A: AUTHORITY - This signed Authority and Mandate refers to our contract dated ______________________ (“the Agreement”). I/We

hereby authorize you to issue and deliver payment instructions to your Banker for collection against my/our above-mentioned account at

my/our above-mentioned Bank (or any other Bank or branch to which I/we may transfer my/our account) on condition that the sum of such

payment instructions will never exceed my/our obligations as agreed to in the Agreement and commencing on ______________________

and continuing until this Authority and Mandate is terminated by me/us by giving you notice in writing of not less than 30 ordinary working

days, and sent by prepaid registered post or delivered to your address as indicated above. The Individual payment instructions so authorized

to be issued must be issued and delivered as follows: MONTHLY / BIMONTHLY / THREE MONTHLY / SIX MONTHLY, ANNUALLY / WEEKLY, BI-

WEEKLY (delete which is not applicable)

If the payment date falls on a Sunday, or recognized South African public holiday, the payment day will automatically be the very next

ordinary business day. Payment instructions due in December may be debited against my account on ____________________________.

I/We understand that the withdrawals hereby authorized will be processed through a computerized system provided by the South African

Banks. I also understand that details of each withdrawal will be printed on my Bank Statement. Such must contain a number, which must be

Included in the said payment instruction and if provided to me should enable me to identify the agreement. This number must be added to

this form in Section E before the issuing of any payment instruction.

B: MANDATE – I/We acknowledge that all payment instructions issued by you shall be treated by my/our above-mentioned Bank as if the

instructions have been issued by me/us personally. I/WE AGREE TO PAY ANY PENALTY BANK CHARGES RELATING TO THIS DEBIT ORDER

INSTRUCTION.

C: CANCELLATION – I/We agree that although this Authority and Mandate may be cancelled by me/us, such cancellation will not cancel the

Agreement. I/We shall not be entitled to any refund of amounts which you have withdrawn while this Authority was in force, if such amounts

were legally owing to you.

D: ASSIGNMENT – I/We acknowledge that his Authority may be ceded or assigned to a third party if the Agreement is also ceded or assigned

to that third party, but in the absence of such assignment of the Agreement, this Authority and Mandate cannot be assigned to any third

party.

Terms & Conditions1. KCS Internet Service Provider will be referred to as KCS ISP2. The subscriber shall be liable for all of his or her own hardware and other costs for connection to the KCS ISP services.3. KCS ISP will not be liable to the Subscriber nor to any associated party for damages, incidental or consequential, of any nature whatsoever.4. The Subscriber shall not, without the express written permission of KCS ISP resell or make available to any third party such services as they might receive from KCS ISP.5. The Subscriber must pay KCS ISP in advance for the selected service option, which payment must reach KCS ISP prior to the account expiry date. KCS ISP reserves the right to

withhold access for overdue accounts, while the Subscriber shall continue to be liable for the service until the conditions of notice of termination are fulfilled. Direct debit payments may be processed up to 10 (ten) days prior to account expiry date in order to allow time to resolve any difficulties, which may arise.

6. Intention to terminate this contract must be communicated in writing to KCS ISP giving one calendar months notice prior to the actual termination date.7. If the contract is terminated before the 12 month period, the client will be liable for the full length of the remaining term.8. KCS ISP is dependent on Fiber, Wireless Towers and cannot be held liable if/when the Fiber lines are down.9. KCS ISP isn't liable for any lighting damage or Acts of God.10. Clients must install their own surge protectors as needed.11. If your connection is suspended, the account holder will stay liable for the service term fees. There is a R100 reconnection fee.12. Speeds cannot be guaranteed, all connections are up to speeds.13. Signal can be influenced by Interference, lighting, wind and rains, some packages might not be available in certain areas.14. KCS retains the right to cancel any service rendered at any time.15. KCS retains the right to with hold any equipment passwords to protect the KCS Network or where accounts are overdue.16. All Internet Packages are best effort except where stated differently, all connections is subject to a FUP Policy (www.kcsisp.co.za).17. All peer to peer downloads & torrents have lowest priority and may be shaped if the network is under pressure. 18. This is a 12 month contract, this agreement cannot be downgraded within the term. This agreement will be renewed for another 12 months if, no notice is received before the

expiry of the contract term, one calendar months' notice.19. KCS ISP (KCS Internet Service Provider) Retains the right to increase any fees as needed at any time during the contract term.20. All equipment stays the property of KCS Internet Service Provider (Pty) Ltd until the end of the contract term, if the contract is cancelled within the term KCS ISP will remove all

equipment and the installation amount will NOT be paid back to the client to redeem expenses. 21. Home Broadband packages are not recommended for VOIP Services.22. All WiFi Passwords can only be changed at the Clients Premises; all WiFi Password changes are charged at R150-00 per Change.23. KCS ISP DO NOT keep any history of data used or Sites Visited. 24.
