INTRODUCTION

This publication is intended to help you understand and interpret entries on the driving records available from Oregon Driver and Motor Vehicle Services (DMV). RECORD TYPES There are four types of driving records available: Certified court prints; nonemployment driving records; nonemployment, open-ended driving records; and employment driving records. • The certified court print driving record includes most traffic violations and accident

entries for at least the previous five years. Serious criminal traffic offenses, such as driving under the influence of intoxicants, may remain on the record permanently.

• The nonemployment driving record has entries for at least the previous three years. This record lists all nonemployment-related accidents, convictions, suspensions, cancellations, revocations, and diversion agreements.

• The nonemployment, open-ended driving record contains the same information as a nonemployment driving record but is not limited to three years and is available only for the purpose of providing insurance discount to an individual.

• The employment driving record is a three-year record that is limited to convictions and accidents the driver had while on the job.

For each record type there are two versions of the record available: (1) a version containing the driver’s personal information and (2) a version that has the driver’s personal information removed (sanitized). Personal information is removed from a record if a requestor does not qualify to receive it under Oregon’s Record Privacy Law (ORS 802.175-802.191) or does not have a written, notarized permission slip from the individual whose information is requested. Personal information is: driver license, driver permit or identification number; name; address; and telephone number. Under Oregon’s Record Privacy Law, only certain qualified entities are allowed to receive personal information. These include such entities as attorneys, legitimate businesses, insurance companies, police agencies, and other government agencies. See the Records, Privacy & Account Holders section on the DMV website (www.oregondmv.com) for additional information. FIXED ENTRIES Fixed entries generally include information we record for each driver/customer, such as name, address, and date of birth. This portion of the record also contains information about any identification card or Oregon driving privilege the person holds, as well as endorsements, restrictions, and expiration dates. VARIABLE ENTRIES Variable entries are those that make up an individual’s driving history, such as accidents, convictions, suspensions, revocations, cancellations, and other administrative actions. Variable entries may also include information about the type(s) of license, permit, and/or endorsement the person holds (or has held in the past).

This is a certified court print that includes convictions for traffic crimes, commercial driver license entries, diversion agreements, and alcohol rehabilitation entries; convictions for minor offenses and accidents will show for at least five years. Suspensions, cancellations, and revocations also are included, along with miscellaneous administrative entries and multiple status entries. It may also contain some out-of-state commercial driver entries.

This is a certified three-year record that includes Oregon accidents, diversion agreements, and convictions other than those in the employment driving record. The record may contain some commercial driver license entries, some out-of-state commercial entries, miscellaneous administrative entries, and multiple status entries.

NONEMPLOYMENT OPEN-ENDED DRIVING RECORD

This record is available only to an insurer, insurance support organization, and the person to whom the record pertains for the purpose of providing a discount to the individual. It contains the same information as a nonemployment driving record but is not limited to three years.

(a) Date the driving record was produced. (b) Account number used by DMV, or the account number charged. (c) Page number of the record. (d) Customer number (Oregon driver license, driver permit, identification card number or reference

number assigned by DMV to create a driving record). (e) The label “NAME” appears followed by the driver’s name. (f) The label “ADD” or “WRK” appears on this line. If “ADD” is displayed, the address shown is the

person’s residence address. If “WRK” is displayed, the address shown is the person’s employment address.

(j) Expiration date of driver’s license. 00/00/00 indicates no license has been issued or expiration date has been down-dated because of another reason (such as a cancellation, revocation, or surrender of driving privilege form).

(k) License type. Indicates the class of license. If a person does not have a valid license and has been issued an ID card, license type displays “I”. Refer to Classification of Licenses for explanation of license types.

(l) The Policy or ID field is available for use identification, such as name or case number of the person ordering the record. A maximum of 20 spaces may be used.

(m) Endorsements attached to a license are displayed here. CODE ENDORSEMENT

H Any vehicle which carries hazardous materials (HAZMAT) that requires placards. M Motorcycle endorsement for any motorcycle regardless of engine displacement. N Tank vehicles designed to transport any liquid or gaseous material within a tank that is

either permanently or temporarily attached to a vehicle or chassis. Does not include portable tanks with a rated capacity of less than 1,000 gallons.

P Passenger vehicles designed to carry 16 or more persons, including the driver. S School bus used to transport students to/from school or school events. T Double/triple trailers. X Combined hazardous materials/tank endorsement. Y Farm endorsement (Class A). Z Farm endorsement (Class B).

(q) Expiration date of ID card. If a date appears in this field, it is the expiration date of the identification card; otherwise, the word “NONE” appears here.

(r) 1st licensed. Indicates when the person was first issued their Oregon driver license if issued on or after March 1, 2000. 00/00/00 indicates the person’s first license was issued prior to March 1, 2000, or no license has ever been issued.

LICENSE CLASSES

License Classification Vehicles That May Be Operated Class A Commercial May drive any vehicle or combination of vehicles with the proper

endorsements. Class B Commercial May drive any single vehicle with the proper endorsements. May tow a trailer

up to 10,000 pounds GVWR (Gross Vehicle Weight Rating). If the trailer has a loaded weight of more than 10,000 pounds, the gross weight of the combination (towing vehicle and trailer) must be less than 26,000 pounds.

Class C Commercial With the proper endorsements, may drive any single vehicle that does not weight more than 26,000 pounds.

Class C May drive any single vehicle with a loaded weight of not more than 26,001 pounds designed to carry less than 16 passengers (including the driver). May tow another vehicle with a loaded weight less than 10,001 pounds, as along as the combined weight does not exceed 26,000 pounds. May operate a moped. Firefighters operating emergency fire vehicles are also included in this class.

CDL ISSUANCE ENTRY This entry is used when a CDL is issued, whether it is an original CDL issuance, a renewal, or a replacement (adding or deleting an endorsement or restriction is a replacement transaction).

STATE OF RECORD DMV uses this entry to show that a record on the Commercial Driver License Information System (CDLIS) has been changed to show Oregon as the State of Record (SOR), because a license was issued or driving privileges were reinstated. It is also used when another state issues a drive license to a person who has an Oregon record on CDLIS. Prior to 2007, it was also used to record the license number of an out-of-state driver when DMV created an Oregon record due to a traffic conviction.

RESTORE CDL ENTRY This entry is used when a CDL is downgraded to a Class C noncommercial license or a Hazmat endorsement is removed while waiting for the results of a security check. The downgrade could be for a number of different reasons. The segment indicates the driver may restore a CDL if they meet eligibility requirements within the permitted restoration date.

ACCIDENTS

Accidents are posted to a driver’s record after a reportable accident. Oregon law requires an accident be reported to DMV when one or more of the following occurs:

• An injury or death to any person; • Damage to the vehicle you were driving is over $1,500; • Property damage (not including a vehicle involved in the accident) is over $1,500; or • Damage to any vehicle is over $1,500 and any vehicle is towed from the scene due to damages

from the accident. 11

The following entries show the formats that Oregon uses to post accidents to driving records. The first format is an example of an accident occurring in Oregon. The second format is an example of an accident occurring in another state and the information was electronically transferred to Oregon.

(f) Special notation code. BLANK No special notations or driver improvement action taken.

A Preventable accident. Used as part of DMV’s Driver Improvement Program. N Nonpreventable accident. Used as part of DMV’s Driver Improvement Program. U Preventability undetermined. Used as part of DMV’s Driver Improvement Program. H Report at Accident Data Unit for coding. (No longer used.)

(g) CMV. The vehicle was a commercial motor vehicle; otherwise, field is blank. (h) HAZ. The vehicle was carrying hazardous materials; otherwise, field is blank. (i) State. Displays the two-character state abbreviation where the accident occurred; otherwise, field

is blank. This data is reported as part of a CDL change state-of-record transaction. (j) Out-of-state accident number. Displays other state’s accident ID number; otherwise, field is blank.

FINANCIAL RESPONSIBILITY

Financial responsibility means the ability to pay for damages resulting from an automobile accident. The Financial Responsibility Law requires that proof of financial responsibility be carried in any vehicle operated on public highways or roads. Future responsibility must be filed and maintained for three years with DMV by persons suspended for the following reasons: uninsured accident, fail to furnish proof of insurance, driving uninsured, and false certification.

Future responsibility filings are also required at the end of mandatory suspensions or revocations issued by a court or DMV. These include traffic crimes such as reckless endangerment, menacing, criminal mischief, failure to perform the duties of a driver in an accident, reckless driving, DUII, etc.

certification program. DMV selects samples of registered vehicles to ensure compliance with insurance requirements. This entry is used when a person failed to respond to the request to provide insurance information or the insurance company named as the provider denied coverage. CDL MEDICAL CERTIFICATION Federal regulations and state law require a person to be medically qualified to hold a CDL that authorizes operation of a commercial motor vehicle. The medical qualifications are dependent upon the driving type certified by that person. CDL medical qualification entries are included in a record only if the driver has a CDL or commercial instruction permit and an authorized customer requests a record that includes medical certification information. Convictions are entered on an Oregon driver record when DMV receives notice from a court or out-of-state jurisdiction that the driver has been convicted of a violation of motor vehicle law. Convictions display in one of two different formats.

1. The first is the format for convictions which occurred in Oregon.

2. The second format is the ACD Code system used to record convictions received from another state, whether manually entered by Oregon or electronically transmitted from another state. An ACD code starts with a letter followed by a two-digit number, such as S93.

IGNITION INTERLOCK DEVICE A person is required to have an Ignition interlock devices (IID) on any vehicle they operate. The length of the requirement for an IID depends on the driver record:

• One year for a first DUII conviction; two years for a second or subsequent DUII conviction; or five years for an aggravated vehicular homicide conviction;

• Five years if the DUII conviction included, as part of the same criminal episode, a conviction for: murder; manslaughter in the first or second degree; criminally negligent homicide; or assault in the first degree;

• Five years if the DUII conviction included permanent revocation of driving privileges by a court under ORS 809.235(1)(b) and later ordered restored under ORS 809.235(4);

• For the length ordered by an Oregon court as a condition of a DUII diversion agreement.

The IID requirement starts from the date ordered by the court for a DUII diversion agreement; the end dates of the suspension or revocations caused by the conviction; and during a DUII suspension if the driver applies for a hardship permit. Suspension is the temporary withdrawal of driving privileges. Revocation is the termination of driving privileges. Cancellation means the driver’s license or ID card is void and terminated. All these actions affect the status of Oregon driving privileges.

NOTE: Withdrawal (WTHD) is an entry used to record an action taken in another state. DMV records “Withdrawals” for historical/informational purposes. Withdrawal entries should not be used to determine if a driver has valid driving privileges in Oregon or in another state.

The suspension type was used on a temporary basis in order to implement 1999 legislation. The Standard Convictions Abbreviations table contains the standard conviction abbreviations used by DMV to post convictions to driving records. The table is made up of the following four columns:

COLUMN 1 – LITERAL This column contains either the Oregon conviction abbreviation (literal) or the out-of-state ACD code.

Oregon conviction abbreviations are three to 12 character alpha/numeric abbreviations for the offenses.

ACD codes are the standardized codes as determined by the AAMVA Code Dictionary (ACD) used to transfer driving record information from state to state. ACD codes are three characters; an alpha character followed by a two-digit number. These codes appear on Oregon driver records as convictions or withdrawals:

• When an out-of-state commercial licensed driver moves to Oregon and the driver’s previous state driving record is transferred electronically to Oregon; or

• When an Oregon licensed driver receives a conviction in another state. The out-of-state conviction is entered on the Oregon driver record using ACD codes.

COLUMN 2 – CITE This column references the Oregon Revised Statute (ORS) or other cite authority for the offense. The following are examples of the entries found in this column.
