    EXPLANATORY NOTE"The"State affirms labor as a primary social economic force.     AN ACTPROVIDING FOR A P6,OOO INCREASE IN THE MINIMUM pAy OF EMPLOYEESAND IIIORKERS IN THE PUBLIC SECTOR NATIONWIDEAND FOR OTHER PURPOSES

    Be it enacted bg the Senate and the House of Representatiues of thePhilippines in Congress as sembled:Section L. Tttle -- This Act shall be known as "The P6,000 Increase in theMinimum Pay Act of 2010. "Section 2. Declaratlon of Policg - It is hereby declared to be the policy ofthe State to alleviate the living conditions of the ordinary Filipino through policiesthat provide for a decent and humane standard of living and improved quality of

    life, particularly of the workers, both private and public; to ensure the right oflabor to just share in the fruits of production; to guarantee the workers' right to aliving wage; and to promote social justice through the adoption of measurescalculated to ensure the well-being arrd economic security of all the members ofthe community.Section 3. Scope -- The government as the employer of public sectorworkers shall grant all employees in atl National Government Agencies,Government Owned and Controlled Corporations, Government FinancialInstitutions, State Universities and Colleges, Local Government Units and otherinstrumentalities of the government, a P6,Oo0 increase in the Minimum pav(Salary Grade I).

    Section 6. Compliance to Collectiue Negotiations Agreement -- No salaryincrease shall be credited as compliance with the increase prescribed hereinunless expressly provided under a valid collective negotiations agreementsection 7. Non-diminution of existlng allowances and henefits --Nothing in this Act shall be construed to reduce any existing allowances an6benefits of any form under existing laws, decrees, ssuances, executive orders andany contract or agreement between employees and the government.Section 8. Implementing Rules and. Regulatlons -- The Department ofBudget and Management, after a thorough process of consultation with thegovernment employees shall promulgate the necessary rules and regulations toimplement this Act including the corresponding increases per Salary Grades

    necessary o address the distortion created by the P6,000 increase in theminimum pay.Section 9. Separabilitg Clause -- If any provision or part of this Act or theapplication thereof to any p6rson or circumstance is held invalid orunconstitutional, the remainder of this Act or the application of such provision orpart thereof to other persons or circumstances shall not be affected thereby.Section LO. Repealtng Clause -- All laws, orders, issuances, rules andregulations or parts thereof inconsistent with the provisions of this Act are herebyrepealed, amended or modified accordingly.Section LL. Effecttuitg Clquse -- This Act shall take effect within fifteen(15) days after its publication in the Official Gazette or in at least two newspapersof general circulation, whichever comes earlier.
