G.S.R. 319(E).-In exercise of the powers conferred by clause (xii) of sub-section (2) of Section 96.of theProtectiono.fPlantVarietiesand Farmers' RightsAct, 2001 (53 o.f2001),theCentralGQvernmentherebymakesthefQIlQwing.

rules furthertoamend thefrotectiQn QfPlant Varieties and Farmers' ~ights Rules, 2003, namely:--

1. (1) These rules may be called the PrQtectio.nQfPlant Varie~ies and Farmers' Rights (Amendment) Rules, 2009.

(2) They shall CQmeinto. fQrce Qnthe date Qftheir publicatio.n in the Official Gazette.

2. Inthe SecQnd Schedule to.the ProtectiQn of Plant Varieties and Farmers' Rights Rules, 2003, after entry 4 (a), thefQllowing entries shall be inserted :-

"4 (b) Fees fQr registratiQn of any variety of the genera and.species Qtherthan extant varieties and farmer~ varieties as specified in clause (a)of Section 14 read with sub-sectio.n (2) QfSectio.n 29 o.fthe Act.

Individual - Rs.5,000Educatio.nal-- Rs.7,000Commercial- Rs.10,000

4 (c) Fees fo.r registratio.n o.fa variety about which there is common

knowledge i.e., the extant variety as specified under clause G) (iii) o.fo.f Sectio.n 2 o.fthe Act.

Individual - Rs.2,000Educatio.nal- Rs.3,000Co.mrnercial- Rs.5,000"
