Sub: Tender Notification for the supply, installation and commissioning of Software in the

Department of Collegiate Education amongst empanelled vendors of the

Department of E-Governance, Government of Karnataka.

With respect to the above please find herewith enclosed the BID DOCUMENT for the supply,

installation and commissioning of Software in the Department of Collegiate Education amongst empanelled

vendors of the Department of E-Governance, Government of Karnataka.

Hence we request the concerned software vendors empanelled by the Department of E-Governance to

send in detailed sealed quotations in sealed box kept for this purpose in the office of Information Officer, Room no-

207, Commissioner for Collegiate Education, Tantrika Bhavana, Palace Road, Bangalore – 560 001, before 1.30

COMPETITIVE BIDDING FOR THE SUPPLY AND INSTALLATION OF SOFTWARE

The Commissionerate for Collegiate Education, DTE building, Palace Road, Bangalore, Karnataka invites sealed bids from eligible bidders for supply and installation of Software, as specified in schedule of requirements section-I:

1. Schedule of Supply: Within 2 Weeks after the receipt of purchase order 2. Supply and Installation of SOFTWARE to the office of the Department of Collegiate

Education, Palace Road, Bangalore, Karnataka and colleges as listed in the schedule of requirements in section VII

3. Interested eligible Bidders may obtain further information from and inspect the bidding documents at the office of The Commissioner for Collegiate Education, Palace Road, Bangalore, Karnataka, India.

4. The provisions in the instructions to Bidders and in the General Conditions of contract are based on the provisions of the Government of Karnataka, Purchase Rules

5. The bidding document may be obtained from the office of The Commissionerate for Collegiate Education, DTE building, Palace Road, Bangalore-560 001, Karnataka, during office hours, on all working days either in person or by post.

7. The cover of the bid document must clearly show “Competitive bid for supply and

installation of Software“. All bids must be accompanied by a bid security as specified in the bid document and must be delivered to the above office at the date and time indicated above.

8. Technically Passed Bids will be opened in the presence of Bidders' representatives who choose to attend on the specified date and time.

9. In the event of the date specified for bid receipt and opening being declared as a closed holiday for purchaser’s office, the due date for submission of bids and opening of bids will be the following working day at the appointed time.

1. The Project

The Government of Karnataka, Commissionerate for Collegiate Education, Bangalore-

560001. To procure software for the office and its colleges for which this Invitation for Bid

is issued.

2. Eligible Bidders

2.1 This Invitation for Bids is open to all eligible suppliers as per the vendors list approved by

the Department of E-Governance, Government of Karnataka.

2.2 Bidders should not be under a declaration of ineligibility for corrupt and fraudulent

practices issued by Govt. of Karnataka.

3. Content of Bidding Documents

3.1 The goods required, bidding procedures and contract terms are prescribed in the bidding

documents. In addition to the Invitation for Bids, the bid include duly filled:

a) Technical specification form

b) Price Schedules form;

c) Contract Form;

d) Performance Security form:

3.2 The Bidder is expected to examine all instructions, forms, terms, and specifications in the

bidding documents. Failure to furnish all information required by the bidding documents or

submission of a bid not substantially responsive to the bidding documents in every respect

will be at the Bidder's risk and may result in rejection of its bid.

4. Amendment of Bidding Documents

4.1 At any time prior to the deadline for submission of bids, the Purchaser may, for any

reason, whether at its own initiative or in response to a clarification requested by a

prospective bidder, modify the bidding documents by amendment.

4.2 All prospective bidders who have received the bidding documents will be notified of the

Amendment in writing or by faxes, and will be binding on them.

4.3 In order to allow prospective bidders reasonable time in which to take the amendment

into account in preparing their bids, the Purchaser, at its discretion, may extend the

deadline for the submission of bids.

5. Documents Comprising the Bid

The bid prepared by the bidder shall be submitted in two envelopes comprising the

following components:

5.1 First Envelope shall contain:

Attested copies of documents showing that the bidder has the financial, technical and

service capability necessary to perform the contract and meet the criteria outlined in the

qualification requirements to this end. All bids submitted shall include the following

information:

i. Attested copies showing the legal status, place of registration and principal

place of business of the firm.

ii. Documentary evidence established in accordance with I.T. Department's

eligible list of vendors that the Bidder is eligible to bid and is qualified to

perform the contract if its bid is accepted;

iii. Microsoft WLP certificate, Energy Star compliant, ACPI Compliant, ISO 9001

for the Product, DMI 2.0 And MRP II certificate for the Model quoted to

supply.

iv. Attested copies of sales tax registration and sales tax returns filed in the last

financial year 2006-07

v. Attested copies of acknowledgement of income tax returns filed in the last 03

years of 2004 – 2005, 2005 – 2006 and 2007-2008

vi. Details of the organization as per Section VII (a), (b), (c) including list of

technical employees as required and details of service/maintenance centers

setup in Karnataka state.

vii. Bid security in the form of Demand Draft drawn on a Nationalized Bank for

the prescribed sum as mentioned

5.2 Second Envelope shall contain:

i. The Bidder shall indicate on the Price Schedule the unit prices and total bid

prices of the Goods it proposes to supply under the Contract.

ii. Price Should Include the Warranty Period.

iii. Prices indicated on the Price Schedule shall be entered separately in the

following manner:

a. The price of the goods, including all duties and sales and other taxes

already paid or payable and the price for transportation, Insurance and

other local costs incidental to the delivery and installation of the goods at

their final destination.

b. Price per unit in the technical specification form of section II and

deviation of configuration if any.

6. WARRANTY:

Warranty of the software shall be TWO years from the date of acceptance by way of

demonstration of benchmarks at the time of installation. During the period of warranty the

software shall be maintained on site free of cost and kept in full working condition. Service

calls shall be attended within 4 hours in Bangalore and within 24 to 36 hours for

outstation.

7. Bid Security

7.1 The Bidder shall furnish, as part of its bid, a bid security of an amount of Rs

10,00,000=00(RupeesTen lakhs only) as Schedule of Requirements.

7.2 The bid security is required to protect the Purchaser against the risk of Bidder's conduct,

which would warrant the security's forfeiture.

7.3 The bid security shall be in Indian Rupees and shall be in one of the following forms:

Crossed Demand draft from Nationalized Bank Payable to The Director of Collegiate

Education, Sheshadri Road, Bangalore-1

7.4 Any bid not secured in accordance with above will be rejected by the Purchaser as non-

Responsive bid

7.5 Unsuccessful bidder's bid security will be discharged/returned as promptly as possible

but not later than 30 days after the expiration of the period of bid validity prescribed by The

Purchaser,

7.6 The successful Bidder's bid security will be discharged upon the Bidder signing the

Contract, and upon furnishing the performance security, as shown at section VI or in other

form acceptable to the purchaser.

7.7 The bid security may be forfeited:

In case of a successful Bidder, if the Bidder fails:

(i) To sign the Contract; or

(ii) To furnish performance security.

8. Period of Validity of Bids

8.1 Bids shall remain valid for 50 days after the date of bid opening prescribed by the

Purchaser. The Purchaser as non-responsive shall reject a bid valid for a shorter period.

8.2 In exceptional circumstances, the Purchaser may solicit the Bidder's consent to an

extension of the period of validity. The request and the responses thereto shall be made

in writing (or by cable or telex or fax). The bid security provided shall also be suitably

extended. A Bidder may refuse the request without forfeiting its bid security. A Bidder

granting the request will not be required nor permitted to modify its bid.

9. Formats and Signing of Bid

9.1. The Bidder shall prepare two copies of the bid, clearly marking each "Technical Bid"

and "Price Bid", as appropriate.

9.2. The all copies of the bid shall be typed or written in indelible ink and shall be signed by

the Bidder or a person or persons duly authorized to bind the Bidder to the Contract.

Written power-of-attorney accompanying the bid shall indicate the latter authorization.

The person or persons signing the bid shall initial all pages of the bid, except for in

amended printed literature

10. Sealing and Marking of Bids

10.1. The Bidders shall seal the original and each copy of the bid in separate inner

envelopes, duly marking the envelopes as "Technical" and "Price”. He shall then place

all the inner envelopes in an outer envelope.

10.2. The inner and outer envelopes shall:

(a) Be addressed to the Purchaser at the following address:

(b) Bear the Project Name or the Invitation for Bids title namely "Competitive

bidding for Supply & Installation of Computer etc" and number, and a

statement "Do not open before 15.00 hours on 31/01/2008"

10.3. The inner envelopes shall also indicate the technical/price, name and address of the

Bidder to enable the bid to be returned unopened in case it is declared "late".

10.4. If the outer envelope is not sealed and marked as required above the Purchaser will

assume no responsibility for the bid's misplacement or premature opening.

11. Deadline for Submission of Bids

11.1 The Purchaser at the address must receive bids no later than the time and date

specified in the Invitation for Bids. In the event of the specified date for the

submission of Bids being declared a holiday for the Purchaser, the Bids will be

received up to the appointed time on the next working day.

11.2 The Purchaser may, at its discretion, extend this deadline for submission of bids by

amending the bid documents in which case all rights and obligations of the Purchaser

and Bidders previously subject to the deadline will thereafter be subject to the

deadline as extended.

12. Late Bids

Any bid received by the Purchaser after the deadline for submission of bids prescribed by

the Purchaser will be rejected and/or returned unopened to the Bidder.

13. Opening of Bids by the Purchaser

13.1. Technically passed vendors names will be informed to the bidders before opening the

price bid on that day.

13.2. The Purchaser will open technically eligible bids, in the presence of Bidders'

representatives who choose to attend, at 15.00 hours on 31/01/2008 and in the

The Bidders' representatives who are present shall sign a register evidencing their

attendance. In the event of the specified date of Bid opening being declared a holiday for the

Purchaser, the Bids shall be opened at the appointed time and location on the next working

day.

13.3. Bids that are not opened and read out at bid opening shall not be considered further

for evaluation, irrespective of the circumstances.

14. Evaluations and Comparison of Bids

14.1 The Committee constituted will evaluate and compare the technical bid which are

Substantially responsive.

14.2. The Purchaser's evaluation of a bid will take into account, in addition to the total bid

price the following :

a Legal status, place of registration and principal place of business of the firm. b Microsoft WLP certificate, Energy Star compliant, ACPI Compliant, ISO 9001 for

the Product, DMI2.0 and MRP II certificate for the Model quoted to supply. c Attested copies of sales tax registration and sales tax returns filed in the last

financial year 2006 – 2007. d Attested copies of acknowledgement of income tax returns filed in the last 03

years of, 2004 – 2005, 2005– 2006.and 2007– 2008. e Bid security in the form of Demand Draft drawn on a Nationalized Bank for the

prescribed sum as mentioned 14.3 The purchaser's will evaluate technically qualified bid’s price bid of items by taking

into account, in addition the overall price.

(a) Cost of transportation, insurance and other costs incidental to the delivery of the goods to their final destination;

(b) Delivery schedule offered in the bid;

15. Award Criteria

1. The Purchaser will award the contract to the successful Bidder only after formal approval of additional components for additional funds by the government.

2. The Purchaser will award the Contract to the successful Bidder whose bid has been determined to be substantially responsive and has been determined as the lowest evaluated bid, provided further that the Bidder is determined to be qualified to perform the Contract satisfactorily.

16. Purchaser's right to vary Quantities at time of Award

The Purchaser reserves the right at the time of Contract award to increase or decrease

by up to 20 percent the quantity of goods and services originally specified in the Schedule

of Requirements (rounded off to the next whole number) without any change in unit price

or Other terms and conditions.

17. Notification of Award

17.1 Prior to the expiration of the period of bid validity, the Purchaser will notify the successful bidder in writing by registered letter or by cable or telex or fax or E-mail, to be confirmed in writing by registered letter, that its bid has been accepted.

17.2 The notification of award will constitute the formation of the Contract. 17.3 Upon the successful Bidder's furnishing of performance security the Purchaser will

promptly notify each unsuccessful Bidder and will discharge its bid security.

18. Signing of Contract

18.1 At the same time as the Purchaser notifies the successful bidder that its bid has been

accepted, the Purchaser will send the bidder the Contract Form provided in the

bidding documents, incorporating all agreements between the parties.

18.2. Within 10 days of receipt of the Contract Form, the successful bidder shall sign and

date the Contract and return it to the Purchaser.

19. Performance Security

19.1 Within 10 days of the receipt of notification of award from the Purchaser, the successful

Bidder shall furnish the performance security in accordance with the Conditions of Contract, in

the Performance Security Form provided in the bidding documents or in any other form

acceptable to the Purchaser.

19.2 Failure of the successful bidder to comply with the requirement shall constitute

sufficient grounds for the annulment of the award and forfeiture of the bid security, in

which event the Purchaser may make the award to the next lowest evaluated bidder

or call for new bids.

20. The Tender accepting authority shall have the right to reject any or all the tenders without

assigning any reason whatsoever.

21. Delivery:

Supplier should display the stock for verification at the Office of Commissionerate for

Collegiate Education Department, Bangalore. After verification, supplier should dispatch

the items to scheduled places as per section VII (a), (b) and (c). Payment will be against

obtaining stock certification & installation certificate from the concerned Principals /

Officers.

2. All bids submitted shall also include the following information along with formats under

(i) Defining the constitution or legal status, place of registration and principal,

place of business of the company or firm or partnership, etc.

ii) Details of Service Centers and information on service support facilities that

would be provided after the warranty period.
