Notification

The 5th November, 1976

exercise of the powers conferredby the proviso to Article 309 of the Constitution of India and all other powersenabling him in this behalf, the Governor of Haryana hereby makes thefollowing rules regulating he recruitment, and the conditions of service ofpersons appointed to the Haryana Service of Town Planners (State ServiceClass I), namely

2.

(a) 'Commission' means the Haryana Public Service Commission ;

(b) 'Direct recruitment' means an appointment made otherwise thanby promotion from within the service or by transfer of an officeralready in the service of the Government of India or any StateGovernment ;

(c) 'Government' means the Haryana Government in the Administra-tive Department ;

(d) 'Planning Assistant' means an official who is working as such inthe Town and Country Planning Department ;

(e) 'Recognised University'

(i) any University incorporated by la tv in any of the States of India;or

(ii) In the case of a degree, diploma or certificate obtained as q resultof an examination held before the 15th August, 1947, thePunjab, Sindh or Dacca University ; or

(iii) any other University which is declared by the Government tobe a recognised University for the purpose of these rules;and

Recruitment to Service

3. The service shall comprise the posts shown in Appendix 'A' to theserules ;

Provided that nothing in these rules shall affect the inherent right of the

(a) a citizen of India, or

(b) a subject of Nepal ; or

(c) a subject of Bhuttan ; or

(d) A tibetan refugee who came over to India before the 1st January1962, with the intention of permanently settling in India ; or

(e) a person of Indian origin who has migrated from Pakistan, Burma,Ceylon and East African Countries of Kenya, Uganda and UnitedRepublic of Tanzania (formerly Tanganyika and Zanzibar) withthe intention of permanently settling in India ;

Provided that a person belonging to category (b), (c), (d) or (e) shall bea person in whose favour a certificate of eligibility has been issued by theGovernment of India and if he belongs to category (e) the certificate of eligi-bility will be issued for a period of one year, after which such person will beretained in the service subject to his having acquired Indian citizenship.

(2) A person in whose case a certificate of eligibility is necessary may beadmitted to an examination or interview conducted by the Commission orany other recruiting authority or his furnishing proof that he has applied forthe certificates and he may also provisionally be appointed subject to thenecessary certificate being issued to him by the Government of India.

(3) No person shall be appointed to the Service by direct recruitment,unless he produces a certificate of character from the Principal, AcademicOfficer of the University College, School or Institution last attended, if any,and similar certificates from two other responsible persons, not being hisrelatives who are well acquiantcd with him in his private life and are uncon-nected with his University, College, School, or Institution.

5. No person shall be appointed to this service by direct recruitment whois less than twenty-one years or more than thirty-five years of age, on the lastdate fixed for submission of applications to the Commission.

Provided that in the case of candidates belonging to the Scheduled Castesand other Backward Class the maximum age limit shall be such as may befixed by the Government, from time to time.

6. Appointment to the posts in the Service shall be made by the Govern-ment.

2. No person shall be appointed to the Service unless he is in possession Q ua l i l i -of academic qualifications and experience specified in column 2 . of Appendix c a t i o n s .'FP to these rules in the case of direct recruitrnent or by transfer and thosespecified in column 3 of the aforesaid appendix in the case of recruitment bypromotion.

8. Disqualify.cations.

(a) who has entered into or contracted a m a rriage with a person havinga spouse living, or

(b] who huming a spoum living, has mi red in to ar oontracted amarriage with any person.

shall be eligible for appointment to any post in the Service :

Provided that the Government may, if satisfied that such marriage ispermissible under the personal law applicable to such person and the otherparty to the marriage and there are other grounds for so doing, exemptany person from the operation of this rule.

(a) who has more than two chi ldren and has not not himself/herselfhis or her spouce sterilised ; o r

(b) who having not more than two children, does not give an under-taking not to have more than two children,

shall be allowed to jair_ the Service.

(3) A breach of undertaking under clause (b) of sub -rule (2) shall renderthe Government employee liable to removal from Service.

9.recruitment,

(a) in the case of Assistant Town Planners :

(b) In the case of District Town Planners:-

Probation.

(d) /n the case of senior Town Planner, by promotion of a RegionalTown Planner, but if a Regional Town Planner is not available or is notconsidered suitable, the post may he filled up from amongst the DistrictTown Planners :

PART IIICONDITIONS OF SERVICE

Provided that(a ) any p e r i o d a f t e r s u c h appointment spent on deputation on a

corresponding or a higher post shall count towards the periodof proiection

(b) in the case @f an appointment by transfer, any period of work inequivalent or higher ranks, prior to the appointment to theService may, at the discretion of the appointing authority, beallowed to count towards the period of probation fixed under thisrule ; and

(c) any period of officiating appointment to the Service shall bereckoned as period spent ort probation, but no @mon I A D

(2) If, in the opinion of the appointing authority, the work or conductof a person during the period of probation

(h) if such person has- been appointed otherwise then by direct re-cruitment

(1) revertrevert him to his former post ; or(ii) deal with him in such other manner as the terms and conditions

of his previous appointment permit.

(3) On the completion of the period of probation of a person, the appoint-ing authority

(n) if his work, or conduct has, in its opinion, been satisfactory

(ii) extend his period of probation and thereafter pass such order,as it could have passed on the expiry of the lint period of pro-bation,

U. Seniority, in/errs of members of the service in each cadre shall be Seniority ofdetermined by the length of their continuous servier.. on a post in that cadre members elof the Service: the service.

Provided that in the ease of members appointed by direct recruitmentthe order of merit determined by the Commission shah i not be disturbed infixing the seniority and persons appointed as a result of an earlier selectionshall be senior to those appointed as a result of a subsequent selection

(d) 111 the case of members appointed by tiansfer form different cadre!?their seniority shall be determined according to pay, Preferencebeing given to a member who was drawing a higher rate of payin his previous appointment, and if the rates of pay drawn arealso the same, then by the length of their service in the appoint- .ments, and if the length of such service is also the same, the older, ,member shall be senior to the younger one.

12. (1) A member of the service shall be liable to serve under theGovernment at any place whether within or outside the State of Haryana.

(2) A member of the service shall also be deputed to SCTVC

(i) a company, an association or a body of individuals whether in- ,corporated or not, which is wholly or substantially owned orcontrolled by the State Government. a municipal corporationor a local authority within the State of Haryana; or

(ii) the Central Government or a company, an association or a body 'of individuals, whether incorporated or not, which is whollyor substantially owned of controlled by the Central Government; or

(iii) any other Slate Government. an international organisaiton, anautonomous body not controlled by the Government, or a privatebody:

Provided that no member of the Seivice shall be deputed to the Central0 1 a n y O t h e r State Government ot any organisation or body referred to inclauses (ii) and (iii) except with his consent.

Leave. Pen-sion and 13. In respect of pay, leave, pension and all °the' matters not expressly

other matters, provided for in these rules, the members of the Service shall be govened bysuch rules and reugulations as may have been, or may hereafter be adoptedof made by the competent authofty under the Const't ution of India or under .any other law for the time being in force.

14. (1) In inattets relating to discipline, penalties and appeal members c.inc, Penalties of the Service shall be govencd by the Punjab Civil Services (Punishmentand appeals.and Appeals)

Provided that the nature of penalties which may be imposed, the authorityempowered to impose such penalties shall, subject to the provisions of anylaw or rules made under article 309 of the Constitution of India, be such asare specified in Appendix to these rules.

(2) The authority competent to pass an ordet under clauses (e) and (d) 'of sub -rule (i) of rule 10 of the said rules shall be as specified in Appendix 1 rto these rules.

Liability for 15. Every member of the set vice shall get himself vaccinated or re,:vaccination, vaccinated if and when the Government so directs by a special or general

order. .

Oath of all- 16. Every inemebr of the Service, unless he has already done so, shallegiance. be required to take the oath of allegiance to India and to the Constitution

of India as by law established.

Power of 17. Where the Government is of the opinion that it is necessary orrelaxation, expedient to do so, it may, by order, for reasons to be recorded in writing,

relax any of the provisions-of these rules with respect to any class or categoryof persons.
