly super scribed as “Tender for

SECURITY SERVICES (24 HOURS WATCH & WARD WITHOUT ARMS). at

ICMR - NITM, BELAGAVI”. The hard copies of sealed tender’s documents must

be dropped in the tender box kept at Administration Department so as to reach

this Institute well before the due date and time.

TERMS AND CONDITIONS

1. This Invitation for tenders is open to the registered agencies havingexperience in Security Service for a period of minimum threeyears, executed with Central / State Govt. Departments / Govt.Bodies / Undertakings funded by Govt.

2. The tendering agency is expected to examine all instructions, forms,terms & conditions, and specifications in the document. Failure tofurnish information required in the document or submission of atender not substantially responsive to the document in everyrespect will result in rejection of the tender.

3. EMD amount Rs. 1,40,000/- (Rs. One Lakh forty thousand only) andTender Fee (non-refundable) amount Rs.1000/- (Rs. One Thousandonly) should be submitted in separate enveloped in the form of twoseparate Demand Draft drawn in favor of DIRECTOR, ICMR-NATIONALINSTITUTE OF TRADITIONAL MEDICINE, payable at BELAGAVI.Tender/Bid submitted without the EMD & Tender Fee would be summarilyrejected. Micro & Small Enterprises registered under Single Pointregistration scheme of NSIC are exempted from payment of EMD andTender Cost. Copy of such registration certificate may be attached.

4. Contract period will be initially for One year from the date of awarding ofcontract, which is further extendable for a period of three years withrates applicable to Labour Wages (As per declared by Govt. of India) andterms & condition; subject to satisfactory performance each year.Institute reserves all the rights to extend or reduce the period of contractat the discretion of Director-in-Charge, ICMR-NITM, BELAGAVI.

5. The Tender Document submitted by the tenderer shall include thefollowing:

(a)Valid license under Contract Labour (Regulation & Abolition) Act,1970 (Central labour). Copy of Registration with the LabourCommissioner having jurisdiction over the territory in whichservices are sought to be provided by the Agency under thiscontract. In case the agency is exempted from obtaining suchRegistration, the agency is required to produce an affidavitsigned by the authorized signatory of the agency that their firmis exempted & is not required to obtain any such Registration orapproval or order from the Labour Commissioner.

(b)Copy of Valid EPF and ESIC registration particulars, Sales TaxRegistration Certificate / Service Tax Registration Certificate ifany.

(c) Income tax return particulars for the previous three financialyears.

(d) A copy of PAN card.

(e) Copies of experience in Security Services executed with Central/State Govt. Departments/Govt. Bodies / Undertakings funded byGovt. for a period of two years (Self-attested copies of therelevant work orders are to be enclosed).

(f) Information regarding any litigation, current or during the lastfive years in which the tenderer was/is involved, the oppositeparty(s) and the disputed amount.

(g)Details regarding any work order that was abandoned at anystage, prematurely terminated or resulted in inordinate delayalong with reasons for the same (copies of relevant documents tobe enclosed).

6. Submission of Tenders:

The Tender along with requisite documents shall be placed in sealed

envelope superscribed “Security Services (24 hours Watch & Ward

without arms)” and shall be addressed to Director-in-Charge, ICMR-

NITM, Nehru Nagar, Belagavi - 590 010. The tenderer’s name,

telephone number and complete mailing address shall be indicated on the

outer envelope. Bidders may please note that:

a) If the envelope is not sealed and marked as required, theInstitute will assume no responsibility for the tender’smisplacement or premature opening.

b) All the Tender documents submitted shall be serially pagenumbered and contain the table of contents with pagenumbers.

c) Tenders must be sent to the Institute on the above address notlater than the time and date specified in the Invitation forTenders. In the event of the specified date for the submission ofTenders being declared a holiday for the Institute, the Tenders willbe received up to the appointed time on the next working day.

d) The Institute may, at his discretion, extend the deadline forsubmission of tenders which will be binding on all the tenderers.

e) Any tender received by the Institute after the deadline forsubmission of tenders prescribed in the tender document will berejected and will not be opened.

7. Tenders shall remain valid for 90 days after the date of tenderopening prescribed by the Institute. A tender valid for a shorterperiod shall be rejected by the Institute as non- responsive.

8. Opening and Evaluation of Tenders:

a) The Tender Committee appointed by the Institute will open allTenders in the first instance on the appointed date & time.

b) During evaluation of the tenders, the Institute may, at hisdiscretion, ask the Tenderer for clarification of his tender.

c) No tenderer shall contact the Institute on any matter relatingto his tender from the time of the tender opening to the timethe purchase order is placed. If the Tenderer wishes to bringadditional information to the notice of the Institute it shall bedone in writing. However, all tenderers are strongly advised tofurnish all material information in the tender itself.

d) Any effort by a Tenderer to influence the Institute in hisdecisions on tender evaluation, tender comparison orpurchase order decision will result in rejection of the tender.

e) The Tender shall comprise the price component for all theservices. The price quoted by the tenderers shall include allapplicable taxes, wherever applicable. The tenderer shallinclude Service tax and surcharges/cess etc. as applicable onthe services that are provided under this contract in the lumpsum rates quoted and Institute would not bear any additionalliability on this account.

f) Institute shall however, deduct such tax at source as per therules in force. The prices once accepted by the Institute shallremain valid till the currency of the contract. The Instituteshall not entertain any increase in the prices during theperiod.

Rates shall ensure compliance of under noted statutoryobligations:

Contract Labour (Regulation & Abolition) Act, 1970 (Centrallabour)

Employee State Insurance Act and rules made there under Minimum Wages Act, 1948 & Payment of Bonus Act, 1965,

Payment of Wages Act, 1936 and rules made there under EPF (Misc. Provisions) Act 1952 and rules made there under Any other labour Legislate that may be applicable or may

become applicable time to time Industrial Safety Rules

g) The rates are inclusive of all (i.e. Provident Fund, ESI, Bonus,Gratuity, Paid Leave, pay for National Holidays, UniformAllowance, Operational Cost etc) charges and levies that areapplicable from time to time shall be met within the totalinvoice value.

h) Prices shall be quoted in Indian rupees only.

9. Payment terms:

The Institute shall make the contract payment as per the paymentschedule mentioned below:

a) Monthly bills submitted by the agency for the Security Servicesexecuted in the preceding month, shall be paid after submission ofbills duly completed in all respects. The payment for the work will bereleased only after production of attendance records and copies ofAcquaintance rolls/scroll for proof of payment of wages to thelabourers. Inadequate supply of work force for Security Services, willattract deduction at pro-rata basis from the work bill towardscompensation. The decision of Director-in-Charge, I C M R - N I T M,Belagavi, is final and binding in this regard.

b) If the performance of the Security Services by the agency is foundunsatisfactory the Competent Authority of Institute shall have powerto terminate the contract. Upon such termination, the securitydeposit of the Agency shall be liable to be forfeited and shall beabsolutely at the disposal of ICMR-NITM.

c) The monthly bills will be calculated only for the number of workingdays in a month.

10. The Institute reserves the right to accept or reject any tender,and to annual the tendering process and reject all tenders at anytime, without thereby incurring any liability to the affected Tendereror Tenderers or any obligations to inform the affected Tenderer ortenderers of the grounds for the Institute’s action.

11. The Institute will award the contract to the successful bidderdetermined to be the most responsive to the Tendering Documentand who has offered the best- evaluated tender, within 30 days ofthe opening of the Tender.

12. In case the Tender document submitted has deviations fromthe specifications or terms and conditions prescribed, the Tenderershall describe them separately and prominently. The Institutereserves the right to reject the tender having deviations from theprescribed terms and conditions.

13. It will be the sole responsibility of the tenderer alone toexecute the entire contract on his award.

14. Prior to the submission of Tender, the Tenderer/authorizedrepresentative shall personally inspect the Campus Area at ICMR-NITM, Belagavi at their own cost and under prior intimation. This isnecessary to enable the tenderer to gather all the information, so asto prepare the Tender accurately after taking into consideration allthe relevant factors. Submission of the tender will, therefore, beconsidered as meeting the requirements of tenderer having fullyread and understood the tender document and the scope of workprescribed therein.

15. The Agency will submit undertaking that it is fully acquaintedwith all the conditions and circumstances under which the suppliesrequired under the contract will have to be made or furnished andthe terms, clauses and conditions, specifications and other details ofthe contract and the supplies. The Agency shall not plead ignoranceon any matter as an excuse for deficiency in service or failure toperform or with a view to asking for increase of any rates agreed tothe contract or to evading any of his obligations under the contract.

16. The selected agency will have to deposit performanceguarantee deposit of 10% of the total contract value in the name ofDirector, ICMR-NITM, Belagavi for the full contract term.

17. In the event of the Agency failing to fulfill or committing anybreach of any of the terms and conditions of this contract or indulgein following omission or commission then without prejudice to theInstitute’s right and remedies otherwise, Institute, shall be entitled,the contract shall be terminated forthwith, forfeit the performanceguarantee deposit and to blacklist the Agency and execute the workor arrange otherwise at the Agency’s risk and at the absolutediscretion of the Institute. The cost of such works together with allincidental charges or expenses shall be recoverable from theAgency; under the following circumstances:-

a) If the Agency or his agents or employees are found guilty of fraudin respect of the contract or any other contract entered into by theAgency or any of his partners or representatives thereof with theInstitute; or

b) If the Agency or his agents or employees attempt to or indulge ingiving, promising or offer in any bribes, gratuity, gift, loanperquisite, reward or advantages pecuniary or otherwise to anyperson in the employment of the Institute; or

c) If the Agency or any of his partner become insolvent or appliesfor relief as insolvent debtor or commence any insolvencyproceedings or makes any composition with his/their creditors orattempts to do so; or if

d) At any time during the pendency of the contract, it comes to thenotice of the Institute, that the Agency has misled it by givingfalse/incorrect information.

18. The Agency will be responsible for the conduct of all workersdeployed by him and will be legally liable for any harm or lossarising to any person whomsoever, in whatever form, from anymisconduct or any act of negligence, omission or commission,whether intentional or otherwise, of the Agency or any of theworkers / agents / any others deployed by the Agency in the courseof providing any services stated in this contract, and will bear fullresponsibility and cost of the same. The Institute will not be liablefor any loss or harm to any person within or outside the Institutecampus from any act of omission or commission of any of theworkers / agents / any others deployed by the Agency in the courseof providing any services stated in this contract.

19. The Institute shall not be liable for any compensation, claim ordamages etc. due to any accident, injury or harm to any persondeployed by the Agency or death due to accident or otherwise,which may arise out of any circumstances related or unrelated withtheir duties at Institute. The Institute shall be indemnified by theAgency for all such claims.

20. Without prejudice to the preceding term of contract, theAgency will be liable to reimburse the Institute of any cost or legalliability/penalty/fine imposed on the Institute by any authority,because of any misconduct or any act of omission or commission,whether intentional or otherwise, of the Agency or any of theworkers / Sub Agency’s/ agents / any others deployed by the Agencyin the course of providing any services stated in this contract. Itshall be the responsibility of the Agency to comply with theprovisions of various Labour Laws. The Agency shall faithfullydischarge all the liabilities under the labour laws. The Agency shall

indemnify the Institute against the claims arising out of non-fulfillment of obligations by him under the various labour laws.

21. The Agency shall be solely responsible for compliance with allstatutory laws/rules/regulations such as those concerning PF, ESI,Labour laws, Minimum wages, etc. The Institute shall not be liable forany contravention/non-compliance on the part of the Agency. Anycontravention/non-compliance on the part of the Agency would beconstrued as a sufficient ground for termination of the contract at thediscretion of the Institute. Notwithstanding with this, in the event ofthe Institute imposed with any penalty/ fine etc., by anyagency/authority due to the noncompliance/contravention on the partof the Agency to any statutory laws/rules/regulations etc., theInstitute reserves the right to recover such fine/penalty etc., from theAgency by way of recovery from the bills raised by the Agency or byany other means.

22. The Institute may discontinue the contract at any point oftime, by giving a notice at least 30 days before the intended date ofdiscontinuation, and will not be liable to any additional charges orcompensation payable to the Agency or any other person.

23. The Agency may discontinue the contract the contract at anypoint of time, by giving a notice at least 60 days before the intendeddate for discontinuation. But will forfeit his Security Deposit (EMD)submitted by it, in case of discontinuation without a notice or anotice less than 60 days prior to the intended date ofdiscontinuation. The Institute will have the right to claim damages,and recover them from the payments due to the Agency or by anyother means, in addition to forfeiting the Security Deposit of theAgency.

24. Identity Cards must be issued to the employees and theirwages must be paid to them on acquaintance roll/scroll by 7th dayof every month. Before submission of bills by the Agency toInstitute for payment against the jobs a certificate will have to besubmitted by the Agency for having paid in full to the workersemployed by him along with the copy of acquaintance roll/scroll.

25. The Agency has to maintain all the relevant register/records asper the laws related with labour engagement etc. An affidavit on anon-judicial stamp paper of appropriate value to the effect that theAgency will be entirely responsible for fulfilling all the statutoryobligations under different statutes like workmen compensationAct., Contract Labour (Regulation & Abolition) Act, ESI Act, PF Act,Bonus Act, Gratuity Act for the workers employed by him on the jobwill be submitted by the Agency before execution of the contract

agreement. The workers employed by the Agency will not betreated as the employees of the Institute for any purposewhatsoever.

26. Notwithstanding whatsoever stated above and in case of anycontroversy regarding the scope of work or any other terms andconditions of tender, the decision of the Director-in-Charge, ICMR-NITM, Belagavi shall be final and binding in this regard.

27. In case the workers engaged by the agency / contractorhave any grievances, the same should be resolved by theagency / contractor without creat ing any disturbance in theInstitute. On the expiry of the contract the agency / contractorundertakes the responsibility to leave the premises in peace withall the workers without creating any disturbances to the Institute.The agency / contractor will be solely responsible if the employeesmisbehave or create problems to the Institute; such employeesmay be removed from his duties immediately and shall providereplacement. And also noted that in case of employee goes onleave a substitute employee has to be provided.

28. The Courts of India at Belagavi will have exclusive jurisdictionto determine any unresolved dispute with respect to this contract.

29. Offer must be kept open at least for six months from the date ofquotation.

30. Any dispute arising out of the terms of this contract on theinterpretation of any clause herein shall be settled by mutual discussionbetween the Institute and agency / contractor. The Director-in-Charge,National Institute of Traditional Medicine will be the final authority inresolving such disputes and his decision will be binding on the agency.

31. Agency/contractor should possess the requisite registration licenseof Shop Act/ Establishment, ESI, EPF, GST, Professional Tax etc., fromstate/ central government departments as applicable from time to time.The agency / contractor will have to maintain registers / records asrequired under the provision of various acts and complete the formalitiesprescribed there under. Institute shall not be responsible in any way forany breach of these rules and regulations by the agency/ contractor.

32. Security Personnel age should be between 18 to 50 yearsonly, PAN Card & Aadhar card of Security Personnel to besubmitted.

33. Tobacco/ Alcohol and Cigarettes/ Beedies are banned whilethey are on duty and should not litter in campus.

i) If a Security Guard is found with Consumption of Tobacco/Alcohol and Cigarettes/ Beedies (Abusive substance) a fine

of Rs. 5000/- is imposed. If the same person is foundviolating second time, he may be terminated from theservices.

ii) If a Security Guard is found Sleeping - a fine of Rs. 1000/- forfirst time, if found second time Rs. 2000/- and if found thirdtime, he may be terminated from the services.

iii) Attendance muster cum wages register of persons maintainedshould be duly signed with In-Out Timings by the individualemployees and countersigned by the representative of the agency /contractor and ICMR-NITM.

iv) All employees have to be paid wages, special allowance at rates,not lesser than the minimum rates prescribed by the governmentunder relevant rules. All the statutory payments and wages as perprevalent applicable Minimum Wages Act to its employee shall bethe responsibility of the agency / contractor and the Institute shallnot be responsible for any lapse on the part of the agency /contractor in this regard.

v) All the employees shall be covered by EPF & ESI as per the eligibilityunder EPF & ESI act and appropriate deductions may be made fromthe salary / wages as per the provision of the payment of wages act.

vi) License under the provision of Contract Labour (Central labour) Acthave to be obtained /renewed and kept operative.

vii) In case of loss of property due to the theft / negligence of theagency/ contractor during the contract period, the cost of propertiesshall be borne by the agency / contractor and such loss of propertyshall be recovered from the monthly bills or security deposit of theagency / contractor.

viii) A client list with their name, address and telephone numbers wherethe agency / contractor is presently rendering its services / hasrendered its services along with the performance certificate issuedby such establishments must be enclosed.

ix) The employees engaged by the agency / contractor should observethe discipline and office decorum during their course ofemployment.

x) Absence or deploying fewer people shall be liable for penal recoveryfrom monthly bills.

xi) Agency/contractor should supply reliable person after thoroughlychecking their personal identity with police verification of eachperson employed. The credential of the employed contractual staffwill be checked by ICMR-NITM authorities. One set of verifieddocuments must be provided for records.

xii) The appropriate payment of wages and other benefits to theemployees of the agency/ contractor shall be the EXCLUSIVE

RESPONSIBILITY OF THE AGENCY and persons so employed bythe agency / contractor shall have NO CLAIM whatsoever on theInstitute.

xiii) All personnel employed by the agency / contractor shall bemedically fit at the time of employment.

xiv) The agency / contractor shall supply good quality uniforms to theiremployees and strictly instruct to wear during working hours. Anyemployees found improperly dressed will be treated as absent andagency shall bind to provide immediate replacement in such cases.

xv)Institute will not accept any claim in the event of any of theagency’s/contractor’s employees sustaining any injury, damages orloss of a life of a person either inside or outside of the Institute’spremises.

xvi) Institute has a right to modify any conditions as and when requiredwith the mutual understanding with the agency / contractor.

xvii) The proprietor or his subordinate shall visit Institute at least twicein a month to ensure supervision and smooth functioning of theagency / contract.

xviii) The contractor shall not be allowed to sub-contract any part of thecontract without the prior consent of ICMR-NITM. If such consent isgiven, this shall not relieve the tenderer from any liability orobligation under the contract and he shall be responsible of theacts/ defaults and neglects of any sub-contractor, his agents orworkmen as if they were the acts, defaults or neglects of thetenderer, agents or workmen.

xix) In case of any ambiguity/ dispute in the interpretation of any of theclauses/ terms and condition, Director-in-Charge, ICMR-NITM’sinterpretation of the clauses/ terms and conditions shall be final andbinding on all the parties. The jurisdiction of arbitration shall beBelagavi.

PROVIDING ROUND, THE CLOCK SECURITY SERVICES

The security agency will provide trained and experienced Security Guards(without Arms), preferably ex-servicemen category in such a number atrequired by ICMR - NATIONAL INSTITUTE OF TRADITIONAL MEDICINE, BELAGAVI.

i) To provide round the clock safety and security of all land, buildings,fitting, furniture, plant and machinery, moveable and immoveableproperties at ICMR- NITM Campus.

ii) Safety of trees, shrubs, electric overhead installations, water pipelines,boundary walls etc. in ICMR-NITM, BELAGAVI and fresh additions/installations in ICMR-NITM, BELAGAVI from time to time.

iii) To verify identity and allow to employees of ICMR-NITM, BELAGAVI toperform the official work at ICMR-NITM, BELAGAVI, Campus.

iv) To ensure that no employee is permitted beyond office hours exceptwith special permission assigned by the Designated Officers. TheSecurity staff shall record the entry of employees attendingwork on holidays including vehicle & vehicle number they arebringing.

v) The Security staff will inspect and monitor the vehiclesentering and making exit of the campus. They shall ensure thatnothing illegal or detrimental done to the safety and security of theemployees as well as moveable and immoveable properties within thecampus.

vi) The security staff shall permit entry of visitor/ vendors after theconfirming from the concern department/ officers of ICMR-NITM,BELAGAVI & issue pass only to perform official works. They willmaintain separate register for this purpose.

vii) The security staff shall allow the entry & exit of any stores/materialsonly after verifying gate pass. They should also physically verify andcheck.

viii) In case of emergencies like flood, fire, earthquake etc., the securitystaff will be trained enough to evacuate the staff, properties etc. andinform the police, fire and other required departments as quickly aspossible.

ix) The Guards on patrol duty should take care of supply of water to thestaff quarters.

x) The Guards are required to display mature behavior, especially towardsfemale staff and female staff visitors.

xi) Any other related work may be assigned by the Director-in-Charge or his representative.

RATES / QUOTATION

1) The bidder has to submit the quotation, statutory charges (withdocumentary proof in its support) and service charges. The bidder has toclaim the GST as revised by the government from time to time.

2) Agency / contractor shall not be entitled to any additional payment duringthe period of contract except revised special allowance / variable dearnessallowance / basic pay etc., depending on the government orders from timeto time, with permission of the competent authority.

3) Successful agency/contractor has to enter into agreement with theInstitute as per detailed terms and conditions and to pay Bank Guaranteeof 10% of Annual Contract amount to the institute, which shall bear nointerest.

4) The Bank Guarantee will be released to the agency / contractor onwritten request within a period of two months after completionand fulfilling all the liabilities of the contract.

5) Agency / contractor can submit bills once in a month by 1st week of everymonth and payment will be made by through PFMS after 30 days afterreceipt of bill along with copy of ESI & EPF deposit list of previous months.TDS will be deducted as per prescribed rate every month. Agency /contractor should make payment to its workers on or before 07thday of every month. The agency / contractor should pass on all thebenefits offered by the Institute to the contractual staff andmandatorily make the payments to the staff through electronicbank transfer only and issue monthly pay slips separately.

6) Criteria for shortlist will be exclusive of GST.

7) All quotations must be sealed and superscribed on the cover along withattested valid copies of their Labour Contract License (Central),Shop Act / Establishment Certificate, EPF, ESI, GST RegistrationCertificate, Professional Tax Enrolment Certificates, Agency & ProprietorPAN Card, three years latest IT Return / clearance Certificate, PresentClient List and Profile of the agency. The above said documents aremandatory, failing which agency / contractor shall be treated asdisqualified.

8) Offers made on conditions like “subject to execution” or “taxes asapplicable” or such other vague conditions are likely to be ignored. Hencespecific mention of conditions in the quotations must be ensured.

9) Agency/ Contractor should submit their all documents mentioned in belowacceptance form. The agency/contractor will be scrutinized by thecommittee for opening of commercial bid on the basis of their eligibilitycriteria.

10) The agency / contractor shall abide by this terms & conditions ofICMR-NITM, BELAGAVI. No other terms & conditions of theagency/contractor are binding on ICMR-NITM, BELAGAVI.

I have gone through the Terms and Conditions of the tender documentsand the same are acceptable to me. I know that the Liveries / Uniforms of goodquality are to be provided by me at my cost to all the staffs engaged in thiscontract.
