make decisions about

your life.


Mental Capacity Act (2005): Principles 4 & 5

4) Any act or decision made for someone who

lacks capacity must be done in their best

interests.

5) Before any act or decision is made, should

look at the options that give the person the most

freedom.

Always ask:


This is like if someone makes decisions for you.

Even if you could do it yourself.

This can be around:

Going out

What you eat and drink

Going to the toilet

What you wear

Decorating your room

Seeing your family

Time by yourself

Your medication

Do they help you make decisions?


GOING OUT/MOVING

AROUND YOUR HOME

Can you leave?

Would someone let you

out if you asked?

Are there locks/ codes on

the doors?

Are you free to go anywhere

you like?


Does anyone take your shoes,

walking stick or wheelchair, so

that you cannot walk?

Are you ever taken away from

everyone else?

Are you even taken to a

place or a room you didn’t

want to go?


EATING, DRINKING AND

SMOKING

Can you choose what you eat

and drink?

Would some food or drink not

be allowed?

Can you choose when and

where you eat?

Can you eat alone?


Can you get food made for

your religion or culture?

Can you make your own

food?

Can you smoke when you

want?

Does someone say when you

can smoke?


GOING TO THE TOILET

AND WASHING

Does someone go to the

toilet with you?

Does someone help you have

a wash/ shower/ shave etc?

Is the bathroom locked or are

you told not to use without

some help?


Can you use the toilet when

you want to?

Can you use it at night?

Do you wear pads?

Do you need them?

How often are they changed?

If you need help with the toilet,

is someone there to help?

Do you choose how you have a

wash, shower or a bath?


WHAT YOU WEAR

Can you choose your

clothes?

Does anyone ever take any

clothes or jewellery from you?

Do you have to wear any safe

clothes like a helmet?


Do you ever not want someone

to dress or undress you?

Are your clothes your own?

Can you buy your own

clothes?

Do you have your glasses,

Do they all support you in the

Do you get to do the things that

make you happy?

Going outside; shopping, cafe or

meeting friends?

Are you shown how to do things you

don’t know?

Things around the house; making a brew or

snack, or baking.


WHEN THINGS MIGHT

HAVE TO GO TO COURT

The Law says certain things

have to be agreed with the

court.

This is called a Deprivation of

Liberty.

A Deprivation of Liberty is;

Someone knows where you

are all the time

You cannot go and live

somewhere else


Some of the other decisions that

would have to go to court:

Stopping you from seeing

people

Making you move home

Serious medical treatment

Stopping you from having

sex

Someone has to be with

you when you go out

A really strict diet
