EXECUTIVE SUMMARY A Hazardous Waste/ Contaminated Materials Screening was conducted for the Route 531 Terminus Project located in the Towns of Ogden and Sweden. The screening included the intersection of 531 and Route 36 as well as approximately 1.6 miles of Route 31 extending west from the intersection of Route 36. This screening included available record review and a project corridor walkover which was conducted on June 3, 2011. The purpose of this screening is to identify potential areas of environmental concern that may be disturbed during construction. This screening yielded 7 sites of potential environmental concern. Based on current design alternatives the following is recommended: 1. Based on the road side visual inspection of the residential property at 3752 Route 31

(Site 1), it is recommended that the debris at the property (including any non working vehicles) be removed prior to acquisition and the property inspected for evidence of environmental contamination (surface staining, stressed vegetation, pools of liquid, etc.). If the site is to be acquired without removal of the debris, the debris should be thoroughly inspected so that proper disposal can be arranged. After the removal of the debris is complete the site should be reinspected to check for evidence of environmental contamination (surface staining, stressed vegetation, pools of liquid, etc.). If environmental contamination is suspect the appropriate sampling should be conducted to arrange for the removal and proper disposal.

1. Based on the current and historic use of the Yellow Goose Convenience Store and Gasoline station (Site 2) as well as the spills reported at adjacent properties, it is recommended that the intersection of Routes 31 and 36 be called out on the plans and a specification be added to contract documents for the screening, segregating, sampling and potential disposal of petroleum contaminated soil, if intrusive work is conducted adjacent to this site.

2. Due to the potential presence of household chemical in the structures on the parcels that

will be acquired, it is recommended that the current home owners be requested to remove any chemical from the properties prior to transferring the properties. After the properties are transferred the interior of the buildings should be inspected, any chemicals present in the structures should be identified and arrangements made for proper disposal. The sites where this is recommended include the following: • Residential property at 3748 Route 31 (Site1). • Residential property at 3750 Route 31(Site 3) • Residential property at 3746 Route 31 (Site 4) • Residential property at 3652- 3654 Route 31 (Site 5) • Residential property at 3650 Route 31 (Site 6) • Residential property at 3648 Route 31 (Site 7)

The following report discusses the complete findings of the Hazardous Waste/ Contaminated Materials Screening.

1.0 INTRODUCTION Ravi Engineering & Land Surveying, P.C. (RE&LS), as sub-consultant to Stantec has been retained to perform a Hazardous Waste/ Contaminated Materials Screening for the Route 531 Terminus Project located in the Towns of Ogden and Sweden. The screening included the intersection of 531 and Route 36 as well as approximately 1.6 miles of Route 31 extending west from the intersection of Route 36. The NYSDOT Environmental Manual (TEM) Chapter 4.4.20 was utilized for guidance during this assessment. The location of the project corridor is indicated on the Site Location Map, Figure 1. The purpose of this assessment is to identify potential contaminant locations that may be encountered during construction. This assessment is necessary for the NYSDOT to avoid becoming the unwitting owner of a hazardous waste site or hazardous materials, to contemplate disposal alternatives for excavated soils and to identify health and safety concerns that could affect contractors and the surrounding community.

2.0 METHODOLOGY

This assessment included a site inspection, past and current land use research, review of published databases and government records, including Inactive Hazardous Waste Site Registry, Chemical and Petroleum Bulk Storage records, waste incident/chemical releases reports, and other federal, state, county, and local sources of information. In May 2011, Environmental Data Resource, Inc. (EDR) was contracted to provide of the project area. The EDR study provides a listing of areas of concern as identified by a systematic review of Federal, State and local databases. RE&LS supplemented this study with a review of published databases available through the New York State Department of Environmental Conservation (NYSDEC) web site. The EDR study can be provided upon request.

2.1 Site Inspection A site inspection of the project limits and adjacent properties was conducted on June 3, 2011. Items of significant concern that were looked for during the site inspection include, but were not limited to: discolored soil, evidence of previous fires, stressed or dead vegetation, spills, leaks, leachate or discolored water, air emissions or odors, oil sheen on water, seeps or discolored springs, fill vents or pipes/underground tanks, aboveground tanks, hills, mounds or depressions, lagoons or impoundments, sumps, drums, ponds or basins, landfill or dump sites, pipelines or pipes, dumpsters/bulkwastes, berms or dikes, air stacks, posted signs, sewers or manholes, railroad tracks, drainage ditches, floor drains or riser pipes from monitoring wells, stored hazardous materials, transformers or electrical equipment. 2.2 Past and Current Land Use Research Historical mapping and aerial photography are utilized as part of the Hazardous Waste/ Contaminated Materials screening since they serve as an historical reference to prior land use. The process used in review of historical mapping and aerial photography is to highlight all locations where past use(s) could be considered an environmental concern. Examples of how a past land usage could lead to an environmental concern is the presence of contaminated soils from a former filling station, automotive repair shop, large manufacturing plant, chemical plant, drycleaner, etc. Based on the location of such sites with respect to the project corridor and the specific past land use, the need for further investigation may be eliminated or warranted. The following resources were researched to establish the past and current land use at and adjacent to the project: Sanborn Map Review –Sanborn maps are not available for the project area. Aerial Photographs - Aerial photographs taken in 1958, 1966, 1979 and 1994 supplied by EDR were reviewed. The photographs supplied by EDR are available upon request. Supplemental aerial photography from Google Earth for the years, 1994, 2005, 2006, 2009 and 2010, was also reviewed. United States Geological Services (USGS) Mapping – Historic topographic mapping for the project area was compared to current mapping to identify if large structures were present within the project area. Such large structures may represent historic manufacturing facilities that have been removed. Following USGS maps were reviewed:

2.3 Record Review 2.3.1 Environmental Data Resources (EDR)

A review of Federal, State and local Environmental databases was conducted. Environmental Data Resources (EDR) Inc. was contracted to provide a comprehensive review of Federal, State and local listed data on potential hazardous waste sites in the project vicinity. A complete copy of the EDR report is available upon request. This data search was performed in accordance with ASTM E-1527-05

standards for minimum search distance. The use of the EDR report allows for a comprehensive listing of sites of potential concern.

2.3.2 Online Database Review United States Environmental Protection Agency (USEPA) and New York State Department of Environmental Conservation (NYSDEC) online databases were reviewed and cross-referenced as part of the review process. This cross reference produced two additional records for the project area.

3.0 FINDINGS The project is located in the Towns of Sweden and Ogden, Monroe County, New York (Figure 1). The project includes improvements to the terminus of Route 531. The purpose of the project is to improve traffic operations and safety at the present terminus of Route 531. The project will include improvements to the intersection of Route 531 and Route 36. Traffic calming measures are proposed of the section of Route 31 between Route 36 and Salmon Creek Road. A roadside trail is also proposed along Route 31 between Route 36 and Gallup Road. The build alternatives will require nine acquisitions and five parcel impacts within the project corridor. The project area is generally flat, gently sloping toward the northward flowing Salmon Creek. Groundwater west of Salmon Creek likely flows northeastward toward Salmon Creek. East of Salmon Creek the groundwater likely flows toward the northwest. The review of the historical mapping and aerial photography indicated that there were at least 12 structures (houses and/or barns) on the south side of Route 31 between Route 36 and Hubbell Road that are no longer present. Additional discussion of the findings of the historical mapping and aerial photography review is included in the discussion of the properties and/or locations of concern in Section 3.1 of this report, if warranted. The EDR report identified 4 properties or sites of environmental concern within the ASTM search distances. Table 1 summarizes the information available through the EDR database search and supplemented through a review on line databases, an understanding of the project area, and a site inspection.

3.1 Locations of Concern

Based on the site inspection and record review seven sites were identified as potentially posing a negative impact on the proposed project were (Figure 2). Five of these sites are household residences where there was no exterior evidence or records suggesting an environmental concern, but due to the potential for the presence of household hazardous waste they are listed as properties of concern. The sites of potential environmental concern are described below:

3.1.1 Residential Property

3752 Route 31 Site 1

This property is located northwest of the intersection of Hubbell Road and Route 31. There are no environmental records associated with this property. Site Observations The house is one story structure. A garage is located west of the house. Household debris is scattered between the road and the house (photos 1 and 2). There are at least three vehicles that appear to be unlicensed on the property. Debris and vegetation suggest that these vehicles have not been moved in an extended period of time. Historical Maps and Aerial Photography Household debris is shown on the 2005, 2006, 2009 and 2010 aerial photography. The aerial photography shows debris in the front of this house, as well as behind the house and along the western property line. A house is visible at this location on the 1958 aerial photography. Federal and State Database Review The database review revealed no environmental concerns related to this site. Alternative Impacts The build alternatives will include acquisition of this parcel and the removal of the buildings. Conclusion This site presents a potential environmental concern; miscellaneous debris is scattered throughout the site including tires and automobiles. Household chemicals may be present within the house and garage. 3.1.2 Yellow Goose Convenience Store and Gasoline Station

3512 Brockport Spencerport Road (Route 31) Intersection of Routes 31 and 36 Site: 2

This property is located at the northeast corner of the intersection of Route 31 and Route 36. The parcel is a Yellow Goose Convenience Store and Sunoco gasoline station. There are three EDR records for this facility, all relating to the storage of petroleum. A review of the NYSDEC spills data base indicates there have been two spills reported adjacent to this property.

Site Observations Site improvements at this location include, a one story building, pump islands equipped with a canopy, and underground storage tanks (photo 3). The building occupies the northeast portion of the property and functions as a convenience store. The pump island is located in the southern portion of the property. The underground storage tanks are located in the southwest corner of the property. Absorbent clay is present along the road at the southwest corner of the intersection of Routes 31 and 36. Broken automobile parts and recently disturbed soil is also present at the southwest corner of this intersection (photo 4). Historical Maps and Aerial Photography A building is shown at this location on the 1971 and 1978 topographic maps. A review of the aerial photography for this location was inconclusive. NYSDEC Petroleum Bulk Storage Database Based on a review of the information supplied by EDR and supplemented through a review of the NYSDEC online database, this site is a registered petroleum bulk storage facility, facility number 8-514195. According to the information provided by EDR and NYSDEC there are two underground storage tanks in use at this facility. Historical records indicate that three underground storage tanks and one aboveground storage tank were removed from this site in 1997. The historical records indicate that the former tanks were installed in 1971. NYSDEC Spill Reports There are no spill records for the Yellow Goose parcel. Two spills have been reported adjacent the Yellow Goose parcel. Spill number 9208301 was reported on October 16, 1992, for 3517 Route 31. An unknown quantity of diesel was spilled impacting the soil at 3517 Route 31. This spill is considered closed by the NYSDEC. Spill number 0270484 occurred on September 9, 2002. Unknown petroleum was spilled to the soil at 537-539 Washington Street at Brockport-Spencerport Road (Rt. 31). This spill is considered closed by the NYSDEC. USEPA RCRA Database This site is not listed in the RCRA database. Alternative Impacts Alternatives 2, 3 and 5 include pavement, striping and utility improvements to the intersection at this location. Alternative 5 also includes the acquisition of portion of the property at the southeast corner of the intersection of Routes 31 and 36.

Conclusion Although there have been no reported spills at this Yellow Goose property, due to the current and historical use of the site as a gasoline station petroleum contamination may be present. In addition, spills have been reported adjacent to this property, although these spills are reportedly closed, residual contamination may be present.

3.1.3 Residential Properties with Proposed Acquisition The following residential properties may be acquired for the construction of this project:

• 3748 Route 31 (photo 1), Site 1 (see discussion provided in Section 3.1.1) • 3750 Route 31 (photo 5), Site 3 • 3746 Route 31 (photo 6), Site 4 • 3652-3654 Route 31 (photo 7), Site 5 • 3650 Route 31 (photo 8), Site 6 • 3648 Route 31 (photo 9), Site 7

The environmental data base review did not reveal items of concern for these properties. Also, with the exception of 3748 Route 31 (see Section 3.1.1); the visual inspection did not reveal items of concern for these properties. These properties are listed as areas of concern because of the potential that household chemicals may be present with the houses and other structures present on the properties. If the household chemicals are not removed prior to property acquisition, the disposal of these chemicals will become the responsibility of the state.

3.2 Dismissed Properties

Three of the sites identified by EDR were determined not likely to pose a negative impact on the property. The EDR site reference as spill number 9970567, “Northampton Park Office”, 304 Salmon Creek Road, is identified in the EDR report as being located at the intersection of Salmon Creek Road and Route 31. Further review indicates that the Northampton Park office is actually located approximately 0.66 mile south of the project. Based on the distance between the spill location and the project corridor it was determined that the spill will not have a negative impact on the project. The EDR orphan site referenced as “NYSDOT Northeast Corner Junction” is the northeast corner of the intersection of Route 31 and Gallup Road. This site is listed as a RCRA Non-Generator with no listed violations. Piping for water service is present at this location. This piping does not appear to be an environmental concern. Therefore this site was dismissed as a site of potential concern The EDR orphan site referenced as spill number 0912928, “Route 31 BTW (between) Route 19 & Route 531” includes a majority of the project corridor. This spill is described as a surface spill resulting in a petroleum sheen along Route 31 in the east bound land between

the Monroe/Orleans County line to Route 531. According to the information provided in the EDR report, there was no possible recovery of the product spill and rain had washed a majority of the sheen from the road. This spill was closed meeting the standards of the NYSDEC. Any residual contamination from this spill is expected to be minimal and unlikely to have negative impact on the project. The locations of the 12 structures identified in the historical mapping and aerial photography south of Route 31 between Hubbell Road and Route 36, were visually inspected from the road side. There was no visual evidence suggesting environmental concerns at these locations. No further investigation of these locations is warranted at this time.

4.0 Conclusions and Recommendations Based on the information reviewed and the site inspection the following items of environmental concern were identified as having a potential negative impact on the project:
