RICHMOND HOMEOWNERS’ ASSOCIATION (RHOA)

Upon taking possession of your Home, you automatically become a member of

RICHMOND HOMEOWNERS ASSOCIATION LIMITED (RHOA).

Each owner holds exclusive rights to the portion of the property called “THE LOT”, and

shared rights to the portion of the property called THE COMMON AREA.

Each owner is bound by the provisions in the (1) Restrictive Covenants, (2) Articles of

Incorporation, (3) By-laws and (4) Rules and Regulations.

Each “LOT” is entitled to one vote in the collective management of the Community of

Richmond.

At the last Annual General meeting (AGM) The RICHMOND HOMEOWNERS

ASSOCIATION LIMITED’s (RHOA) Board was duly elected by you, the homeowners.

Board members VOLUNTEER to serve and are not paid. The board makes the day to

day decisions in managing the Community on behalf of the owners.

At present, here are your representatives on the RHOA board:

For your convenience, the Restrictive Covenants are outlined verbatim in Appendix 1

(pages 40-46) of this document.

The Restrictive Covenants are strictly enforced. Please view the enclosed

documents carefully.

All breaches of the Restrictive Covenants must be addressed and rectified and if not

corrected will be forwarded to the RHOA’s legal team for enforcement.

All referrals to our legal team attract legal fees which will be applied to your

maintenance account.

Dagyene Wilson is located in the Palms at the RHOA Management office.

She handles collection of your monthly maintenance, RHOA budget reconciliation

PROPERTY MANAGEMENT

Property Manager

JOSEPH "JOE" WILSON is Richmond’s Property Manager.

He is also located at the RHOA’s Management Office and can be reached at

876 622-8635 or 876 456-1119; [email protected]

The Property manager is responsible for the physical management of ALL COMMON

AREAS, performing preventative property maintenance and repairs to keep the common

areas functioning in top condition.

Common Areas are the amenities provided by the developer within Richmond, for

the comfort and use of all owners. They include:

Open Spaces and Children Play Areas

Community Swimming Pools and Clubhouses

Community Gyms and Tennis Courts

Perimeter walls, Entrance Gates and Guard Booths

maintenance of the storm water system within the Richmond Community.

The Property Manager assists Richmond Homeowner Association (RHOA) in policing

the restrictive covenants.

Paying Your Maintenance

Your Monthly Maintenance Fee is JMD$15,000.00.

You have already paid, in advance, 1-month Monthly Maintenance with your closing

fees.

Hence, the RHOA Management Office will begin to draw down on the 1-month advance

payment of Monthly Maintenance in the 2nd month of you taking possession of your

Home.

In other words:

1. 1st Month you take possession of Home – No Maintenance applied

2. 2nd Month – 1-month advance payment of Monthly Maintenance is applied

3. 3rd Month - you are to commence paying Monthly maintenance. You will be

notified in writing when this occurs.

Payment Options Homeowners can make their Monthly Maintenance Fee payment by using any one of the

following options:

(1) Bank of Nova Scotia Jamaica Limited a. Scotiabank Online (see steps Table 1).

Note: Homeowners living overseas with a Scotia Jamaica Account may

use the Scotia Online services

b. Tele Scotia and at the Branch.

Note: Payment at the bank requires the homeowner to provide the RHOA with proof of

payment.

Applying for Service

Richmond Development Company Limited (RDCL) through its company, Richmond

Environmental Services Limited (RESL), has implemented a formal billing and

collection process for water consumption to ensure efficiency and fairness for all

Residential users within the Richmond Community.

Similar to your formal application for electricity (JPS), immediately upon taking

possession, the owner applies for water services from Richmond Environmental Services

Limited.

Here are the steps:

(1) Fill out the Application & Contract Form for Water Supply & Sewerage

Services. Please see FORM in Appendix 2 on pages 50-55.

(a) Please include when the service is needed.

(b) We also ask that you present your Tax Registration Number (TRN)

and Valid identification (A Driver’s Licence, Passport or National

Identification)

(2) Submit the form at anyone of the following locations:

There is a onetime charge for the installation of meter amounting to Jamaican

six thousand dollars (JMD$6,000.00).

CURBSIDE GARBAGE COLLECTION

Waste materials are collected as follows:

The Palms Monday, Wednesday & Friday

Coolshade Tuesday, Thursday & Saturday

The Crest Tuesday, Thursday & Saturday

Residents can schedule garbage pick-up on the non-scheduled days, as the property

must be clean of all waste daily: Collections on “off” days will be at a cost to the

resident.

To avoid collections issues, please make sure household

garbage is contained securely in plastic garbage bags

and in garbage bins.

1. Please keep garbage on your property until collection day. Residents are

advised to invest in a Garbage Bin. Waste can be stored in bins until collected.

These bins can be purchased at any hardware or variety store in Ocho Rios.

2. Separate Household garbage from organics or yard waste. They are collected

at different times on your collection day.

3. Place organics, leaf or yard waste in plastic bags next to your garbage bin. In

other words, do not mix leaf and yard waste with household garbage.

4. Put garbage at the curb in the morning of your collection day and no later than

11:00 a.m.

5. Separate all broken glass from your garbage and place it in a cardboard box

clearly labelled 'broken glass'. Doing otherwise can result in serious injuries to

collection operators.

6. Do not use cardboard boxes as garbage containers. (it rains frequently in

Richmond)

7. Dismantle your Cardboard moving boxes and tie them all neatly together for

collection.

8. Remnants of any construction activity will not be collected by the Garbage Truck.

These include: All types of aggregate and lumber, tiles, bricks etc.

These items should be removed by the contractor engaged.

9. If not, a removal fee will be charged to the resident. The fee will be assessed

based on the volume and type of materials. Please contact the RHOA Office

(876-622-8635) for more information.

Policy Breach

Garbage Collection

A fee of Two Thousand Dollars ($2,000.00), will be charged to all units that breach the

Waste Collection Schedule.

Fees will be attached to the Monthly Maintenance Invoice.

RECYCLING

PLEASE SUPPORT OUR ONGOING RECYCLING EFFORT BY

SEPARATING PLASTICS FROM YOUR REGULAR HOUSEHOLD

WASTE.

HOME DEFECTS

LIABILITY PERIOD

We strive to provide you with a home of the highest quality. However, in the event that

you may need remedial works to be carried out to your Home, there is a six-month (180

days) DEFECTS LIABILITY PERIOD which starts from the day you take possession

of your Home.

Please refer to clause 7.02 (a) & (b) and 7.03 of your CONSTRUCTION AGREEMENT:

… appear or arise within one hundred and eighty (180) days of the Date of

Possession and written notice thereof shall have been given by the Owner to the

Contractor within such period…

Here is the procedure:

1. Create “list of defects”

2. Send “list of defects” via email to your respective Sales agent

3. The Remedial Supervisor and the remedial works crew will visit your home and

arrange a convenient time for the works to be completed.

Please note: The terraced stepping-stones are not built to support vehicles.

Therefore, homeowners are asked not to park their vehicles in this area. If you

chose to do so, Richmond will not be liable for broken stepping-stones.

Subterranean Termites

Regrettably the location of the property is in a zone that is adversely affected by

subterranean termites. We are able to manage any possible damage by the termites by

treating each Lot; treatment is done by a reputable company.

We provide each homeowner with a warranty certificate for Three (3) years, within this

time any treatment and/or damages are at the expense of Richmond. Thereafter, the

homeowner is responsible for the treatment of their home. It is recommended that the

homeowner continues treatment and obtain a warranty from a reputable company.

Key Things to Note in Your Home

Solar Hot Water Heater:

On Overcast days you will need to turn-on the

WATER HEATER BACK-UP SWITCH

which is located inside the pantry cupboard in the kitchen.

This switch enables water to be heated via JPS electricity

as opposed to Solar Energy. The hot water heater should

be maintained to prevent the buildup of calcium in the

heater and the pub that operates the system. Please contact

a reputable company to perform maintenance.

External Security Lights: Security lights are located in the four, external corners of

your home which TURN ON

AUTOMATICALLY AT DUSK.

However, there are two OVER-RIDE SWITCHES;

(1) one switch is located in the bank of switches next

to the entrance door, controlling the 6 external

security lights to the front of the house.

(2) the second switch is located next to the master

bathroom door which controls the 4 external

security lights to the back of the house.

Water Lock off: There are two water lock offs;

(1) The MAIN LOCK-OFF is located externally, in the garden, to the front of the

lot near the water metre. This turns off the water coming into the Lot.

(2) The SECOND LOCK-OFF is located externally, next to the house, below the

dining room window in the carport area. This turns off the water coming into

the house.

Electrical Panel: The electrical panel is located in the passageway and is clearly labeled. The

ELECTRICAL LOCK-OFF SWITCH is labeled “MAIN” in the panel box; switch

numbers 1 & 3.

MAKING CHANGES TO YOUR EXTERNAL PROPERTY

All changes to the external property require approval by the Richmond Homeowner’s

Association Limited’s (RHOA) Architectural Review Committee.

The Architectural Review Committee’s role is to review designs for conformance to the

guidelines and not to participate in a substantial way in the design process or to suggest

alternative designs. Approval will only be given to designs that follow the guidelines

outlined by the RHOA committee and are in line with the set of possible changes that can

be made.

The intention is to create a community which is aesthetically unified through the use, by

all owners, of a common set of design Guidelines. The Guidelines are not intended by

any means to stifle creativity but rather to assist homeowners.

We recommend that owners familiarize themselves with these guidelines.

Guidelines

You are allowed to: (1) Enclosed the Veranda using one of two approved designs; see Fig 1.

(2) Install Wrought Iron Security Grill using ONLY the approved design; see Fig 2.

(3) Add an additional bathroom / powder room. Please collect approved design from

the RHOA’s office.

(4) Cover the carport area and or the drying yard area. Please collect approved design

from the RHOA’s office.

You are NOT allowed to: (5) Change the external colour to your home.

(6) Change the roofing material and colour of your home.

(7) Install fence, hedge or other construction of any kind, tree or plant of a height

above 1.35 meters above road level and within 5.4 meters of any road intersection

or along any road way or any adjoining boundary.

Policy Breach Making Changes to External Property

Breaches will be handled as follows:

1. The property manager will contact the home-owner and advise them of the breach

and they will agree on a time line in which the infraction will be corrected.

2. The property manager will follow-up after the agreed on time-line and if the

breach has not been corrected, written notices will be delivered by email or

regular mail. Please note; if the home-owner does not reside in the Palms or is off

the island the notice will be mailed or emailed to the address on file.

3. Non-compliance of the written request will result in referral to our legal

representative for action.

MAINTAINING YOUR LANDSCAPING

Each Lot is the responsibility of the individual home-owner.

We ask you to follow the landscaping guidelines already established as anarchy in the

community's landscaping would decrease property values.

Here are a few important things to note:

1. Your backyard is planted with grass just before or just after you take possession.

2. The newly planted back yard needs watering and constant weeding until the grass

has “caught” (in about three months)

3. Over half of the water you use at home is used outdoors, which makes watering

efficiently one of the best and easiest ways to save water.

Proper watering will also keep your landscape plants healthy and beautiful

throughout the year.

4. Note: Please ensure that your landscape contractor (gardener) is

aware, ‘Weed whackers’ & Power Tools cannot be used:

prior to 8:00am or later than 6:00pm on weekdays.

Policy Breach

Landscaping

If your landscaping is not maintained to the standards outlined in the covenant Appendix

1, First Schedule, Clause k (page 33) of this document, the RHOA will take action to

correct this breach.

Rule: To maintain the lawn and garden on the Lot to a standard which is no less

than as landscaped and handed over by Richmond Development Company

Limited, failing which the Company shall be entitled, at the sole cost and expense

of the Owner, to maintain the lawn and garden and shall be entitled to carry out

the necessary remedial work. The cost of such remedial work shall be

recoverable from the Owner by the Company as part of its Maintenance.

The property manager will advise you of any landscaping breaches. Once advised,

remedial works must be completed within one week. Here are the steps:

Step Action 1 The landscaping department supervisor checks the entire development on a monthly

basis and will issue a report, to the Property Manager and the RHOA

administration, of properties that are not meeting standards.

2 Breach notices will be sent via email or a call will be made to the home-owner

advising of the breach and the penalty.

3 Home-owners will be given one (1) week to correct the breach

4 On the 8th of each month (unless it falls on a Sunday, then the follow-up date will

be the 9th of the month), the property will be serviced by the HOA landscaping team

5 The home-owner will be billed $10,000.00JMD., this amount, will be shown on the

maintenance invoice on the month the charge is incurred.

General Rules & Regulations CLUB HOUSE / POOL DECK

The club house facilities are for the use of homeowners, their immediate families, and

their house guests.

Any homeowner may delegate their right of enjoyment of the club house facilities to their

tenants who reside on the property. Please notify the RHOA in writing of the name of any

such tenant. The homeowner/tenant is responsible for the conduct of his/her guests. Be

mindful of other users of the facility and the Residents surrounding the facility.

1 All minors, under the age of 18 years must be accompanied by an ADULT,

whilst using the facilities. In other words, it is against the rules to leave an

adolescent unattended at the pool / club house area.

2 The club house facilities must be vacated by midnight (12:00 am).

3 NO riding of bicycles or skates on the Pool Deck

5 NO ball playing on the Pool Deck

4 No pets are allowed in the club house, gardens, deck or pool.

6 No cooking is allowed in the Club house facilities including the pool area and

Deck.

7 No illegal substance will be allowed at any time within the club house

facilities, including pool area and deck, at any time

8 No smoking is permitted within the clubhouse facilities, including pool area

and deck, at any time

9 No Loud Music: Music, and/or any other noise, must be kept at a level

which doesn’t disturb residents in the surrounding homes. Use of personal

music devices is only permitted with head phones.

10 Owners may not reserve the area on behalf of a third party. No political,

religious, commercial or outside organization is permitted use of the club

house facilities, even though a homeowner/tenant is a member of the

organization.

11 The club house cannot be used for money raising purposes by an individual or

organization other than the RHOA.

12 The pool area is separate from the Clubhouse and may not be rented. There

should be no guest traffic on pool decks.

13 The homeowner will be responsible for the repair or replacement of any

damage done to the Clubhouse, or its furniture, equipment. Nothing may be

taped to the windows, doors or walls.

SWIMMING POOL

The swimming pool is exclusively for use of Owners, their immediate families, and their

house guests.

Please note that there will not be a lifeguard on duty, so all persons using the pool swim at

their own risk. Each person is solely responsible for any accident or injury in connection

with the use of the pool facilities.

Hours of Pool operation are from 9.00 am to 6.30 pm.

1 All bathers, before entering the swimming pool are required to take a shower

located on either side of the club house.

2 No one under the age of 18 years will be permitted to use the pool unless

accompanied by a parent or legal guardian.

3 The pool area cannot be used for games which involve diving and running.

Diving, playing ball and other boisterous activities are not permitted.

Pool users are requested to maintain decorum at all times.

4 Please respect others by minimizing noise. Use of personal music devices is

only permitted with head phones.

5 Please cover the pool furniture with a towel when using suntan oils.

6 There is no smoking at the pool area.

7 Persons under the influence of alcohol/drugs are not allowed to use the Pool.

8 You are permitted to bring food and beverages provided they are in paper and

plastic containers and you dispose of them in the proper receptacle.

9 Applicable to Cool Shade: Club House Area, Gym equipment and benches

are not to be used by persons attired in wet bathing suits or wet clothing.

10 Persons wearing wet bathing suits are not allowed in the Club House Area other

than to go to and from the restrooms.

11 No drinking allowed whilst in the pool (ie. No glass, glass bottles or alcoholic

beverages are permitted in the pool).

12 These rules and regulations are subject to change any time without notice.

GYM FACILITIES

1. As a courtesy to other gym users, a small gym towel must be carried to wipe

down equipment after use.

2. Inappropriate clothing such as bathing suit, bikini or wet clothes and flip-

flops/sandals are not permitted.

3. Please ensure that you put your weights back in their original place when

finished.

4. Please do not misuse the weights by dropping them on the floor.

5. Smoking is strictly prohibited in all areas of the gym.

6. Food and beverages (except water or sports drinks for hydration) are strictly

prohibited in all areas of the gym.

7. You may not use the gym whilst under the influence of alcohol, narcotics,

tranquilizers or any medication or other substance which may affect your

ability to exercise safely.

8. Bags are not permitted onto the gym floor.

9. You must not behave in an aggressive, abusive, anti-social or threatening

manner to any gym user.

10. Gym users may not bring any pets into the gym.

11. Richmond Homeowner Association Limited accepts no responsibility for any

loss or damage to personal property.

A violation by the homeowner (s) or their guests of any rules and regulations established

by the board governing the use of the Club House & Pool Deck, Pool & Gym Facilities

will result in a suspension in their “right to use” for a period to be determined by the

Board of Directors.

If a Homeowner is in default in the payment of monthly Maintenance fees or special

assessment levied by the RHOA, the right to use the Club House & Pool Deck, Pool &

Gym Facilities will be suspended by the Board of Directors until dues or assessment are

paid.

RICHMOND BEACH CLUB

RENTAL RULES Richmond Development Company Limited (RDCL) are the proprietors of the Richmond

Beach Club (RBC). There can be no exclusive arrangement for the use of the facility.

The RBC is a facility provided to our residents on the Richmond Development and as a

result, our residents can access and use the facility at their pleasure. The following rules

apply:

1. The Beach House building is subject to restricted usage.

2. ALL functions have a cut off time of 2:00am.

3. The renter is solely responsible for any damage(s) caused to the property or

buildings during period of rental.

4. Motor Vehicles (cars, vans etc.) are permitted to park on said property. However,

service vehicles, buses and trucks are prohibited.

5. All the necessary permits and license required for any event, is the responsibility

of the renter. Permits and license must be presented prior to the event.

6. ALL waste material must be collected and disposed of in the assigned area.

7. RDCL accepts no liability for damage caused to electrical and electronic

equipment caused by power surges and/or outages.

8. RDCL accepts no liability for any damage to or loss of vehicles during any event.

9. RDCL accepts no liability for any personal injury sustained to any visitor to the

event, as a result of engaging in any activity sanctioned by the renters.

RDCL agrees to provide:

1. A clean beautiful property, with utilities.

2. Support staff- Admin Staff, Security, Life Guard and Grounds Man.

Usage Fee

Please contact the Property Management Office for details:

1. Usage fee is to be paid two (2) weeks prior to the event for confirmation.

2. Payment can be made by Cash, Credit Cards, Debit Cards or Managers’ Cheques.

Payee: Richmond Development Company Limited. Personal Cheques are not

CLUB HOUSE

RENTAL RULES

1. The host must be a unit owner and must be in attendance at all

times during the party or the entire security deposit will be

forfeited.

2. An approximate time schedule must be submitted at the time the event

is booked. An attendant is in place at the Club House between the

hours of 10:00 AM and 6:00 PM.

3. A maximum of 30 persons are allowed at any semi-private function

unless approved by the Property Manager at the time of rental.

4. All parties must end and the area rented vacated by mid-night (12:00

pm) unless prior arrangements are made with the Richmond

Homeowners Association Limited.

5. All party activities must be confined to the Club House, unless

approved by Richmond Homeowners Association Limited and the

homeowner has a signed agreement. The attendant on duty must be

obeyed in all pool safety regulations.

6. Guests are required to park in an acceptable fashion in accordance

with the Richmond parking rules. Guest parking is restricted to the

East and West parking areas adjacent to the club house.

7. No unreasonable noise will be permitted in the parking lot and in no

instance will the party be allowed to spill over to the exterior of the

Clubhouse or Park.

8. Between the hours of 10:00 AM and 7:00 PM (on weekends the bar is

open until 9:00PM) a limited supply of alcohol and cold drinks are

available for sale at the Club House.

9. All garbage must be placed in garbage bags and placed in the area

behind the bar to be removed by Richmond personnel prior to opening

the Club House and pool the following day. Facilities must be left in

the same condition as they were in before the party.

10. The Clubhouse will not be made available for semi-private rental on a

holiday or holiday weekend.

Rental Rules Continued 11. Parties, gatherings or meetings of children or young adults under the

age of 21 are not permitted unless the parents are in attendance. An

attendant is in place between the hours of 10:00 AM and 6:00 PM.

12. The host is responsible for all Club House furnishings and fixtures.

The Owner reserving the facility will pay for any damage to the

premises.

13. Richmond is not responsible for any personal articles left in the

building after the party.

14. Home-owners booking a party at the Club House must be in good

standing with the RHOA in terms of maintenance.

15. After 6:00 PM a life guard must be on duty at all functions at the pool,

homeowner’s can negotiate with the Richmond lifeguard on a

personal basis or provide documentation to prove that they have a

qualified lifeguard in attendance.

16. No cooking is allowed at the Clubhouse or the Park areas, catered

service only.

17. The eastern section of the Clubhouse will always be used for the

purposes of rental and signage will be placed identifying the section.

The Park will have signage indicating a private function is in session.

18. All added furnishings such as tents, pool enhancements must be

approved by the property management prior to the date of the function

or they will not be allowed.

19. Richmond Homeowner Association board reserves the right to refuse

rental and use of the properties and facilities, to anyone not agreeing

to these Rules and Terms.

BASIC SAFETY RULES

Residents are being asked to ensure that basic safety rules are applied in the use of our

roadways and public facilities. There seems to be a flaunting of rules, especially by

children.

Care and safety of children are the sole responsibility of their parents/guardians and

safety rules must be explained and complied with.

Cycling and Skating Safety Rules Bicycles and Skates must be outfitted with the necessary lighting and reflectors,

especially for night usage.

Headgear and joint protection gears must be worn

In Jamaica, the Left side of the Road, is the right side.

Observation of Stop Signs

Service breaking systems

Road Usage & Sanitary Rules Drivers are being reminded that the Road Users Code is still in effect on the

Property. Driving on the left, Observing Stop Signs, and most importantly, be on

the lookout for pedestrians.

When using public facilities, please ensure your waste is disposed of in

receptacles provided. It keeps the area clean and presentable for other users.

PET POLICY

Pets are a serious responsibility and a possible liability for each resident.

If not properly controlled and cared for, pets can disturb the rights of others and cause

damages for which the resident may be liable.

The restrictive covenant stipulates the following:

Covenant: not to raise, breed or keep any animals in the dwelling house erected

on the Lot, save and except for a reasonable number of dogs, cats or other usual and

common household pets and not to take any animals, or allow any animals to be

taken on to the Common Area. Any pet which the RHOA in its sole discretion

determines to be a nuisance shall be removed from the Lot and the Development

upon the request of the RHOA. If the pet owner fails to honour such request, RHOA

may remove the pet and recover the cost of so doing from the Owner.

As a result of this stipulation, Pet-Owning Residents (POR) must comply with the

following regulations:

1. Pet Registration. All POR are to complete the Pet Registration Form. Only

registered pets are authorized to be kept on the property.

2. Prohibited Pets. This includes birds (except those caged), Bull Mastiffs, Bull

Terriers, Chinchillas, Chow Chows, Doberman Pinschers, Ferrets, German Shepherds,

Huskies, Iguanas, Insects, Monkeys, Pit Bulls, Pot-Bellied Pigs, Rabbits, Rodents of any

kind, Rottweiler, Snakes or Reptiles of any kind, Spiders of any kind.

3. Liability. POR shall be strictly liable for any injury to any person or property

damage caused by their pet.

PET RULES

Residents are responsible for the actions of the pet at all times. PORs are to abide by the

following rules:

1. Creating a Nuisance. PORs agree that a pet will not disturb the rights, comforts

and conveniences of neighbours or other residents. This applies whether the pet is inside

or outside of resident’s housing unit.

2. Sanitation. Residents shall not permit their pet to defecate or urinate anywhere on

the property, including patio areas, walkways, parking lots, verges, parks, roadways and

any other area designated a public area. Residents will have a sanitary waste remover,

commonly called a Pooper Scooper or Pet Scooper, with them at all times while walking

the pet outside of the unit and should remove and properly dispose of any pet waste.

3. Securing Your Pet. Pets should not be tied to any fixed object outside the

housing unit, including walkways, stairs, parking lots, or any other part of the property.

4. Prohibited Areas. Pets are not allowed at the Club House, Model House, Gym,

Offices or any other recreational areas.

5. Supervision of Your Pet. Pets shall be kept on a leash and supervised when

outside of the housing unit. The RHOA has the right to pick up any unleashed pet and

shall impose reasonable charges for picking up/or keeping unleashed pets.

6. Wearing Collars. Collars are to be worn at all times.

7. Public Health Inspection. All housing units with any pets will be subject to

yearly inspections from the Public Health Department.

8. Removal of Pet by the RHOA The RHOA, with reasonable judgment and

after giving written notice, may enter the housing unit with the proper authorities and

remove the pet if a resident has (1) abandoned the pet (2) violated the RHOA’s Pet

Policy, or (3) repeatedly allow the pet to urinate or defecate in public spaces. RHOA may

turn the pet over to a humane society or the local authority for animal control. RHOA has

no lien on the pet for any purpose; however, the resident shall pay for reasonable care and

kenneling charges for any such pet. RHOA retains the right to immediately remove any

animal that causes or appears to be a threat to any person. Additionally, any animal with a

history of aggressive behavior will be considered a dangerous animal and will be

removed.

ACCESS GUIDELINES FOR YOUR EMPLOYEES Residents are to procure ID Cards for their employees. The ID Card is the property of the

Resident and it must be collected by the Resident upon termination of employment.

Procedure to Acquire ID 1. Prospective employee must submit two (2) passport size photographs.

Photographs must be signed by a Justice of the Peace or gazetted Police Officer.

2. Provide an information sheet of the Prospective employee to include:

- Full Name

- Address

- Contact Number

- Frequency of service (days per week)

(it is expected that the resident would have received references)

3. Submit documents to the Property Management Office for further processing.

4. Resident will then be advised when the Prospective employee should visit the

contracted Photo Studio to pay the appropriate fee and collect the ID card.

FIRST SCHEDULE

The Lot is subject to the undermentioned restrictive covenants which shall run with the

land and shall bind as well the Purchaser, his heirs, personal representatives, successors

and transferees as the Registered Proprietor for the time being of the Lot, his heirs,

personal representatives, successors and transferees and shall enure to the benefit of and

be enforceable by the Registered Proprietor for the time being of the lands or any portion

thereof comprised in the Development Lands.

a) The registered proprietor of the Lot shall not in any manner restrict or interfere with

the discharge of storm water from any road on the land comprised in this certificate

of title (hereinafter called “the said land”) and the Road Authority shall not, under any

circumstances, be liable to the owner or occupier of the said land, for any damage

occasioned by storm water flowing off roadways.

b) The registered proprietor of the Lot shall not permit any gates and doors in or upon

any fence or opening onto any roads to open outwards.

c) The registered proprietor of the Lot shall not permit any waste or sullage water or

effluent waste to be discharged from the Lot onto any part of adjoining lands and any

road.

d) No fence, hedge or other construction of any kind, tree or plant of a height more than

1.35 meters above road level shall be permitted within 5.4 meters of any road intersection

or along any road way or any adjoining boundary without the prior approval from the

local planning Authority (St. Ann Parish Council)

e) No access/egress to the Lot shall be established other than by way of the roads in the

subdivision of which the Lot forms part and shall in any event not be established without

the approval of the Superintendent of Roads and Works.

f) No building or permanent structure shall be erected less than 9.14m from the

reservation along the North Coast Highway and 12.19m from the centerline of the

parochial road, respectively.

g) No building or permanent structure shall be erected less than 15.24m and 11.12m from

the center line of the 15.24m wide and 10m wide reserved roads respectively.

h) No building or permanent structure shall be erected less than 6.1m from the bank of

any canal, earth drain or gully respectively.

i) No building or permanent structure shall be erected less than 4.57m from any side road

j) No new building or permanent structure shall be erected within 1.5m of any adjoining

lots.

k) At all times not to permit the Lot to be kept other than clean and free from

undergrowth.

l) The Lot shall not be subdivided

m) The building on the Lot shall not be used for purposes other than a private dwelling

house.

n) The registered proprietor of the Lot shall not cause or allow the Lot and the dwelling

house erected thereon to fall in disrepair

o) The registered proprietor of the Lot shall not use and enjoy the Common Area in such

a manner as to unreasonably interfere with its use and enjoyment by other owners of lots

in the Development, their families, guests and invitees.

p) The registered proprietor of the Lot shall not use the Lot or permit it to be used in such

a manner or for such purpose as shall cause a hazard to the occupier of any other lot in

the Development, whether a body corporate or not, or the family, guests, employees or

invitees of such occupier.

q) The registered proprietor of the Lot shall not carry on any trade or business on it,

PROVIDED HOWEVER that the long term rental of the Lot as a single family rental unit

shall not be deemed to be a trade or business for the purpose of this restrictive covenant.

r) The registered proprietor of the Lot shall not allow the dwelling house on the Lot to

be occupied by more than two (2) persons per bedroom. For the purpose of this

restrictive covenant “occupy” shall be defined as staying overnight in the dwelling house

for more than thirty (30) days in any six- (6) month period.

s) The registered proprietor of the Lot shall not make any structural modifications or

alterations to the dwelling house on the Lot.

t) The registered proprietor of the Lot shall not erect or cause to be erected any type of

awning on the Lot without the prior written consent of all the other owners of lots in the

Development and not to erect any security grills on the patio or entry area of the house to

be erected on the Lot other than such security grill as has been designed by Richmond

Development Company Limited, the design of which has been made available to each

owner of lots in the Development.

u) The registered proprietor of the Lot shall not make noises or use musical

instruments, radios, televisions and amplifiers in such a manner as to disturb other

owners of lots in the Development, their families, guests, occupiers and invitees

v) The registered proprietor of the Lot shall not raise, breed or keep any animals in the

dwelling house erected on the Lot, save and except for a reasonable number of dogs, cats

or other usual and common household pets and not to take any animals, or allow any

animals to be taken on to the Common Area

w) The registered proprietor of the Lot shall not post any advertisements or posters of any

kind on the buildings on any of the other lots in the Development or Common Area or on

the external boundary walls of the Development.

x) The registered proprietor of the Lot shall not hang any garment, laundry, rugs or

articles of a similar nature in any area or erect any clothes line that is visible from

any other lots in the Development or the Common Area other than in the areas

designated as a drying yard and in particular shall not hang or erect any such items from

the windows or from any of the facades or patios of the building on the Lot

y) The registered proprietor of the Lot shall not dust rugs or articles of a similar

nature from the windows of the building on the Lot or clean any rugs or articles of a

similar nature by beating same on the Lot or the Common Area.

z) The registered proprietor of the Lot shall not throw any garbage or trash outside of the

disposal installations provided for such purposes on the Common Area and shall not

dispose of any garbage or trash in the disposal installations provided unless such garbage

or trash is adequately packaged to prevent leaks and spills before being placed in the

disposal installation.

aa) The registered proprietor of the Lot shall not install or have installed any wiring for

electrical or telephone installation, television antennae, satellite receiver, machines or air

conditioning units or things of a similar nature on the exterior of the building or that

protrude through the walls or roof of the building on the Lot except as previously

approved in writing by all the owners of lots in the Development.

bb) The registered proprietor of the Lot shall not bring or permit to be brought on to the

Lot or place or store or permit to be placed or stored or to remain in or about the Lot any

article or thing which is or may become dangerous, offensive, combustible, inflammable,

radio-active or explosive and shall not do or permit to be done on the Lot any hazardous

act or thing in consequence of which any insurance policy in respect of any construction

on the Common Area or any other lot in the Development might be vitiated or prejudiced.

cc) The registered proprietor of the Lot shall not carry on or allow to be carried on any

illegal, noxious, unpleasant or offensive activity or anything which may be or tend to

become or cause an unreasonable annoyance, nuisance or safety hazard, whether public

or private, to residents in the immediate vicinity of the Development which may be or

tend to become or cause unreasonable interference with the comfortable and quiet use,

occupation or enjoyment of any of the lots in the Development.

dd) The registered proprietor of the Lot shall not stop up or obstruct or interfere with in

any way or permit to be stopped up obstructed or interfered with in any way the drains,

conduits, pipes or other things used in common with other owners of the lots in the

Development.

ee) The registered proprietor of the Lot shall not park or permit to be parked any vehicle

or otherwise obstruct or permit to be obstructed any roads, access ways or service areas

or other common areas excepting for designated parking areas, and in particular, shall not

park any commercial vehicles or equipment, mobile homes, boats, trailers or store

inoperable vehicles and equipment on the Lot or anywhere in the Development.

ff) The registered proprietor of the Lot shall not build or erect any wall, fence or

similar structure along the front boundary of the Lot.

gg) The registered proprietor of the Lot shall not allow any tree permitted to be on the

Lot to exceed a height of twenty feet.

hh) The registered proprietor of the Lot shall not allow or permit any well or other

structure or facility for the extraction of water or other from the ground on the Lot.

Development Lands in such form as RICHMOND’s Attorneys-at-Law may deem

necessary or desirable to ensure:

(a) That wires for the purpose of providing electricity and telephone services may pass in,

over, under and upon the Lot.

(b) That poles to carry electricity, telephone wires and other equipment may be erected in

or near the boundaries of the Lot.

(c) That pipes for the purpose of providing water and pipes and/or drains for the purpose

of removing effluent may pass under and upon the Lot.

(d) That the providers of utility services, their respective servants, agents, workmen,

licensees and independent contractors together with vehicles of all kinds shall have the

right of entry way and passage along and within five feet of the boundaries of the Lot for

the purpose of erecting and installing poles, wires, pipes and/or drains and other

equipment and maintaining repairing and renewing the same and for the purpose of

procuring the efficient continuation of the services.

(e) That RICHMOND ENVIRONMENTAL SERVICES LIMITED, its respective

servants, agents, workmen, licensees and independent contractors together with vehicles

of all kinds shall have the right of entry way and passage along and within five feet of the

boundaries of the Lot for the purpose of erecting and installing poles, wires, pipes and/or

drains and other equipment and maintaining repairing and renewing same and for the

purpose of procuring the efficient continuation of the services.

PROVIDED THAT for the more efficient use and enjoyment of the foregoing easements

or higher than fifteen feet from the ground within fifteen feet of the line adjoining any

2. That the providers of utility services shall each have the right to pull down and/or

remove any fence or part thereof which will obstruct them or any of them in establishing,

inspecting and operating their respective systems and undertakings and shall not be liable

to pay any compensation for or to restore any such fence wholly or in part if such pulling

down and/or removal was necessary for the execution of the work and if no greater

damage is done than is reasonably necessary for the attainment of that object.

CONDITIONS OF SUPPLY

1. Customers must pay the cost for pipes, fittings, labour and all other costs associated with the

installation and connection of a supply to their premises.

2. Customers must make a deposit on account at the time of service request or if an existing customer

account is disconnected. This deposit is to cover any water charges that are unpaid on account. NB: This is different from the installation cost and/or reconnection cost.

3. Pipes which are laid outside the boundaries of the customer’s premises belong to and are the

responsibility of Richmond Development Limited. Where meters are placed outside the premises,

piping from the meter to the premises is the responsibility of the customer.

4. Metering of a customer’s supply line is at the discretion of the RESL. Where no meter has ever been

on the premises, the consumption charged will be stipulated by the RESL. and will be subject to

review from time to time.

5. When a meter reading is not available, the RESL. will use estimates based on an average of the last

three (3) consistent readings within a specific period.

6. A meter can be temporarily installed on premises to adjust or determine a fixed consumption for a

supply which is not permanently metered.

7. The RESL. reserves the right to bill a customer retroactively in the case where: {a} there is an unmetered supply and the RESL. determines that the customer has been

undercharged based on misrepresentation of the number of household occupants; or

{b} the customer has trespassed or illegally connected to the RESL network to reflect a lower

consumption; or

{c} there is any other evidence that consumption is greater than the previous charges. or

{d} where a customer has been using the central sewerage system operated by the RESL and was

not charged for the use of such service

8. Bills must be paid monthly, on or before the due date specified on the bill. In the event the customer

does not receive a bill, the customer is obligated to ascertain the monthly charges from the RESL.

9. Where an account is in arrears, the RESL. reserves the right to disconnect without notice at any time

before payment of the full amount required is made; where disconnection made on the same day

that the required payment is made, the disconnection shall be lawful and the reconnection fee shall be due and payable. The RESL. will charge the customer a fee for reconnecting the supply and such

fee shall be specified by the RESL. from time to time. The supply will not be reconnected until the

arrears and reconnection fees have been paid.

10. The RESL. reserves the right to temporarily disconnect or reduce a supply without notice, and to

effect repairs to any part of its water supply system. No liability shall be attached to the RESL. by

reason of such reduction or temporary discontinuance of the supply, nor shall the liability of the customer to pay all proper rates, charges or fees be affected. RESL reserves the right to vary

conditions/availability of supply at any time and no liability shall be attached to the RESL as a result.

During periods of drought, the customer will be notified at least 24 hours before.

11. A Commercial rate will be charged for water consumed on a premises where trade or business is conducted. NB. Where the service applied for, is for construction purposes the applicable rate for water consumed is the commercial rate. It is incumbent on the customer to inform the RESL when such construction is completed so that a review can be done of the rate where applicable.

12. Supply of water to others, whether sold or free of charge, is illegal and can result in disconnection

and prosecution.

13. Violating water restrictions can result in a fine.

14. Customers can be disconnected for allowing water to run to waste.

15. Customers are liable for meters damaged on their property and will be charged for any replacement costs.

16. Customers should not erect any structure (whether temporary or permanent) on or above the meter

nor around the meter for a minimum of one 91) meter radius, or otherwise cause the meter to be become obscure or unreadable.

17. One (1) month’s written notice is required to cancel this contract. This contract can be terminated by

either party, that is, the customer or the RESL. All outstanding amounts to the date of termination of

the contract must be settled.

18. Customer applying for Sewer connection and who have existing disposal system are responsible for retrofitting and retiring such system after property is connected to the central sewers.

I, the undersigned, hereby apply to the Commission for the supply of water/sewerage to the above

mentioned property and for the aforesaid purpose in accordance with the conditions of the supply and

scale of charges in force from time to time under the provisions of the National Water Commission Act and

Regulations, the Policies and Procedures of the Commission and all other relevant Laws and Regulations

and which shall be deemed to be incorporated herein and form part of the conditions of contract of supply.
