THE HARYANA STATE MINOR IRRIGATION AND TUBEWELLS

CORPORAITON LTD. EMPLOYEES SERVICE BYE LAWS, 1980.

No. _______________/Admn. In exercise of the powers conferred by Clause 81 (xvi) of the Articles of Association of the Haryana State Minor Irrigation and Tubewells Corporation Ltd. and all other powers enabling the Board of Directors of the Corporation in this behalf, the following bye-laws shall govern the appointment and conditions of service of the employees appointed to the service of the Corporations.

PART-I

GENERAL

1.1 SHORT TITLE, COMMENCEMENT AND APPLICATION.

(i) These bye-laws may be called the Haryana State Minor Irritation and Tubewells Corporation Ltd. Employees Service Bye-Laws, 1980 and shall herein after be referred to as ‘Service bye-laws’.

(ii) These ‘Service Bye-Laws’ shall come into force immediately, on their approval by the Board of Directors.

(iii) These Service Bye-laws shall apply to all the employees of the Corporation but shall not be applicable to:-

a) Persons employed on special contract:

b) Persons taken on deputation from the Government and other agencies who will continue to be governed by the terms and conditions of their deputation;

c) Workmen engaged by the Corporation as may form time to time be covered by the statutory Standing Orders, framed under the Industrial Employment (Standing Orders) Act, 1946.

d) Any class of employees who may be specifically exempted from the application of these bye-laws by the Board of Directors.

Note: Under Section 13-B of the Industrial Employment (Standing Orders ) Act, 1946, the Standing Orders of this Corporation shall not apply to those Workmen to whom the Punjab Civil Services Rules Vol.I, Part-I (Haryana Edition) have made applicable by a decision of the Board e.g. employees working in the Administrative officers (including sub-offices) of the Corporation at different stations.

1.2 GRADING OF EMPLOYEES

1) The employees of the Corporation shall be classified in four grades i.e. Grade-I, II, III and IV. The list of such employees for the time being is indicated in appendix ‘I’ (A to D) respectively.

2) The Board of Directors may from time to time add or omit any post to or from any grade by edition or deduction, depending on the exigencies of work load etc. at any point of time.

1.3 DEFINITIONS.

In these bye-laws, unless the context otherwise requires;

1) “Act mans the Companies Act, 1956 (Central Act I of 1956).

2) “”Appointing Authority” means the authority empowered to make appointments to any grade of post.

3) “Board” mans the Board of Directors of the Haryana State Minor Irrigation and Tubewells Corporation Limited.

4) “Chairman” means the Chairman of the Board of Directors of Haryana State Minor Irrigation and Tubewells Corporation Limited.

5) “Compulsory Retirement” means pre-mature retirement in accordance with these service bye-laws which does not attach any stigma to the concerned employee.

6) “Controlling Authority” means the authority designed as such for purpose of these service bye-laws.

7) “Corporation” means the Haryana State Minor Irrigation and Tubewells Corporation Limited, represented by its Board of Directors or its duly authorized officers.

8) “Direct appointment/requirement” means an appointment/requirement made otherwise than by promotion of an existing employees of the Corporation employees of the Corporation or transfer of a person in the service of Government of India, or any State Government or Statutory Board/Government Undertaking.

9) “Discharge” means termination of employment of any employee in accordance with the conditions of the contract or the service bye-law, otherwise than on dismissal/compulsory retirement.

10) “Dismissal” connots removal of an employee for misconduct, as a result of the enquiry stipulated in the service bye-laws.

11) “Duty period” means the period of service rendered by an employee which counts for pay, leave and other service benefits (but does not include any period of suspension or extra-ordinary leave without pay).

12) “Employees” means an employee of the Corporation to whom these bye-laws apply.

13) “Government’ means the Government of Haryana.

14) ‘Honorarium” means a recurring or non-recurring payment granted to Corporation employee as remuneration for special work of an occasional or intermittent character.

15) “Managing Director” means the Managing Director of the Haryana State Minor Irrigation and Tubewell Corporation Limited as appointed by the Government of Haryana.

16) “Post” means the post sanctioned by the Board from time to time.

17) “Probationer” means an employee appointed against a regular vacancy and placed on probation for a specific period, as provided under these service .

18) “Promotion” means elevation of an employee of the Corporation from lower to higher post in the same grade.

19) “Recognized Institute” means any school or institution recognized by the Haryana Government.

20) “Recognized University” means:-

a) Any university incorporated by law in India, or

b) In the case of a degree, diploma, Certificate obtained as a result of an examination held before the 15th August, 1947, the Punjab, Sind or Dacca University, or

c) Any other University which is declared by Haryana Government to be a recognized University for the purpose of these service bye-laws.

21) Retirement” means normal retirement on superannuation.

22) “Selection Committee” means a Committee constituted under these service bye-laws for making selection for initial appointment.

23) “Service” means the service of Haryana State Minor Irrigation and Tubewell Corporation Ltd.

24) “Suspension” means halting in abeyance the contract of service and consequently the master and servant relationship between the Corporation and its employees, for a specified period.

25) “Transfer”-

1) This in relation to initial appointment means absorption of a person already in the Service of Govt. or any statutory Corporation, to the Corporation with adequate benefit of the service, rendered therein.

2) In relation to the existing employees of the Corporation, this implies change in posting form one station to another.

1.4 ADMINISTRATIVE FUNCTIONS:-

The Board, or the Managing Director as the Chief Executive functionary of the

Corporation may issue policy instructions, not inconsistent with these service bye-laws for the

day to day administration of the affairs of the Corporation.

PART-II.

GENERAL CONDITIONS OF EMPLOYMENT

2.1 1) The number of posts and their strength shall be as sanctioned by the Board in the annual budget from time to time.

2) The Board has the power to abolish any post in the exigencies of service, and no claim shall lie in this regard to the extent provided in these service bye-laws.

2.2

MODE OF APPOINTMENT.

1) Appointment to the service of the Corporation shall be:-

i)

by direct recruitment ;

ii)

by promotion.

2)

Except as hereinafter provided, the appointing authority has full discretion to resort to any particular mode of appointment to any post.

Provided that instead of making the appointment, any particular post (s) may be filled up by deputation form the Irrigation Department, or Haryana Govt. in general, or any other Department of Haryana Government in particular, with the approval of the Board/Managing Director as specified in Appendix II.

2.3

PROBATION.

1) Every person appointed to a post in the Corporation (except by deputation) shall

remain on probation for a period of one year;

a)

Any period after appointment to the service spent on deputation on a corresponding or a higher post shall count towards the period of probation fixed under this Rule;

b)

An officiating appointment against a post in the service shall be reckoned as a period spent on probation. .

2)

If the work or the conduct of an employee during the period of probation is, in the opinion of the Appointing Authority, unsatisfactory, it may:-

a) dispense with his service, if recruited direct, without assigning any reason by giving notice or without notice as per terms of his appointment.

OR

b) If appointed by promotion:-

(i)revert him to his former post, or

(ii)deal with him in such other manner as the terms and conditions of previous appointment permit.

OR

c) Extend his period of probation and thereafter pass such order as should have been passed on the expiry of the first period of probation.

Provided that the total period of probation including extension, if any, shall not exceed 2 years.

2.3 NATIONALITY DOMICILE AND ANTECEDANTS OF CANDIDATES FOR APPOINTMENT.

1) No person shall be appointed to the service of the Corporation unless he is;

a) a citizen of India, or

b) a subject of Nepal, or

c) a subject of Bhutan, or

d) a Tibetan refugee who came over to India before of the 1st of January, 1962 with the intention of permanently settling in India., or

e) a person of Indian origin who has migrated form Pakistan, Burma, Sri Lanka, East African countries of Kenya, Uganda, the United Republic of Tanzania (formerly Tanganyika and Zanzibar), Zambia, Melawi, Zaire and Ethiopia with the intention of permanently settling in India.

Provided that a person belonging to categories (b), (c) (d) and (e) shall be a person in whose

favour a certificate of eligibility has been issued by the Government.

2) A person in whose case a certificate of eligibility is necessary may be admitted to

an examination or interview conducted by the Corporation or any other recruiting authority,

but the offer of appointment may be given only after the necessary eligibility certificate has

been issued to him b the Government.

3) A person applying for any post by direct recruitment shall be required to furnish a

character certificate from the principal academic officer of the University, College, School certificates from two other independent responsible persons, not being relatives, who are well acquainted with him/her in private life, for a period of at lest 3 years and are otherwise un-connected with his/her University, College, School or Institution.

4) In the case of a person with prior experience, discharge certificate from the

previous employer has to be furnished in addition to the certificates mentioned above.

2.4 AGE.

Unless specifically provided otherwise for any category of posts, the minimum age for entry into the service of the Corporation will be the same as applicable to Haryana Government employees from time to time. No person shall be appointed to service by direct recruitment unless he falls within the approved age limit on or before the date specified

in the press advertisement or in the Requisition placed with the Employment Exchange, inviting application.

Provided that in the case of candidates belonging to Scheduled Castes/Tribes, backward classes, and Ex-servicemen, the upper age limit shall be relaxable as per the policy adopted by the Government in this regard from time to time.

Provided further that the appointing Authority may, in any particular case, relax the upper age limit, on exceptional merits, after recoding the reasons therefore.

2.5 QUALIFICATION.

No person shall be appointed to the service unless he satisfies the essential qualification and experience prescribed in Appendix ‘II’.

Provided that it will be open to the appointing authority to take into account the preferential qualification where so specified in appendix ‘II’.

2.6 DISQUALIFICATION FOR APPOINTMENT.

No person shall be eligible for appointment to any post in the Corporation:-

a) Who has previously been dismissed or compulsorily retired from the service of the Corporation or from any Department of the State or Central Government or from any Public Sector undertaking; or

b) Who has been convicted in a court of Law for any offence involving moral turpitude; or

c) Who has entered into or contacted plural marriage, i.e. who having a spouse living has entered into or contracted a marriage with any other persons, or has married any person having a spouse living.

Provided that the Board may, in any case where such a marriage is permissible under the personal law applicable to the concerned employee as well as the other party to marriage and thee are good and sufficient grounds for so doing, exempt any person from the operation of Clause (c) above.

2.7 RESERVATION FOR SCHEDULED CASES/TRIBES AND OTHER BACKWARD CLASSES/EX-SERVICEMEN AND OTHER CATEGORIES IN THE SERVICE UNDER THE CORPORATION.

In making appointments in the Corporation, reservations and other concessions shall be given to scheduled Castes/Tribes and other backward classes, ex-servicemen and other categories

of persons, in accordance with the instructions of the Haryana Government issued from time to time in regard to such reservation/concessions.

2.8 MEDICAL FITNESS.

No person shall be initially appointed in the service of Corporation unless he produces a medical certificate of fitness from the prescribed Medical Authority, in accordance with the prevalent rules/instructions of Haryana Govt. in this regard.

2.9 OATH OF ALLEGIANCE AND SECRECY.

Every person on his first appointment to a post in the Corporation, except grade

IV posts, shall before entering into the services of the Corporation , take an oath of allegiance to the Constitution of India, loyalty to the Corporation and to country in regard to its affairs.

2.10 LIABILITY TO SERVICE.

An employee of the Corporation shall be liable to serve the Corporation at any place, within or outside the State of Haryana, on being required to do so by the appointing authority.

2.11 DEPUTATION OF OFFICERS/OFFICIALS OF THE CORPORATION TO OTHER ORGANISATIONS.

An employee of the Corporation may be sent on deputation to other organizations including the Central/State Government or any Govt. undertaking with his consent, and prior approval of the Appointing Authority. The deputation of such an employee shall be governed by the terms and conditions to be agreed upon between the said employee, the Corporation and the Borrowing Authority.

2.12 RECORD OF SERVICES.

The following record of service of every employee shall be maintained:-

i) Personal File;

ii) Service Book;

iii) Annual Qualification Reports

PART-III

APPOINTMENT , PROMOTION AND SENIORITY

3.1 SELECTION COMITTEES.

I. For recruitment to grade I and II posts, the Selection Committee shall comprise of the following:-

1.

Chairman.

2. Commissioner and Secretary to Government Haryana, Irrigation Department , or his representative.

3. Managing Director.

4. Engineer-in-chief, (I.B.).

5. One non-official Director of the Board (MLA, if any)

6. One Specialist in the field/line.

** IIFor selection/requirement to grade-III posts, the Selection Committee shall

comprise.;

1. Managing Director or his representative.

2. One non-official Director, if any.

3. Chief Accounts Officer (only in the case of Selection/recruitment of Accounts knowing persons.)

4. Secretary (for centralized recruitment done in Head Office) .

5. On local officer to be co-opted by the Superintending Engineer concerned.

The quorum for the Committee shall be 3 members.

II. The Selection/recruitment to grade-IV posts, shall be made by the SE in the field office and by a Committee comprising of Chief Engineer (or his nominee) Secretary, XEN/Admn. in the Head Office.

FOR FIELD OFFICE (S).

The Superintending Engineer concerned shall if so authorized by the M.D constitute Selection Committee consisting of 3 officers (including a representative of the Managing Director deputed from the Head

Office) for interviewing the candidates for the post of Clerk-cum-Typist, Steno-typist, Tracers and to the posts of equal rank. The Superintending Engineer shall place the recommendations of the Selection Committee before the concerned Chief Engineer (formerly General Manager) who shall examine the same and submit to he Managing Director for issue of Appointment letters. The Managing Director may have the recruitment to all the Class-III posts made centrally by constituting a Selection Committee.

RECRUITMENT AND PROMOTION TO THE RANK OF ASSISTANT ENGINEERS.

3.2 (i) The direct recruitment to the level of Assistant Engineers shall be made to the extent of 50% of the total vacancies on the date of approval of the panel by the competent authority.

APPOINTMENT BY PROMOTION.

* 3.2 (ii) Appointment by promotion to the rank of Assistant Engineers/Sub-Divisional

Officers will be made in accordance with the provisions set out herein after:-

1) Not-withstanding anything provided otherwise, the promotion to the rank of Sub-Divisional Officer shall be made from amongst the junior Engineers, A.M.I.E hand, Circle head Draftsmen in the services of the Corporation.

2) The promotion to the rank of Sub-Divisional Officer shall be made to the extent of 50% of the total vacancies fallen vacant as on the date of approval of panel from amongst the categories set out in Clause (1) above, as below:-

2) The aforementioned Rule further substituted vide 7th amendment approved by the Board of Directors in their 68th meeting held on 09.06.1983.

Categories set out in Clause (1) above

a) Promotion from the Junior Engineers already in the service of the Corporation who have passed D.P.E.

35%

b) Promotion from Junior Engineers , eligible Circle Head Draftsmen already in

the service of the Corporation possessing AMTE/Degree qualification.

5%

c) Promotion from the category of Circle Head Draftsmen who have passed

D.P.E.

10%

Total: 50%

Reserving 50% of the vacancies for direct recruitment of Assistant Engineers, the remaining vacancies will be filled by promotion from different categories referred to in Clause (a), (b) & (c), of sub rule (2) of Rule 3.2 (ii) of these Bye-:Laws .

Allocation of each source in a lot of 50 vacancies to be filled by promotion will be as below:-

In respect of (a) above:-

1, 2, 3, 4, 5, 6, 7, 8, 9, 12, 13, 14 ,17 ,18, 19, 21, 22, 23, 24, 27, 28, 29, 31, 32, 33, 34, 37, 38, 39, 41, 42, 43, 44, 47, 48, 49.

In respect of (b) above:- Now (c)

6, 16 ,26 , 36, 46

In respect of (c) above:- Now (b)

5, 10, 15, 20, 25, 30, 35, 40, 45, 50.

3) In case suitable candidates are not available form source (b), the vacancies shall be filled form source (a) and any shortfall in respect of source (c) shall be met

(a) and any short fall in respect of source (c) shall be met from source (a) provisionally till an eligible candidate from the allotted source becomes available. In such an eventuality, the provisionally promoted person (s) shall liable to be reverted on the availability of the eligible employees form source (b) or (c) as the case may be.

3.2 (2) (i) QUALIFICATIONS FOR PROMOTION.

(a) To become eligible for promotion against quota mentioned at 3.2 (a) (a) the candidate must possess Engineering Diploma from an Institution recognized by Haryana Government and must have put in continuous service for a period of 10 years in the capacity of Junior Engineer in the Corporation and should have passed D.P.E.

(b) To become eligible for promotion against quota mentioned at 3.2 (ii) (b) the candidate must have put in 2 years service in case he is a Degree holder/AMIE. He will have to pass the D.P.E. within 3 years of such promotion otherwise he will be reverted to his original post and his seniority will be determined from the date of his passing the examination.

(c) To become eligible for promotion against quota mentioned at 3.2 (ii) (c) the candidate must possess Diploma in Draftsmanship from an Institution recognized by Government of Haryana and must have put in continuous service for a period of 3 years in the capacity of Circle Head Draftsman in the Corporation. The candidate must have passed the

DPE Examination conducted by the Corporation from time to time.

3.2 (2) (ii) PROCEDURE FOR PROMOTION.

1. The Managing Director shall, at intervals, ordinarily not exceeding one year, consider the cases of all eligible officers/officials for promotion to the higher rank, as on the day of approval of the panel by the competent authority.

*2. The Corporation shall prepare a list of officers suitable for promotion to the next higher rank. The selection for inclusion in such list shall be based on merit and suitability in all respects with due regard to seniority.

3. The names of the officers/officials included in the list shall be arranged in order of seniority.

4. The list so prepared shall be revised every year.

5. if in the process of preparing the list or its revision, it is proposed to supersede any eligible candidate, the Corporation shall draw up a list of such officers and may record its reasons for the proposed suppression.

6. The list prepared or revised in accordance with the above procedure shall than be forwarded to the Board of Directors by the Managing Director along with:-

1) records of all officers included in the list.

2) Records of all officers proposed to be superseded as a result of the recommendations of the Managing Director.

7. The Board of Directors shall consider the list prepared by the Managing Director alongwith other

documents received and unless it considers any change necessary, approve the list.

8. If the Board of Directors consider it necessary to make any change in the list received from the Managing Director, the Board of Directors shall make the change it considers suitable and send the list to the Managing Director.

9. Promotion to the next higher rank will be made by the Managing Director.

3.3 RECRUITMENT AND PROMOTION TO THE RANK OF EXECUTIVE ENGINEER.

Appointment to the rank of Executive Engineer shall be made through promotion from eligible Assistant Engineers in the manner given below:-

1) To become eligible for promotion to the rank of Executive Engineer or its equivalent from an Institution on recognized by the Government of Haryana and must have put in 8 years continuous service, in the capacity of Assistant Engineer in the service of the Corporation.

2) PROCEDURE FOR PROMOTION

Procedure for promotion to the rank of Executive Engineer shall be the same as in the case of Assistant Engineers.

3.4 RECRUITMENT AND PROMOTION OF SENIOR SPECIALIST.

The Senior Specialist in the relevant discipline shall be recruited directly in the manner provided in these service-by-laws . in case, the candidates with the requisite qualifications and experience are available in the Corporation, they will also

be considered for promotion in accordance with the provisions of these service bye-laws.

2) DEPARTMENTAL ACCOUNTS EXAMINATION.

The Senior Specialist will be eligible to appear in paper ‘B’ of the Departmental Professional Examination in “Accounts ”. those getting 60% marks or above shall be declared as having passed the said examination. A senior specialist will be competent to exercise the powers of the drawing and disbursing officer of a Division handling work relevant to his discipline, only. He will be responsible for the up-keep of accounts of all the financial transactions of such a division under his charge like any other Divisional Officer.

3.5PROCEDURE FOR RECRUITMENT.

1. In the case of Grade I and II posts, the vacancies will be widely advertised in

the press, besides notifying them to the Central Employment Exchange, Haryana, Chandigarh.

2. The vacancies in Grade-III posts shall be notified to the Central Employment Exchange, Haryana and in case suitable candidates are not forthcoming in this way, resort may be had to press advertisement.

3. Class-IV post shall be filled by placing Requisition with the Employment Exchange.

4. The Competent Authority shall give 15 days notice to the Employment Exchange to sponsor the candidates.

5. The Selection Committee may, in its discretion, recommend candidates upto 50% in excess of the notified vacancies. The panel shall be valid for a period of six-months.

Note:- i) The candidates will be required to appear for Selection/Interview at their own expense.

Provided that in the case of any grade I and II posts, the Board may approve payment of Traveling expenses at such rates as it may deem fit.

Note:- ii) This will be duly notified in the press advertisement.

*3.6

PROCEDURE FOR DEAPRTMENTAL PROMOTION.

1.Unless otherwise provided, all promotions form lower to higher grade shall be made on the basis of seniority-cum-merit. The merit shall be determined in accordance with the instructions issued by Government of Haryana, from time to time.

2. All eligible persons shall be placed in the panel comprising of three names for the first vacancy and two for nay subsequent vacancies arising together.

3.The panel shall then be considered by the appointing authority and promotion shall be ordered accordingly.

4. With regard to promotion to grade I and II posts, the eligibility of the candidates will be reckoned as per approved panel.

PART-IV

DEPARTMENTAL EXAMINATION, TRAINING, SUBJECT ETC.

DEPARTMENTAL EXAMINATION, FOR ENGINEERING OFFICERS.

1. All Assistant Engineers/Assistant Design Engineers and Assistant Directors have to pass the Departmental Professional Examination (D.P.E) within three years of the appointment ; and Departmental Revenue Examination (D.R.E) within 5 yeas. Failure to pass the above examination will disqualify them from the 4th/6th increment in the running grade, as the case may be till such time as he passes it when the increments shall be released retrospectively:-

“Provided that he shall not be entitled to get any arrears of the grade increments for the period during which he could not pass the examination.

2. While passing of D.P.E. is one of the conditions precedent for eligibility for promotions as Executive Engineer, earning of further increment in the promoted rank will be conditional on the further clearance of D.R.E.

3. No Engineering diploma holder, whether Junior Engineer, or Circle Draftsman, will be eligible for promotion as Assistant Engineer unless he has cleared both the Departmental Examination.

Provided that Circle Head Draftsman who has cleared the D.P.E though not the D.R.E may be promoted as Chief Draftsman, if and when such a post is created.

4.1. The syllabus and procedure for holding the above examinations shall conform, with marginal adjustments to suit the special conditions prevailing in the Corporation, to the standards laid down in the Haryana Irrigation Department.

Note:- 1) Inserted below rule 4.1 as per the amendment approved in the 61st Board Meeting held on 10.02.1982. Amendment at page 74.

Note:- 2) Detailed guide-lines for the departmental examination are to be prescribed by the Managing Director before conducting the first examination under these bye-laws who will issue instructions in this behalf.

*4.2 JUNIOR ASSISTANTS EXAMINAIONS.

i) To become eligible for promotion to the post of Junior Assistant (including those who were formerly designated as Accounts Clerks), it will be obligatory to pass a ‘Departmental Professional Examination’ comprising of two papers- one in ‘Accounts ’ and one in ‘Office Procedures and Establishment Rules’ Only those Clerks, Steno-Typists or Clerks-Cum-Typists who have completed 5 years approved service in this Corporation shall be eligible to appear therein. The examination shall be held once in a year or after such interval as may be decided by the Managing Director. The Junior Assistants recruited or promoted as such before the enforcement of these bye-laws who have already passed Sub Divisional Clerks’ Examination shall be exempted from passing the Accounts Paper. This provision shall also apply to serving Junior or Senior Assistants for becoming eligible for promotion as Head Assistant (Head Clerks).

*4.3 CORPORAITON DIVISIONAL ACCOUNTANT EXAMINATION .

For appointment as Divisional Accountants it is necessary to pass the prescribed examination. The syllabus, for such examination has been laid down by the Managing Director. The Managing Director will be competent to make necessary alteration therein from time to time.

Pass percentage both in individual papers as well as aggregate will be 50% , 60% marks in a paper will entitle one to exemption therefrom.

*4.4 TRAINING .

1. A Junior Engineer or directly recruited Assistant Engineer will have to undergo training for a period of three months.

Provided that if the employee has undergone training in the Corporation under the Apprenticeship Act, the requirement of training may be waived off by the appointing authority.

2. For this purpose, a Junior Engineer will be attached with some Circle and it will be for the Superintending Engineer concerned to devise the training schedule so that he has an opportunity to acquaint himself with the various field activities as well as the Stores Accounts etc.

3. During the period of such training, an Assistant Engineer will be attached with the Head Office. The training schedule in his case will be one month in the design office, one month in the Tubewells Organization, and one month in Watercourses Lining Wing.

4. A report on the progress of training should be submitted by the respective Executive Engineers to the Superintending Engineer concerned in the case of Junior Engineer and respective Chief Engineer to the M.D. in the case of Assistant Engineer, not later than the last day of each phase of training.

5. In the event of the progress during training being found un-satisfactory , the period of training may be extended upto a further period of 3 months.

6. Regular appointment/Charge will be dependent on successful completion of the training programme.

7. During the period of training, the employee shall be paid such amount as the Board may fix from time to time, which will in any case be not less than the amount fixed under the Apprenticeship Act.

8. The period of training shall not count towards increments in the regular time scale.

9. An employee selected for specialized training outside the sphere of the Corporation, whether in India or abroad, shall have to execute a Bond as may be prescribed by the Board for the purpose.

*4.5 TRAINING OF ZILLADAR CANDIDATES FOR APPOINTMENT AS ZILLADARS .

Candidates provisionally selected shall be required to undergo the following training:-

1. DEPARTMENTAL CANDIDATES i.e. ASSISTANT CLERK REVENUE CLERK AND ASSISTANT REVENUE CLERK.

About four month’s training in revenue work will be under a Quanungo in the Land Revenue Department.

Their final acceptance will depend on the results of this training.

2. DIRECT CANDIDATES.

Six months for training under selected Zilladars during which period they shall be required to pass the Patwar’s examination prescribed for the purpose.

At the end of this period, they shall be required to hold charge of Patwari’s section for at least one whole Crop viz from 1st April to 30th September, or form 1st October to 31st March or longer if necessary, to ensure that they get fully acquainted with the preparation of Khataunies etc, after having completed training.

4. Viva-voca.Allotted for each subject and 66% of the aggregate must be obtained in order to secure pass marks.

No candidate shall be allowed to appear more than once in this examination except for special reasons in the absence of which the names of those that fail shall be removed from the list of selected candidates. On passing this examination, they shall be required to undergo training for a period of about four months under Quanungo in the Land Revenue Department and final acceptance shall depend on the result of this training. If final accepted as “Candidates Zilledars” they shall be appointed as officiating Zilledars on probation or additional Revenue Clerks in the Circle with which they are attached.

During the above period (s) of training, examination and joining time, all direct candidates shall receive a fixed allowance of Rs. 200/- per mensem. This allowance shall not be admissible during the period s they officiate as Zilladars or after appointment as Zilladars on probation.

3. If the work or conduct of any candidate Zilladar during the period of training and prior to his being placed on probation is in the opinion of the Managing Director not satisfactory, the Managing Director, may at any time during this period, remove his name form the list of accepted candidates, if recruited direct, or revert him to his original post, in case he fails under category (a) of this rule.

4.A direct candidate shall not apply for another post without the permission of the Managing Director.

4.6 SECURITY

1) The following categories of employees who are required to handle large stores/cash will be required to furnish security in cash, as indicated below, and in addition execute an idem-nity bond by an acceptable surety, in the sum equal to four times the amount of cash surety:-

Junior Engineer (including Graduate Engineer)

: Rs. 500/-

Potedar.

: Rs. 200/-

2) The cash security indicated above may be paid in lump sum or in five equal monthly instalments, the first one being deposited at the time of appointment, alongwith the Bond.

PART-V

PAY GRADES PERQUISITES, HONORARIUM, LEAVE RULES JOINING TIME AND TRAVELLING ALLOWANCE ETC.

5.1 PAY GRADE

1) Each post in the Corporation will carry a time scale of pay.

2) The pay scale is subject to revision by the Board which will, however, generally follow the pattern adopted by the Government of Haryana from time to time.

5.2 INCREMENTS

1) Increments will be allowed to every employee on the first date of the month in which he was employed, unless the same has been with –held by orders of the competent/appointing authority as a measure of punishment.

2) However, the crossing of efficiency bar being hallmark of efficiency, the same will not be allowed as a matter of course, without a written declaration to that effect by the competent/appointing authority. The efficiency bar shall be crossed in accordance with the instructions issued by Government of Haryana.

5.3 PERQUISITES:

1) The employee of the Corporation shall be entitled to such perquisites as are approved by the Board from time to time.

NOTE:-Special pay attached to any post by reasons of either higher responsibility or ardous working conditions etc. will not be regarded as a perquisite.

2) Every employee of the Corporation shall be paid House Rent Allowance on the scale approved by the Board from time to time.

3) The employees of the Corporation will be entitled to medical reimbursement on the same terms as admissible to Haryana Government employees from time to time.

5.4 HONORARIUM:

Honorarium may be granted to any employee for outstanding contribution or commendable service to the cause of the Corporation with the approval of the Board:-

NOTE 1:- No Honorarium will, however, be admissible (i) for the discharge of ordinary duties of the post, merely because it has been done commendable (ii) for occasional working over time;

(iii) for attending the meetings of the Board of Committee set up by the Government of Haryana or those financed wholly or partly by the Corporation funds.

5.5 LEAVE RULES, LEAVE TRAVEL CONCESSION, AND TRAVELLING ALLOWANCE.

The employees of the Corporation will be governed by the same rules in this regard as are applicable to Haryana Govt. employees from time to time, Leave covers both casual leave as well as earned leave.

5.6 JOINING TIME.

The employees of the Corporation under transfer shall be entitled to the same joining time as may be admissible to Haryana Government employees from time to time.

PART-VI

RETIRAL AND OTHER BENEFITS.

6.1 CONTRIBUTORY PROVIDENT FUND.

1) No pension will be admissible to the Corporation employees; they shall, however, be entitled to the benefit of E.P.F. The E.P.F shall be regulated in accordance with relevant law for the time being in force.

6.2 CORPORATION GROUP INSURANCE.

Every employee of the Corporation who has completed one year’s service shall be eligible to become member of Group Insurance Scheme of L.I.C of India. The Corporation shall ‘suo moto’ ensure its implementation and the benefit of this scheme shall accrue to the legal heirs of the employees in the event of his death while in the service of the Corporation. The benefit shall be determined with regard to age, salary as per fixed yard-stick in consultation with the L.I.C of India.

6.3 DEATH-CUM-RETIRAL GRATUITY.

Every employee of the Corporation will be entitled to the payment of D.C.R gratuity on the same terms and conditions as may be applicable to Haryana Govt. employees from time to time, provided that the employee covered under the Payment of Gratuity Act, 1972, shall not be entitled to this benefit.

6.4 LOANS AND ADVANCES:

i) The employees of the Corporation may be given

loan for the following bona-fide purpose e.g.

i)Purchase of motor-vehicle;

ii) Purchase or building a house for personal residence.

2) The conditions for the grant of loan and the rate of interest chargeable thereon shall be as applicable to Haryana Govt. employees from time to time.

3) In addition, the employees of the Corporation may be given interest free advances with prior approval of the Board, for the following bona-fide needs, e.g.

i) Purchase of wheat; or

ii) Purchase of a cycle.

iii) Repairs of the houses owned by the employees in the same manner and subject to the same condition as are applicable to Haryana Govt. employees.

PART-VII

TERMINATION OF CONTRACT OF SERVICE.

7.1 CODE OF CONDUCT:

Unless otherwise provided, the Government Employees Conduct Rules , 1966 as amended form time to time by the Government of Haryana shall apply to the employees of the Corporation.

PART-VIII

TERMINATION OF CONTRACT OF SERVICE.

8.1 SUPERANNUATION:

1. The age of superannuation for Corporation employees is 58 years, except for Grade-IV employees in whose case it is 60 years.

2. Any person may, however, be re-employed after his superannuation, for a period of one year at a time, with prior approval of the board and on such terms and conditions as may be approved by it.

8.2 DISCHARGE/RESIGNATION:

1) Unless otherwise provided, the appointing authority may discharge any officer/employee by giving him the notice prescribed in clause (2) or salary for the period of shortfall in the requisite notice.

2) The notice in the case of temporary employees will be one month and that for the employees appointed on regular basis shall be three months.

3) There is a corresponding right in the employee to resign his/her hob on the same basis as for discharge.

Provided that an employee who has executed a special bond will be governed by the terms thereof.

4) Any notice of discharge/resignation may be rescinded in any case before the expiry of notice period, unless the other party has in the meanwhile conveyed a formal acceptance thereof.

5) No person who has once been discharged from this Corporation shall be re- employed. However, this prohibition will not apply in the case of an employee who has resigned his post on personal grounds.

PART-IX

INTERIM SUSPENSION.

9.1 SUSPENSION PENDING DISCIPLINARY PROCEEDINGS.

1) The appointing authority may suspend an employee pending enquiry into allegations which if established, are likely to lead to dismissal or removal of the employees.

2) Ordinarily, the suspension will not be ordered unless the allegations made against the official concerned are of serious nature and on the basis of evidence available, there is a prima facie’ case for his dismissal or removal or there is a reason to believe that his continuance in service is likely to embarrass or hamper the investigation of the case.

3) The suspended employee will be entitled to subsistence allowance as admissible to Haryana Government employees from time to time.

Provided that the delay in the speedy disposal of the enquiry cannot be attributed to the employee concerned and that his-co-operation in the matter is not in doubt.

Provided further that the payment of subsistence allowance is subject to the employee furnishing a certificate that during the period of suspension, he has not engaged in any other gainful employment, and a certificate from the officer with whom the employee is attached during suspension, that he has not delayed or refused delivery of orders issued to him from time and that he has been fully co-operating with the conduct of formal enquiry against him.

9.2 SUSPENSION DURING ARREST AND CRIMINAL PROCEEDINGS.

1) A Corporation employee against whom proceedings have been taken either for his arrest for debt or on a criminal charge or who is detained under any law providing for preventive detention should be considered as under suspension for nay periods during which he is detained in custody or is undergoing imprisonment, and not allowed to draw any pay and allowances (other than any subsistence allowance that may be granted in accordance with the principles laid down in these bye-laws) for such period until the final termination of the proceedings taken against him or until he is released from detention an allowed to rejoin duty, as the case may be. An adjustment of his allowance for such periods should thereafter be made according to the circumstances of the case, the full amount being given in the event of the officer/official being acquitted of blame or (if the proceedings taken against him were for his arrest for debt) of its being proved that the officer’s liability arose form circumstances beyond his control or the detention being held by the competent authority to be un-justified.

2) A Corporation employee against whom a criminal charge or a proceeding for arrest for debt is pending should also be placed under suspension by the issue of specific orders to this effect during periods when he is not actually detained in custody or imprisoned (e.g. while released on bail), if the charge or proceedings

taken against him is in connection with his position as a Corporation employee or is likely to embarras him in the discharge of his duties as such, or involves moral turpitude.

9.3 REVOCATION OF SUSPENSION.

1) If, at any stage of enquiry proceedings, it transpires that it may not be desirable to dismiss the concerned employee, the appointing authority may forthwith revoke the interim suspension.

2) The revocation of suspension will be without prejudice to the enquiry which may proceed thereafter. But the appointing authority has to consider and decide as to what further emoluments are to be paid during the period of suspension and whether or not it has to count as duty period for all or any specified purposes.

3) In case, the suspension in the circumstances of the case is found to be wholly unjustified, then the period of suspension has got to be treated as duty period, with full emoluments of the post as admissible.

Provided that no order to the deteriment of the employee is to be passed unless he has been afforded an opportunity of hearing.

4) If at any stage, it is decided not to persue the enquiry proceedings but instead resort to discharge simplication, the suspension would be deemed to be removed and the employee concerned, shall be entitled to full salary for the period of suspension with other consequential benefits.

5) Where suspension is revoked by order of any court of law, then also the entire period is to count

as duty with full emoluments benefit therefore alongwith other consequential benefits.

6) Where a Corporation employee under suspension is acquitted by a Court of Law and the order re-instating him is passed sometime after the date of acquittal, full pay and allowances have to be paid from the date of acquittal to the date of rejoining duty and the period counted as duty for all purposes whereas for the period from the date of suspension, removal, dismissal to the date of acquittal, he is to be allowed pay and allowances as directed by the competent authority.

NOTE:-

Every employee under suspension without payment of subsistence allowance is expected to make deligent efforts to provide due information regarding any amount earned during the period of suspension to the employer, so that at the time of settling the matter of arrears for the period of suspension, deduction has to be made for whatever amount may have been earned by the employee during that period.

PART-X

PUNISHMENT AND APPEALS.

10.1 Punishment and Appeal Rules, 1987, as contained in the Punjab Civil Services Rules, Vol.I, Part II and as amended by Haryana Government form time to time shall be applicable to the officers/officials of this corporation.

10.2 Appeals against adverse remarks recorded in Confidential Report.

New Rule 10.2 inserts vide 17th amendment approved by the BOD in their 88th meeting held on 7.12.87 amendment at page 98 (17th amendment).

PART-XI

MISCELLANEOUS PROVISIONS.

11.1 INCENTIVE FOR ACQUISITION OF HIGHER QUALIFICATIONS.

1) As a general policy, the Corporation will courage its employees to improve their qualifications. For this, not only selected employees would be frequently nominated to sponsored courses of study, both, refresher as well as specialized ones but permission will liberally be granted to the employees with not less than 5 years service in the Corporation, to join higher course, the only considerations being that:-

i) the record of the employee seeking such permission is reasonable meritorious; and

ii) the normal work assigned to the employee is not likely to suffer by his/her pursuing the higher course of study.

2) As for the grant of leave, unless there be very exceptional circumstances, it should invariably be allowed for the actual days of examination and also fro a period of upto a fortnight in advance for preparation; if the exigencies of work so permit.

*3)As an incentive, the Corporation employees improving their qualifications after joining the service of the Corporation, personal pay shall be granted to them on the scale indicated hereafter where the said qualifications are higher than the minimum qualification prescribed for the post occupied by the said employee, and it is acquired from a recognized university.

*4) `The scales for the grant of personal pay will be in terms of increments for the post as under:-

Provided that the maximum benefit admissible to any employee will not exceed equivalent of four increments.

*5) The above benefit will be available to an employee for a period of 5 years from the month after the declaration of the result and shall be governed by the increment admissible at that stage of service.

*6)The payment of the benefit is irrespective of the maximum pay of the time scale for the said employee and shall be admissible even after the employee has reached the maximum of the grade.

*7)The benefit of personal pay will be available to an employee once during the entire service career.

11.2 STUDY LEAVE.

The employee of the Corporation may be allowed special leave by the Board for higher study, whether in India or abroad, on the same terms and conditions as applicable to Haryana Government employees.

11.3 EX-GRATIA PAYMENT TO THE EMPLOYEES WHO DIE WHILE IN THE SERVICE OF THE CORPORATION.

Where an employee with at least 5 years’ continuous service in the Corporation dies, his dependents shall be paid such ex-gratia benefits as are admissible to the employees of Haryana Government.

11.4 POWER OF RELAXATION .

Where the Board is of the opinion that the application of these bye-laws or any particular provision thereof is likely to cause substantial hardship in the case of any individual employee, it may for reason to be recorded, relax the operation of the Service Bye-Laws or the particular provisions thereof, as the case may be, to that extent.

11.5 INTERPRETATION .

Where-ever the provisions made in these service Bye-Laws at any stage are found to be not clear

or silent, the rules/instructions as applicable in Haryana Government in Irrigation Department, shall be applied.

11.6 REPEAL AND SAVING CLAUSE .

1) Promotion Rules for appointment to the posts of Assistant Engineers and Executive Engineers in the services of HSMITC 1979 are hereby repealed.

2) Any order made or action taken prior to the promulgation of these bye-laws shall be deemed to have been taken under under the corresponding provisions of these bye-laws.
