At Deanefield late last Tuesday evening Eugene Phillips and Chas Thorn ¬
ton became involved in a difficulty Inwhich the former struck the latter overthe head with a hammer Thorntonswore out a writ for Phillips whichwas placed in the hands of MarshalJohn Guess to be executed
Shortly afterwards Guess saw Phil ¬
lips a short distance away and told himto consider himself under arrest Thishowever was after the Marshal hadstarted out to hunt for Phillips and wasnot in Deanefield L Phillips had a shot-gun

in his possession at the time andhis reply to the Marshals remark wasto raise the weapon and fire both bar¬
rels at the officer Guess fell to theground but drew his revolver and firedfive shots at Phillips only one of whichtook effect but which produced death inabout half an hour The charge ofshot fired by Phillips took effect InMarshal Guess right leg just abovethe knee and produced a dangerouswound He was at once taken tothe hospital at Owensboro After aconsultation by surgeons it was decid¬
