The Government hereby empower the Officers of the Prohibition and

Excise Department mentioned in column (1) of the Table below to take disciplinary action against the subordinate Officers and staff of that Department mentioned in column (2) for the irregularities committed by them and to impose on them penalties mentioned in column (3) thereof:

Note: If any irregularities on the part of Assistant Commissioners and Distillery Officers are noticed by the Joint Commissioners they shall report the irregularities to the Commissioner of Prohibition and Excise.

4) The Commissioner of Prohibition and Excise

i) All Officers and staff of the Prohibition and Excise Department in the headquarters and districts. ii) All Officers and staff working in the Blending Units, Sugar Mills, Distilleries, Bonded Manufactories licensed premises, etc.,

All kinds of minor penalties

Note: As regards the imposition of major penalties , the Commissioner of Prohibition and Excise shall consult the Collectors concerned in respect of Tahsildars, Deputy Tahsildars etc. and the Commissioner of Revenue Administration in respect of Deputy Collectors and take action as advised by them.

2. The Government also direct that the appellate authorities against

the orders imposing penalties passed by the Officers mentioned in column (1) of the Table below shall b e the Officers mentioned against each in column (2) thereof:

I am directed to issue the following amendment to the G.O. cited.

A M E N D M E N T

In the said G.O. in the Table under the first paragraph, for the entries in columns (1), (2) and (3) in S. No. 4 , the following shall be substituted, namely.

Note: I) As regards the imposition of major penalties on the officers mentioned above in the cadre of Tahsildars, Deputy Tahsildars and Revenue Inspectors, the Commissioner of Prohibition and Excise shall consult the Collectors concerned and take action as advised by them.

II) If any irregularities on the part of Assistant Commissioners of Prohibition and Excise and the Deputy Collectors working and Distillery Officers are noticed, the Commissioner of Prohibition and Excise may call for the explanation of the Officers concerned and transfer the papers to the Commissioner of Revenue Administration for further action. As regards irregularities noticed on the part of the Joint Commissioners the Commissioner shall send a detailed report to the Government for action.

ORDER:- In the G.O. first read above, two posts of Joint Commissioners of

Prohibition and Excise in the grade of District Revenue Officer were sanctioned to the office of the Commissioner of Prohibition and Excise. In the G.O. second read above, an additional post of Joint Commissioner of Prohibition and Excise in the grade of District Revenue Officer was sanctioned. The Commissioner of Prohibition and Excise has sent draft adhoc rules for classifying the above posts. The Government approve the draft rules subject to certain modifications.

2. The following notification will be published in the Tamil Nadu

Government Gazette: NOTIFICATION:

In exercise of the powers conferred by the proviso to Article 309 of

the Constitution of India, the Governor of Tamil Nadu hereby makes the following rules.

The rules hereby made shall be deemed to have come into force on

the 7th May 1981.

RULES The General and the Special Rules applicable to the holders of the

permanent posts in Category 1 – District Revenue Officer of the Tamil Nadu Civil Service shall apply the holders of the temporary posts of Joint Commissioner of Prohibition and Excise, sanctioned from time to time in the Office of the Commissioner of Prohibition and Excise, Madras.

2. Constitution:- The posts shall constitute temporary addition to the said post in the said category of the said service.

ORDER:-

In the G.O. first read above, orders were issued sanctioning the

creation of twenty five posts of Assistant Commissioners of Prohibition and Excise on Rs. 750-50-1350- in the Prohibition and Excise Department, for the work connected with the implementation of the revised policy of the Government of Prohibition. Out of 25 posts, three are for the Office of the Commissioner of Prohibition and Excise and twenty two for the districts. In the G.O. second read above it was ordered inter-alia that 5 Selection Grade Section Officers of the Secretariat be appointed as Assistant Commissioners of Prohibition and Excise in the Prohibition and Excise Department. In the G.O. third read above, it has been ordered that while all Selection Grade Section Officers of the Secretariat are generally eligible for appointment as Assistant Commissioners of Prohibition and Excise, preference should be given first to those who have already served or undergone training as Tahsildar / Deputy Tahsildar in the districts and

secondly who have passed the Revenue Test in all parts. It has been further ordered that if persons who have already served or undergone training in the districts and who have passed Revenue Tests in all parts are not available for appointment to the posts of Assistant Commissioners of Prohibition and Excise, persons who are sufficiently seniors and are otherwise considered suitable may be appointed to the posts and that the Selection Grade Section Officers should be given postings either as Assistant Commissioners of Prohibition and Excise in the districts or in the Office of the Commissioner of Prohibition and Excise, or as Distillery Officers.

(i) by recruitment by transfer from among the Superintendents in the Offices of the Commissioner of Prohibition and Excise, the Special Commissioner and Commissioner of Revenue Administration and the Commissioner of Land Administration; or

(ii) by recruitment by transfer from among the Assistant Secretaries (since re designated as Assistant Commissioners) in the Offices of the Special Commissioner and Commissioner of Revenue Administration and the Commissioner of Land Administration included in Class XXV of the Tamil Nadu General Service ; or

(iii) by transfer from Category 2 - Deputy Collectors

of the Tamil Nadu Civil Service. (2) Appointment to the posts of Assistant Commissioners of Prohibition and Excise in the districts shall be made--

i) by transfer from Category 2 – Deputy Collectors

of the Tamil Nadu Civil Service ; or

ii) by recruitment by transfer from among the Section Officers in Class XII of the Tamil Nadu General Service,

(3) (a) Appointment to the posts in the Office of the Commissioner of Prohibition and Excise by transfer from Category 2 - Deputy Collectors of the Tamil Nadu Civil Service shall be restricted to one post only.

(b) Appointment to the posts in the districts from among the

Section Officers in Class XII of the Tamil Nadu General Service shall be restricted to one post only.

4. Qualification:- (1) No person shall be eligible for appointment to the posts in the Office of the Commissioner of Prohibition and Excise by recruitment by transfer from among the Superintendents in the Offices of the Commissioner of Prohibition and Excise, the Special Commissioner and Commissioner of Revenue Administration and the Commissioner of Land Administration unless he has completed the training as Tahsildar and his name has been included in the panel fit for appointment to the posts in Class XXV of the Tamil Nadu General Service.

(2) For appointment to the posts in the districts by recruitment by transfer, all Section officers are generally eligible but preference shall be given in the following orders to --

i) those who have already served or undergone training as Tahsildar or Deputy Tahsildar in the districts; and

ii) those who have passed the Revenue Test in all parts.

Provided that if persons with such preferential qualification are not available persons who are seniors and are otherwise considered suitable by the Government may be appointed to the posts.

5. Probation:- Every person appointed to the post of Assistant Commissioner of Prohibition and Excise in the Office of the Commissioner of Prohibition and Excise by recruitment by transfer from among the Superintendents in the Offices of the Commissioner of Prohibition and Excise, the Special Commissioner and Commissioner of Revenue Administration and the Commissioner of Land Administration shall, from the date of which he joins duty, be on probation for a total period of two years on duty within a continuous period of three years.

6. Pay:- There shall be paid to the holders of the posts a monthly pay calculated in the scale of pay of Rs. 750-50-1350.

In exercise of the powers conferred by the proviso to Article 309 of

the Constitution of India, the Governor of Tamil nadu hereby makes the following rules.

ORDER: In the G.O. first read above, orders have been issued upgrading the

eight posts of Distillery Officers in the cadre of Tahsildars employed for supervision of work in eight distilleries in the State to those of Deputy Collectors. Actually the term “ Distillery Officer” is a functional name given to an officer of the Prohibition and Excise Department appointed and entrusted with the supervision and working of a distillery as defined in the Tamil Nadu Distillery rules, 1981, issued under the Tamil Nadu Prohibition Act, 1937 ( Tamil Nadu Act X of 1937) Besides, Deputy Collectors, Deputy Tahsildars also employed for supervision of distilleries and are called Distillery Officers. Hence, the 8 posts of Distillery Officer upgraded in the G.O. mentioned above are only posts of Deputy Collectors created for functioning as Distillery Officers at the distilleries and the cost of staff is recovered from the distilleries. In the G.O. second read above, orders have been issued, sanctioning the employment of Excise Supervisory Staff in different categories including three posts of Deputy Collectors for excise Supervision of the work at the bonded ware-houses relating to Indian-made Foreign Spirits. The cost of the staff is recovered from the owners of the bonded ware-houses. It is proposed to issue adhoc rules for the above posts.

In exercise of the powers conferred by the proviso to Aticle 309 of the Constitution of India, the Governor of Tamil Nadu hereby makes the following rules.

The rules hereby made shall be deemed to have come into force—

(i) on the 19th July 1981 in respect of the post of Distillery Officers in the Prohibition and Excise Department employed for supervision of work in distilleries; and

(ii) on the 15th October 1981 in respect of the posts of Excise

Supervisory Officers in the Prohibition and Excise Department employed for excise supervision of work in bonded ware- houses relating to Indian-made foreign spirits.

RULES.

The General and the Special Rules applicable to the holders of the

permanent posts in Category 2 - Deputy Collectors of the Tamil Nadu Civil Service shall apply to the holders of the temporary posts of –

(i) Distillery Officers in the Prohibition and Excise

Department employed for supervision of work in the distilleries under the Tamil Nadu Distillery rules, 1981 and

(ii) Excise Supervisory Officers in the Prohibition and Excise

The Commissioner of Prohibition and Excise has submitted draft ad- hoc rules for the temporary posts of Executive Assistant in the headquarters office and Excise Officers in the taluks in the grade of Tahsildar in the Prohibition and Excise Department. 3. Appointment:- Appointment to the posts shall be made:-

(a) by transfer from among the Tahsildars in category 1

of the said Service ; or

(b) by recruitment by transfer from among the Section Officers in Category 3 of Class XII in the Tamil Nadu General Service.

Provided that preference shall be given, firstly to those section

Officers who have already served or undergone training as Tahsildars or

5. Pay:- The holders of the post recruited by transfer from among the Section Officers of Secretariat shall be paid a monthly pay calculated in the scale of Rs. 1160-50-1460-70-1950.

With a view to implement the prohibition policy as further relaxed with effect from 1.5.1981, the Government decided to revise and restructure the administrative set up of the Prohibition and Excise Department. ORDER:

The Commissioner of Prohibition and Excise has submitted

draft ad hoc rules for the temporary posts of drivers of staff cars and Jeeps in his office. The Government approve the draft ad hoc rules subject to certain modifications.

The following Notification will be published in the Tamil Nadu

Government Gazette.

NOTIFICATION In exercise of the powers conferred by the proviso to Article 309 of

the Constitution of India, the Governor of Tamil Nadu hereby makes the following rules.

The rules hereby made shall be deemed to have come into force on the 7th May 1981.

RULES. The General and the Special Rules applicable to the holders of the permanent posts of Tahisldars in Category 1 of the Tamil Nadu Revenue Subordinate Service shall apply to the holders of the temporary post of Executive Assistant, in the Office of the erstwhile Joint Director of Prohibition and Excise, Madras upto the 21st July 1981 and in the office of the Commissioner of Prohibition and Excise, Madras, with effect on and from the 22nd July 1981,. subject to the modification specified in the following rule.

2. Constitution :- The post shall constitute a temporary addition to the said Category of the said Service.

NOTIFICATION –II

In exercise of the powers conferred by the proviso to Article 309 of

the Constitution of India, the Governor of Tamil Nadu hereby makes the following rules.

The rules hereby made shall be deemed to have come into force on

the 7th May, 1981.

RULES.

The General and the Special Rules applicable to the holders of the permanent posts in Class XII of the Tamil Nadu General Subordinate service shall apply to the holders of the temporary posts of driver, sanctioned from time to time ,for the Office of the Prohibition and Excise Department, subject to the modification specified in the following rules:-

2. Constitution:- The posts shall constitute a separate Category in the said Class of the said Service.

3. Appointment:- Appointment to the posts shall be made:-

(i) by direct recruitment ; or

(ii) by recruitment by transfer from among the holders of the post of Peon in the Office of the Commissioner of Prohibition and Excise or from any other service.

4. Appointing authority :- The appointing authority for the posts shall be the Joint Commissioner of Prohibition and Excise, Madras. 5. Qualification :-

(a) Age—No person shall be eligible for appointment to the post by direct recruitment , if he has completed or will complete thirty years of age on the first day of July of the year in which the selection for appointment is made;

(b) Other qualifications—No person shall be eligible for appointment to the post unless he possesses the following qualifications, namely;

(1) A pass in the VIII Standard from a recognized school. (2) A current driving licence issued by a licensing authority

specified in rule 4 of the Tamil Nadu Motor Vehicles Rules, 1980.

(3) A thorough knowledge of motor mechanism;

(4) Practical experience in driving heavy or light motor vehicles, for a period of not less than two years.

Explanation-- For the purpose of this sub-rule “a recognized school “ means a school maintained by or opened with the sanction of the State Government or to which recognition has been accorded by the Director of School Education, Madras under the Tamil Nadu Educational Rules. 6. Probation—Every person appointed to the post by direct recruitment shall, from the date on which, he joins duty, be on probation for a total period of two years on duty within a continuous period of three years.

7. Pay:- There shall be paid to the holders of the post a monthly pay calculated in the scale of Rs. 310 –10-470-15 500.

Provided that with effect on and from the 1st October 1984 the

monthly pay shall be calculated in the scale of Rs. 555-15-615-20-795-25- 970.

Constitution.-- The post shall constitute a separate category ion a distinct class of the said Service. 3. Appointment: Appointment to the posts shall be made—

a) by transfer from the post of Assistant in the Revenue Units; and

b) by recruitment by transfer from among the holders of the post of Assistant in Category 2 of the Tamil Nadu Secretariat Service and with effect on and from the 30th November 1984 from among the holders of the post of Assistant Section Officer in the said category of the said service:

Provided that the total number of persons appointed to the posts by the method specified in clause ( b) shall not exceed forty.

4. Appointing authority :- The appointing authority for the posts shall be the District Revenue Officer of the District concerned except Kanniyakumari Nilgiris and Madras districts :

Provided that in respect of Kanniyakumari , Nilgiris and Madras districts , the appointing authority for the posts shall be the Collector concerned.

5. Qualifications No person shall be eligible for appointment to the posts by the method of appointment specified in Column (1) of the Table below unless he possesses the qualifications specified in the corresponding entries in column ( 2) thereof:-

Provided that, other things being equal, preference shall be given to those who have----

(i) served or undergone training an Firka Revenue Inspector in the districts for a period of not less than one year.

(ii) passed revenue Tests Parts I, II and III.

6. Pay :- (a) every person appointed to the post by transfer shall be paid a monthly pay calculated in the scale of Rs. 400-15-490-20-650-25-700.

Provided that with effect on an from the 1st October , 1984 the monthly

pay shall be calculated in the scale of Rs. 705-20-745-25-845-35-1230.

(b) Every person appointed to the post by recruitment by transfer shall be paid a monthly pay calculated in the scale of Rs. 780-35-1025-40-1385.

ORDER: During May 1981, Prohibition policy was relaxed by the Government.

In order to attend to the increased volume of work involved in implementing the relaxed policy on prohibition the administrative set up of the Prohibition and Excise Department was restructured by sanctioning staff at headquarters, district and taluk levels. In the G.O. second read above, sanction was accorded for the appointment of 5 Selection Grade Section officers of Secretariat as Assistant Commissioner of Prohibition and Excise ( in the grade of Deputy Collector), 15 Section Officers, of secretariat as Excise Officers ( in the grade of Tahsildar ) and 40 Assistant section officers of Secretariat ( formerly Assistant) as Excise Inspectors / Excise Movement Inspectors ( in the grade of Assistant).

2. In the context of the modified prohibition policy now introduced

in the State, with effect from 1.1.1987, wherein the sale and consumption of arrack and toddy have been prohibited, the work load in the Prohibition and Excise Department has since been reduced. The Government, therefore, reviewed the staff position and have sanctioned in the G.O. fourth read above reduced pattern of staff for the Department.

3. As the strength of the posts in the categories wherein reservation

was made for secretariat personnel has now been reduced, the Government have decided to make a corresponding reduction in the reserved posts. They, accordingly direct that, in partial, modification of the orders issued in the G.O. second read above, the reduced number of posts mentioned in column 4 of the statement in the Annexure to this order, may now be reserved for the Secretariat personnel mentioned in column 3 against each, for the posts mentioned in column 2 thereof.

dated: 17.10.89, the Government sanctioned among others, the creation of four posts of press operators and two posts of Helpers in connection with printing of Excise Labels consequent on the entrustment of the work of printing of excise labels to the Commissioner of Prohibition and Excise, Madras. In his letters read above, the Commissioner of Prohibition and Excise, Madras has sent draft ad-hoc rules for the posts of Press Operators and Helpers. The Government accept the said draft ad-hoc rules.

(b) Other qualifications No persons shall be eligible for appointment to the posts unless the possesses the following qualifications, namely:-

(i) Minimum General Educational Qualifications or its equivalent ;

and (ii) A technical Trade Certificate in the Trade of letter Press Machine

minder from an institution approved by the Government of Tamil nadu or an equivalent certificate issued by an institution approved by the Government of India.

6. Preparation of annual list of approved candidates:- For the purpose of preparation of annual list of approved candidates, the crucial date on which a person should possess the qualifications for appointment to the post of press operator by promotion or recruitment by transfer shall be the first December of every year. 7. Probation:- (a) Every person appointed to the post by direct

recruitment shall, from the date on which he joins duty be on probation for a total period of two years on duty within a continuous period of three years.

(b) Every person appointed to the post of the press operator by recruitment by transfer shall, from the date on which he joins duty, be on probation for a total period of one year on duty within a continuous period of two years.

8. Pay:- There shall be paid to the holder of the post specified in

column (1) of the table below a monthly pay calculated in the scale specified in the corresponding entries in column (2) thereof.

ORDER: In the G.O. third read above, the Government have issued orders

sanctioning among others the employment of one Distillery Officer ( Deputy Collector cadre) and two Deputy Tahsildars to each of the 6 distilleries set up by following Sugar Mills:-

Kothari Sugars and Chemicals Ltd., Trichy District. 5. 5. Thiru Arooran Sugars Ltd., Thanjavur District. 6. 6. Aruna Sugar Ltd., South Arcot Vallalar District.

2. The ( Erstwhile) Board of Revenue Officials Association, Chennai and represented that in view of stagnation in their office four posts of Deputy Tahsildars cut of the 12 posts of Deputy Tahsildars sanctioned in the G.,O. third read above, may be reserved for the personnel of Revenue Administration. The Tamil nadu Secretariat Association has also represented that in view of the severe stagnation in various categories of Secretariat Staff the Excise supervisory Staff sanctioned ion the G.O. third read above may be filled up from the Selection Grade Section Officers/ Assistant Section Officers of Secretariat.

3. The Government have examined the representation of the above Associations in consultation with Principal Commissioner and Commissioner of Revenue Administration Chennai and they have decided to reserve 50 % of the posts for Secretariat personnel and 50% of the posts to the personnel of Revenue Administration Department.,

4. Accordingly, the Government direct that 50% of the Excise

Supervisory Staff sanctioned in the G.O. third read above, I.e. 3 posts of Distillery Officers in the cadre of Deputy Collector and 6 posts of Deputy Tahsildars be reserved for Selection Grade Section Officers and Selection Grade Assistant Section Officers of Departments of Secretariat respectively and the remaining 50% of the Excise Supervisory Staff i.e. 3 posts of Distillery Officers in the cadre of Deputy Collector and 6 posts of Deputy Tahsildars be reserved for the personnel of Revenue Administration Department.

5. This order issued with the concurrence of Personnel and

Administrative Reforms and Revenue Department vide their U.O. No. 69853 / P&AR (H) 96-1 dated 29.10.96 and U.O. No. 68407/Rev. (B1) 96-1 dated 5.11.96 respectively.

The Commissioner of Prohibition and Excise has sent draft adhoc rules for the temporary posts of System Person ( Computer) and Data Entry Person sanctioned in the Government Order read above, The Government accepts the draft adhoc rules and issue the adhoc rules to the above mentioned posts.

In exercise of the powers conferred by the proviso to Article 309 of the Constitution of India, the Governor of Tamil Nadu hereby makes the following rules:

2. The rules hereby made shall be deemed to have come into force on the 29th January 1991.

RULES The General Rules applicable to the holders of the permanent post

in the Tamil nadu General Service shall apply to the holders of the temporary posts of System Person (Computer) sanctioned, from time to time, for the Office of the Commissioner of Prohibition and Excise, Madras, subject to the modification specified in the following rules:-

2. Constitution:- The posts shall constitute a distinct Class of the said service.

3, Appointment:- Appointment to the post shall be made by the direct recruitment.

4) Qualifications :- (a) Age No person shall be eligible for appointment

to the post, if he has completed or will complete the age of thirty years on the first day of July of the year in which the selection for appointment is made.

5) Other Qualifications: No person shall be eligible for appointment to the post unless he possesses the following qualifications, namely:-

(i) M.Sc., Computer Science or Msc., in Physics, Chemistry Mathematics or Statistics with Post Graduate Diploma in Computer Science or B.E. Degree in Computer Science or a Master Degree in Computer Applications;

(ii) Working knowledge in not less than three programming languages; and

Experience in Software development in Companies registered under the Companies Act, Government undertakings or Government Departments for a period of not less than three years.

6. Probation:- Every person appointed to the post shall, from the

date on which he joins duty be on probation for a total period of two years on duty within a continuous period of three years.

7. Pay:- There shall be paid to the holder of the post a monthly pay calculated in the scale of Rs. 2200-75 -2800-100-4000.

8. Savings : Nothing contained in sub rule (a) of rule 4 shall

adversely affect any persons already working as System Person

in the Tamil nadu General Subordinate Service shall apply to the holders of the temporary posts of Data Entry Person sanctioned, from time to time, for the Office of the Commissioner of Prohibition and Excise, Madras , subject to the modification specified in the following rules:-

2. Constitution:- The posts shall constitute a distinct Class of the said service.

3, Appointment:- Appointment to the post shall be made by the direct recruitment.

4. Appointing authority : The appointing authority for the post shall be the Joint Commissioner of Prohibition and Excise in charge of establishment.

5. Qualifications :- (a) Age No person shall be eligible for appointment to the post, if he has completed or will complete the age of thirty years on the first day of July of the year in which the selection for appointment is made.

6) Other Qualifications: No person shall be eligible for appointment to

the post unless he possesses the following qualifications, namely:- (a) A pass inS.S.L.C. (b) A Certificate in Date Entry issued by an institute recognized by the

Government of Tamil nadu or the Government of India; and A Certificate of having passed English Typewriting by higher grade issued by the Director of Technical Education, Chennai or its equivalent.

In G.O.Ms.No. 222, Prohibition and Excise dated: 9.9.81 sanction was accorded for the appointment of 5 Selection Grade Section officers of Secretariat at as Assistant Commissioners of Prohibition and Excise (equivalent to the rank of Deputy Collectors ) 15 Section Officers as Excise Officers ( equivalent to the rank of Tahsildars ) and 40 Assistant Section Officers ( formerly Assistants ) as Excise Inspectors / Excise Movement Inspectors . Consequent on the reduction of staff strength in the Prohibition and Excise Department due to introduction of modified Prohibition Policy in the State with effect from 1.1.87 , the Government issued orders in G.O.Ms.No. 1758, Prohibition and Excise dated: 13.11.87,

Accordingly, the following Notifications will be published in the Tamil Nadu Government Gazette.

NOTIFICATION-I In the exercise of the powers conferred by the proviso to Article 309

of the Constitution of India, the Governor of Tamil Nadu , hereby makes the following amendment to the rules, published with Prohibition and Excise Department Notification No. B. 230/84 dated: the 31st May 1984 at Pages 239-290 of P& E II Section 1 (b) of the Tamil Nadu Government Gazette.

2. The amendment hereby made shall be deemed to have come into force on the 13th November, 1987.

AMENDMENT

In the said Rules, in rule 3, in sub rule ( 3), in clause ( b) for the expression “ five posts “ the expression “ two posts “ shall be substituted.

2. The amendment hereby made shall be deemed to have come into

force on the 13th November 1987.

AMENDMENT In the said Rules, in rule 3 in sub rule (b) in the second proviso for the

expression fifteen vacancies “ the expression “ six vacancies “ shall be substituted.

NOTIFICATION-III In exercise of the powers conferred by the proviso to Article 309 of

the Constitution of India, the Governor of Tamil Nadu hereby makes the following amendment to the rules published with Prohibition and Excise Department Notification No. SRO B-406/86 dated: the 24th September 1986 at Pages 537-539 of Part III Section 1 (b) of the Tamil Nadu Government Gazette dated: the 22nd October 1986.
