1. Overall Project Objective
The objective of the Haiphong Component of the Vietnam Sanitation Project is to rehabilitate
and upgrade the existing sewerage and drainage system of Haiphong City with the following
planined physical outputs:
* rchabilitationi v' the drainage channels (6lkm)
* rehabilitationi of regulation lakes for rainwater retention
* constructioni of nlew combined sewers in critical areas (7,6 km)
* construction of interceptor sewers to reduce pollution of the regulation lakes including
small pumps stations
* inspection, cleaniing and rehabilitation of the major existing combined sewers and
manholes (70 kIm are to be cleaned in which 20 km are to be rehabilitated)
* inspection, clcanling and rehabilitation of the sewerage system in the phuong areas
(arounld I 00 kmii are to be cleancd in which 25 km are to be rehabilitated)
* sludge and septage treatment and disposal facilities at Trang Cat landfill.
2. Overview of implemenllec RAP Reports
2.1. Initial RAP Report
The first RAP was prepared in February 1999 by Soil and Water Consultant, approved by the
relevant authorities and has been carrying out by the PMU.
It described the procedures required for the preparation of RAP for the sanitation project. It
contained the objcctives and principles of RAP, a general compensation and entitlements
policy and matrix, a legal framewvork, institutional arrangements, the contents of public
participation and consultationi programs, grievance procedures and an internal and external
I monitor-ing programl.
It conitained the scope of the components requiring land acquisition and resettlement, socio -
economic characteristics of the project affected persons, results of the detailed measurement
surveys, detailed specified entitlement policies and compensation matrix, estimiated costs and
budget, and the iniiplementation schedule for the components i.c. (a) rehabilitation of the
drainage canals, and (b) construction of sludge disposal and septage treatmenit facilities at
Tran,g Cat landfill.

It also provided an assessment of the potential of the additional resettlement that may arise
duriing the implementation of the project components.
2.2. Overview of RAP 3
It is already foreseen in the initial RAP Report that the project contents components for
which resettlemaent can only be determined after the detailed designs have been completed
and during the projcct implementation.
The potential for resettlement arising from the implementation are:
Ticin Nga. 1io Sen, Du Hang and Lam Tuong lakes
Clearanice aroulld the lakes (which was not included in the lakes rehabilitation on the
initial RAP) with 6m width.
The periodic desILidging of the lakes used for rainwater retention is unavoidable. This
requires resettlemenlt of houses built on the lakeshores to reclaim sufficient land along side
the lakes to provide the necessary access.
The PMU has decidcd that the resettlemenm,t magnitude is of great significanlce, therefore, a
full RAP 3 is rcquired, keeping in line witlh the policies/principles of the initial RAP Report
with updated socio economic paraLmeters.

the initial RAP) with 6m width.

3. Overview of RAP 4
Duc to the savin;s generated through the Project's bidding process, additional components
arc carnie(d out as l'bllowing:
* Cat Bi and Pihuong Luu lakes
Protectioni cor-ridor- of 6m wide arounld the lakcs will be c;cared off. Cat Bi lake is in Cat Bi
ward, Ngo QuyenI district with prescnt area of 3S,000 m2. it locates close to Lach Tray river.
The lake manau,errent area is from the above edge of the lake at the height of 3.8m to 6m
towards the population area. Phuong Luu lakc is presently a agricultural field in Dong Hai
ward, Hai An district which will bc constructed as a regulation lake of 24 hectares of area.
Thc lake will be cemibanked, with manageement road of 6m of width. A new canal of over
2()()m of length and 15 m of width will be constructed to connect the lake to the Northeast
Ca;nal. Managemncit roads along canal sides of Om will be build and a consultant's workoffice
of 500m2 will be set by the lake.

3.1 Compensation and Entitlenient Porcy
Project Affected Pcr-sons (PAPs) are people who will have their: (a) stanidard of living
ad\vcrsely affected; or (b) right, title or intcrcst on all or part of any house, lanid or any other
fixed or movable asset acquired or possessed temporarily or permanently; or (c) business,
occLupationi, placc of work or residenice or habitat adversely affected temiiporarily or
perm-lanenitly.The general principles of compensatioin and entitlement are summarized as follows:
PAPs who have, or are eligible to lhave, permranent rights to use land or to builtstructures will be compensated at ful' replacement cost for their losses.

* PAPs \~l o do not have pertniarcni tights to use land or build stl-uctures will be
entitledl to rehabilitation mreasures in amounts and levels sufficient to ensure their
livinig standard, income earning capacity and production.
* PAPs \k ho have crops affected will be compensated at market value for their lost
crops ruegardless of their land tcitu-e status. PAPs who have trees atlI'ected will be
comlpenisated at substitution cost.
* PAPs x \ho have shops or other bismiSess affected will be assisted to improve, or at
least restore, their income earni g caDacity and production.
* PAPs sx ith legally construc;ed 5truetures will be compensated at 1 00% of their
replacemalenit cost. PAPs with iiWga 'y constructed structure will be compensated

* Compensation shall al\\ays inciudc the cost of any fees, taxes on land transfer.
duties or other expenses that may be attached by any central or local government
unit to anly transaction contemplated by the resettlement.
* Compenisation shall be provided prior to displacement.
Every severely affected PAP would also be entitlied to subsistence allowance duLring transition
period, anid inicome reilabilitationi allowance.
The Provincial People's Committee (PPC) will establish unit rates for compensation for land
and structures. During the implementation, rates of compensation for land and structures will
be updated to reflect current market rates.
3.2 Legal Franiework
The resettlement an(d rehabilitation plan described has been designed in accordance with the
laws of the GOV aned the provisions of the World Bank's Operational Directive 4.30. The
basis guiding principle of the World Bank's Policy on Involuntary Resettlement is that the
affected people should be "assisted in their effrorts to improve their former living standards,
income earninig capacity, and production le, els, or at least to restore them".
3.3 Institutional Arrangements
The roles and responsibilities of' institutes involved in the implementation of the land
acC lnisition and resettlement activities are summarized below:
* People committee of Haiphong City
- establisling a resettlement comnmittee
- issuing the compensation unit prices
- approving comnpenisation amounts
- providing instruction necessary for implemenitation
- allocating the land necessary for the ProJect, and
- assigning tasks to each district (quzait) within their territory.

3.4 Public Participation and Consultation!N o phases for puLblic information campaigns and PAP con1sultation are established for theRAP. The two phascs are summariied as follo\Ns:

3.5 Grievance Procedures
The grievances log,geld by an affectcd person can relate to any aspect of the lanld acquisitionanid resettlement program. Detailed procedures for addressing grievances have beenestablished for the project. The procedures are organized into four stages and summarized asfollows:
Stage I If any person is aggrieved by any aspect of the resettlement program, he/shecan loge a written or verba grievance to the Resettilement C'ommittee andSADCo will be conveyed by th-em to the Qutaln PC.
Stage 2 If the person making the co q-p?aint is not sasisl`ed *%ith the dccision or heishedo not receive any response, he/she can appeal to SADCo, Quati PC andPhlonug PC who will decide the matter.
Stage 3 If the person making the conmplaint is not satisfied with 'he decision or he,'sherccei\ es no satisfactory responise, the case will be submitted to the chair-man ofthe C'PC who will make the decision on the issue.
Stage 4 If the person making complaint is not satisfied with the dccision by thechail-rmian of the CPC or h1cshe does not receive any response, he/she canappeal to the district court of aw.
3.6 Monitoring(}
Imiipleniciitationi of' RAP will include both internal and external monitoring activities whichare sumrnmarized as l'ollows:
Internal The PMU of SADCo and member of the Resettlement Committee willMionitorinig be responsible for internal monitoring activities. The main indicator-s
which will be monitored are:
- compensation assessment and accuracy- payment of-compcnsation- public information and consultation
- grievance procedures
- provision of training
- job creation, and
- linkage of resettlement on construction.

External An agency specialized in social sciences will be responsible forMilonitoring conducting independent external monitoring and evaluation of RAP

1.1 Project Coiniponetits
Part 2 As described in Part I of this document, tlc components of thie project for
wliclh resettlement hias becen identified awid implementation include thefollow ing:

6m width clearance around thie lakes; according to land use plainning map ofPhLuoIng Luu regulationi lake, established in October 2003, total occupation areaof land is of 269,758 in2 , of wlhich water surface land of 245,767.5 m2 , green
land of 10,552.5 m2 , transport land of 12,233 m2 and management house of
1,205 m2.
Part 3 Components of the project for which additional resettlemenit would be
identi tied during implementation include the following
* Rehabilitation of combined sewer network
* Construction of new combined sewers
* Construction of new interceptor sewers
* Rehabilitation of sewera-e in phuonigs
1.2 Detailed Description of Impacts
1.2.1 General
Clearanice of 6m width arouLnd Phuonig Luu and Cat Bi lakes is envisa-ed. There are
structures on the top or very close to the canals and the lakes causing land acquisition
requiremlents and needs for compensation.
Such land area has already been allocated to SADCo by the decision of the HPPC andthe compensaLtions are anticipated.
1.2.2 Impact on Affected People and Assets
IThe groun(d clearance surrounding iregulation lakes will have several permanient and
temlporary affects oni households and structures surrounding lakes. The ground clearance on
arouLnd the lakes wxiltl 6 m width. Phuong Luu lake is located in a agricultural field of flowers,
frtLit trees and aquaculture; 232 farml housclholds are with their agricultural land perpetually
lost and they xN ill ticd alternative jobs.
Altogethel-, 14 houselholds have to be resettled. Besides this, some subsidiary structures on
the lakeshiores arcas like kitchcil, live-stock hoLIses... have to be removed. Th. clearance of
lakeslhores includcs removal of trees and ot-er plants.

1.3 Minimizing Adverse Sociha k'1n1p.' t s
All possible steps are taken to minimizc a&derse social impacts on households in the projectarea. Those PAI's that have to be rcsettled iil be entitled to a rehabilitation package whichincluides training foir I household member and a subsistence allowance for every household
member.
1.4 Detailed Surveys
A detailed measurcment and socio-cconornc surveys were carried out in May-June 2003 andi
MaN 2004 around (at Bi and Phuong Luu 'akes taking into account the clearance areas
around the lakes. The losses of land and hoase area as well as other assets to be compenisated%\erc measured in this survey.
According to thle survey, there are altogt,eher 14 households severely affected and in need ofrelocation., 116 individual households partly affected, and 232 farm households withaLricultural land lost. Thcse figuLes fo6r the total amouLnt of af'fected houselholds aresuLmml1arized as lollows

Onily 17.13% of the hlouseholds hav e been living in the address less than 5 years, 20.72% of
the households have been living in the address 6-10 years and 62.15% of the households have
beoen living in the address more than 10 years. 65.47% of the households have the permanent
residential registration and 34.53% of the households have the temporary residential
rc4istration. Pleasc see Table 2 and 3.

1.4.3 Housing
Amnong the 14 households required resettlemnent, no households had the LURC. The averagesize of the hlouse is '5m2. Almost 85% of the houses are 4th category houses.
All the households have electricity and vAater supply. The private bucket latrine (directlydischarlge into the canal or lake) is the most common type of toilet. I-lalf of the householdsha iing shower.
It is noted that among the 362 surveyed households (including the above mentioned 14household reqLuired- resettlement) there are around 10% of the households having no waterresources of their own (they hax e to buy the potable water) and around 80% of thehouseholds ha\ mii ino decent solid \\aste services.

3.2 Inflation Adjustment
The rates of compensationi and cash entitlements for rehabilitation and allowances payable tothe affected persons will be adjusted a"nUally, based on the actual annuai inflation rate.SADCo together \ ith various relevant a;,Wncies will determine the annual infation rate andensure the necessary annual adjustments are made to compensation rates and to all casleltitlements.
3.3 Implementation, Administraf .o,n and ContVigency Costs
Imlplemenitationi costs include costs already made for land demarcation and surveys, costs ofpayment (salaries. per diem) for resetliement committees and for monitoring costs.Administrationi costs represent 4"0 of the total project costs. The cost estimates for RAPimlplementation also include provision ior contingencies at 15% of total project costs.S,ADCo is responsible for the pro\ ision of adequate funds to carry out the implementationi ofthe RAP.
3.4 Unit Prices for Cost E9stimation
Unit prices for cost estimates for structures losses have been established according to HPPChousing classification and construction unit prices with consideration of the recenitcompenisationi tarifls of the adjaccent projects. The rates are adjusted based on the currentmlar-ket rates andi rfclect replacement costs.
Each city and province establishes its own prices levels for land in accordance with the priceranges stipulated in Decree 87/CP. HPPC's unit prices and estimated market prices for landan(d houses arc listed in Table 6. lb

4.4 Conducting Public Informiiation Campaign

RAP' prcparation and these activitics will continue during the implementationi stage as
well. Thc Resettlemcnt Committee will develop a campaign to disseminate frequelnt
linorm-lation about the Project to the PIAPs and the general public in the Project area. This
camiipaign will begin as soon as the RAP 4 is approved.
4.5 Compensation and Other Entitklement of PAPs

I General
The Project contains components for which resettlement can only be deteminied
during the pr-oject implemenitationi. This situation occurs for several reasons: (a) the
precise impacts of these components can only be determiined after the finalization of
the alignmniiits and selection of alternlatives following conIsultation witlh relevanlt
authorities, (b) one objective of detailed design is to adopt constrLction metlhods
whlich mliniilmize resettlemenit etc.
Consequently, the Project slhould anticipate the possibility of a supplementary RAP -

'I he Department oifrransport and Public Works (DTPW) is preparing a Feasibility Study and Preliminary
D)esign for project of rehabilitation and upgrading the existing sewerage and drainage system of Hai
Phong. The project is financed by the WB's loan, Vietnamese Government's budget and Finnish
(iovernrment's development aid. Some land areas will be requested for the Project use due to the
maintenance roads of the North-eastern and South-western canals long to Tien Nga lake, Sen lake, Lam
'I'uong and Du Hang lakes aim to improve environment, convenience transportation, life condition and
health lfor people.

During the previous No.5 Highway Project, two land developme nt sites were constlucted.
The sites were constructed in anticipation of resettlement associated with the road
construction project. Both sites include functional facilities for water supply. sewerage and
drainage, and electricity supply, as well as pave streets and sidewalks.
