Interoperability

“Cromnibus” 2015 Office of the National Coordinator for Information Technology Appropriation

Information Blocking – “…ONC should use its authority to certify only those products that clearly meet current meaningful use program standards and that do not block health information exchange. ONC should take steps to decertify products that proactively block the sharing of information …

The Committee requests a detailed report from ONC no later than 90 days after enactment of this act regarding the extent of the information blocking problem…”

Interoperability–Health IT Policy Committee report

House of Representatives21st Century Cures

Led by E&C Chairman Upton (R-MI) and Rep. Degette (D-CO)

Promote better access and sharing of data among researchers

design new products.

House Republican Conference Chairman Cathy McMorris Rodgers (R-WA) Draft legislation to be part of 21st Century Cures HIPAA changes Data policy

Potential for cybersecurity or data breach legislation

Uniform state laws needed

Meaningful Use

MU2 Concerns that a surprisingly low number of healthcare providers have

successfully achieved Stage 2 meaningful use. CMS said in December about 257,000 doctors will face MU penalties

this year. Final rule gave additional year to meet Stage 2 requirements

MU3 Set to begin Oct. 1, 2016, for hospitals and Jan. 1, 2017, for physicians Proposed Rule currently at OMB for review (Dec 31) and expected to be

issued soon. Will propose changes to the reporting period, timelines, and

structure of the program, including providing a single definition of meaningful use.

Address a broader systemic healthcare landscape (care coordination, etc…)

Final rule expected June 2015

ICD-10

Compliance date is set for Oct. 1, 2015. Congress quietly slipped a year delay into

another Sustainable Growth Rate patch (expires March 31, 2015).

Delay could happen again to appease physicians if Congress does not permanently fix SGR this year.

Senate

REBOOT group Senate Republican Conference Chairman John Thune (R-

SD); Chairmen Lamar Alexander (R-TN) and Mike Enzi (R-WY) ; Senators Pat Roberts (R-KS) and Richard Burr (R-NC) Concerned about 5 challenges facing HIT policy:

increased costs,

lack of a clear path toward interoperability,

lack of oversight,

program sustainability,

patient privacy.

HELP and SFC Hearings likely

Obama Administration

Final version of the ONC interoperability roadmap expected this year

SOTU remarks about cybersecurity and privacy policy and personalized medicine

Final version of the Food and Drug Administration Safety Innovation Act (FDASIA) health IT report, a joint effort of the ONC, FDA and Federal Communications Commission.
