Recent legalization in the states of Washington, Colorado, District of Columbia, Alaska, and Oregon have caused an excitement and buzz around medical marijuana in the United States unlike any other place in the world.

The memo stated that they would only enforce marijuana laws when one of the following things occurred:

CHAPTER 1-MEDICAL MARIJUANA VS. RECREATIONAL MARIJUANA

Medical Marijuana and Recreational Marijuana are two very different things.

The legal use of medical marijuana began in California in the year 1996, and since that time has expanded to now 25 states in America, as well as the District of Columbia.

Although the medical marijuana laws differ greatly from state to state, for the most part, they allow for cultivation and the sale of cannabis to state approved patients.

Recreational cannabis on the other hand, does not require a doctor’s recommendation to obtain.

In Colorado anyone over the age of 21 can legally obtain and use cannabis, even out-of-state visitors.

Washington is also a recreational state although it is lagging behind in the development of its program.

Alaska, Oregon, and District of Columbia are also recreational cannabis states.

(Many More Recreational States Are Expected To Jump On Board Soon As Well)

The laws in Colorado and Washington in regards to recreational cannabis do vary in ways such as:

Colorado allows residents of the state that are 21 years or older to purchase up to 1 ounce of cannabis per transaction, and out of state visitors over the age of 21 to purchase up to 1/4 ounce of cannabis per transaction.

Washington on the other hand allows adults 21 years of age and older to possess 1 ounce of cannabis regardless of residency.

In Colorado, those who are interested in opening a licensed recreational retail store can be awarded an unlimited amount of licenses to do so. In other words, a Starbucks of recreational marijuana can be accomplished in Colorado.

Although recent laws have slowed this down in Colorado as licenses are not being handed out as freely.

Washington, in regards to recreational licenses limits it at 3 licenses maximum per company

There are 344 licenses for recreational pot shops in Washington.

In Colorado the growing of marijuana at a persons residence is allowed as long as the limit is 6 plants per person.

In Washington home growing is allowed for medical purposes but the plant limits have not been established. Some areas do not allow home growing.

Some people in states like Washington are concerned that the laws will require them to purchase their cannabis at a recreational store, rather than growing it at home.

Many patients prefer to grow their own and find it much more affordable to do so than buying it at recreational shops where the government puts a heavy tax on each sale.

CHAPTER 2-MEDICAL MARIJUANA STATES & CANNABIS POSSESSION LIMITS

The following states have enacted laws to legalize medical marijuana in America (as of 2017) and the possession limits for each are listed as well:

◉ Alaska (Use, possession and cultivation of medical cannabis is legal for patients with written documentation of their medical need from their physician. The law establishes a state registry for identification cards. Patients can possess no more than one ounce of useable cannabis and cultivate no more than six cannabis plants – with no more than three of those plants fully matured) *(Newly Recreational State as well)

◉ Arizona (2.5 ounces of usable cannabis, 0 to 12 plants). Patients with written physician identification can use and possess no more than two and half ounces of useable cannabis. Patients can obtain a state-issued identification card. Patients who live more than 25 miles from a state-licensed cannabis dispensary may cultivate no more than 12 cannabis plants in an “enclosed and locked” facility.

◉ California (8 ounces of usable cannabis, 6 mature or 12 immature plants) (although this is the minimum, some cities allow greater amounts) Use, possession and cultivation of medical cannabis are legal for patients with “written or oral recommendation” by their physicians. In 2004, amendments were made to limit the amount of possession to no more than eight ounces and/or six mature (or 12 immature) cannabis plants. However, if patients demonstrate an extra need by their doctors, higher quantities may be allowed, depending on the county and municipality.

◉ Colorado (2 ounces of usable cannabis, 6 plants, 3 mature, 3 immature) Use, possession and cultivation are legal for patients with written physician-approved documentation. Patients may possess no more than two ounces and may cultivate no more than six plants. Patients can obtain a state-issued identification card. State dispensaries must be licensed and in compliance with zoning laws. *(And recreational cannabis is legal for those 21 years and older)

◉ Connecticut (One Month Supply allowed, amount to be determined) (Home cultivation not allowed yet)

◉ Washington DC (2 ounces of dried cannabis, limits not yet determined on other forms of cannabis such as edibles or wax) (home cultivation illegal still) Medical marijuana dispensaries in DC can be non-profit or for-profit and can only grow up to 95 plants on site. *Recreational Cannabis Laws as well

◉ Delaware (6 ounces of usable cannabis) (home cultivation is illegal even for medical marijuana patients in need in Delaware)

◉ Hawaii (3 ounces of usable cannabis, 7 plants of which 3 can be mature and 4 can be immature) Residents may use, possess and cultivate medical cannabis if they have a signed statement from their physician. Patients may possess up to three ounces at a time and can grow no more than seven plants with only three of those plants mature. Patients must obtain a state-issued identification card.

◉ Illinois (2.5 ounces of usable cannabis during a period of 14 days) (home cultivation still illegal at this time)

◉ Maine (2.5 ounces of usable cannabis, and 6 plants) Use, possession and cultivation are legal. Patients must obtain written recommendation from their physician. Patients cannot possess more than two and a half ounces, and may cultivate no more than six cannabis plants with only three mature plants. The law establishes a state registry and identification card system, and allows the sale of medical cannabis in state-licensed, non-profit dispensaries. The state recently eliminated local penalties for possession of up to two and half ounces for all residents, not only patients.

◉ Maryland (30 day supply, amount to be determined)

◉ Massachusetts (60 day supply for personal medical use) (Decriminalized) (Patients in Mass will no longer be able to grow cannabis once the dispensaries open their doors for business, unless the patient has what is called a “hardship license”. The hardship license is dependent on being able to demonstrate an inability on the patient’s part to afford, or travel to dispensaries to purchase their cannabis.)

• 1 oz. or less = violation • No jail time / $100 fine • More than 1 oz. = misdemeanor • Up to 6 months in jail / $500 fine • More than 1 oz. (2nd offense) = misdemeanor • Up to 6 months in jail / $500 fine • There are some dispensaries open in Massachusetts now and many

more to come. Many growers are growing in Massachusetts as the laws are slowly being changed.

◉ Michigan (2.5 ounces of usable cannabis, 12 plants) Use, possession and cultivation are legal with written physician authorization. Patients cannot cultivate more than 12 cannabis plants, and they must be kept in an enclosed, locked facility. Patients can only possess 2.5 ounces of usable cannabis. The law establishes a state registry that issues identification cards.

◉ Missouri (decriminalized) If caught with 10 grams or less of marijuana it will result in no jail time.

◉ Montana (1 ounce of usable cannabis, 4 mature plants and 12 seedlings)

◉ Nevada (1 ounce of usable cannabis, 7 plants, 3 mature, 4 immature) Use, possession and cultivation are legal with written documentation from a physician. Patients cannot possess more than one ounce of usable cannabis, and may cultivate no more than seven plants with only three of those mature. A state registry is established to disburse ID cards.

◉ New Hampshire (2 ounces of usable cannabis during a ten day period, 1 mature plant)

◉ New Jersey (2 ounces of usable cannabis) Legal protection is offered to state-authorized patients. They can only possess up to two ounces of marijuana per month. No cultivation is allowed. Six state-licensed “alternative treatment” centers are to be created. Some are open already.

◉ New Mexico (6 ounces of usable cannabis, 16 plants, 4 mature and 12 immature) Patients must register with the state Department of Health with a state-authorized condition. Patients may legally possess six ounces of medical cannabis (or more if a physician approves) and/or 16 plants (four mature, 12 immature). State-licensed facilities can grow up to 150 plants.

◉ Oregon (24 ounces of usable cannabis, 24 plants, 6 mature, 18 immature) Use, possession and cultivation are legal. Written physician approval is required. Patients can possess no more than 24 ounces of usable cannabis, and may cultivate no more than six mature plants and/or 18 seedlings. The plants must be grown in one location, and patients must have been diagnosed for at least a year before growing (in order to use “affirmative defense”). A state registry is established to disburse identification cards. *Recreational Cannabis Laws as Well!

◉ Rhode Island (2.5 ounces of usable cannabis, 12 plants) Use, possession and cultivation are legal. Written physician approval is required. Patients can only possess up to 2.5 ounces of cannabis and cultivate up to 12 plants. Their cannabis must be stored in an indoor facility. Patients must register with the state and obtain an identification card. There are some dispensaries in Rhode Island for patients.

◉ Vermont (2 ounces of usable cannabis, 9 plants, 2 mature, 7 immature)

◉ Washington (24 ounces of usable cannabis, 15 plants) *And recreational cannabis is legal for those 21 years and older

WHICH STATES ALLOW HOME CULTIVATION OF MARIJUANA FOR PATIENTS OR CAREGIVERS? Growing cannabis indoors is allowed for patients or caregivers in the following states in America:

Cannabidiol Laws (CBD)

Some states in America are finally realizing that CBD-Rich strains of cannabis can be extremely helpful for treating various medical conditions.

CBD-rich strains contain very low levels of THC and are not psychoactive.

Here are some states in America who have passed CBD Laws.

On Mar. 21, 2014, Utah Governor Gary Herbert signed HB 105 (80 KB), known as "Charlee's Law," which allows the use and possession of marijuana extract, under certain conditions, by people with intractable epilepsy who have a statement signed by a neurologist. The extract must be composed of less than 0.3% tetrahydrocannabinol (THC) and at least 15% cannabidiol (CBD) by weight, and may not contain any other psychoactive substance. The law goes into effect on July 1, 2014. The extract must be obtained in a sealed container from a laboratory that is licensed in the state where it was produced, with a label stating the extract's ingredients and origin, and transmitted by the laboratory to the Utah Department of Health.

The Utah Department of Health is required to determine the details of the registration program.

On Apr. 1, 2014, Alabama Governor Robert Bentley signed SB 174 (33 KB), known as "Carly's Law," which allows an affirmative defense against prosecution for CBD possession by people suffering from a debilitating epileptic condition. The law states "a prescription for the possession or use of cannabidiol (CBD) as authorized by this act shall be provided exclusively by the UAB [University of Alabama at Birmingham] Department for a debilitating epileptic condition." Since marijuana is illegal under federal laws, doctors are not allowed to write "prescriptions" for it. The states that have legal medical marijuana allow doctors to "recommend" it.

On Apr. 10, 2014, Kentucky Governor Steve Beshear signed SB 124 (70 KB). The law excludes from the definition of marijuana the "substance cannabidiol, when transferred, dispensed, or administered pursuant to the written order of a physician practicing at a hospital or associated clinic affiliated with a Kentucky public university having a college or school of medicine."

On Apr. 16, 2014, Wisconsin Governor Scott Walker signed AB 726 (120 KB), which states that "any physician may provide an individual with a hard copy of a letter or other official documentation stating that the individual possesses cannabidiol to treat a seizure disorder if the cannabidiol is in a form without a psychoactive effect." A release from the Governor's office characterizes the law as "clearing the way for a new treatment for children suffering from seizure disorders, pending FDA approval."

On Apr. 17, 2014, Mississippi Governor Phil Bryant signed HB 1231 (180 KB), known as "Harper Grace's Law," which allows for cannabis extract, oil, or resin that contains more than 15% CBD and less than 0.5% THC. "The CBD oil must be obtained from or tested by the National Center for Natural Products Research at the University of Mississippi and dispensed by the Department of Pharmacy Services at the University of Mississippi Medical Center." The law also provides an affirmative defense for defendants suffering from a debilitating epileptic condition who accessed the CBD oil in accordance with the requirements set forth in the bill and is effective July 1, 2014.

Cannabis growers who know how to grow marijuana that has high levels of CBD can carve out a nice niche for themselves.

Marijuana Laws Around The World:

Many other areas of the world have favorable cannabis laws or tolerate it to some degree.

In 2013, Uruguay fully legalized the distribution, production, and sale of marijuana across the entire country! Way to go Uruguay!

Here are some parts of the world where marijuana is either in some way legal, or is not completely illegal and being caught with it does not always result in an automatic fine or incarceration.

Argentina-Marijuana is decriminalized in Argentina in that it is legal in small amounts for personal use and consumption in private locations such as in a home.

Australia-Residents of the Australian Capital Territory and South Australia are allowed to grow one or two cannabis plants for personal use. Those who live in the Northern Territory of Australia are allowed to grow up to two cannabis plants for personal grows.

Belgium-Marijuana is decriminalized in Belgium. Adults 18 years of age and older may possess up to 3 grams of cannabis or have one female plant in their residence.

Belize-Although technically illegal, cannabis use in Belize is very common and is mostly tolerated by the authorities, as long as it is not in excessive quantities.

Brazil-Similarly to Belize, cannabis use in Brazil is illegal, but mostly tolerated, as long as it is in small amounts and in private areas.

Cambodia-Many residents and foreign visitors enjoy the use of cannabis in Cambodia. Although technically illegal, marijuana can be purchased and smoked even in public in many parts of Cambodia without threat of arrest.

Canada-In Canada, the use of, and cultivation of cannabis are very common. Although in some ways still illegal, it is legal for medical purposed and can be grown legally with a license to grow from the government. There are currently licensed growers who operate large-scale cannabis gardens and legally ship by mail cannabis to registered patients throughout the country.

Columbia-The cannabis laws in Columbia are a bit odd. The use of cannabis is decriminalized for possession of up to 22 grams for personal use. But the sale of cannabis and growing of cannabis remains illegal.

Costa Rica-The use of marijuana is prevalent in Costa Rica. It is illegal by law, yet extremely popular amongst residents. Rightfully and logically so, those carrying only a small amount of cannabis will not be detained by police officers in Costa Rica.

Croatia-Although somewhat decriminalized, Croatia still has some tough laws in regards to marijuana. Being caught with a small amount of marijuana is a misdemeanor resulting in a fine of $800 to $3500. And worst of all, the authorities will take your weed! (And probably smoke it)

Czech Republic-The possession of up to 15 grams of marijuana for personal use, and the growing of up to 5 marijuana plants is a misdemeanor crime.

Ecuador-Having less than 10 grams of cannabis in ones possession is legal in Ecuador.

Estonia- Having 10 grams of marijuana in Estonia is punishable by a small monetary fine.

Iran-In Iran, it is legal to cultivate cannabis as long as it is being grown for the purpose of food. The people in Iran often use the oil in cannabis seeds as food.

Israel-Personal use of cannabis in Israel is decriminalized. First time offenders receive little or even no fine at all.

Italy-Although cannabis is somewhat decriminalized in Italy; it still remains a strict country to be caught with it. Possession of even just small amounts of cannabis is considered a misdemeanor crime and will result in a suspension of ones drivers license or passport.

Jamaica-Many people use cannabis in Jamaica on a daily basis. Cannabis is sold all over the country and is generally tolerated by authorities as long as it is on a small scale. But, the growing of, consumption of, and sale of cannabis are still illegal by Jamaican law.

Mexico-Those caught with up to 5 grams of cannabis will receive no penalty at all, since Mexico decriminalized personal use in the year 2009. But the sale of and cultivation of cannabis in Mexico is still illegal.

Netherlands-The Netherlands has always been known as a cannabis-friendly country. Coffee shops sell cannabis legally to residents and visitors in amounts up to 5 grams.

Pakistan-Cannabis often grows wild in Pakistan without any enforcement from the authorities.

Hash and cannabis are commonly used for spiritual and medicinal reasons and are generally tolerated by the government.

Peru-The possession of up to 8 grams of cannabis is legal in Peru.

Portugal-The use of all drugs in Portugal is legal and a choice. People can still be arrested if they are caught many times using drugs. The system looks at drug users as being sick, as opposed to being criminals.

Russia-People in Russia can grow up to 20 cannabis plants and receive only a small monetary fine if caught by authorities and no jail time. They can also possess up to 6 grams of cannabis or hash and it can result in a fine, with no time spent in jail.

Spain-Growing marijuana on private property for personal use, and its consumption by adults in a private space is 100% legal throughout Spain! Although selling marijuana and using it in a public place can result in a fine, misdemeanor arrest, and the cops will steal your weed!

Switzerland- Growing of up to 4 cannabis plants at home is legal in Switzerland.

Uruguay-The production and sale of marijuana in Uruguay is 100% legal, although amounts and limits have not been determined yet.

CHAPTER 3-CHALLENGES FOR THE CANNABIS ENTREPRENEUR

Before we get into the many awesome opportunities in the booming cannabis industry, it is only right to mention some of the potential hurdles that may arise for investors looking to jump into the “Green Rush”.

Here are some pitfalls that may present a few challenges for cannabis investors:

Banking Unfortunately, due to the federal governments classification of cannabis as a Schedule 1 Narcotic, with no medicinal value, banks typically do not want to touch anything to do with the industry.

The ability to set up a business bank account and to accept credit cards can be of great difficulty for any cannabis business operator.

Although cannabis is becoming more and more accepted in the United States, it is still considered illegal under federal law.

The Internal Revenue Service has a civil tax code section 280E that states, “No deductions or credit are allowed for any amount incurred in a business that consists of trafficking controlled substances prohibited by federal law.

Because of the 280E code, many cannabis cultivators and businesses are unable to pay taxes on their net income like most businesses do, and instead have to pay taxes on their gross income.

Cannabis laws vary from state to state and a professional accountant can help with the 280E Tax code.

If you plan on operating a cannabis business, it is important to deal with these problems up front, and figure out legal ways to decrease your out-of-pocket taxes.

Some things that are advisable for anyone interested to do are:

◉ Hire a Professional Accountant & Attorney

◉ If operating a dispensary, try to decrease the square footage that is used for cannabis sales and add in some non-cannabis activities such as “massage services, spa treatments, yoga studio, grow classes”.
