I have acquired knowledge in International Human Rights law, norms and principles in over 25 years of professional work specialising in all aspects of transitional justice including truth-telling, justice and reparations. I have experience in investigating and prosecuting cases involving human rights violations at the various international courts and hybrid tribunals. I was awarded 2017 Criminal Lawyer of the Year by the Society of Asian Lawyers and also honorary doctorates in law in 2012 from FAMA university, Pristina and 2013 from European University, Tirana, Albania. I am a member of the advisory board at the WSD Handa Centre for Human Rights and International Justice at Stanford University. In 1998, I was awarded a Diploma in the International Protection of Human Rights at Abo Akademi / Turku school of law, Finland. I have published extensively in the field of international law, criminal law and human rights. I have taught International Human Rights law in various universities around the world. I have been an advocate in court proceedings where the main language of record was French or English or Arabic. I have extensive experience in public speaking gained through court room-based advocacy, training legal practitioners, giving more than 100 presentations in academic and senior non-academic contexts , giving interviews to the media and making public statements with media interest.

In over 25 years of practice, I have attempted to promote truth, justice and human rights. My work has involved all aspects of transitional justice mechanisms, with a focus on criminal justice and reparations for victims of human rights violations. I have specialised in cases involving human rights and international criminal law in all of the UN Tribunals, hybrid courts and at the ICC while applying ICCPR, ECHR, ACHPR and other international conventions in my everyday work. I have investigated and prosecuted in cases involving alleged violations of human rights in various continents of the world. I have also defended individuals alleged to have committed serious violations of human rights at the ICTY,ICC, STL, EULEX courts in Kosovo and also represented the largest group of victims in the first case before the ECCC (Prosecutor v Kaing Guek Eay alias Duch) and I am currently representing 116,000 victims in Kenya as well as victims in Sierra Leone and Darfur. My work has largely covered the link between the four pillars of the Special Rapporteur's mandate and social and economic rights. I have published extensively in the field of human rights and justice. I was the first member of the English Bar to be employed by the Office of the Prosecutor of the ICTY in 1996/7 and ICTR. My experience includes, Director of Global Victims Initiative; Founding Director, The Peace and Justice Initiative (2012-Present).

At the international level, I have been engaged as lead counsel in various courts including the SPSC, SCSL, ICC, ICTY, STL, ECCC, EULEX courts. I have investigated human rights abuses in various continents of the world. I represented the largest group of victims in the first case before the ECCC and I currently represent 116,000 claimants of human rights abuses during the colonial period in Kenya, as well as victims of mass violations in Darfur & Sierra Leone. I am currently the President of the International Criminal Court Bar Association (ICCBA-ABCPI) which represents victim and defence counsel at the ICC. I have addressed state officials in numerous events and am scheduled to present a Report at the ICC Assembly of States Parties in New York on 06 December 2017. I have lectured in international human rights and on transitional justice mechanisms around the world, including at the Universities of Florence, Padowa, Tsinghua (China), in Tokyo at the 2015 Global Human Rights Summit in Tokyo and at PHILJA, Philippines. I have been a Senior Research Fellow at King's College London and a visiting lecturer in law at Utrecht University. At the national and regional level, I have provided technical advice to governments, victim organisations, civil society, and individuals on measures under this mandate including the right to justice, right to reparations and on other remedies for human rights abuses.

Please note that the work of mandate holders is unpaid. Those appointed as mandate holders serve in their personal capacities. They are not United Nations staff members, they are not based in United Nations offices in Geneva or at another United Nations location, and they do not receive salary or other financial compensation, except for travel expenses and daily subsistence allowance of “experts on mission”.

As a Queen's Counsel and member of the Bar, I am self employed, and need no external authorisation in order to dedicate the required time to the work of the mandate. I am in a position to devote a significant amount of time and will enthusiastically do so. I am independent and impartial. As a practitioner specialising in international law, I have worked & conducted investigations on human rights violations and advised in Asia, the Middle East, Far East, and North, West and East Africa and in Europe. This has enabled me establish necessary contacts that might be useful in directing research for the work of the mandate. Country visits, investigations, examination of issues, and timely drafting of reports are all familiar to me. In addition, I have directly engaged with various Heads of State, cabinet officials, senior members of the judiciary in many continents of the world. Within the UN system, I have productively engaged with various SRSG's, such as the late Sergio Viera de Mello of Brazil, the former SRSG in Timor Leste. Similarly, I have a track record of positive engagement with various USG/ASG level UN officials, as well with senior officials in regional organisations such as the African Union. I am flexible in my work practices and therefore confirm my availability and commitment to dedicate at least 3 months a year to mandate related work if appointed.

III. MOTIVATION LETTER (600 word limit, must be included below and not in a separate e-mail or as an attachment)

The road to justice in the aftermath of armed conflict is rarely straight. Many women, children and men in post conflict countries that are victims of human rights abuses live with no hope of getting any closure to the cycle of violence they have experienced. In the last decades, the international community has unequivocally asserted the importance of combatting impunity for human rights violations and has made an effort in developing transitional justice processes for dealing with the past human rights abuses. The establishment of this mandate is a positive step towards human development and a reaffirmation that the member States of the Human Rights Council are determined to recognise victims of human rights abuses as beneficiaries of the processes.

For more than 25 years, I have devoted my career to criminal justice, human rights and to strengthening the rule of law. My work has covered all the four elements under the Special Rapporteur's mandate (criminal justice, seeking the truth, reparations for victims and prevention of repetition of human rights violations). Each element aims to provide recognition to victims as "rights holders" and to acknowledge the harm and suffering they endured. Having been privileged to act for victims of human rights abuses at the international and national level, I am sensitive when dealing with such victims and am acutely aware of their circumstances. Effective victim participation and an enlightened and meaningful gender approach is essential to any criminal justice process or process aimed at securing the truth and preventing reoccurrance of violations.

I believe that I have the distinct advantage in that I have prosecuted, defended and represented the victims in international cases where serious international crimes are alleged. I have actively investigated such cases in post conflict countries and other fragile states including Libya, Sierra Leone, Liberia, Cambodia, Sudan, Kenya, Kosovo and Bosna-Herzegovina.The fact that I have acted for the Prosecution, Defence and Victims in different cases before the ICC, ICTY, ICTR, SPSC, SCSL, STL, ECCC, EULEX courts may give me a degree of credibility with States and other actors. This varied experience can be used to help foster an environment of cooperation - rather than adversarial opposition. Having acted for all sides in cases, not only helps demonstrate my independence and ability to be impartial, but I believe that it can lend additional credibility to my role as Special Rapporteur. The mandate holder must be cognisant of his or her role and be prepared to work within the terms of the mandate conferred. It is pertinent to note that States, NGO's, Regional organisations all have a role to play in seeking to prevent non-recurrence of human rights violations.

I understand that for transitional justice to be effective, it must focus on combatting impunity and building trust in the different groups within the society. In other words, it is an attempt for the people that have suffered human rights abuses to come to terms with the legacy of past atrocities so as to ensure accountability, secure justice and achieve reconciliation.

I believe that transitional justice measures must include a significant dimension of institution building. As such, the mandate holder must be determined to help in restoring the rule of law and strengthening key institutions such as the police, state departments and the judiciary so as to foster reconciliation in society. This necessarily includes th use of judicial and non-judicial mechanisms.

If selected as Special Rapporteur, I will strive towards entrenching the right to truth, justice, reparations and guarantees on non-recurrence. This would entail having first hand experience with victims, as well as engaging with alleged perpetrators and state institutions. This dialogue and work will assist in establishing the truth of human rights abuses and preventing recurrence.The aim of the present mandate is nobel indeed -and remains all too necessary as events around the world attest.

the Extraordinary Chambers of the Courts of Cambodia (ECCC). I represented the largest group of victims of torture and their families in the first case before the ECCC (Prosecutor v Kaing Geuk Eav alias Duch) relating to the notorious S-21 detention centre.

(1)International Criminal Tribunal for Rwanda (ICTR)

I was one of two lawyers advising the Prosecutor of the ICTR based in the Hague. I worked in the appeals section of the Prosecution and also in the Legal advisory section. In this capacity I worked on many leading cases including on the Akayesu appeal as well as the Kayishema & Ruzindana, Serushago and Kambanda appeals. These cases involved allegations of genocide, crimes against humanity

(2) International Criminal Tribunal for Former Yugoslavia (ICTY)

I was a Prosecution Legal Officer working with the senior trial attorney on the Delalic et al case. This case involved allegations of widespread torture in the Celebici detention centre in Konjic in Bosnia. I participated in indictment reviews in several major cases.

DOMESTIC EXPERIENCE:

Grade 7 Lawyer, Law Commission of England & Wales. -The Law Commission is the body responsible for law reform in the UK. I was in the Criminal Law team and worked on various law reform projects dealing with issues of evidence and substantive law.

Senior Crown Prosecutor, Crown Prosecution Service of England & Wales-Responsible for the review and conduct of cases covering the entire criminal spectrum including murder, rape, sexual violence. My primary responsibility was to review the evidence and decide if a prosecution was in the public interest and conducted prosecutions in court.
