COMPLIANCE STATEMENT ON PUBLIC HEARING (VRMP)

S. No Public Comments HPCL Reply

1. Shri K Badrinath (Ex Corporator) We do not oppose the expansion. The fears of the people to be removed. There should be thorough monitoring on the Pollution. There was increase in capacity from 3 MMTPA to 8.3 MMTPA. Now it is going to be increased to 15 MMTPA. At the same time, pollution also will be increased. It has to be kept in notice by the Pollution Control Board. There is no problem to the permanent workers, however, there are problems to temporary workers. In case of any accident, there is no hospital in the nearby areas. Though the GVMC Hospital established with the initiative of the then MLA Malla Vijaya Prasad, no Doctor is available. No Maternity Hospital is available. Under Corporate Responsibility, the Company has to provide Doctors. You also help the neighboring people as per Mumbai Refinery. At the time of fire accident in colony near to the Refinery, the Company has provided 450 asbestos sheets. We are thankful to the Corporation. However, it will be appreciable if the Company help the people.

A variety of pollution control measures is in place in existing refinery viz., Sulphur Recovery Units, Fuel Gas Amine Absorption Unit, Flue Gas Desulphurization Units and

Flare with proper water seal and steam dispersion for safely burning the refinery flare gases. Under proposed project also,

Pollution control means i.e. Sulfur recovery Unit, Fuel Gas Treatment Unit, Integrated Effluent Treatment Plant etc. has been envisaged. Rs.1437 Crores is specially allotted for this purpose. Also there is an yearly recurring expenditure budget of Rs. 4.0 Cr. for the same. Green belt provision as per MoEF compliance is also envisaged under this proposed project. A detailed EIA study has been carried out for the project as per approved Terms of Reference given by MOEFCC. Though the capacity will increase from 8.33 MMTPA to 15 MMTPA, pollution levels will be within the stipulated norms. The total SO2 emissions after VRMP will be within the consented limit of 11.5 TPD. An air modeling has been carried out for predicting max ground level concentrations (GLC) in post project scenario. The resultant GLC’s Post project are estimated within the standard value. Baseline data in terms of various parameters were collected for one season. Parameters in the vicinity were found within limits. Details are provided in EIA report. As a responsible corporate citizen, HPCL has taken up Corporate Social Responsibility initiatives in different thrust areas such as Child Care, Education, Health Care, Livelihood and Community Development. In 2013-14, HPCL‟s expenditure on CSR activities is Rs 1.43 crore which includes Rs 1 crore expenditure on construction of oncology block at King George Hospital, out of the total expenditure of Rs 5 crore over the period of five years (Rs 1 crore annually). The other activities supported by HPCL in Vizag during 2013-14 include provision of hospital furniture for newly constructed additional block of St. Ann‟s Jubilee Memorial Hospital, school furniture, stationary for SC/ST students in

various schools. The estimated capital cost expenditure on Healthcare/ Medical facility under VRMP is Rs. 180 Lakh in span of 4 year of project construction phase.

HPCL will continue to extend its support to activities towards social development as sanctioned under CSR budget. The activities undertaken under CSR will be regularly disseminated through mass media.

2 Seeram Pydiraju (Ex Standing Committee Chairman, GVMC, ex-Corporator) There was no development when the Refinery was established in the year 1957. Now very much development there. The local people to be provided with employment opportunities on the part of the enhancement of this project. There is very much pollution in this area. We face many problems in the past due to Coromandel, Zinc and HPCL. The people residing in Ramnagar, Malkapuram, Sriharipuram, Gullapalem and other areas have been suffering from sickness. Many people in these areas are very poor. There are no medicines for their sickness. When there was a fire incident in Visakh Refinery, it was compelled to go to Mumbai for treatment. It is necessary to adopt wards in King George Hospital and other Government Hospitals. Save the lives of the people. At the time of heavy rains, there are many problems due to nallas situated at Ramnagar and Gullalapalem. The stream to be cleared for every 3 months. Arrangements to be done that water should not come into the houses of these areas. More importantly, all the people are having hope on employment

There is no drainage from the refinery routed to nallahs situated at Ramnagar and Gullalapalem. Regular cleaning of nallahs passing through the refinery is being taken up.

3 RAMPRASAD (DISTRCT UNION LEADER) We have no objection for expansion. But in the year 2009, Central Pollution Control Board has rejected the expansion due to pollution and suggested the expansion at any another place. You have not taken the lands given by the APIIC for expansion and you are expanding the project here only.

4 Pilla Kanakaraju (Ex-Corporator) A lot of pollution issues are there in this area. In rainy season drainages overflowed, total industrial area is completely polluted. I am not against the expansion. Keeping in view of accidents in future, please construct one Hospital in this area for immediate treatment. HPCL should supply drinking water to every residence. In previous accidents so many persons were expired. It should not repeat again.

Please take all the precaution measures to control the accidents. Mainly control the drainage overflowing in rainy season

5 M. Jaggu Naidu (CPM City Committee Member) HPCL is going to double their capacity. Tell us the what steps HPCL is going to take to control the pollution and accidents? Accidents are happening in HPCL. In 1997, 14th Sept. due to explosion 61 contract workers were expired. Public in surrounding areas were ran away from this area. corrective steps. In 2013 August 23, 26 contract workers were lost their lives. Accidents are common in production areas. This is different accident and it can be controllable. Only due to negligence and not following the safety rules, this accident was happened. Only for 8.33 MTs capacity, this is the situation if it expands to 15 MTs, where is the guarantee for safety? Explain…. Whenever accidents happened, Investigation Committees were formed and they were submitting Reports, but no action on any of the officials? Accidents were repeating because no disciplinary action is on officers. This area is totally polluted and diseases pertaining to brain, lungs, asthma are prevailing. HPCL is releasing poisonous gases in rainy season. Children and aged people were facing so many health problems. Boring water totally polluted in Venkannapalem, Sriharipuram, Gullallapalem, Malkapuram, Ramnagar. Not only HPCL, there are many chemical industries are here. This became a chemical hub. All precautions to prevent accidents and safety to be provided to the persons working inside and also to the public living in surrounding areas. HPCL should mainly help the local workers. There was no minimum facility for contract labour working inside. No toilets for contract workers. As a principal employer HPCL should provide the above facilities. Maintenance jobs are key jobs. Contract workers are doing these jobs without minimum wages. It is HPCL

Oil refining is a process which involves inherent risks due to handling of crude and products which are inflammable in nature. The risk thereof is minimised by adopting the highest standards of safety in design and day-to-day operation. The safety measures followed in the refinery include Safe Work Practices, Operating Manuals conforming to OSHA-PSM standards, Comprehensive Work Permit System conforming to OISD norms, periodical Safety Audits, Emergency Preparedness Plans, etc. Quantitative Risk Assessment (QRA) has been carried out for the project and all the recommendations thereof will be adequately addressed besides strict compliance with the existing safety regulations in the refinery

No poisonous gases are released by the refinery. All the gaseous emissions from the refinery are well within the stipulated norms. As per health records of HPCL, no prevailing endemic diseases were recorded in the past 10 years for people working within refinery complex.

Awarded contractors are not paying minimum wages to their workers and also not producing quality work. Management is not looking the above issues and not implementing the statutory compliances. Workers can be permanently employed who were doing permanent nature jobs. Injustice is going on employment also. When lands were taken from local people in 1958, it was promised to provide employment but 36 persons were only taken on permanent basis, still 176 workers are on contract basis. Request to permanent all these workers. When contracts awarded to non-local contractors, they are bringing workers from their locations and no employment for local people. Minimum 75% employment should be provided to local persons. Outside contractors can provide permanent jobs to any location persons but other jobs can provide to local persons. Visakhapatnam is an Industrial city. Industries should develop here. Public Sector companies to come, we will welcome all these but HPCL has to take responsibility to construct Hospital, free education to children, free medical facilities.

6 Mangal kakkad, Eastern Naval Command:

Requested the HPCL Management to clarify on the following issues:

A. With this new expansion project what is

going to be impact on environment basically in-terms of Traffic, Pollution i.e. Sulphur, Nitrozen and TSP contents in the air.

The current level of TSPM emission from the refinery is in the range of 0.9 to 1.0 T/day against the statutory limit of 1.11 T/day. A detailed EIA study has been carried out (as per the approved Terms of Reference given by MOEFCC) to analyse the impact of the project on each component of environment, i.e., air, water, land, soil, flora & fauna and socioeconomics and it is found either low or medium. The emissions will be within the limits of statutory norms. The total SO2 emissions after VRMP will be within the consented limit of 11.5 TPD. An air modeling has been carried out for predicting max ground level concentrations (GLC) in post project scenario for SOx (41.09 microg/m3) & NOx (49.0 mircrog/m3). The resultant GLC’s Post project are estimated within the standard value (80.0 microg/m3 for both SOx and NOx). Various statistical parameters like minimum, maximum, Average and 98th percentile concentrations have been computed from the data generated during sampling period at all the sampling stations

for PM10 & PM2.5 and impact analysis has been carried out. There is no significant impact due to these parameters. Further details are provided in EIA report. The traffic management measures shall be adopted such as minimisation of the problems associated with road traffic accidents. A Traffic Management Plan shall be developed and implemented. This shall include the appropriate routing and scheduling of Project traffic, setting suitable speed limits to be observed by Project vehicles and trucks, specific training requirements for Project drivers, procedures for vehicles travelling in convoy and abnormal loads. This plan shall be communicated throughout the workforce and enforced with appropriate disciplinary measures.

7 Lakshaman Murthy (CPM) There is no jobs, no facilities and no minimum wages for local workers. Nobody is taking up these issues. HPCL management is not taking care of contract workers. Are you implementing G.O.s ? Day by day diseases are increasing, especially lung diseases. Pregnant and infants are suffering more. Road accidents have been increased. Water pollution is there. No drinking water. Skin diseases are there while using bore water. Why public is tolerating this, only for the reason to get employment. Shut down works are giving to non-local. Is it correct? Local public also to get benefit while developing.

8 G. Nageswara Rao (45 Ward, YCP Party) Pollution is more in this area. Public are suffering from diseases. Compensation paid to employees. But what is the position of public staying locally ? There is no hospital nearby. Doctors are not available in GVMC Hospital. HPCL has to adopt GVMC Hospital. People are in fear about pollution due to this expansion. Take action to control the pollution

9 T. Srirama Murthy (District President, AP Human Rights Commission) Postpone the expansion. HPCL failed in many issues. Not implementing statutory compliance. There is no information about expansion to public. No structured system for controlling pollution. Public have no faith in this. What they did to this area in the last 50 years under Corporate Social Responsibility? After implementing all these, go for expansion.

The notice for Public Hearing conduction of Public Hearing in ‘Deccan Chronicle’ as National Daily and ‘Andhrajyothi’ as vernacular language Newspaper was published on May 24, 2015 in line with MoEF guidelines.

HPCL refinery has all the required facilities for control and monitoring of gaseous emissions which are well within the stipulated limits. State-of-the-art Effluent Treatment Plants are in operation in the refinery to treat the liquid effluent towards meeting the stipulated quality parameters. HPCL has undertaken many activities towards social development in the vicinity of the refinery as part of its Corporate Social Responsibility. During 2009-10, a total expenditure of Rs 1.32 crores was undertaken by HPCL for various CSR activities in the healthcare and education sector and upliftment of SC/ST/backward communities and for physically challenged persons. During 2010-11, the social initiatives supported by HPCL include provision of artificial limbs to Sri Gurudeva Charitable Trust, providing PCs, inverters etc for visually impaired girl students, construction of additional class rooms, stationary and teaching aids to various schools, and scholarships for SC/ST/OBC and visually impaired among

others. The total expenditure undertaken by HPCL in 2010-11 was to the tune of Rs 1.09 crores. Similarly, the expenditure on CSR initiatives/activities during 2011-12 was Rs 1.06 crore spanning activities in the healthcare, education and community development areas. In 2012-13, for the activities undertaken under CSR the total outlay was Rs 1.22 crore which included providing an ambulance to Vivekananda Medical Trust, wheelchairs to M/s. Ability People, school furniture, scholarships for SC/ST/OBC students and for visually impaired students. In 2013-14, HPCL‟s expenditure on CSR activities is Rs 1.43 crore which includes Rs 1 crore expenditure on construction of oncology block at KGH, out of the total expenditure of Rs 5 crore over the period of five years (Rs 1 crore annually). The other activities supported by HPCL in Vizag during 2013-14 include provision of hospital furniture for newly constructed additional block of St. Ann‟s Jubilee Memorial Hospital, school furniture, stationary for SC/ST students in various schools. Under Corporate Social Responsibility, HPCL has committed to work towards improvement in the living conditions of local population near the project, particularly in the areas of health & hygiene, civic amenities, infrastructure, education & training, water supply etc. Total CSR expenditure proposed is Rs. 10 crores during construction phase of the VRMP project which shall be around 4 years. This amount is over and above the allocations for 2014-15 CSR activities as mentioned above and aligned to the MOEF OM

of 11.08.2014. Subsequent expenditure on CSR shall be guided by HPCL‟s CSR policy.

Madhubabu (Local Leader) It is stated that employment will be provided to locals when expansion is done. Till today how many jobs were given to local? Technical qualified persons are there locally. Provide opportunity to everybody. HPCL has to adopt surrounding five villages. However locals are getting some help but it has to be increased. HPCL has to supply 20 ltrs. drinking water per house. There is no college in this area. HPCL has to construct the same. It is good, people will get employment when expansion is there. But

11 Ganesh Mishra (Union Leader) Now 90% jobs are giving to non-local. In expansion jobs and afterwards also 90% employment to go given to local workers only. Contractors are not making wage payments to their workers after receiving bill amounts from HPCL. HPCL has to take action against these contractors. One injured in the last fire accident was still in the hospital whose burns % is 55%. No help provided to him even representation submitted through the Minister. Expansion is required. HPCL products are necessary for the country. But is not correct that locals should bear loss and face difficulties. 5 lakhs of people living in the neighbor-hood. Pollution levels are increasing day by day. All unions join together to fight. Provide employment, medical facilities and minimum wages. Public hearings to be conducted every year not only for expansion. Safety to be reviewed periodically.

All the injured personnel in the last fire accident have been treated and discharged from the hospital. No representation is pending with HPCL in this regard. expansion point of view. Plot plan for the new

units has been adjusted in view of restricting

the major Individual risk to Refinery compound wall only. HPCL will continue to extend its support to activities towards social development as sanctioned under CSR budget. The activities undertaken under CSR will be regularly disseminated through mass media.

12 Lakshmana Rao (TSTUC District Joint Secretary) There are other industries are also there in this area. Each industry is releasing pollution. No details how much % of pollution releasing by each industry. Safety rules to be strictly followed. We are not against the industries and expansions. But pollution to be controlled fully. To provide employment to local workers and have to pay minimum wages.

13 P.V.S. Madhav (BJP Leader) HPCL is also part in development of Visakhapatnam. It is to be changed as Green Refinery after modernization and expansion and it should not be harmful to environment. Hydro carbons are important for nation’s development. In small countries like Singapore with 50 lakhs population having 4 Refineries with high safety measures and less accidents. HPCL has to review the systems & procedures of the same to implement here. There is no Burns Hospital in this area. Burns ward is there in KGH. Patients had airlifted to National Burns Hospital at Mumbai at the time of fire accidents at HPCL & VSP. Same type of hospital to be constructed here. At the time of 1997 fire incident, public become panic and ran away to nearby cities and some climbed the hills. There is no awareness in the public to face that type of situations. Kindly increase the awareness in the public by giving booklets, etc.

Earlier Disaster Management discussed on safety and collected public opinion and advised measures. No action has been taken on that. If it repeats what is the situation. Request to take strict measures on safety.

Oil refining is a process which involves inherent risks due to handling of crude and products which are inflammable in nature. The risk thereof is minimised by adopting the highest standards of safety in design and day-to-day operation. The safety measures followed in the refinery include Safe Work Practices, Operating Manuals conforming to OSHA-PSM standards, Comprehensive Work Permit System conforming to OISD norms, periodical Safety Audits, Emergency Preparedness Plans, etc.

Normally, for any new project, Rapid Risk Analysis has been carried out based on consequence analysis. However, considering safety as our dictum, Detailed Quantitative Risk Analysis has been carried out for the existing refinery and proposed VRMP facilities. Plot Plan for the new units has been adjusted in view of keeping the societal risk within the refinery premises. All the necessary requisite safety features shall be taken care in design of new units in line with national & international standards.

During 2009-10, a total expenditure of Rs 1.32 crores was undertaken by HPCL for various CSR activities in the healthcare and education sector and upliftment of SC/ST/backward communities and for physically challenged persons. During 2010-11, the social initiatives supported by HPCL include provision of artificial limbs to Sri

Questioned GVMC Officials why there should be a speed breaker before HPCL Main Gate (which is against IRC code) leading to accident and death of one person.

Illegal parking of HPCL vehicles on roads creating public nuisance. HPCL has to provide parking for these vehicles.

Closing road from EPCDL substation to Naval Wharf Substation near Naval Dock Yard and using for HPCL’s acitivities has created inconvenience to public. Even Malkapuram Sriharipuram road has also been converted for the necessities of HPCL.

Srinivas Nagar (West) is more affected area due to HPCL quarters than Malkapuram, Sriharipuram & Naval

EIL has established baseline data during winter season in an area of 10 km radius around the refinery. Pollution parameters in the study area were found to be within the limits of NAAQS. EIL considered IMD historic data for assessment of GLCs.

The treated effluent from the refinery is discharged to the sea through the effluent canal as per the CFO issued by APPCB. Thus, there is no possibility of ground water pollution in and around the refinery. Baseline levels of ground water quality were found to be well within the limits.

The issue of speed breaker in the road opposite to HPCL Main Gate needs to be taken up with the concerned local authorities. However, major road repair works in that area have been completed.

All vehicles meant for HPCL activities are taken in the parking lots allotted.

Usage or closure of any public road around the refinery is under the purview of the local authorities.

Joint study by APPCB and HPCL revealed that the source of smell is not from HPCL refinery.

Now there is increase of pollution leading to many kinds of diseases, thereby all money is spent for hospitals for treatment.

In the accident occurred in the past, when I took the burnt patient to Kalyani hospital lifting with my own hand, they rejected to admit as they have their own rules being Navy people. But what about our fate. Build a hospital for us. 28 people expired. It was assured that their families will be taken care of. Where has the assurance gone? Off and on Pollution levels keep increasing, whom should we complain? We are positive with Expansion. But what about past assurances? To be answered.

Accident prevention efforts are to be undertaken by all industries with necessary coordination.

This is all because of Industries…. How if you say not to Industries now? Here we all have developed by HPCL only. Pollution, Diseases and problems… none of these are true. We should encourage Industries. We all gave our lands to HPCL. Many people have immigrated to this place for jobs. Many unauthorisedly occupied

We are not against expansion of this Industry. This who do not belong to this place not to speak. Malkapuram has changed in four stages over a period of time. First it used to be on sea shore. Then it came to Shipyard side and then it came here. Those who are saying no to industry are not from this area. We the locals are totally welcoming the expansion.

35 Dr. Bheemeswara Rao (GVMC) HPCL is helping our Hospital. They have developed Sriharipuram Hospital with an expenditure of Rs. 12 lakhs. They arranged mobile hospital. We request for more cooperation of HPCL in social activities of this area after expansion.

36 . Shri Ramanujam (Contractor) Modernisation and Expansion are part of development. But Pollution should be controlled. Trees highly contribute to pollution control. Wide spread plantation of trees a must. Village people are asking for potable water. The same should be supplied. Accidents may occur in Industry. They should be prevented. If accident occurs immediate necessary actions are to be taken. Hospital has to be set up. Education to be provided to children. Skill development is an important factor. Being the advice of our Prime Minister, everybody is now giving importance to this issue. One Training Institute has to be set up in this area skill development to be undertaken. Children of this area are to be educated. We are pro expansion. It is not good to have apprehensions in people. Forums like this should be held for people to get rid of apprehensions.

As a responsible company, HPCL has so far planted 3,00,000 trees in and around Visakhapatnam. Plantation of another 1,50,000 is being taken up this year.

37 Potti Murthy (TDP Leader) I have been residing here since my birth. I am eye witness of all the accidents took place here. We did lot of things like shifting the accident victims to hospitals. There are lot of fears about Refinery. Locals have no information about this Expansion Public Hearing. How many of the assurances given to the accident victim families have been fulfilled? Jobs are offered? Where are they? Here pollution definitely exists. Not only Refinery, pollution is releasing from all industries. Pollution should controlled in true spirit. Many times in the past it was assured to control pollution. But no change in the situation. That is why people are welcoming this expansion.

39 There are no international safety standards in this Refinery. I have worked in countries like US and Canada. There they will not give chance for accident to occur. But here they won’t take least care to the extent of 90%. Zero Accident Safety is implemented in other countries. Incentives are paid to those who achieve this, failing which stringent action is taken. If everything is foolproof here, when then accidents are taking place? HPCL should adopt polluted villages. Skilled workers are within the reach here. All are leaving to Dubai for doing jobs. But why NOCs are asked here? We are positive to Expansion. But the Safety Measures to be followed strictly.

Oil refining is a process which involves inherent risks due to handling of crude and products which are inflammable in nature. The risk thereof is minimised by adopting the highest standards of safety in design and day-to-day operation. The safety measures followed in the refinery include Safe Work Practices, Operating Manuals conforming to OSHA-PSM standards, Comprehensive Work Permit System conforming to OISD norms, periodical Safety Audits, Emergency Preparedness Plans, etc.

Quantitative Risk Assessment (QRA) has been carried out for the project and all the recommendations thereof will be adequately addressed besides strict compliance with the existing safety regulations in the refinery.

HPCL will continue to extend its support to activities towards social development as sanctioned under CSR budget. The activities undertaken under CSR will be regularly disseminated through mass media.

40 Kakara Ramana (SC/ST Leader, Malkapuram) It was said that the Public Hearing will be conducted in Malkapuram Village. This is not Malkapuram. Re-conduct Public Hearing in the Village to know opinion of village people. Malkapuram is a conglomeration of 16 case associations. All of them are to be assembled and opinions have to be collected. Grass Root level study has to be done on present pollution, expansion and modernisation. Ground waters in this area were spoiled. Desalinations Plant has to be set up and water to be supplied to people. There are lot of problem education-wise. No Junior and Degree Colleges. Refinery should help on this. Malkapuram Village has to be adopted. The reasons for spending CSR funds in Madugula and Chodavaram has to explained.

The notice for Public Hearing for conduction of Public Hearing in ‘Deccan Chronicle’ as National Daily and ‘Andhrajyothi’ as vernacular language Newspaper was published on May 24, 2015 in line with MoEF guidelines.

. The location of the Public Hearing is also as approved by the concerned authorities.

But while people here are suffering without doctors and medicines why Rs. 25 lakhs are donated to American Hospital. We want answer? Help the Govt. Hospitals. It was told that Ambulance and Mobile Medical Hospital are arranged. What is their schedule? Where the treatment is offered? Such details are to be published through pamphlets. Facilities like College and Park are to be construed. We are agreeable to Expansion. But the locals are to be given opportunity. (After all speakers have completed giving their opinions Jt. St. Ann’s JM Hospital, Malkapuram, has been located in the vicinity of Visakh Refinery and has requested HPCL-VR to donate Hospital equipment. It is an Aided hospital and located in the vicinity of Refinery, also providing medical facility to the poor and middle class at cheaper cost compared to the super speciality hospitals. The amount has been provided under CSR activity with an objective to provide medical facilities to the surrounding public of Visakh Refinery at cheaper costs & all the CISF personnel have been undergoing medical treatment at St. Ann’s Hospital and also residents of Yarada Park have been using the medical facility at this Hospital in emergency. Mobile Medical Unit (MMU) is available for conducting medical check-ups and also providing medicines to the poor & needy people residing in different villages in the vicinity of Visakh Refinery. Monthly schedule of MMU has been prepared and fixed at the notice boards of GVMC hospitals at Malkapuram and Sriharipuram and also specified in awareness meetings conducted by field staff of GVMC in surrounding areas. It is also proposed to have a Public Address system to announce the timings & dates of schedules of Health Camps in surrounding areas of Visakh Refinery. CSR Activities under VRMP, the HPCL has committed to work towards improvement in the living conditions of local population near

the project, particularly in the areas of health & hygiene, civic amenities, infrastructure, education & training, water supply etc. Total CSR expenditure proposed is Rs. 10 crores during construction phase of the VRMP project which shall be around 4 years. This amount is over and above the allocations for 2014-15 CSR activities as mentioned above and aligned to the MOEF OM of 11.08.2014. Subsequent expenditure on CSR shall be guided by HPCL‟s CSR policy.
