EHRA: March 2012

“Worker’s Compensation Claims Management” Overview: Steve, Greg, and Rebecca (bios below) will explain Indiana’s Workers Compensation Act and how the applicable statutory laws impact everyday business. They will also discuss common issues faced by HR professionals when dealing with workers compensation claims, such as compensability of a claim and the elements of potential recovery. In conclusion, they will discuss workers compensation in-surance and steps to take which may help to reduce premiums. Benefits to HR professionals: Workers compensation laws vary from state to state, and are seemingly intertwined with other employment laws such as the ADA and FMLA. This creates an area of confusion for today’s HR professional. This seminar will help to compartmentalize these laws by estab-lishing the purpose of Indiana’s Workers Compensation Act, and the situations where this act is applicable. It will also help to inform HR professionals about workers compensation insurance and steps that can be taken to help reduce premium exposure for today’s businesses.

Stephen S. Lavallo, has over 25 years' experience in the prac-tice of worker's com-pensation, business, real estate, and estate planning and admini-stration. He represents

businesses, both large and small, as well as individuals in a wide variety of business transactions, organization, sales and leas-ing of properties, and in the defense of companies from worker's compensation claims. Steve is the Founder and President of the Southern Indiana Division of the Indiana Worker’s Compensation Institute and was listed as a Best Lawyer in Indiana (Worker’s Compensation). Email: [email protected]

Greg J. Freyberger is a Jasper native and partner at Kahn, Dees, Donovan & Kahn. He practices primarily in the Litiga-tion and Trial Services practice group, where he represents clients in court

concerning matters of insurance coverage, tort defense, appeals, commercial law, workers compensation, and employment litigation. Freyberger also advises clients concerning workers compensation claims and cost management, and represents em-ployers in front of Indiana’s Workers Compensation Board when their cases are litigated. He is the past chairman of the Trial Tactics section of Defense Trial Counsel of Indiana, and is currently a Di-rector of that organization. He also cur-rently serves as the President of the Board of Directors of Leadership Evansville. Email: [email protected]

Rebecca Ness Rhymer joined Kahn, Dees, Donovan, & Kahn, LLP in 2005 as a member of the Litigation and Trial Services practice group. Rebecca has successfully represented

clients in over 100 bench trials and a num-ber of jury trials. Rebecca focuses her litigation practice in the areas of collection and creditor’s rights, insurance subrogation and defense, worker’s compensation, and probate and trust litigation in both Indiana and Illinois. In addition to her litigation practice, Rebecca also has experience with estate planning and appellate prac-tice. Rebecca was selected as a Rising Star for Indiana Super Lawyers® magazine in 2010, and currently serves as President of the Reitz Home Preservation Society and Secretary for Keep Evansville Beautiful.

EHRA: March 2012

“Celebrating Community – Ignite Community Spirit: Get Involved!” By Danyelle Granger  March  is  Disability  Awareness  Month  in  Indiana.    This  year’s  theme, “Celebrating  Community    ‐  Ignite  Community  Spirit:  Get  Involved!” was chosen by the Governor’s Council for People with Disabilities.   When you think of diversity, do  you  immediately  think of disabilities?   More often race, ethnicity and gender are thought of first when the word “diversity” is mentioned.  It’s important to note that in Indiana, people with disabilities represent a larger percentage of the population than minorities.  According to the Census Bureau, adults and children with disabilities represent slightly more than 19% of Indiana’s population, while racial and/or ethnic minorities repre‐sent approximately 14%.  Policymakers increasingly recognize the rights of people with disabilities to have the opportunity to participate fully in the community, which includes living and working in an inclusive environment.  Because of this, a number of dis‐ability rights laws have been implemented, with the most widely recognized one being the Americans with Disabilities Act (ADA), which was originally enacted in 1990.  ADA provides civil rights protections to individuals with disabilities and guarantees equal opportunity  in public accommodations, employment,  transportation, State and  local govern‐ment services, and telecommunications.    This year’s theme “Celebrating Community” is a call to action to develop relationships with our neighbors, and make our communities a place where everyone participates and is a valued member.  Imagine the impact we could have if we all got involved in the promotion of inclusion!

March 4 – World Day of Prayer (International) March 8 ‐ International Women's Day (United Nations/International) March 8 ‐ Magha Puja Day (Buddhist) March 8 ‐ Purim (Jewish) March 8 ‐ Holi (Hindu) March 17 ‐ St. Patrick’s Day (Christian) March 21 ‐ Naw Ruz ‐ New Year (Bahá’í ) March 25 ‐ Feast of Annunciation (Christian)

Women’s History Month By Danyelle Granger  “How important it is for us to recognize and celebrate our heroes and she‐roes!”  ‐ Maya Angelou, poet  March is officially recognized as Women’s History Month with the National Women’s History Project  (NWHP) serving as the main clearinghouse.   This year’s theme is Women’s Education – Women’s Empowerment and commu‐nities are encouraged to honor women who have contributed successfully to initiatives within their local community.  In 1980, a group of women  in California founded the NWHP, a nonprofit organization, to broadcast the historical achievements of women because they felt women’s history was widely excluded from formal education programs.  As a result of their actions, initially the week of March 8 in 1981 was established as Women’s History Week to coin‐cide with International Women’s Day.  After additional lobbying of Congress, in 1987 President Jimmy Carter signed a  bill  officially  recognizing  the  entire month  of March  as Women’s  History Month.    Since  then,  the  National Women’s History Month Resolution has been approved every year with bipartisan support in both the House and Senate.  For more information on women’s history, visit: National Women’s History Project ‐ www.nwhp.org       Additional March Diversity Observances     Women’s History Month     Irish‐American History Month     Greek‐American History Month     Deaf History Month

Death by Meeting: A Leadership Fable About Solving the Most Painful Problem in Business

By Patrick Lencioni

Chances are that you’ve been to a meeting or two.  Chances are that you also think that there’s a better way to conduct those meetings. Enter Patrick Lencioni’s Death by Meeting: A Leadership Fable About Solving the Most Painful Problem in Business. From the book’s title, you may think that this book is about how to have less meetings.  Think again.   Lencioni uses his storytelling ability

to present a quick‐reading fictional tale that helps the reader understand that with some out‐of‐the‐box thinking, those inefficient meetings can be a thing of the past. Pick this book up. In fact, once you’re done, pass it along to

others in your organization.  They will thank you.
