AN ACT concerning 1

Alcoholic Beverages – Modern Brewery License 2

FOR the purpose of establishing a Class 10 modern brewery license; authorizing the license 3

holder to establish and operate a brewery for certain activities and import beer from 4

a certain person; authorizing a license holder to contract with or on behalf of a certain 5

person to perform certain activities; authorizing a license holder to brew, blend, or 6

package beer and to sell and deliver beer under certain circumstances; authorizing 7

a license holder to serve samples of beer under certain circumstances and to sell beer 8

for off–premises consumption under certain circumstances; specifying certain 9

amounts of beer that the license holder may sell annually for on–premises 10

consumption under certain circumstances; authorizing a license holder to sell or 11

serve certain foods; specifying certain persons that may not act as a caterer of food; 12

providing hours of sale for beer sold for on–premises consumption; providing that 13

this Act does not limit the application of a certain statute to certain activities; 14

authorizing the license holder to store certain beer under certain circumstances; 15

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF MARYLAND, 24

That the Laws of Maryland read as follows: 25

Article – Alcoholic Beverages 26

2–130. 27

(a) In this section, “limited permit holder” means a person who holds a brewing 28

company off–site permit and also holds a manufacturer’s license for: 29

(1) a Class 5 brewery that produces less than 3,000 barrels a year; 30

(2) a Class 7 micro–brewery that produces less than 3,000 barrels a year; 31

[or] 32

(3) a Class 8 farm brewery; OR 33

(4) A CLASS 10 MODERN BREWERY. 34

(b) There is a brewing company off–site permit. 35

(c) The Comptroller may issue the permit to: 1

(1) a Class 5 brewery; 2

(2) a Class 7 micro–brewery; [or] 3

(3) a Class 8 farm brewery; OR 4

(4) A CLASS 10 MODERN BREWERY. 5

(d) During an event listed in subsection (f) of this section, a limited permit holder 6

may: 7

(1) provide to a consumer a sample of beer that has been produced by the 8

limited permit holder and that may not exceed 1 fluid ounce for each offering; 9

(2) sell to a consumer up to 288 ounces of beer that has been produced by 10

the limited permit holder for off–premises consumption; and 11

(3) except for farmers’ markets listed in subsection (f) of this section, sell 12

to a consumer up to 288 ounces of beer that is produced by the limited permit holder for 13

on– and off–premises consumption. 14

(e) While selling beer or providing samples of beer at a farmers’ market as 15

provided in subsection (f) of this section, a limited permit holder shall have an agent present 16

who is certified by an approved alcohol awareness program. 17

(f) Except as otherwise authorized under subsection (g) of this section, a limited 18

permit holder may use the brewing company off–site permit only: 19

(1) at the Montgomery County Agricultural Fair; 20

(2) at the Maryland State Agricultural Fair; 21

(3) at the Frederick County Agricultural Fair; 22

(4) one night each week from June through November at the North Beach 23

Friday Night Farmers’ Market; 24

(5) for up to seven events, at an event that has as its major purpose an 25

activity: 26

(i) that is other than the sale and promotion of alcoholic beverages; 27

and 28

(ii) for which the participation of a brewing company is a subordinate 1

activity; and 2

(6) at other farmers’ markets that are listed on the Farmers’ Market 3

Directory of the Maryland Department of Agriculture. 4

(g) A person that holds a brewing company off–site permit may use the permit at 5

a nonprofit beer festival that: 6

(1) has as its primary purpose the promotion of Maryland beer; and 7

(2) is authorized by a local licensing board under § 2–131 of this subtitle. 8

(h) (1) No later than the 20th day of the month preceding the off–site event, 9

the permit holder shall notify the Comptroller of the permit holder’s intention to attend an 10

off–site event. 11

(2) The notice shall be on a form that the Comptroller provides. 12

(i) The permit is valid for 1 year. 13

(j) An applicant shall submit an application for the permit to the Comptroller on 14

a form that the Comptroller provides. 15

(k) The permit fee is $100. 16

(A) THERE IS A CLASS 10 MODERN BREWERY LICENSE. 18

(B) THE LICENSE HOLDER MAY: 19

(1) SUBJECT TO SUBSECTION (C) OF THIS SECTION, ESTABLISH AND 20

OPERATE A BREWERY FOR BREWING, BLENDING, AND PACKAGING BEER AT THE 21

LOCATION DESCRIBED IN THE LICENSE; AND 22

(2) IMPORT BEER FROM A HOLDER OF A NONRESIDENT DEALER’S 23

PERMIT. 24

(C) IF THE LICENSE IS ISSUED FOR USE ON A FARM, THE LICENSE HOLDER 25

SHALL MANUFACTURE BEER USING AT LEAST ONE INGREDIENT GROWN ON THE 26

FARM, SUCH AS HOPS, GRAIN, OR FRUIT. 27

(D) THE LICENSE HOLDER MAY CONTRACT WITH OR ON BEHALF OF A 1

HOLDER OF A MANUFACTURER’S LICENSE OR NONRESIDENT DEALER’S PERMIT TO 2

BREW AND PACKAGE BEER THAT: 3

(1) MAY BE SOLD AND DELIVERED ONLY BY THE LICENSE HOLDER; 4

(2) SHALL BE COUNTED AGAINST ANY BARRELAGE LIMITATION ON 5

THE OWNER OF THE BEER; AND 6

(3) SHALL BE TAXED IN ACCORDANCE WITH § 5–301(B) OF THE 7

TAX – GENERAL ARTICLE. 8

(E) THE LICENSE HOLDER MAY: 9

(1) BREW, BLEND, OR PACKAGE BEER AT: 10

(I) A BREWERY FOR WHICH A LICENSE HAS BEEN ISSUED; OR 11

(II) A LOCATION FOR WHICH THE LICENSE HOLDER HAS BEEN 12

ISSUED AN INDIVIDUAL STORAGE PERMIT, IF: 13

1. THE LICENSE HOLDER DOES NOT SERVE OR SELL THE 14

LICENSE HOLDER’S PRODUCTS TO THE PUBLIC AT THE STORAGE LOCATION; AND 15

2. THE COMPTROLLER HAS FULL ACCESS AT ALL TIMES 16

TO ENFORCE THIS SECTION; 17

(2) SELL AND DELIVER BEER TO: 18

(I) A HOLDER OF A WHOLESALER’S LICENSE THAT IS 19

AUTHORIZED TO ACQUIRE BEER; OR 20

(II) A PERSON OUTSIDE THE STATE THAT IS AUTHORIZED TO 21

ACQUIRE BEER; 22

(3) SERVE, FOR A FEE OR AT NO CHARGE, SAMPLES OF BEER BREWED 23

BY THE LICENSE HOLDER FOR ON–PREMISES CONSUMPTION, WITH EACH SAMPLE 24

CONSISTING OF NOT MORE THAN 4 OUNCES FROM A SINGLE STYLE OF BEER, TO AN 25

INDIVIDUAL WHO HAS ATTAINED THE LEGAL DRINKING AGE; 26

(4) SELL, FOR OFF–PREMISES CONSUMPTION, BEER THAT IS BREWED 27

BY THE LICENSE HOLDER: 28

(I) AS PREPACKAGED BEER IN A NONREFILLABLE CONTAINER, 1

WITH A MAXIMUM AMOUNT OF 288 OUNCES OF BEER FOR EACH INDIVIDUAL; OR 2

(II) IN A SEALED REFILLABLE CONTAINER THAT: 3

1. MAY BE RETURNED FOR REFILLING; AND 4

2. SHALL BE SEALED BY THE LICENSE HOLDER WHEN 5

REFILLED; 6

(5) SELL ANNUALLY, FOR ON–PREMISES CONSUMPTION: 7

(I) NOT MORE THAN 4,000 BARRELS OF BEER THAT IS BREWED 8

BY THE LICENSE HOLDER; AND 9

(II) AN AMOUNT IN EXCESS OF 4,000 BARRELS THAT IS BREWED 10

BY THE LICENSE HOLDER, IF THE LICENSE HOLDER FIRST PURCHASES THAT 11

AMOUNT FROM A LICENSED WHOLESALER; AND 12

(6) SELL OR SERVE: 13

(I) BREAD AND OTHER BAKED GOODS; 14

(II) CHILI; 15

(III) CHOCOLATE; 16

(IV) CRACKERS; 17

(V) CURED MEAT; 18

(VI) FRUITS (WHOLE AND CUT); 19

(VII) HARD AND SOFT CHEESE (WHOLE AND CUT); 20

(VIII) SALADS AND VEGETABLES (WHOLE AND CUT); 21

(IX) ICE CREAM; 22

(X) JAM; 23

(XI) JELLY; 24

(XII) VINEGAR; 1

(XIII) PIZZA; 2

(XIV) PREPACKAGED SANDWICHES AND OTHER PREPACKAGED 3

FOODS READY TO BE EATEN; 4

(XV) SOUP; 5

(XVI) CONDIMENTS; AND 6

(XVII) IF THE LICENSE HOLDER OBTAINS A CLASS B OR CLASS D 7

LICENSE FROM THE LOCAL LICENSING BOARD, OTHER FOOD THAT MAY BE SOLD 8

UNDER THE CLASS B OR CLASS D LICENSE. 9

(F) (1) A CATERER IS NOT LIMITED TO SELLING OR SERVING ONLY THE 10

FOODS SPECIFIED IN SUBSECTION (E)(7) OF THIS SECTION. 11

(2) A LICENSE HOLDER OR ENTITY IN WHICH THE LICENSE HOLDER 12

HAS A FINANCIAL INTEREST MAY NOT ACT AS A CATERER OF FOOD. 13

(G) UNLESS OTHERWISE DETERMINED BY A LICENSE ISSUED BY A LOCAL 14

LICENSING BOARD, THE HOURS OF SALE FOR BEER SOLD FOR ON–PREMISES 15

CONSUMPTION ARE: 16

(1) FROM 10 A.M. TO 10 P.M. ON SUNDAY THROUGH THURSDAY; AND 17

(2) FROM 10 A.M. TO MIDNIGHT ON FRIDAY AND SATURDAY. 18

(H) THIS SECTION DOES NOT LIMIT THE APPLICATION OF THE RELEVANT 19

PROVISIONS OF TITLE 21 OF THE HEALTH – GENERAL ARTICLE, AND REGULATIONS 20

ADOPTED UNDER THAT TITLE, TO THE LICENSE HOLDER. 21

(I) THE LICENSE HOLDER MAY STORE, IN A SEGREGATED AREA APPROVED 22

BY THE COMPTROLLER: 23

(1) BEER PRODUCED AT THE BREWERY FOR SALE AND DELIVERY TO A 24

WHOLESALER LICENSED IN THE STATE OR A PERSON OUTSIDE THE STATE 25

AUTHORIZED TO ACQUIRE THE BEER; AND 26

(2) THE PRODUCTS OF OTHER HOLDERS OF MANUFACTURER’S 27

LICENSES TO BE USED AT TRADE ASSOCIATION ACTIVITIES, IF RECORDS ARE 28

MAINTAINED AND REPORTS FILED AS THE COMPTROLLER REQUIRES. 29

(J) (1) A LICENSE HOLDER WHOSE LICENSED PREMISES IS A FARM MAY 1

SPONSOR AT THE FARM A MULTIBREWERY ACTIVITY THAT: 2

(I) INCLUDES THE PRODUCTS OF OTHER BREWERIES IN THE 3

STATE; AND 4

(II) PROVIDES FOR THE SALE OF BEER BY THE GLASS FOR 5

ON–PREMISES CONSUMPTION. 6

(2) A LICENSE HOLDER MAY STORE THE PRODUCTS OF OTHER 7

BREWERIES IN THE STATE FOR THE MULTIBREWERY ACTIVITY IN A SEGREGATED 8

AREA APPROVED BY THE COMPTROLLER. 9

(3) THE MULTIBREWERY ACTIVITY: 10

(I) MAY BE HELD FROM 10 A.M. TO 10 P.M. EACH DAY; AND 11

(II) MAY NOT EXCEED 3 CONSECUTIVE DAYS. 12

(K) (1) THE COMPTROLLER MAY ISSUE A BREWERY PROMOTIONAL 13

EVENT PERMIT TO THE LICENSE HOLDER. 14

(2) AT LEAST 15 DAYS BEFORE HOLDING A PLANNED PROMOTIONAL 15

EVENT, THE LICENSE HOLDER SHALL OBTAIN A PERMIT FROM THE COMPTROLLER 16

BY FILING A NOTICE OF THE PROMOTIONAL EVENT ON THE FORM THAT THE 17

COMPTROLLER PROVIDES. 18

(3) THE PERMIT AUTHORIZES THE LICENSE HOLDER TO CONDUCT A 19

PROMOTIONAL EVENT AT WHICH THE LICENSE HOLDER MAY: 20

(I) PROVIDE SAMPLES OF NOT MORE THAN 6 FLUID OUNCES 21

PER BRAND TO CONSUMERS; AND 22

(II) SELL BEER PRODUCED BY THE LICENSE HOLDER TO 23

PERSONS WHO PARTICIPATE IN THE EVENT. 24

(4) THE BEER AT THE EVENT SHALL BE SOLD BY THE GLASS AND FOR 25

ON–PREMISES CONSUMPTION. 26

(5) THE LICENSE HOLDER MAY NOT BE ISSUED MORE THAN 24 27

PERMITS IN A CALENDAR YEAR. 28

(6) A SINGLE PROMOTIONAL EVENT: 1

(I) MAY BE HELD FROM 10 A.M. TO MIDNIGHT; AND 2

(II) MAY NOT EXCEED 3 CONSECUTIVE DAYS. 3

(7) THE PERMIT FEE IS $25 PER EVENT. 4

(L) (1) THE LICENSE HOLDER MAY BE ISSUED: 5

(I) A CLASS 7 LIMITED BEER WHOLESALE LICENSE; AND 6

(II) ONE OR MORE LICENSES BY A LOCAL LICENSING BOARD. 7

(2) A LICENSE HOLDER THAT OBTAINS MORE THAN TWO CLASS B OR 8

CLASS D LICENSES MAY NO LONGER HOLD A CLASS 7 LIMITED BEER WHOLESALER’S 9

LICENSE. 10

(M) A LICENSE HOLDER THAT OBTAINS A CLASS B LICENSE MAY NOT 11

PRODUCE MORE THAN 45,000 BARRELS OF BEER ANNUALLY. 12

(N) A HOLDER OF A CURRENT LICENSE THAT IS A CLASS 5 BREWERY, CLASS 13

6 PUB–BREWERY, CLASS 7 MICRO–BREWERY, OR CLASS 8 FARM BREWERY LICENSE 14

MAY: 15

(1) KEEP THE CURRENT LICENSE; 16

(2) IN ADDITION TO THE CURRENT LICENSE, OBTAIN A CLASS 10 17

MODERN BREWERY LICENSE; OR 18

(3) EXCHANGE THE CURRENT LICENSE FOR A CLASS 10 MODERN 19

BREWERY LICENSE. 20

(O) (1) THE ANNUAL LICENSE FEE IS: 21

(I) $200, IF: 22

1. THE LICENSED PREMISES IS A FARM; OR 23

2. THE LICENSE HOLDER PRODUCES NOT MORE THAN 24

5,000 BARRELS ANNUALLY; 25

(II) $500, IF THE LICENSE HOLDER PRODUCES AT LEAST 5,001 26

BARRELS AND NOT MORE THAN 20,000 BARRELS ANNUALLY; AND 27

(III) $1,500, IF THE LICENSE HOLDER PRODUCES AT LEAST 1

20,001 BARRELS ANNUALLY. 2

(2) A LICENSE HOLDER THAT EXCHANGES A CLASS 5 BREWERY, 3

CLASS 6 PUB–BREWERY, CLASS 7 MICRO–BREWERY, OR CLASS 8 FARM BREWERY 4

LICENSE FOR A CLASS 10 MODERN BREWERY LICENSE IS ENTITLED TO A FEE CREDIT 5

IN AN AMOUNT EQUAL TO THE FEE PAID FOR THE LICENSE THAT IS EXCHANGED. 6

(a) (2) The holder of a distillery, rectifying, winery, limited winery, brewery, 8

[or] farm brewery, OR MODERN BREWERY license may apply for and obtain, under a 9

different name, one or more additional distillery, rectifying, winery, limited winery, 10

brewery, [or] farm brewery, OR MODERN BREWERY licenses for the same or different 11

premises. 12

(b) (3) (i) The holder of a Class 5 brewery license [or], Class 7 13

micro–brewery license, CLASS 8 FARM BREWERY LICENSE, OR CLASS 10 MODERN 14

BREWERY LICENSE may apply for and obtain a Class 7 limited beer wholesaler’s license 15

in accordance with this paragraph. 16

(ii) A holder of a Class 5 brewery license that was selling the holder’s 17

own beer at wholesale in the State as of January 1, 2013, may obtain a Class 7 limited beer 18

wholesaler’s license to continue to sell the holder’s own beer at wholesale in the same 19

location in an amount that is not more than 3,000 barrels annually. 20

(iii) A holder of a Class 5 brewery license OR CLASS 10 MODERN 21

BREWERY LICENSE that produces in aggregate from all its locations not more than 22,500 22

barrels of beer annually may obtain a Class 7 limited beer wholesaler’s license and 23

distribute not more than 3,000 barrels of its own beer annually. 24

(b) (3) (i) The holder of a Class 5 manufacturer’s license or Class 7 26

micro–brewery license may apply for and obtain a Class 7 limited beer wholesaler’s license 27

in accordance with this paragraph. 28

(ii) 1. [A] SUBJECT TO SUBSUBPARAGRAPH 2 OF THIS 29

SUBPARAGRAPH, A holder of a Class 5 manufacturer’s license that was selling the holder’s 30

own beer at wholesale in the State as of January 1, 2013, may obtain a Class 7 limited beer 31

wholesaler’s license to continue to sell the holder’s own beer at wholesale in the same 32

location in an amount that is not more than 3,000 barrels annually. 33

2. A CLASS 7 LIMITED BEER WHOLESALER’S LICENSE 34

MAY BE OBTAINED UNDER THE SAME CONDITIONS SPECIFIED IN 35

HOUSE BILL 1420 11

SUBSUBPARAGRAPH 1 OF THIS SUBPARAGRAPH BY A HOLDER OF A CLASS 10 1

MODERN BREWERY LICENSE THAT HELD A CLASS 5 MANUFACTURER’S LICENSE AND 2
