Beginning of asbestos regulation according to the prefecture ordinance

(1) Background   Tons of asbestos are thought to have been released into the air during and after

the Great Hanshin Awaji Earthquake. The concern of the air pollution led to the introduction of regulation system for the prevention of scattering dust & asbestos by Hyogo prefecture prior to the national government

(2) Progress July 18, 1995 Revise “Ordinance on Conservation and Development of the

Environment”  Jan. 17, 1996 Commencement(3) Contents ・ Give the duty to submit notification on execution of demolition work of special

structures   (target) 1) demolish work of structure with total floor space of demolition exceeding

1,000m2

       2) demolish work or renovation of structure using special materials containing asbestos (spraying asbestos or heat retaining material)

 ・ Comply with the dust & asbestos scattering prevention standard  ・ Give recommendations or orders when the standard is not met, establish

necessary penal provisions when violation of order is observed and make an on-the-spot inspection

Strengthening of regulations by revision of ordinance

(1) Background   Health damage of the surroundings of asbestos products

manufacturing plant became an issue. The suspected threat of scattering of asbestos when structures containing non-scattering asbestos are demolished led to the strengthening of regulations

(2) Progress ・ On November 1, 2005 “Ordinance on Conservation and

Development of the Environment” was revised and regulation was strengthened.

(3) Contents ・ Add the target for regulation  (Target)   3) Demolition work of structures when the total floor area of demolition exceeds 80m2 or more and use asbestos containing materials as well

Regulation under the Law

○May 9, 1996 Revision of Air Pollution Control Law

  Any demolition, renovation or modification work of structures meeting certain requirements of using spraying asbestos requires advance reporting. Obedience of the operation standard is stipulated ( Enforced on April 1, 1997 )

○December 21, 2005 Revision of the Order for Enforcement    Add insulating materials, heat retaining materials and fireproof coating

materials containing asbestos as special construction materials. Eliminate conditions like scale for special dust removal work etc.

( Enforced on Mar. 1, 2006 )

○August 11, 2006 Revision of Act

  Require prevention measure against scattering generated in demolition work of construction using asbestos ( Enforced on Oct. 1, 2006 )

○June 21, 2013 Revision of Act

   Strengthen prevention of scattering standard etc. ( June 1, 2014 )
