Date: Dear Committee, I submit this letter as a formal complaint against Mr. Albert D’Agostino. Mr. D’Agostino is retained counsel for the East Ramapo Central School District, in Rockland County. I am a resident and tax payer in East Ramapo. Therefore, I am Mr. D’Agostino’s cli ent. On March 5, 2013, at the conclusion of a public East Ramapo School Board meeting, held at the school district offices, located at 105 Madison Avenue, Spring Valley, N.Y., in the parking lot, Mr. D’Agostino demonstrated conduct that was undignified and offensive towards a student in the district, Nicholas Pulakos, age 17. There were other students and taxpayers present. Mr. D’Agostino, used curses, and behaved in an intimidating manner towards this young man. He called him “A piece of shit,” and made other confrontational comments and movements, offering to fight physically. Nicholas Pulakos is a senior, and an AP honor student at Ramapo High School, a public school in the district. He was present when Mr. D’Agostino cursed, and berated a parent, Mr. Steven White. Attorneys should not treat people this way. This conduct is unacceptable and offensive. Mr. D’Agostino was present because he is retained counsel. As a member of the N.Y.S. Bar, his behavior is governed by the Rules of Professional Conduct which clearly prohibits discourteous and offensive conduct towards his clients, and during any situation where he is present on East Ramapo School District matters. I therefore request the Grievance Committee to conduct an investigation into this incident, and any related acts by Mr. D’Agostino which confirm his lack of respect for the clients he is paid to represent being the students, parents, and tax payers in the East Ramapo Central School District.
