    11.1 Notice of Motion No 15 of 2012 Re Heritage Advisory Committee

    I, Councillor Sam Gaylard, hereby give notice that it is my intention to move the following motion atthe Ordinary Meeting of Council to be held on 21 August 2012:

    That:

    (a) the Yarra City Council makes greater commitment to consult with residents and heritagegroups by establishing a Heritage Advisory Committee, to advise on and strengthenCouncils response to heritage protection;

    (b) an officers report be provided to the October cycle of Council Meetings outlining thefollowing:

    (i) The purpose of the Heritage Advisory Committee, including: To provide advice on issues relating to heritage protection across the City of Yarra;

    (ii) Objectives of the Heritage Advisory Committee, including:

    To contribute the views of residents, heritage groups and heritage practitionersregarding the role of the Yarra City Council in heritage protection;

    To contribute at an early stage to any review of heritage services or heritage policy;

    To contribute ideas, suggestions and formal advice to the improvement andenhancement of heritage protection;

    To review and advise on the impact of significant heritage decisions or outcomesimplemented in the City of Yarra;

    To review and advise on the impacts of planning decisions on heritage protection; To advise on State Government decisions or policies impacting on heritage in the

    City of Yarra;

    To provide a response to statistical reports and assessments of performance inheritage protection;

    (iii) The Role and Responsibilities of the Heritage Advisory Committee, including to:

    Provide effective and timely advice by community representatives into heritagepolicy, service planning and service delivery;

    Promote consultation and representation of community views on heritage protectionand heritage policy;

    Provide an additional avenue for dissemination of information about Councilsheritage services and decisions impacting on heritage;

    Propose and participate in relevant working parties, forums and workshops onheritage issues relevant to the City of Yarra;

    (iv) The Staff Resources required supporting the work of the Heritage Advisory Committee,including to: Prepare and distribute papers and background information required by the

    Committee prior to any meeting at which they will be discussed; Provide professional advice and expertise to the Committee Chair and Committee; Prepare and distribute agendas and meeting papers to all Committee members and

    Councillors;

    Provide draft minutes promptly after each meeting; Brief the Committee Chair on issues as they arise; Disseminate to all Committee members the minutes, recommendations and reports

    arising from the work of the Advisory Committee;

    (v) The Membership of the Heritage Advisory Committee, including the followingconsiderations:

    The Committee shall consist of up to 12 community members;

    Two Councillors who will be appointed by Council on an annual basis

    The selection process, which shall include that Council will also seek to ensure anoverall balance in terms of gender, cultural background and group representation;

    The criteria for selection to the Committee which should include:(a) For individuals - an interest or expertise in heritage;(b) Representatives from a cross section of heritage groups;(c) Commitment to consider and value a wide cross section of community

    views;

    (vi) The chairing of meetings, but consider the Committee be chaired by a designatedCouncillor, or in their absence, a member agreed to by the Committee;

    (vii) The frequency of meetings but consider the Heritage Advisory Committee should meeta minimum of quarterly per annum, or at other times determined by the Committee;

    (viii) The possibility of the Committee appointing sub-committees or working groups asappropriate to address specific issues and which may include others not on theCommittee;

    (ix) The duration of membership on the Committee;

    (x) A consideration of a conflict of interest arising for any member of the Heritage AdvisoryCommittee, and the process for the member to disclose the interest and clearly statethe nature of that interest at the meeting immediately before the matter is considered;and

    (c) the report include any other consideration in the forming of the Heritage Advisory Committee.

    Background

    The City of Yarra is currently experiencing unprecedented numbers of applications fordevelopment, many of which have serious implications for the protection of our valuable heritagebuildings. In addition, the previous and current State Government through Department of Planningand Community Development; (DPCD) Officers has advised Council that it should not constraindevelopment with the application of heritage overlays.

    Council currently has seventeen precincts which are not covered by heritage overlays, sometimesresulting in real estate advertising boards in front of old houses for sale stating the property

    represents a development opportunity.

    There are many residents, some who have professional heritage or planning expertise, who areconcerned with our current loss of heritage buildings and who are committed to heritage protectionin the City of Yarra. Many residents have joined heritage protection groups which have built upextensive knowledge of local heritage precincts. These individuals and groups tend to be critical ofCouncils performance in heritage protection and have many ideas on how Council could improveheritage protection or advocate for it to the State Government.

    Currently, there is no formal engagement between these residents and Council except throughobjections to individual development applications. The Heritage Advisory Committee will provide aformal pathway where residents and groups can communicate with Council about heritage in a

    more positive manner that goes to a range of issues, including policy formulation.

    RECOMMENDATION

    That:
