The matter has twice been examined inconsultation with DoP&T and DoP&T has notagreed for the same. Moreover, DoP&T being thenodal Deptt., this Ministry is not in position todeviate from the instructions/clarifi cations issuedby them. As such, there appears to be no otheroption left.The long pending item may be 'closed'

In Para 3.2 of the demand No. 2 ofLD. Note dated 17/0512016 sent toDoP&T it is seen that the RailwayBoard have deliberately added'oevenif none of the conditions viz., 30years of service from the date ofinitial joining of the post orcompletion of 10 years of servicefrom the 2nd financial upgradation/promotion is fullilled" - forobtaining negative clarifications. TheFederation does not aeree to this.

l6/2011 Abolition of pay scales andintroduction of upgraded payscales with revised designation

case of SSE (Drawing)clarification on entry grade pay.

The malter has been duly examined inconsultation with DoP&T and reply to Federationhas been issued vide Board's letter dated19110/2016.

Federation's response sent vide letterdated 07/1112016 has not yet beenconsidered. This being deserving caseof JEISSE (Drawing) cadres who havebeen deprived of MACP, Federationurges to review for mitigating theoroblem.

5612012 Counting of service of D-2Khalasis in CLW for extendingbenefits of financial upgradationunderMACPS

The item has been discussed threadbare with theFederation and the reply given by CLW iscomprehensive covering all the doubts on theissue. There appears to be no issue outstandingfor discussion.The lons pendine item mav be 'closed'

Separate meeting in association withCPO, CLW is yet to be arranged bythe Board.

r6/2013 Non-grant of benefit underMACP Scheme to the StockVerifiers working in ZonalRailways/Production Units-reg.

The relevant instructions for allowing benefit ofMACPS to Stock Verifiers by not reckoning theirpromotion from AA to ASV (same Grade Pay)have been issued vide Board's letter dated1911212016 (RBE No. ls6/20r6).Thus. the item mavbe 'CLOSED'.

May be treated as finalized.

t7/20t3 Grant of financial upgradationunder MACP SchemeWrongful clarification issued bythe Railway Board.

Basically, the item is relating grant of higherGrade Pay under MACPS in cases where feederand promotional grade posts are in same GradePay. Meanwhile Federation vide their letter dated22/09/2016 had requested to make available thecopy of reference made to DoP&T and replythereto. Accordingly, the desired information hasbeen furnished to the Federation vide Board'sletter dated 06/10/2016. Moreover, DoP&T beingthe nodal department of Government on MACPS,this Ministry can not deviate from theinstructions/clarification issued by them.As such, there appears to be no issue outstandingfor discussion. The item mav be 'closed'.

The reference provided by theRailway Board relates to OM dated3lll0/20L2 addressed to DoP&T andreply thereto vide dated 0lllll20l2from DoP&T i.e. prior to issuance ofBoard's instructions datedI3ll2/2012. The PNM agenda Itemappeam to have not been examined indetail for apprising Railways situationto DoP&T.

The position fumished does notappear to be correct because of thefact that letter No. PC-V I 2009 / ACP / I 5A{R dated 12 I 0 5 /2016relates to the case ofCash & Pay staffof Northem Railway and not the PNMItem No. 19/2014. NFIR'scommunications on the subject maybe examined.

under MACPS to SSEDrawing (formerly diplomaholder tracers) appointed againstD.R. Quota vacancies asAssistant Draftsman (presentlyJE-Drawing with GP 4200 inPB-2) -reg.

As requested by the Federation vide their letterdated 22/0912016 to examine the matter incontext of their letter in No. IV/MACPS/09/Patl0 dated 0910512016. Accordingly, the matter hasbeen examined and replied to NFIR vide Board'sletter dated 2l I 1012016.Further, DoP&T has already been consulted onthe issue and they have not agreed to the proposalsaying that the services should be reckoned fromthe date of direct recruitment as mentioned in thepolicy circular issued in this regard. As no othercourse of action appears to be left available, theitem may be 'closed'

Federation does not agree with theposition explained in view of the factthat its reference dated 07 I 1 | /2016 hasnot been taken into account beforetaking a view. It should be appreciatedthat serving diploma holders wereabsorbed against D/R quota posts,pursuant to Railway Board's orders.Denying MACP on the pretext thatthey were granted restructuringbenefit (w.e.f. 0l/01/1984) during theyear 2006 is not correct as the staffwere already working against the D/R/

Quota posts prior to issuance ofrestructurins orders.

As requested by the Federation, the matter hasbeen reviewed based on the information obtainedfrom Central Railway as well as in light of theextant instructions on the subject andaccordingly, Federation have been replied videBoard's letter dated 2l/0212017. There appearsno other course of action to be left available.

The decision of the Railway Boardconveyed vide letter dated 2l /0212017to the Federation is not acceptable asthe same being discriminatory for thereasons that the Technical Supervisorsof DC Traction cannot be treateddifferently than the staff of otherTechnical Departments having similareducational qualification. Thereferences made by NFIR may beexamined properly for reachingconclusion. NFIR had given valid in-outs to Board throueh its letters also.

47 /2015 Grant of MACP to the formerTraffic Signallers absorbed asASMs/SMs on North EastemRailway-reg.

As requested by the Federation to examine thematter in context of their letter dated 12109/2016.The same has accordingly been examined andreplied to the Federation vide Board's letter dated0210U2017.

Reply sent by the Board vide letterdated 02/01/2017 is not convincingdue to the reason that the contents ofBoard's letter dated 6* Apil 1972have not been taken into considerationfor appreciating the recruitment background and facts of the case. Alsorefer the facts mentioned in NFIR'sletters.

24/2016 Denial of financial upgradationunder MACP Scheme to theserving Graduate Clerksinducted against LDCE Quotaon East Coast Railway.

As decided in the rneeting held on 19* & 20'May, 2016, E.Co. Railway have been asked toadvise the rule and methodology under which thepay of the employees promoted as Sr. Clerksthrough LDCE against l3%o/o quota has beenfixed.Reply from E.Co. Railway is awaited.Further, as per para 2 of Board's letter datedl8/06/81 and also in terms of Board's letter dated07/10197 benefit of pay fixation has been allowedon promotion to Sr. Clerks post through LDCE.Therefore, this promotion has to be counted forthe purpose of MACPS.

(i) The Senior Clerks wero inductedagainst (D/R Quota) through LDCEand Pursuant to written test conductedby the Railway Service Commission(presently known as RRB). Theseposts therefore pari of D/R Quota forwhich the rules for the directrecruitment have been followed andstaff selected and absorbed.(iD Since the recruitment rulesprovide induction throughLDCE/GDCE, the conditioncontained in Board's letter dated13/1212012 - item No. (i) is tulfilledtherefore the staff should be grantedMACP as already contended byNFIR. 4

The matter has been consulted with DoP&T andthey have advised that the demand does not coverin the MACPS as the Scheme provides forcounting service from direct entry grade.Further, DoP&T being the nodal department, thisMinistry can not deviate from the instructionsissued by them. There appears to be no issueoutstanding for discussion.Thus. the item mav be 'closed'.

Grave injustice has been meted out toEngineering Graduates due to non-allotment of pay scale Rs. 6500-10500(V CPC) consequently, they have beendeprived of MACP. Federation hadexplained the merits through letters.The case should be got reviewed formitigating hardship caused to thiscatesorv.

2 Third financial upgradation underMACPS on complefion of 20years of service from the firstpromotion or l0 years aftersecond promotion or 30 yearsafter regular appointmentwhichever is earlier.

The matter has twice been examined inconsultation with DoP&Tand DoP&T has notagreed for the same. Moreover, DoP&T being thenodal Department, this Ministry is not in positionto deviate from the instructions/clarificationsissued by them.As such, there appears to be no other option left.The long pending item may be 'closed.

Board may refer Federation's viewsagainst PNM Item No. ll20ll inAnnexure 'A' enclosed. Federationreiterates that 3'd MACP should begranted in those cases of staffstagnated for over 20 years from thedate of first promotion.

J Grant of financial upgradationunder MACP in the promotionalhierarchy - (instead of Grade Payhierarchy)'- as per judgment ofvarious Courts.

The factual position/details about the cadreswhere ACP Scheme as contended by theFederations have ascertained from Railways. Thesame is under examination.

The Board's contention is totallyincorrect. In this context NFIR's letterNo. IV/Ir{ACPS/09/Part 10 dated10/0412017 may be connected forreviewins the case.

4 MACP benefits to Railwayemployees - Cases of employeesjoining another unit/organizationon request. (Railway Board'sletter No. PC-V/2009/ACP12dated 3l/01/2013 - NFIR's letterdated 2910712013).

As desired by the Staff Side, necessaryinstructions have been issued vide Board's letterdated 23/Ill20l5 (RBE No. 147/2015) andthereafter a corrigendum has also been issuedvide Board's letter dated 17/0212016 (RBE No.19t2016).

Although DoP&T OM clearlyprovides that the past promotion in thecase of employees who join in lowergrade post at their request in the newunrtlorgaruzation should be ignoredfor the purpose of MACPS, theRailway Board has twisted the materand issued corrigendum to deny theMACP to the staff who joined in thelower grade post of the newuntt/organrzation. The Board'sintepretation is not acceptable to theFederation. In this connection,Federation's lefter No.IV/NIACPS/09/ParI l0 dated09/06/2016 may also be perused.

5 Provision of all benefits onfinancial upgradation underMACPS - including entitlementsfor travel & treatment in hospitaletc.

In the meeting Staff Side was requested to comeout with specific entitlement which are beingdenied to such Staff. No reply from the Staff Sidehas been received so far.

6 Non-grant of benefit of financialupgradation under MACPS to thestaff on North Westem Railwav.

As decided in the meeting, the matter has beenexamined after obtaining information from N.W.Railway and reply to the Staff Side has beenissued vide Board's letter dated 17/0312017.

NFIR's letter No. IVAvIACPS/09/Partl0 dated 06103/2017 may beconsidered for imparting justice to thestaff.

7 Grant of financial upgradationunder MACPS to the Staff whoare in the same Grade Pav formore than 20 years.

The matter has twice been examined inconsultation with DoP&T and DoP&T has notagreed for the same. Moreover, DoP&T being thenodal Department, this Ministry is not in positionto deviate from the instructions/clarificationsissued by them. Federation has requested that the matter may beexamined in context of their letter dated05109/2016. Accordingly, the same has been dulyexamined in consultation with DoP&T and replyto Federation has been issued vide Board's letterdated 19ll0/2016.

l 1 Wrong imBlementation of MACPScheme in IT Cadre/Granting offinancial benefit under MACPScheme to EDP Staff.

The matter has been consulted with DoP&T andthey have advised to examine and decide thematter in terms of clarification No. 35 ofDoP&T's OM dated 18/07/2001. Accordingly,the same is under examination.

In as much as the posts have beenupgraded as part of re-organization,such promotions against upgradationare required to be ignored in terms ofPara 5 of Board's letter dated10106/2009 for the purpose ofapplying MACP Scheme. The case ofIT cadre needs to be reviewed.
