Meeting of the Eastern Regional Committee (ERC), National Council for Teacher

Education (NCTE) was convened on 4th – 6

th February, 2016 at Conference Hall, ERC, NCTE, 15,

Neelakantha Nagar, Nayapalli, Bhubaneswar. The Chairperson, Members and Convener as listed below

were present at the time of the 203rd

ERC Meeting.

At the outset, the Regional Director welcomed all the members of Committee and apprised

them about the provisions of the NCTE Act, Rules, Regulations and Guidelines issued from time to

time. With the permission of Chairperson, Shri Mukesh Kumar (Convener) presented the Agenda before

the Committee for its due consideration and appropriate decision.

ATTENTION!

1. The committee unanimously decided that the institution may reply in

response to the decision of the committee uploaded on the ERC

website without waiting formal letters from the office of ERC. The

replies so received will also be considered by the committee.

2. The Endowment Fund / Reserve Fund (5 Lakhs + 7 Lakhs) is 12 Lakhs

per programme. (See ERC website for detail).

3. The institution need to submit list of 10 schools for internship and

school based activities duly approved by District Education Officer.

4. Institutions must give the affidavit for consent / willingness for

number of units either one or two if it was not submitted earlier.

5. The institution shall comply with the additional facilities required

(additional built-up area, additional staff, additional funds etc) for the

SECOND UNIT as prescribed in NCTE (Recognition Norms and

Procedure) Regulations 2014 before 31.10.2015.

6. As per provisions u/s 17(4) of the NCTE Act, 1993, if an institution

offers any course or training in Teacher Education without obtaining

recognition or permission under this Act, the qualification in teacher

education obtained pursuant to such course or training or after

undertaking a course or training in such institution, shall not be treated

as a valid qualification for purposes of employment under the Central

Government, any State Government or University, or in any school,

college or other educational body aided by the Central Government or

any State Government.

7. The Committee suggested to prepare Data Bank for the teachers.

8. The institution needs to install Fire Safety equipment and submit

the Fire Safety Certificate if not submitted earlier.

(vi) Original copy of affidavit on Rs. 100/- stamp paper mentioning the details of land in the

prescribed format.

(vii) Notarized copy of Change of land use certificate.

(viii) A clear copy of Non-encumbrance certificate.

ER-203.3 Circulars/ Guidelines/ Instructions received from NCTE Headquarters

328 203.3.1 F.49-1/2016/NCTE/ N&S 20483 dated 19.01.2016 received from NCTE

Hqrs.

This letter has been circulated by NCTE HQrs. to all Regional Committees of NCTE with reference to

clarification sought by WRC, Bhopal regarding requirement of land and Built up area in cases where an

institution conducting 1 unit of D.El.Ed. + 1 unit of B.Ed. + 1 Unit of M.Ed. Course has applied for 1

unit of B.A B.Ed / B.Sc.B.Ed integrated Course. It is stated in the letter that this clarification may be

brought to the notice of the Regional Committee.

It is noticed that in case of B.Sc.B.Ed / B.A. B.Ed. course, a specific provision exists for infrastructure

under clause 6.1 of Appendix 13 of NCTE Regulations 2014; which inter alia provides that the

Department of Education shall possess 3000 sq. mts (three thousand square metres) of exclusive well

demarcated land for the initial intake of one hundred students out of which 2500 sq. mts (two thousand

five hundred square metres) shall be the built up area and the remaining space for lawns, playfields etc.

and that the institute shall have one classroom for every 50 students with an area of 500 sq. ft for each

classroom.

The clarification given by NCTE HQrs. is as under:

If a TEI having multiple Teacher Education courses applies for an additional 4 years integrated course,

it should have land and built up area as defined for various combination of courses and an additional

minimum required land / built up area as specified for the additional unit of B.Ed programme i.e. 500

sqm of land and built up area each. This is based on the fact that in the Regulation 2014, the

infrastructural requirement for a B.Ed programme/ Educational component of B.Sc. B.Ed./B.A.B.Ed. is

the same (table under clause of Appendix 4 for B.Ed course). It is expected that in all combination of

teacher education programmes with B.Sc. B.Ed/B.A.B.Ed course, the total land and built up area shall

not be below 3000 sqm of land and 2500 sqm of built up area (as specified in the Norms for B.Sc.B.Ed /

B.A.B.Ed. course) as mentioned in para 2 above. It is also expected that number of classrooms and labs

as prescribed under the Norms of relevant integrated programme shall be accommodated in this

additional land / Built up area.

The committee noted the clarification given by the NCTE Hqrs.

Issuance of NOC with countersignature of Registrar, University of Gour

Banga for the purpose of establishment of new B.Ed. Colleges under the

University in the State of West Bengal

The ERC in its 202nd

meeting held on 18-23 January, 2016 have considered the case of some teacher training

institutions who have applied for grant of recognition/permission for the session 2016-17 under the

University of Gour Banga and decided that Show Cause Notice u/s 14/15(3)(b) of NCTE Act, 1993 be issued

in the matter of issuance of NOC by Dr. Rajib Patitundi, Development Officer, University of Gour Banga

instead of Registrar, University of Gour Banga apart from other deficiencies.

Further, in the said meeting, the Committee decided on some cases that VT/ Composite VT may be

constituted subject to submission of NOC with countersignature of Registrar of University of Gour Banga.

This is relevant to mention that on the above context, a letter vide Ref. No.051/UGB/VC-16 dated 28.01.2016

has been received in ERC office on 03.02.2016 from Professor Gopalchandra Misra, Vice-Chancellor,

University of Gour Banga, P.O. Mokdhumpur, Dist. Malda, West Bengal-732103 stating therein as under:

“… This is to put on record that the post of Registrar of the University of Gour Banga is lying vacant

for the time being and in pursuance of the resolution taken in the 1st Meeting of the Executive

Council of this University held on June 4, 2015 under agendum No. 02 (Miscellaneous) and in

exercising the power conferred upon the University under Section 6 of the “Gour Banga University

Act, 2007”, the Development Officer, Dr. Rajib Patitundi, was asked to put signature for the

Registrar of the University of Gour Banga on the official circular(s), notification(s), order(s) etc.

which shall duly be asked to him by the Vice Chancellor.

Therefore, it is clarified that as per the direction of the Vice Chancellor, Dr. Rajib Patitundi,

Development Officer of the University of Gour Banga had put his signature for the Registrar of the

University of Gour Banga on all the NOCs that were submitted to the ERC-NCTE by the authorities

of different B.Ed. Colleges for the purpose of establishment of new B.Ed Colleges under the

University”. A copy of Circular vide Ref. No.141A UGB/VC-15 dated 09.06.2015 issued by the VC,

University of Gour Banga delegating the powers upon Dr. Patitundi in exercise of the power

conferred upon the University of Gour Banga under Section: 6 of UGB Act, 2007 has also submitted.

The committee noted the decision of Vice Chancellor, University of Gour Banga and decided to

consider the NOC issued by Dr. Rajib Patitundi, Development Officer for further necessary action.

State of Jharkhand.

A letter dated 22/25.01.2016 followed by reminder on 27.01.2016 was issued by Chairperson, ERC to

Chairperson, NCTE, New Delhi seeking clarification in the matter of issuance of NOC for D.El.Ed.

programme by examining/affiliating body i.e. Jharkhand Academic Council, Ranchi.

In response, the NCTE Hqrs. vide letter dated 03.02.2016 has given clarification as under:

“... In view of the clarification received from Director of Primary Education, Government

of Jharkhand, as quoted in your letter dated 25th

January 2016 that the State Government has No

Objection for opening D.El.Ed course in the State of Jharkhand in accordance with NCTE Rules and

Regulations, 2014 and in the context that Jharkhand Academic Council, Ranchi is authorised only to

conduct examination for the institutions recognised by NCTE, it is felt that it will be expedient for

the ERC to further process the application for the said course, without insisting on NOC of the

Jharkhand Academic Council, Ranchi at this stage.”

The National Council for Teacher Education (NCTE) has filed S.L.P.(c ) No. 2779-2780/2016 against the

order dated 05.10.2015 in W.P.(c) No. 7409/2015 passed by the Hon’ble High Court of Orissa at Cuttack.

The Hon’ble Supreme Court of India upon hearing the Counsel the Court made the following order:

“Issue Notice returnable within six weeks”.

However, the National Council for Teacher Education (NCTE) shall comply with the order passed

by the High Court in the meantime.

Keeing in view the Hon’ble Supreme Court direction the Eastern Regional Committee considered

the application of the petitioner institution and given its opinion as follows:-

The Committee observed that the land area is only 1.655 Acre as per building plan submitted for B.P.Ed.

programme whereas the requirement of land for B.P.Ed. programme is at least 5-8 Acre as per NCTE

Regulation 2014. The building plan submitted for B.Ed. & B.P.Ed. programme is not approved by any

Govt. Civil authority. The land document is in regional language i.e. odia version. The notarized translated

copy of English version not submitted.

Hence, the Committee decided to ask the university to submit a blue print of building plan

indicating total land area as well as total built up area as per requirement of NCTE Regulation 2014 duly

approved by Govt. civil authority and notarized translated land document in English version for taking

appropriate decision in the matter.
