“Heidelberg is itself a resplendent romantic, where spring entwines the houses and courtyards

and everything ordinary with vines and flowers, and castles and forests tell a wonderful sto-

ry of times gone by, as though there were nothing evil in the world”, wrote the poet Joseph

von Eichendorff at the start of the 19th century in his memoirs. Heidelberg has succeeded in

preserving this irresistible magic right up to the present day. The Neckar, which winds pictur-

esquely through the green valley, and the romantic castle ruins, which tower over the roofs of

the scenic old town, attract several million visitors to the town every year. Heidelberg is linked

as inextricably to the castle – residence of the Electors of the Palatinate for almost five centu-

Heidelberg Philosopher’s Walk is widely known. At one time, scholars strolled here in stiff frock

coats to clear their minds with a walk. On the sunny side of the Heiligenberg, many scholars

often gained new insights, and there were always unique views of the town, the river, the Old

Bridge, the Castle and the almost 600-meter high “Königstuhl” (King’s Seat hill).

I . OLD TOWN AND CASTLE TOURS Our Classics

2. Castle TourIt towers majestically above the roofs of the old town and impresses millions of people year after year - the Heidelberg Castle. With a tour through the castle courtyard and the castle garden, you can immerse yourself in the col-orful history of the world-famous structure. A visit to the giant barrel, the largest wine barrel in world ever to be filled, is also featured on the program (no inside areas).

3. Old Town and Castle TourThe combined old town and castle tour brings history to life. With a tour through the winding alleys of the old town you can get to know the many different faces of Heidelberg – dreamy squares, the oldest university in Germany, the Heiliggeistkirche (Church of the Holy Spirit) and the Jewish Quarter. And then it’s up to the castle with the funicular railway. In a tour around the inner courtyard and the castle gar-den you can discover the electoral residence ruins and visit the famous giant barrel.

4. City and Castle sightseeing tourWith your own bus, you can enjoy Heidelberg town center in comfort (approx. 1 hour), be-fore continuing on to the Castle. Here you will discover the electoral residence ruins in a guided tour (no inside areas).

If arriving with your own bus, we recom-mend Neckarmünzplatz as a meeting point for joining up with the tour guide and, if arriving individually, the Löwenbrunnen at Universitätsplatz. Further meeting points you will find at the booking form at page 28.

Note: For Castle tours, prices for admission into the Castle courtyard are not included in the rates. You can find more information on en-try to the Castle courtyard on page 25

(Castle ticket including funicular railway). For coach groups with more than 28 peo-ple, a second tour guide is necessary for the Castle tour (extra charge: German € 85, other languages € 95).

5. Old Town Tour with Boat TripDiscover the beauty of Heidelberg with an old town tour and then experience the special at-mosphere of the town in a 40-minute boat tour along the banks of the Neckar. This com-bined tour on foot and by boat will give you access to the Heidelberg triad of the river, the town and the Castle.

1. Old Town TourWinding alleys and dreamy squares, interest-ing museums and galleries: Heidelberg’s Old Town is multi-faceted. A guided tour around the old town brings the past to life. Wheth-er the Heiliggeistkirche (Church of the Holy Spirit), the Jewish Quarter, Germany’s oldest university with the Studentenkarzer (student’s prison) or any of the other sights, every station in the old town has an interesting story to tell. The route also leads through the main street, one of the longest pedestrian zones in Europe.

6. The Truth about Heidel-berg - an entertaining tour by and with Mark Twain

The major American writer and comedian Mark Twain takes an hour to lead you on a guided tour through Heidelberg. He describes the sights, history and inhabitants of the town from his personal per-spective in his typical way. His motto: “Truth is the most valuable thing that we have. Let us econo-mize it!” A walking delight.

7. Out and about with the “Bürgersfrau” in Heidelberg

Back then, luxurious dining was commonplace in the court, but the common people lead a hand-to-mouth existence. It was said: As you have brewed, so must you drink - and from the common cup. A Bürgersfrau (middle class/bour-geoisie woman) accompanies you on a tour through the town, gos-siping about the daily comings and goings in the old town while shar-ing some inside secrets. Eavesdrop on her stories about the high-class ladies and gentlemen, juicy stories from the court included.

8. Witches, oppressors and poor sinners:Straight out of Heidelberg’s judicial history

In earlier times, executions were real fairs. In 1762 the universi-ty was closed so the students could take part in an execution - an “abhorrent example”. In this tour you will be led through the centuries with a “real” witch. On the way through the town, she tells of amusing ordinances and gruesome punishments. History of the town is not for children or the light-hearted.

9. Through the dark alleys of Heidelberg with the night watchman

Since the Middle Ages, the night watchman has ensured the safe-ty of the citizens within the town walls. When the Romantics be-gan to celebrate Heidelberg in songs and immortalize the enor-mous castle ruins in copper en-gravings at the start of the 19th century, guests came from all over the world to the Neckar. The night watchman also protected them from robbers, fraudulent antique dealers and other immoral of-fers. Go through the alleys of the old town by the side of the night watch while he tells you stories from days long forgotten.

21. Luther TourHeidelberg was a milestone en route to the Reformation – Luther’s not uneventful journey to Heidelberg in 1518 was his first theological appearance outside of Wittenberg after nail-ing his 95 theses to the door on October 31, 1517. On the invitation of the Augustine Or-der and Elector Ludwig V., he led the Heidel-berg Disputation in April 1518 in the local Au-gustine Monastery and, in doing so, defended the fundamental concept of his new theology – the full dependency of people on the grace of God. This interesting stroll will lead you on Luther’s trail through the town.

23. “Wissen-schafft-STADT” As part of the international building exhibition (IBA) HeidelbergThe IBA (Internationale Bauausstellung = International Building Exhibition) is a German format for building culture and urban development with a hundred year old tradition. Christmas Market TourThe scent of roasted almonds wafts through the alleys of the old town and handicrafts and winter delicacies are peddled in enchanting lit-tle wooden stalls – the Heidelberg Christmas Market with its individual stalls is one of the most beautiful Christmas markets in Germany. Heidelberg history, pre-Christmas traditions and festive anecdotes await you in this tour. 24. “It’s Burning!!!”Medieval Heidelberg and the Heidelberg Cas-tle went up in flames in 1693. In the great fire during the Palatinate War of Succession, the city was completely destroyed - the blaze was horrific. Therefore, it is not surprising that an important impetus for firefighting emanated from Heidelberg. One of the oldest volunteer fire brigades in Germany was started here in 1846 – and is closely linked to the Heidelberg fire extinguisher manufacturer, Carl Metz.

Heidelberg Stadtrallye (city rally)Discovery tours for a communicative experi-ence Heidelberg’s romantic Old Town provides a board to play the games with its winding al-leys and beautiful squares. There are tricky puzzles and tasks for participating teams to solve. At the prize-giving, all participants will receive a “lesson”.

28. Guided hike to Benedictine Abbey Stift NeuburgThe hikes leads along the Philosopher’s Walk, Heidelberg’s famous natural balcony, and then further on through the woods to the “Neuenheimer Schweiz”, an impressive nature reserve with great views into the Neckar valley. Finally, you will reach the old Benedictine Abbey Stift Neuburg where you can have a tour of the monastery church after the hike. A stop at the restaurant “Gasthaus zum Klosterhof” rounds this tour off.

27. “Philosophical” Segway tourIn this tour you have the opportunity to discover Heidelberg in a totally extraordinary way. Fol-lowing an introduction, you will glide along the Neckar until you reach the historic and trendy district of Neuenheim. From here you will continue on along the water in the direction of the zoo and through the Neuenheimer Feld campus with its impressive university and hospital build-ings. 31. Ceramic paintingThe are countless occasions and opportunities to take great pleasure yourself from time spent at the ceramic furnace being creative, as well as giving joy to others. You will have the opportunity to pick out a piece of pot-tery at the “Keramikofen” (ceramic kiln) in the Heidel-berg Old Town (like a bowl, an amusing figurine, a stein, etc.) and design it the way you want. Take inspiration from templates or get interesting tips from the owner on color combinations or special effects. The final painted ceramics are glazed and fired and sent out to you with-in one or two days. A ceramic piece, welcome glass of sparkling wine and canapés are included in the program.

32. Take a Ride with the Historic StreetcarThe Old Town, the Castle, the shopping boulevard - Hei-delberg is world famous for its attractions and points of interest. We invite you to go off the beaten tourist paths and discover some of the best kept secrets - during a tour on the historic streetcar through the city’s Hand-schuhsheim and Neuenheim neighborhoods. Hop-on/hop-off of the historic streetcar whenever and as often as you want. You can also choose the route you want along the railway network. A trained tour guide will ac-company you on your journey.

Wine tasting with Old Town tourAfter an hour-long tour through the winding streets and alleys of the Heidelberg Old Town, your wine expert welcomes you to the tradi-tion-steeped and convivial Kulturbrauerei, where you will become ac-quainted with excellent regional wines from the Seeger vineyard (Lei-men) and the Heger vineyard (Ihringen). Cold snack platter will served during the wine tasting with all kinds of treats. This is topped off with a hearty meal including regional delicacies.

33. Wine tasting in the Heidelberg Old TownUnder the leadership of our wine expert, you will have the opportu-nity to get to know six different wines in the “Zum Güldenen Schaf” restaurant. ABBEYSTIFT NEUBURG

Embedded in the Neckar valley, surrounded by lush green with a divine view of the winding river and the slopes of the Odenwald moun-tain range, the monastery is an attraction for both locals and tourists. The Benedictine ab-bey was founded back in 1130 by the Lorsch monastery and constantly battled a difficult economic situation until the monastery was dissolved in 1562. For a long time after that, the building was used for a variety of pur-poses, including as a “Jungfern-Stift” (con-vent), where noble women lived together as a “society of virtuous gentlewomen” (thus the current name Stift Neuburg - convent). Since 1927 it has once again been inhabited by monks according to the rule of St. Benedict. A farm shop with organic products from the region and a small organic brewery are con-nected to the monastery. True to the Bene-dictine order, the monks dedicate themselves to pastoral care, the care and welcoming of guests with a variety of cultural programs such as concerts or talks of contemporary issues.www.stift-neuburg.de

Note for extended buses:Buses with lengths exceed-ing “standard dimensions” (up to 15 m) are increasingly being used for trips to Heidelberg. For buses which are pre-regis-tered here, we have limited the permitted bus length to 12 m. Because the parking spots at the castle bus parking bay and at Karlstor are fixed at a length of 12 m, and because there is limited opportunity for turn-ing at the castle in particular, the following rule applies: If an oversized bus arrives at Karl-stor, 1.5 parking spaces will be kept free if possible so that 2 oversized buses can be parked over 3 spaces. If booking a ex-tended-length bus at the cas-tle, the diagonal parking space furthest east must be left emp-ty to allow for coach turning. Excess-length buses may also only be parked parallel with the slope. The same applies in this case as with Karlstor. GENERAL TERMS AND CONDITIONSTerms and Conditions of Travel of Heidelberg Marketing GmbH for Group Package Trips

Dear Guests,To the extent that they are effectively agreed upon, the following terms and conditions shall become an integral part of the contents of the travel contract between you and the Heidelberg Marketing GmbH company – herein-after referred to as “HDM” – as a result of booking travel arrangements. They supplement the statutory provisions of §§ 651a - m BGB (German Civil Code) and the infor-mation requirements for tour operators in accordance with §§ 4-11 BGB-InfoV (Regulation on Information and Reporting Obligations under Civil Law) and fulfill these provisions. They apply exclusively to package travel for groups with at least 15 participants and only for the pe-riod of January 1, 2016 to December 31, 2016. Please read these travel terms and conditions carefully before you make a booking.

1. Conclusion of Travel Agreement, Status of Group Con-tracting Agency and Group Representative 1.1 The Group Contracting Agency is the institution, the association with or without legal capacity, the company or other legal entity under private or public law that com-missions HDM to provide the group trip. 1.2 The Group Representative is the person acting on be-half of the Group Contracting Agency during the trip, in particular the responsible leader appointed by the Group Contracting Agency. 1.3 In the case of trips involving private groups in the sense of these Terms and Conditions of Travel, the par-ticipants have the status of a traveler within the meaning of the statutory provisions and with the legal status of a beneficiary pursuant to the provisions of a contract for the benefit of third parties. 1.4 A group trip can only be booked in writing.1.5 For “group travel” (with overnight accommodations), at the request of the Group Contracting Agency and after agreeing the details, HDM sends a binding offer to con-clude a Travel Agreement to the Group Contracting Agen-cy as an independent contractual partner and payer. The Agreement shall only enter into force when HDM receives the written order acceptance issued by the Group Con-tracting Agency within the acceptance period stipulated by HDM. A declaration of acceptance with changes, re-strictions or extensions to the offer of HDM does not lead to the conclusion of a contract. Should any changes be requested, the customer is advised to ask for a new offer. 1.6 The following applies when booking “Special Activi-ties” (guided tours, excursions, boat trips):a) the Group Contracting Agency issues a binding offer to conclude a Travel Agreement with HDM as an inde-pendent contractual partner and payer. The Group Con-tracting Agency shall be bound to its offer of an Agree-ment for 10 days. b) the Agreement shall only enter into force when the Group Contracting Agency receives the written booking confirmation/invoice from HDM. c) Should the content of the booking confirmation dif-fer from the content of the Group Contracting Agen-cy’s booking, or if HDM first issues a binding offer to the Group Contracting Agency without a booking having been made, the Travel Agreement shall enter into force based on the modified booking confirmation or on the offer of HDM, provided the Group Contracting Agency notifies its acceptance in writing within the period stip-

ulated by HDM for this purpose, or within 10 days if no period is stipulated. 1.7 Insofar as these Terms and Conditions for “group trav-el” (with overnight accommodations) on the one hand, as well as for “Special Activities” (guided tours, trips, cruises) on the other hand, contain differing regulations, in the case of a combination of both product groups only those provisions for “group travel” (with overnight accommo-dations) shall apply.1.8 HDM points out that, according to the legal provi-sions of §§ 312 ff. of the German Civil Code, in both group tours as well as special events there is no right of with-drawal, neither for the Group Contracting Agency nor for the participants; but that only the statutory withdrawal and termination rights apply. A right of withdrawal does, however, exist when the contract for travel services was made in accordance with § 651 a of the German Civil Code outside of business premises (e.g. at home), unless the oral proceedings on which the contract is based were made in previous requests of the consumer.

2. Contractual Bases, Services, Travel Agents, Third-Par-ty Brochures2.1 The contractual service obligation of HDM is deter-mined by the trip description together with the booking confirmation and any supplementary information on the respective trip provided by HDM to the Group Contract-ing Agency. Insofar as HDM has submitted an offer in the sense of paragraph 1.5 or paragraph 1.6 Sentence 4 to the Group Contracting Agency, the foundation of the con-tractual service obligation shall be exclusively the content of this offer and any other information and statements referred to therein pertaining to the services of HDM. 2.2 Service providers (e.g., hotels, transport companies) and agencies are not authorized to enter into agreements, provide information or make assurances that differ from the agreed content of the Travel Agreement, are in excess of the contractually agreed services of HDM or contradict the travel description. 2.3 Brochures for locations and hotels that are not issued by HDM shall not be binding for HDM and its service ob-ligation, unless they have been rendered part of the ob-ject of the trip description or the content of the service obligation of HDM by explicit agreement with the Group Contracting Agency.

3. Payment3.1 All obligations on the part of the Group Contract-ing Agency to make advance payments, outstanding pay-ments or miscellaneous payments requires HDM to hand over a secured payment certificate pursuant to Article 651k of the German Civil Code.3.2 HDM may either issue the Group Contracting Agency an overall secured payment certificate for all participants, or one secured payment certificate for each participant, with the proviso that the Group Contracting Agency is obliged either to hand over the certificates to the indi-vidual participants or to hold them in trust for the par-ticipants as HDM sees fit. The Group Contracting Agen-cy has to ensure that either the overall secured payment certificate or the individual secured payment certificate is available before making a collection to the participants according to paragraph 3.3. 3.3 The Group Contracting Agency is responsible for the collection of the tour price for its participants. The Group Contracting Agency has to ensure that, as far as noth-ing else has been expressly agreed in writing, the partic-

ipants shall only pay the Group Contracting Agency and not directly to HDM. The Group Contracting Agency in turn has to pay the total payment in a lump sum with no partial payments to HDM. The total amount of the pay-ment is due to be paid by the Group Contracting Agency to HDM within 20 days prior to departure irrespective of the willingness to pay for the rest of the tour price by the participant 30 days prior to departure.3.4 The Group Contracting Agency is liable to HDM for culpable violations of its obligations for collection in ac-cordance with the above provisions, insofar as HDM has to accept a default with respect to the participants that is caused by these breaches of obligation. The Group Contracting Agency shall be liable for the total payment, regardless of a corresponding breach of obligation, inso-far as a corresponding obligation by express and separate declaration has been assumed. 3.5 In accordance with the above provisions, and partic-ularly those relating to the secured payment certificate, the Group Contracting Agency must make an advance payment that is due immediately for “Group Travel” (with overnight accommodations). The amount of the advance payment is equal to 10% of the price of the trip.3.6 Insofar as HDM has complied with its obligation to hand over the secured payment certificate in line with the above provisions, the payment or the outstanding payment shall become due 30 days prior to the start of the trip, when it has been established that the trip can no longer be canceled due to failure to reach an agreed minimum number of participants in accordance with para-graph 7 of these Terms and Conditions. For bookings made less than 30 days before the start of the trip, the entire trip price is immediately payable. 3.7 Insofar as HDM is prepared and in a position to pro-vide the travel services constituting the subject of the contract, and the Group Contracting Agency does not hold any statutory or contractual right of retention, no claim to usage of the travel services or handover of the travel documents shall exist without full payment of the trip price. 3.8 If the advance payment and/or the outstanding pay-ment are not paid on or before the agreed payment dates, HDM shall be entitled to withdraw from the Travel Agree-ment, after having issued a warning and setting a dead-line for payment, and to charge the Group Contracting Agency for the costs of withdrawal pursuant to paragraph 5 of these Terms and Conditions.

4. Payment Obligation of the Group Contracting Agency in the case of an Agreed Minimum Number of Partici-pants and Scaled Prices4.1 If a specific minimum number of participants has been agreed with the Group Contracting Agency as a basis for pricing, the Group Contracting Agency shall be liable for payment of the relevant trip price as an independent payment obligation, irrespective of the actual number of participants and without prejudice to the right of HDM to withdraw from the Agreement, where applicable in accordance with the provisions set out in paragraph 7 of these Terms and Conditions.4.2 If scaled prices have been agreed with the Group Contracting Agency in the sense that the price per par-ticipant increases if specific numbers of participants are not met, the Group Contracting Agency shall be liable for the relevant payments as independent contractual obli-gations, irrespective of the payment obligations of the participants themselves.

5. Withdrawal by the Customer Prior to Start of the Trip / Cancellation Costs 5.1 The Group Contracting Agency and the trip partici-pants may withdraw from the trip at any point prior to its start. HDM has to be notified of such withdrawal at the address stated in these Terms and Conditions. The Group Contracting Agency/trip participant is recommended to declare the withdrawal in writing. If the Group Contract-ing Agency is a trader or a legal entity under private or public law, it may only issue declarations of withdraw-al in writing.5.2 In the event that the Group Contracting Agency or the participants withdraw prior to the start of the trip or that participants do not turn up for the trip, HDM shall lose its claim to the price of the trip. However, this shall not affect the payment obligations incumbent on the Group Contracting Agency pursuant to paragraph 4 of these Terms and Conditions. HDM may, insofar as it is not re-sponsible for the withdrawal or a situation of force ma-jeure exists, demand appropriate compensation for the trip preparations made up to the withdrawal and for its outlay, depending on the relevant trip price. The Group Contracting Agency and participants shall be jointly and severally liable for these withdrawal costs.5.3 HDM has scaled this compensation claim by time, i.e., taking into consideration how close the date of with-drawal is to the contractually agreed start of the trip, as a flat-rate sum based on a percentage relationship to the trip price and, in calculating the compensation, has taken into account the usual expenses saved and other possible conventional uses of the travel services. The compensa-tion shall be calculated as follows, in accordance with the date on which notification of withdrawal is received from the customer:a) For “Group Travel” (with overnight accommodations):• up to 31 days before the start of the trip: 10%,• from the 30th day to the 21st day before the start of the trip: 25%,• from the 20th day to the 15th day before the start of the trip: 50%,• from the 14th day to the 7th day before the start of the trip: 80%,• as of the 6th day and in the event that the customer does not show up for the trip: 90%b) for “Special Activities” (guided tours, excursions, boat trips):• from the 9th day to the 5th day before the start of the trip: 50%, • as of the 4th day and in the event that the customer does not show up for the trip: 90%.5.4 In all cases, the Group Contracting Agency and the participants shall be at liberty to prove to HDM that the latter did not incur any loss, or incurred a significantly low-er loss than the flat-rate sum it is demanding.5.5 HDM reserves the right to claim specific sums higher than the flat-rates set out above. In this case, HDM must name and prove a concrete figure for the compensation being claimed, accounting for any saved expenses and any other use of the travel services.5.6 The Group Contracting Agency is advised to strong-ly recommend to the participants that they take out trip cancellation insurance and insurance to cover repatria-tion costs in the event of accident or illness; participants are strongly recommended to take out these insurance policies themselves, independently of corresponding measures and offers from the Group Contracting Agency.5.7 The above provisions shall not affect the customer’s right to provide a replacement participant pursuant to the provisions of Article 651b of the German Civil Code. In corresponding application of the statutory provision set out in Article 651b of the German Civil Code, the Group Contracting Agency and the Group Representative shall also hold the right to provide replacement participants.

6. Unused ServicesIn the event that the Group Contracting Agency and/or the participants do not make use of individual travel ser-vices that have been offered to them in a proper manner for reasons attributable to them (e.g., due to early return or for other compelling reasons), they shall have no claim to a pro-rata refund of the trip price. HDM shall strive to obtain refunds for the expenses it has saved from the service providers. This obligation shall lapse in the case of extremely minor services or if a refund would contra-vene statutory or official provisions.

7. Withdrawal by Heidelberg Marketing GmbH due to Failure to Reach a Minimum Number of Participants7.1 In the event of failure to reach a minimum number of participants, HDM may withdraw from the Agreement with the Group Contracting Agency and the participants pursuant to the following regulations:a) The minimum number of participants and the latest date for withdrawal by HDM must be stated in the spe-cific trip description or, in the case of standardized reg-ulations for all trips or certain types of trips, in a general service description. b) HDM must state the minimum number of participants and the latest date for withdrawal in the booking confir-mation, or make reference to the relevant statements in the brochure in said confirmation.c) HDM undertakes to notify the participants of cancel-lation of the trip without delay if it is established that the trip will not take place due to failure to reach the mini-mum number of participants. d) HDM shall not be permitted to withdraw later than 4 weeks before the start of the trip. e) In the event of cancellation, the customer may request participation in a trip of at least equal value assuming that HDM is in a position to offer such a trip from its range at no additional charge to the customer. The customer must assert this right against HDM immediately after the latter declares its intention to cancel the trip.7.2 In the event that the trip does not take place for this reason, the customer shall immediately be refunded any payments that he/she has made towards the price of the trip.

8. Termination on Grounds of Conduct8.1 HDM may terminate the Travel Agreement without notice in the event that the Group Contracting Agen-cy and/or the Group Representative and/or the partici-pant cause ongoing disruption, in spite of a warning from HDM, or in the event that they behave contrary to con-tract to such an extent that the immediate termination of the Agreement is justified. In the event of behavior contrary to contract on the part of the Group Contract-ing Agency and/or the Group Representative, this shall only entitle HDM to terminate the agreements with the individual participants if and insofar as it becomes objec-tively impossible or unreasonable for HDM to carry out the trips for the individual participants due to said behav-ior on the part of the Group Contracting Agency and/or Group Representative. 8.2 In the event that HDM terminates the Agreement, it shall retain its claim to the trip price; however, it must allow offsetting of the value of the saved expenses and of the benefits that it obtains from another use of the unused service, including the payments refunded to it by the service providers.

9. Obligations of the Customer9.1 The obligation to report deficiencies arising from Arti-cle 651d, paragraph 2 of the German Civil Code is set out in specific terms for trips with HDM as follows: a) Irrespective of the corresponding independent obli-gations incumbent on the Group Contracting Agency/

Group Representative, the participant undertakes to no-tify HDM without delay of any deficiencies that arise and to request a remedy. b) The participant shall be provided with information re-garding HDM as an entity, the days and times when it is possible to make contact with it and its contact details at latest when sending the travel documents. c) In the event of the participant not giving notification of a deficiency, any claims on the part of the participant will be entertained only if the participant, through no fault of his own, was unable to fulfill his obligation to give notification. 9.2 Tour guides, agents and employees of service pro-viders are not entitled and not authorized by HDM to confirm deficiencies or to recognize claims against HDM. 9.3 If a deficiency in the trip has a significant negative impact on said trip, the Group Contracting Agency or the participant may terminate the Agreement. The same ap-plies if the Group Contracting Agency/participant cannot reasonably be expected to travel as a result of a deficiency acknowledged as significant by HDM. The following shall apply with regard to this right of cancellation: a) Cancellation shall only be permitted once HDM or, where present and contractually agreed as a point of con-tact, its agents (tour operator, agency), have allowed a reasonable deadline set by the participant to pass with-out remedying the deficiency. b) A deadline does not have to be set if a remedy is im-possible or if HDM/its agents refuse to seek a remedy or if immediate termination of the Agreement is justified by a particular interest of the participant.c) The Group Contracting Agency’s right to terminate the Agreement shall apply only to the participants for whom the aforementioned prerequisites for termination are in place, unless the deficiencies leading to termination are objectively so serious that the participants and/or the Group Contracting Agency itself cannot reasonably be expected to continue the trip.

10. Special Conditions for Trips Involving Private Groups10.1 HDM shall not be liable for services and parts of services, irrespective of type, that are offered, organized, carried out and/or made available to the participants by the Group Contracting Agency/Group Representative in addition to the services of HDM, with or without the knowledge of HDM. In particular, these shall include: a) Travel organized by the Customer to and from the points of departure and return contractually agreed with HDM. b) Events before and after the trip and at the destination that are not included in the scope of services of HDM. c) Tour guides arranged by HDM at the request of the Customer. 10.2 HDM shall not be liable for measures taken and omissions made by the Group Contracting Agency, the Group Representative or the tour guide, whose services are merely arranged by HDM, prior to, during and after the trip, and particularly not for the following if these have not been agreed with HDM: a) Changes b) Instructions issued to local guides c) Special agreements with the various service providers d) Information and assurances provided to the trip par-ticipants. 10.3 Insofar as the liability of HDM towards the trip par-ticipant is to be linked to the trip price, only the trip price for the trip participant agreed between the Group Con-tracting Agency and HDM will be definitive. No account is taken of any supplements whatsoever that are levied by the Group Contracting Agency from the trip participant. 10.4 The Group Contracting Agency, the Group Repre-sentative and the tour guide, whose services are merely arranged by HDM, are neither entitled nor authorized

in the name of HDM to recognize complaints or claims brought by the trip participants before, during or after the trip. 10.5 Notifications of deficiencies by trip participants that are made only to the Group Contracting Agency and/or Group Representative shall not be sufficient. How-ever, the Group Contracting Agency/Group Represen-tative undertakes to immediately inform the tour opera-tor or agency employed by HDM for this purpose of any such notification of defects. If a tour operator or agency is not obliged to act as a point of contact for notifica-tion of deficiencies in accordance with the contractual agreements, notification must be made immediately to the head office of HDM. 10.6 Irrespective of the obligations of the trip participants to issue notification of deficiencies and of the obligation incumbent upon the Group Contracting Agency/Group Representative to report deficiencies that have been no-tified to them and pass these onto HDM immediately in accordance with paragraph 10.5, the Group Contracting Agency/Group Representative has an independent ob-ligation to report deficiencies without delay and to re-quest a remedy. 10.7 Claims of the Group Contracting Agency and the trip participants will only be entertained if they are unable to comply with the aforementioned provisions through no fault of their own.

11. Restriction of Liability11.1 The contractual liability of HDM for losses that do not arise from loss of life, physical injury or damage to health shall be restricted to three times the price of the trip, a) insofar as the loss was not caused by the Group Con-tracting Agency/participant intentionally or due to gross negligence, or b) insofar as HDM is liable for the loss incurred by the Group Contracting Agency/participant solely through the fault of a service provider. 11.2. The tortious liability of HDM for material damages which are not based on intent or gross negligence is lim-ited to three times the price of the trip. 11.3. HDM shall not be liable for disruptions to services, personal injury and material damage in connection with services that are only arranged as third-party services (e.g., excursions, sporting events, theater visits, exhibi-tions, transport services to and from the advertised start-ing point and destination) if these services are explicitly labeled as third-party services in the trip description and the booking confirmation, stating the arranged contractu-al partners, such that the customer shall recognize them as not forming part of the travel services offered by HDM. However, HDM shall be liable a) for services that consist of transporting the participant from the advertised start point of the trip to the adver-tised destination, interim transport during the trip and accommodation during the trip, b) if and insofar as the reason for any loss incurred by the Group Contracting Agency/participant resulted from the breach of obligations on the part of HDM relating to in-formation, explanation or organization. The above provi-sions shall not affect any liability on the part of HDM due to the breach of its duties as a travel agent.

12. Claims and Statute of Limitations12.1 The Group Contracting Agency and/or participant must assert claims due to non-contractual performance of the trip within one month of the date for completion of the trip specified in the Agreement. If the deadline falls on a Saturday, Sunday, or an officially recognized public holiday in the place of declaration, the deadline shall be automatically extended to the next working day. 12.2 Within the deadline, claims may only be asserted against HDM at the address given below. 12.3 After the deadline has passed, the Group Contract-ing Agency/participant may only assert claims if they have been prevented from meeting the deadline through no fault of their own. This deadline also applies to the reg-istration of luggage damage or luggage delivery delays in connection with flights, if warranty rights are assert-ed under Sections 651c, paragraph 3, 651d and 651e, paragraphs 3 and 4 of the German Civil Code. A claim for compensation for luggage damage must be lodged within 7 days and a claim for compensation for delayed luggage within 21 days of handover. 12.4 Claims asserted by the customer in accordance with Articles 651c to f of the German Civil Code for loss of life, physical injury or damage to health where these arise from an intentional or grossly negligent breach of duty on the part of HDM or one of its legal representatives or vicarious agents shall lapse according to the statute of limitations after two years. This shall also apply to claims for compensation for other loss or damage arising from an intentional or grossly negligent breach of duty on the part of the HDM or one of its legal representatives or vicarious agents. 12.5 All other claims asserted in accordance with Articles 651c to f of the German Civil Code lapse according to the statute of limitations after one year.12.6 The statute of limitations in the sense of paragraphs 12.3 and 12.4 starts on the day on which the trip should have ended according to the contractual agreements. Paragraph 12.1 Sentence 2 shall also apply. 12.7 While negotiations between the customer and HDM regarding the claim or the circumstances on which the claim is based remain unresolved, then the statute of limitations will be suspended until the customer or HDM refuses to continue the negotiations. The statute of lim-itations shall begin, at the earliest, three months after the end of the suspension.

13. Regulations Relating to Passports, Visas and Health13.1 HDM shall inform the Group Contracting Agency/the participant for nationals of a country within the Eu-ropean Union where the trip is offered of the regulations regarding passports, visas and health prior to conclusion of the Agreement, and of any changes to these prior to the start of the trip. For nationals of other countries, the competent consulate will provide the necessary infor-mation. It is assumed that there are no special factors present with regard to the customer and any co-travelers (e.g., dual nationality, statelessness). 13.2 The participant shall be responsible for procuring the necessary travel documents and carrying these with him/her, for any vaccinations that may be required, and for compliance with customs regulations and those per-taining to foreign currency. The participant shall be liable

for any penalties that result from the failure to comply with these provisions, e.g., the payment of cancellation costs. This shall not apply in the event that HDM has not provided information, or has provided information that was inadequate or incorrect.

14. Applicable Law and Place of Jurisdiction14.1 The contractual relationship between the Group Contracting Agency/participant and HDM shall be gov-erned exclusively by German law. This shall also apply to the legal relationship as a whole. 14.2 The Group Contracting Agency/participant may only institute legal proceedings against HDM at its head office. 14.3 Lawsuits brought by HDM against the Group Con-tracting Agency/participant shall be referred to the court having jurisdiction over the customer’s place of domi-cile. The agreed place of jurisdiction for lawsuits brought against Group Contracting Agencies/participants who are merchants, legal entities under public or private law, or persons domiciled or ordinarily resident abroad, or whose domicile or ordinary place of residence is unknown at the time the lawsuit is brought, shall be the head offic-es of HDM. 14.4 The above provisions shall not be applicable if and insofar as mandatory provisions applicable to the Travel Agreement within the EU member state to which the par-ticipant belongs are more favorable for the customer and/or the Group Contracting Agency than the above provi-sions or the corresponding German regulations.
