This amendment accused my son of consp i r ingwi th Mar i t a Lorenz (Frank Stu rg i s ex-mistress) to murder Frank Stu rg i s . Myson has never been ar res ted nor accused of a vio len t crime nor any i e lony.This accusat ion i s f a l s e and mal ic ious and not b e f i t t i n g a member of the BarAssociat ion of the Sta te of Flor ida . In the case o f Nevels v. Wilson, 402 F.2d 479 (5 th C i r. l 9 6 8 ) ,

the F i f t h C i r c u i t Court o f Appeal aff i rmed the d i smissa l o f the

Complaint due to i t s f a i l u r e to e s t a b l i s h a duty owed by the

defendant in t h a t case to the p l a i n t i f f . That case , which con

cerned a negl igence ac t ion , e l i c i t e d the fol lowing language from

t h a t Honorable Court , t o -wi t :

A motion to dismiss a complaint should besus t a ined where p l a i n t i f f cannot e s t a b l i s h

any mer i to r ious c la im under any theory proposed i n his p lead ing . Nevels , supra .

P r i o r to the Nevels case , the F i f t h C i r c u i t Court o f Appeal found

s i m i l a r l y in the case of Walker v. Tampa Cigars , 197 F.2d 72 (1952) .

i s ev iden t from the contents t h a t t he re a re no t s u f f i c i e n t f a c t s
