Welcome to Creekside at Bethpage

Dear New Homeowner(s):

Congratulations on the purchase of your new home. On behalf of the Creekside at Bethpage Homeowners Association Welcome Committee and all homeowners of Creekside at Bethpage, we would like to officially welcome you to our neighborhood. We are so pleased that you have chosen to call Creekside at Bethpage home. We certainly look forward to meeting you whether it is by personal visit, walking throughout the neighborhood, or at a community activity.

Moving into a common-interest community property governed by a homeowners association, can be a confusing and challenging process, especially for those who have never before been involved with a homeowners association. Creekside at Bethpage HOA would like your experience here to be a positive and enjoyable one. We are a community of neighbors.

To help you, we have created this brief document to touch upon some key areas of interest for all new homeowners. This document is not designed to replace or substitute for the Creekside at Bethpage Homeowners Association governing documents; rather it is designed to provide a simple summary. All potential homeowners should be given the opportunity to read and understand the governing documents prior to moving into Creekside at Bethpage, and each homeowner has the responsibility to honor the provisions of these documents.

About Creekside at Bethpage

Creekside at Bethpage offers luxurious and finely crafted homes for those seeking an active lifestyle. With spacious first floor master bedroom floor plans and restricted architectural controls, Creekside at Bethpage residents enjoy a country club active lifestyle. The community features a private clubhouse, Hemingway Hall. Our community also features a pool, tennis courts, pickleball courts, walking paths, dog park, vibrant social activities and a state-of-the-art fitness center. Our exclusive neighborhood is centrally located in the heart of the Triangle area of North Carolina. Award-winning home designs and amenities combine to make Creekside at Bethpage truly a “one of a kind” community for discerning tastes.

Why Creekside at Bethpage HOA?

The Creekside at Bethpage Homeowners Association was created by the original developer, AV Homes (now Taylor Morrison), as a formal legal entity in order to maintain the common areas of the community and to ensure the quality and value of properties within the neighborhood. As a legal authority, the HOA is designated to enact and enforce maintenance and design standards in addition to the standards established by the city and county.

Covenants

Creekside at Bethpage is a covenant-controlled community. It is incumbent upon all homeowners to read and comply with the dedicatory documents of the association called the Declaration, Covenants, Conditions & Restrictions (DCCRs). By accepting title to a home within Creekside at Bethpage, owners automatically accept responsibility to abide by these covenants. The dedicatory documents can be found in your closing papers or on our website under the Documents tab on our community website: http://www.creeksideatbethpage.org.

The association operates via a board of directors that oversees the neighborhood/subdivision. By residing within Creekside at Bethpage, all residents are bound by the rules and regulations set forth in the dedicatory documents. Should a violation of these documents occur, a homeowner would receive a written notice of the covenant violation and given an adequate time frame in which to resolve the issue. Should a violation go unresolved, a fine may be assessed.

Fines are intended to target covenant infractions that have a direct correlation to home values and consistency of architecture. It is not the desire of the board to fine a homeowner; however, violations that affect property values and/or neighborhood appearance must be resolved in a timely manner. The fines are in place to provide motivation to resolve the issue, not as a punishment. Information regarding fines can be found on the website or by contacting Creekside at Bethpage HOA Management, AAM Management. Should you need to address a covenant violation, you may use the Contact Us page on the website at www.creeksideatbethpage.org.

HOA Monthly Dues

Each homeowner, not the bank or mortgage company, is responsible for paying the monthly HOA dues. Your dues cover a comprehensive list of expenses, including the maintenance and operation of Hemingway Hall and the surrounding amenities, like the swimming pool, tennis courts, pickleball courts, dog park, and more. The Creekside at Bethpage HOA also maintains the common landscaping within the community. Homeowner yard maintenance is also provided in these monthly dues. Our HOA will work diligently to provide the community with the best services and amenities while maintaining the necessary operating reserves.

HOA Communications

The Creekside at Bethpage HOA may correspond with homeowners from time to time. The management company will facilitate this communication. You may receive communication through email, US mail or other means. Please ensure the onsite management company has your most current contact information so that you receive timely communications.

HOA Communications (cont.) The Creekside at Bethpage website and Hemingway Hall Club Express sites are maintained for the communication and education of our residents. Please use these sites to learn about events, activities, and other important information regarding our community.

We will conduct monthly orientation programs for residents. These programs will include a new resident orientation by our onsite management company, and an invitation to any planned monthly welcome programs presented by a panel of residents who serve as ambassadors to the community. New residents may request an in-home visit from a member of our ambassador team. The HOA website features links to the governing documents, monthly payment information, contact information, Hemingway Hall room reservation information, and other helpful items. The Lifestyle site features links to the event calendar, event registration, fitness class calendar, and resident directory. Website pages at-a-glance:

Creekside at Bethpage Board of Directors

An active Board of Directors governs the operation of your Homeowners association. The Board currently (January 2019), consists of Bill Kiselick of Taylor Morrison; Scott Lay and Scott Farry of Reader Partners; and Lori College and Kevin Walls, 2 non-voting homeowners. In the future, the Board of Directors will be elected by the community to oversee the daily functions and financial responsibilities of the Association. The Board is also responsible for maintaining members’ compliance with the established dedicatory documents of the Association. It is imperative that members take the time to read through the dedicatory documents you receive during the home purchase process. These are commonly available in your closing papers or during the sales contract due diligence period. Copies are also available in the documents library on our website: www.creeksideatbethpage.org.

The dedicatory documents initially set up by the developer at the inception of the Association and recorded with the Durham County Clerk’s office state the Boards’ primary duty is to preserve the integrity of the development and maintain the appearance of the neighborhood by managing the following:

1. Financial management and neighborhood planning 2. Common area maintenance and repairs 3. Architectural change/improvement guidance 4. Enforcement of Declaration of Covenants, Conditions & Restrictions, and subsequent

amendments 5. Adherence to all state and local regulatory compliance including the completion of

annual reports and tax returns. Included with this document is helpful information that will introduce you to the association, explain your part as a member, and share valuable information on the rules and regulations that are applicable to all members. Architectural Review Committee

• All modifications to the exterior of your property, including painting, fences, & landscaping must be submitted and approved by the ARC prior to beginning the project

• Forms for submitting requests for approval can be found in the Documents Library on the website, www.creeksideatbethpage.org

• If processing exceeds 45 days the application is considered rejected

Monthly Dues/Fees

Meetings

• Creekside at Bethpage HOA holds one annual meeting usually in the fourth quarter of the calendar year

• Notice of meetings is provided to homeowners in accordance with state guidelines

• Each homeowner is encouraged to attend the annual meeting

Property Inspections

• The management company conducts neighborhood inspections each month to identify covenant violations

• If issues arise and need to be addressed, respective homeowners will be notified by mail, email, or telephone

• Homeowners are asked to address such issues with the management company

Deed Restriction Violations (DVR)

• To report a deed restriction violation within the association, please submit your inquiry to both the developer and the management company on the Contact Us page at our website: www.creeksideatbethpage.org

• All inquiries will be added to the next inspection queue for review and subsequent resolution. DVR reporting will not be disclosed to the offending resident

Traffic/Speed Limits

• The speed limit throughout the neighborhood is 25 mph • Please obey traffic signs • Please observe a pedestrian’s right of way • Please report construction traffic violations to the management

office

Parking

• Parking should be only in designated parking spaces

• Parking in resident driveways should not block sidewalks • No RVs, boats and/or utility trailers may be parked in one’s

driveway except during brief periods of loading and unloading • Guest parking on the street is allowed on a temporary basis as

long as street and sidewalk traffic is not impeded

Common Areas & Grounds Maintenance

• Creekside at Bethpage is responsible for maintaining the lawns, trees, shrubs, and other plantings located in the common areas of the HOA. This includes entrances, parks, retention ponds, and walking paths. If issues arise within one of these areas, please submit an inquiry to AAM using the Contact Us page on our website: www.creeksideatbethpage.org

Rules and Policies

• Creekside at Bethpage has adopted a number of helpful rules and policies over time to assist in improving the quality of the community and the operation of the association. These can be found in the Documents Library on our website: www.creeksideatbethpage.org

• Homeowners are bound by these additional restrictive covenants and bylaws

• The City of Durham picks up household garbage within our Creekside at Bethpage neighborhood every Monday. Recycling occurs every other Monday. HOA rules allow for homeowners to place trash receptacles by the curb on Sunday evening, returning them to their proper place by Monday evening

• Contact the city to order a trash receptacle (various sizes available) if you are new to the neighborhood or need a replacement at 919-560-1200

Clubhouse Hours/Information

• Hours are posted on hemingwayhall.clubexpress.com • Pool hours are subject to change based on weather/safety • Guests are required to register at front desk and pay a $3.00 fee • Guest passes may be purchased in advance, but registration is
