PART1INTERPRETATION

Definitions

1. IntheseregulationsawordorexpressiontowhichameaninghasbeenassignedintheActbearsthatmeaning,andunlessthecontextotherwiseindicates-

“AnimalIdentificationRegulations”meanstheAnimalIdentificationRegulationspublishedunderGovernmentNoticeNo.29of5March2009;

“approved”meansapprovedinwritingbytheChiefVeterinaryOfficer;

“approvedform”meansaformapprovedbytheChiefVeterinaryOfficer;

“approved dip” means a dip registered as a stock remedy under the Fertilizers, Farm Feeds,AgriculturalRemediesandStockRemediesAct,1947,againstaninfectiousagentandapprovedbytheChiefVeterinaryOfficer;

“ChiefVeterinaryOfficer”meansaChiefVeterinaryOfficerreferredtoinsection2oftheAct;

“cleanse”meanstogetridofanyinfectiousagent;

“communalarea”meansacommunalareaasdefinedinsection1oftheCommunalLandReformAct,2002(ActNo.5of2002);

“de-flyingstation”meansade-flyingstationreferredtoinregulation81;

“designatedentryorexitpoint”meansaplacedesignatedintermsofregulation3asaplaceofentryorexitforthepurposeoftheseregulations;

“Fertilizers,FarmFeeds,AgriculturalRemediesandStockRemediesAct,1947”meanstheFertilizers,FarmFeeds,AgriculturalRemediesandStockRemediesAct,1947(ActNo.36of1947);

“healthcertificate”meansahealthcertificatereferredtoinsection13oftheAct;

“importpermit”meansanimportpermitreferredtoinsection7oftheAct;

“importandtransitpermit”meansanimportandtransitpermitreferredtoinsection8oftheAct;

“landedproperty”means-

(a) aportionoflandheldunderaseparatetitledeedwhichisregisteredinanydeedsregistryincludingadjoiningportionoflandheldbythesameowner;

(b) anycommunallandasdefinedinsection1oftheCommunalLandReformAct,2002(Actno.5of2002),formingpartofacommunalarea;or

(c) landsituatedinalocalauthorityarea;

“MedicinesandRelatedSubstancesControlAct,2003”meanstheMedicinesandRelatedSubstancesControlAct,2003(ActNo.13of2003);

“movement permit” means a movement permit refer to in Part V of theAnimal IdentificationRegulations;

“NatureConservationOrdinance,1975”meanstheNatureConservationOrdinance,1975(OrdinanceNo.4of1975);

“localauthorityarea”meansalocalauthorityareaasdefinedinsection1oftheLocalAuthoritiesAct,1992(ActNo.23of1992);

“PerformingAnimalProtectionAct,1935”meansthePerformingAnimalProtectionAct,1935(ActNo.24of1935);

“policeofficer”meansamemberoftheNamibianpoliceforceappointedintermsofsection4ofthePoliceAct,1990(ActNo.19of1990);

“poultry”meansalldomesticvarietiesofducks,fowls,geese,guinea-fowls,partridges,peafowls,pheasants,pigeonsandturkeys;

“prescribedconcentration”meanstheconcentrationasindicatedonalabelaffixedtoacontainerofanapproveddiporasmarkedonsuchcontainer,atwhichthedippingfluidobtainedfromthedipconcernedistobekepttobeeffectiveagainsttheinfectiousagent;

“protectedarea”meansanareathathasbeendeclaredasaprotectedareaundersection20(1)oftheActforthepurposeofpreventingtheintroductionintoorthespreadinthatareaofadisease;

“quarantinestation”meansaquarantinestationreferredtoinsection12oftheAct;

“removalpermit”meansaremovalpermitissuedbyaveterinaryofficialfortheremovalofananimal,animalproductorrestrictedmaterial;

“theAct”meanstheAnimalHealthAct,2011(ActNo.1of2011)includinganyregulationorrulesmade,ordeclaration,notice,directiveororderissuedundertheAct;“TraditionalAuthoritiesAct,2000”meanstheTraditionalAuthoritiesAct,2000(ActNo.25of2000);

“vaccines”meansvaccinesdeclaredbytheMinisterasanimalproductsundersection1(2)(b)oftheAct.

Status of declaration

2. Inthecaseofaconflictbetweentheseregulationsandadeclarationmadeintermsofsection17,18,19or20oftheAct,theprovisionsofadeclarationprevails.

PART2DESIGNATEDENTRYANDEXITPOINTS

Designated entry and exit points

3. (1) The places listed in Schedule 1 are designated entry and exit points forpurposesofimportationorexportationofananimal,animalproductorrestrictedmaterial.

(2) An animal, animal product or restricted material in respect of which an importpermit, importandtransitpermitorahealthcertificatehasbeenissuedmustonlybeimportedorexportedatthedesignatedentryorexitpoint.

(3) TheChiefVeterinaryOfficermustensurethataveterinaryofficialisavailableatthedesignatedentryandexitpointforthepurposeofimplementingandenforcingtheprovisionsoftheAct.

PART3IMPORTPERMITSANDIMPORTANDTRANSITPERMITS

Application for permit to import animals, animal products or restricted material

4. (1) Anapplicationcontemplatedinsection7(3)oftheActforanimportpermitmustbemadeintheapprovedformandbe-

(a) submittedintriplicatetoaveterinaryofficialfortheattentionoftheChiefVeterinaryOfficer;and

(b) accompaniedbytheappropriatefeesetoutinSchedule2.

(2) TheChiefVeterinaryOfficermustconsidertheapplicationreferredtoinsubregulation(1)andmayapproveorrefusetheapplication.

(3) IftheapplicationforanimportpermitisapprovedtheChiefVeterinaryOfficermustissuetheimportpermittotheapplicant.

Conditions applicable for importation of animals, animal products or restricted material

5. (1) An animal, animal product or restrictedmaterial imported into NamibiamustbemadeavailabletoaveterinaryofficialatapointofentryonitsentryintoNamibia.

(2) Apersonmaynotremoveananimal,animalproductorrestrictedmaterialinrespectof which an import permit has been issued, from any conveyance or from any other means oftransportationuponwhichithasbeenbroughtintoNamibia,unlesssuchanimal,animalproductorrestrictedmaterialhasbeeninspectedbyaveterinaryofficialandtheveterinaryofficialhasissuedaremovalpermit.

(3) A person may not remove, from a conveyance or from any other means oftransportationreferredtoinsubregulation(2),anyfittingsorequipmentsusedinconnectionwiththeanimal,animalproductorrestrictedmaterial,unlesssuchfittingorequipmenthasbeeninspectedbyaveterinaryofficialandtheveterinaryofficialhasissuedaremovalpermit.

Application for import and transit permit for conveyance in transit through Namibia

6. (1) Anapplicationcontemplatedinsection8(3)of theActforan importandtransitpermitmustbemadeintheapprovedform,andbe–

(a) submittedintriplicatetoaveterinaryofficialfortheattentionoftheChiefVeterinaryOfficer;and

(b) accompaniedbytheappropriatefeesetoutinSchedule2.

(2) TheChiefVeterinaryOfficermustconsidertheapplicationreferredtoinsubregulation(1)andmayapproveorrefusetheapplication.

(3) IfanapplicationfortheimportandtransitpermitisapprovedtheChiefVeterinaryOfficermustissuetheimportandtransitpermittotheapplicant.

Notice of intention to import animals, animal products or restricted material

7. Thenoticeofintentiontoimportananimal,animalproductorrestrictedmaterialforentryintoNamibiaorforconveyanceintransitthroughNamibia,ascontemplatedinsection9oftheAct,mustgivenintheapprovedform.

PART4EXPORTATIONOFANIMALS,ANIMALPRODUCTSORRESTRICTEDMATERIAL

Application for health certificate relating to animals, animal products or restricted material

8. (1) An application contemplated in section 13(3) of the Act for a healthcertificatemustbemadeintheapprovedform,andbe–

(a) submittedintriplicatetoaveterinaryofficialfortheattentionoftheChiefVeterinaryOfficer;and

(b) accompaniedbytheappropriatefeesetoutinSchedule2.

(2) TheChiefVeterinaryOfficermustconsidertheapplicationreferredtoinsubregulation(1)andmayapproveorrefusetheapplication.

(3) Ifanapplicationforahealthcertificatereferredtoinsubregulation(1)isapprovedtheChiefVeterinaryOfficermustissuethehealthcertificatetotheapplicant.

PART5CONDITIONSRELATINGTOIMPORTATIONOFVACCINESANDTHEUSE,

MANUFACTURE,TESTING,DISTRIBUTION,STORAGEANDSALEOFVACCINES

Manufacture of vaccines used for testing, vaccination or inoculating

9. (1) ApersonmaynotmanufactureorcausetobemanufacturedinNamibiaavaccineusedorintendedtobeusedfortesting,treatmentorinoculationofananimalfororagainstadisease,exceptuponwrittenpermittomanufactureissuedbytheChiefVeterinaryOfficer.

(2) An application contemplated in subregulation (1)must bemade in the approvedform,andbe–

(a) submittedintriplicatetoaveterinaryofficialfortheattentionoftheChiefVeterinaryOfficer;and

(b) accompaniedbytheappropriatefeesetoutinSchedule2.

(3) TheChiefVeterinaryOfficermustconsidertheapplicationreferredtoinsubregulation(1)andmayapproveorrefusetheapplication.

(4) If an application for a permit tomanufacture referred to in subregulation (1) isapprovedtheChiefVeterinaryOfficermustissuethepermittotheapplicant.

Dealing in vaccines

10. (1) Apersonmaynotuse,sellordisplayforsaleordistributeavaccineusedorintendedtobeusedfortesting,treatmentorinoculationofananimalfororagainstadisease,exceptuponwrittenpermitbytheChiefVeterinaryOfficer.

(2) Vaccinesusedforthetesting,vaccinationorinoculationofanimalsmustbestoredinaccordancewiththemanufacture’sdirectionrelatingtocooling,storageandexpirydate.

(3) An application contemplated in subregulation (1)must bemade in the approvedform,andbe-

(a) submittedintriplicatetoaveterinaryofficialfortheattentionoftheChiefVeterinaryOfficer;and

(b) accompaniedbytheappropriatefeesetoutinSchedule2.

(4) TheChiefVeterinaryOfficermustconsidertheapplicationreferredtoinsubregulation(1)andmayapproveorrefusetheapplication.

(5) Ifanapplicationforapermitreferredtoinsubregulation(1)isapprovedtheChiefVeterinaryOfficermustissuethepermittotheapplicant.

(6) Theprohibitionreferredtoinsubregulation(1)doesnotapplytoavaccineimportedontheauthorityofanimportpermitorimportandtransitpermit.

Samples of vaccines

11. TheChiefVeterinaryOfficermaytakeorcausetobetaken,samplesandspecimensofavaccineimportedintoormanufacturedinNamibia,andmaycausesuchsamplesandspecimenstobesubjectedtoexaminationsandtestsastheChiefVeterinaryOfficermayconsidernecessary.

PART6PROVISIONSRELATINGTONOTICES

Service of notice of declaration of infected place

12. (1) Serviceofanoticeofthedeclarationintermsofsection17(1)oftheActmaybeeffectedinthefollowingmanner:

(a) byhandingacopyofthenotice-

(i) personallytotheowneroftheplaceorconveyance;or

(ii) toapersoninchargeoftheplaceorconveyance;

(b) byleavingacopyof thenoticeat theplaceorconveyanceandif thereisnooneavailable to receive the notice by affixing it to the main door of the premises,building,structureorconveyanceconcerned;

(c) byfaxingoremailingacopyofthenoticetotheowneroftheplaceorconveyance’sfaxnumberoremailaddress;or

(d) bysendingacopyofthenoticebyregisteredposttothelastknownaddressoftheowneroftheplaceorconveyance.

(2) UnlessotherwiseprescribedbytheActanyothernoticesrequiredtobeservedundertheseregulations,mustbeservedinanymannerprescribedinthisregulation.

Notice of intention to construct fence

13. (1) Thenoticeofintentiontoconstructafencecontemplatedinsection21(2)oftheActmustbegiveninanapprovedform.

(2) Serviceofthenoticereferredtoinsubregulation(1)maybeeffectedinthemannersetoutinregulation12.

PART7PROVISIONSRELATINGTOSTRAYINGANIMALS

Reporting requirements for straying animals

14. (1) Theowneroroccupierof landcontemplated in section22(1)of theAct,must immediately report thepresenceof ananimal referred to in that section, eitherorallyor inwriting,toaveterinaryofficialortoapoliceofficer.

(2) Apoliceofficerwhoreceivesareportreferredtoinsubregulation(1)mustinformaveterinaryofficialofsuchreport.

Disposal of straying animals

15. Thedisposalofananimalcontemplatedinsection22(3)(b)andsection22(5)oftheAct,maybecarriedoutinanyofthefollowingmanner:

(a) ifthedisposalcanbedoneinamannerbeneficialtotheState,itmustbeeffectedinthatmanner,inwhichcaseexpenditureresultingfromthedisposalmustbedefrayedfromincomeobtainedfromthedisposal;

(b) theanimalmaybeslaughteredandcarcassforfeitedtotheState;or

(c) if thedisposal intermsofparagraph(a)and(b) isnotpossible,disposalmustbedoneinaccordancewiththewrittendirectionsoftheChiefVeterinaryOfficer.

PART8

PROVISIONSRELATINGTODISEASESANDNOTIFIABLEDISEASES

Duty to report notifiable disease and isolation and prevention of access to infected animal

16. (1) Thenotificationofanotifiablediseasereferredtoinsection15(1)(b)oftheAct,mayalsobemadetoapoliceofficer.

(2) Apoliceofficerwhoreceivesareportintermsofsubregulation(1)must,withoutdelay,informaveterinaryofficialofthereport.

(3) Thenotificationintermsofsection15(1)(b)maybemade-

(a) orally or telephonically in which case the person receiving it must furnishacknowledgmentofreceipt;or

(b) inwriting,whichincludessendingitbytelegram,facsimile,e-mailorbyaregisteredletterinwhichcasethepersonreceivingitmustfurnishacknowledgmentofreceipt.

(4) Theownerofananimalwhichisinfectedorissuspectedofbeinginfectedwithanotifiablediseasemust,withoutdelay,notify-

(a) theownerofanyotheranimalwhichisonthelandandwhichanimalissusceptibletoadiseasefromtheanimal;and

(b) theowneroroccupierofanyadjoininglandonwhichthereisanyanimalwhichissusceptibletothediseasefromtheanimal.

(5) If the owner of an animal knows or suspects that an animal is infected with anotifiabledisease,theowneroftheanimalmust-

(a) immediately isolate such animal from contact with other animals which aresusceptibletothedisease,andmustkeepsuchanimalinisolation,untilitsreleaseisauthorisedinwritingbyaveterinaryofficial;

(b) preventaccesstotheanimal,place,structure,enclosure,cageorotherthing,wheretheanimalisconfined,byanypersonotherthanaveterinaryofficialorotherpersonwhoseaccessisessentialfortheproperdiagnosis,treatmentandcareoftheanimal;and

(c) prevent access of other animals to such infected animal, the excreta, discharges,carcassoranypartofadeadanimal.

(6) Apersonwhohasbeen in contactwith an animal contemplated in section15(1)(b)oftheActorwithanydischarge,excretaorcarcassoftheanimalmustimmediatelyusethebestavailablemeans todisinfecthimselforherself andhisorher clothingandanyother instrument,implement,utensilorotherarticle,whichhasbeenusedinconnectionwiththeanimal,discharge,excretaorcarcass.

17. (1) Aveterinaryofficialmaygivetheownerofananimalwhichisinfectedorsuspectedofbeinginfectedwithanotifiablediseaseorwhichhasbeenincontactorcouldpossiblyhavecomeintocontactwithananimalinfected,instructionsfortheconfinement,isolation,securing,muzzling,clipping,cleansing,disinfecting,inoculation,immunisation,testingandtreatmentoftheanimalastheveterinaryofficialmayconsidernecessary,inordertodiagnose,treatandpreventthespreadofthedisease.

(2) Aveterinaryofficialmaygivewrittennoticetotheownerofananimalinanareainwhichtheclipping,handdressing,dippingorsprayingofcattleiscompulsoryundertheActorwhereanownerofananimalisrequiredintermsoftheActtokeephisorhercattlevisiblyfreefromliveticks,instructionstocleansehisorhercattlewithinaperiodspecifiedinthenotice.

Taking of smears

18. Subjecttoregulation23,aveterinaryofficialmayinstructtheownerofananimalwhichisinfectedorsuspectedofbeinginfectedwithanotifiablediseaseorhasdiedfromanycauseandissuspectedofbeinginfectedwithadisease,tosubmittoaveterinaryofficialanysmear,blood,milk,excreta,semen,specimen,organordischargefromtheanimal.

Branding of infected animals

19. A veterinary official may instruct the owner of an animal which is infected orsuspectedofbeinginfectedwithadiseaseorwhichhasbeenisolatedorinoculatedundertheActorwhichthemovementofanimalsofsamespeciesisprohibitedorrestrictedundertheAct,tobrandormarktheanimalatthetimeandinamannerandbyamethoddeterminedbytheChiefVeterinaryOfficer.

Release and removal of infected animals

20. (1) Apersonmaynot releaseor removeorcause tobereleasedor removed,fromisolationorconfinementananimaldetainedorseizedundertheAct,exceptonauthorityofaremovalpermitissuedbyaveterinaryofficial.

(2) Theprohibitionreferredtoinsubregulation(1)doesnotapplywhereafixedperiodofdetentionor confinement in aplaceother than aquarantine station is orderedby aveterinaryofficialandsuchperiodhasexpired.

(3) If there is on any land an animal infected or suspected of being infectedwith anotifiabledisease,apersonmaynotmoveorcausetobemovedintoorthroughthatland,anyanimalwhichissusceptibletothatdisease,exceptonauthorityoftheremovalpermitissuedbyaveterinaryofficial.

Removal of restricted material

21. Apersonmaynotmoverestrictedmaterialfromland-

(a) onwhichananimalhasdiedorissuspectedofhavingdiedofanotifiabledisease;or

(b) onwhichanotifiablediseaseoccursorissuspectedofoccurring,

exceptonauthorityoftheremovalpermitissuedbyaveterinaryofficial.

Slaughter of susceptible animals

22. Ifthereisonlandananimalinfectedorsuspectedofbeinginfectedwithanotifiabledisease, apersonmaynot slaughteror cause tobe slaughteredon such land an animalwhich issusceptibletothediseasefromsuchanimal,exceptonauthorityofapermittoslaughterissuedbyaveterinaryofficial.

Opening of carcass

23. (1) Aperson,otherthanaveterinaryofficialoraveterinarian,maynotinciseoropenorcauseorpermittobeincisedoropenedthecarcassoranypartofananimalwhichhasdiedorissuspectedofhavingdiedofanotifiablediseaseorwhichhasbeendestroyedasaresultofbeinginfectedorsuspectedofbeinginfectedwithanotifiabledisease.

(2) Subregulation (1)doesnotapply to theownerof theanimaloranyotherpersonauthorisedbytheownertocuttheear,tailorlimbofsuchcarcassforthepurposeoftakingabloodsmear.

Disposal of carcass

24. (1) Theownerofananimalwhichhasdiedorissuspectedofhavingdiedofanotifiablediseaseorwhichanimalhasbeendestroyedbytheownertopreventthespreadofthediseasemustdisposeofthecarcassbyburningorincineration.

(2) If burning or incineration referred to in subregulation (1) is not practicable, thecarcassmustbedisposedofbyburialinquicklimeatadepthof-

(a) not less than threemetres in the case of large animals and animals infected orsuspectedofbeinginfectedwithrabies;and

(b) notlessthanoneandahalfmetresinthecaseofsmallanimals.

(3) Theownerofananimalreferredtoinsubregulation(1)mustburytheresidueofaburnedorincineratedcarcassatadepthofatleastoneandahalfmetres.

(4) Despiteanythingtothecontraryinthisregulation,theownerofananimalreferredtoinsubregulation(1)mayapplyontheapprovedformtotheChiefVeterinaryOfficer,providedthatthenecessaryfacilitiesareavailableonthelandwhereananimalreferredtoinsubregulation(1)hasdiedorhasbeendestroyed,todisposeofthecarcassbysterilizationatasterilisingplantregisteredintermsoftheFertilizers,FarmFeeds,SeedsandRemediesAct,1947.

Exhumation of carcass

25. Apersonmaynotuncover,diguporremovefromitsburialplace,acarcassoranypartofananimalwhichhasdiedorissuspectedofhavingdiedofanotifiablediseaseorwhichhasbeendestroyedtopreventthespreadofdisease,exceptontheauthorityofapermittouncover,diguporremoveacarcassissuedbyaveterinaryofficial.

Prevention of access to certain places

26. (1) Ifananimalinfectedorsuspectedofbeinginfectedwithanotifiablediseasehasbeenconfinedatanyplace,atanytimewithinaperiodof90days, theowneroroccupierofthelandorplacewheresuchanimalisconfinedortheowneroftheanimalinfectedorsuspectedofbeinginfectedwithanotifiabledisease,mustpreventaccessto,orconfinementinsuchplace,ofanyotheranimaluntilsuchplacehasbeencleansedanddisinfectedinsuchmannerandbysuchmethoddeterminedbyaveterinaryofficial.

(2) Aveterinaryofficialmayordertheowneroroccupierofthelandortheownerofanimalreferredtoinsubregulation(1)to-

(a) cleanseanddisinfect theplace inamannerdeterminedby theveterinaryofficial,ifsuchplaceisorhasbeenoccupiedbyananimalinfectedorsuspectedofbeinginfectedwithadisease,withinaperiodof90days;

(b) cleanseanddisinfectanythingontheplace,whichisinfectedorsuspectedofbeing

infectedwithanotifiablediseaseorwhichintheopinionofaveterinaryofficialiscapableoftransmittingthediseaseorwhichhasbeenorcouldpossiblyhavebeenincontactwithananimalreferredtoinsubregulation(1),inamannerandbyamethoddeterminedbyaveterinaryofficial;

(c) todisinfectanddisposeoftheexcretaanddischargesfrom,thebedding,litter,andfodderofananimalreferredtoinsubregulation(1),inamannerandbyamethoddeterminedbyaveterinaryofficial;or

(d) toconfineallhisorheranimalswhicharesusceptibletoanotifiablediseasetoadefinedportionofhisorherlandortoexcludealltheanimalsfromadefinedportionof his or her land for a period as the veterinary officialmay consider necessaryinorder toprevent the spreador outbreakof disease, if an animal referred to insubregulation(1)wasconfinedforaperiodreferredtointhatsubregulation.

Disinfection of public places and conveyances

27. (1) Aperson in chargeof a publicmarket, sale yardor other placeused forthe assemblyor confinementof animalwhich are infectedor suspectedofbeing infectedwith adiseasemustcleanse,washanddisinfecttheplacetogetherwithallstructuresandenclosureusedinconnectionwiththeanimal,atthecloseofeachdayonwhichthatplacehasbeenused,inamannerandbyamethoddeterminedbyaveterinaryofficial.

(2) Apersoninchargeofaconveyanceorothermeansoftransportationusedforthetransportationofananimalinfectedorsuspectedofbeinginfectedwithanotifiabledisease,mustclean,washanddisinfectsuchconveyanceortransportationusedfortheconfinementortransportationofananimal.

Prohibition on use of infected milk

28. (1) Apersonmaynotuseorcausetobeusedordisposeofforuse,milkofananimalwhichisinfectedorsuspectedofbeinginfectedwithtuberculosis,footandmouthdiseaseorbrucellosisofcattle,unless suchmilkhasbeenboiled,pasteurizedor sterilizedbyefficaciousmethod.

(2) Apersonmaynotuseorcausetobeusedordisposeofforusemilkofananimalwhichisinfectedorsuspectedofbeinginfectedwithrabiesoranthrax.

(3) Apersonwhodiscoversthepresenceoftubercle bacilliinmilkmustwithoutdelay,reportthemattertogetherwiththenameandaddressofthepersonfromwhomthemilkwasobtained,toaveterinaryofficial.

Removal of animal hair and bristles

29. (1) Apersonmaynot,exceptonwrittenpermitbyaveterinaryofficial-

(a) moveorcause tobemoved rawanimalhairorbristles toanyplace inNamibia,whichhairorbristleshavenotbeensterilizedbyasterilizingplantregisteredundertheFertilizers,FarmFeeds,SeedsandRemediesAct,1947;or

(b) removeorcausetoberemovedanyhairorbristlesfromasterilizingplantreferredtoinparagraph(a),unlessthehairorbristleshavebeensubjectedtoaneffectivesterilizingordisinfectingprocess.

(2) Theapplicationforthepermitreferredtoinsubregulation(1)mustbemadeintheapprovedform.

(3) Subregulation(1)doesnotapplytotheremovalofgoathairwithinNamibiaortorawanimalhairorbristlesimportedintoNamibiaontheauthorityofanimportpermitoranimportandtransitpermit.

Duties in respect of dead or abandoned animals

30. (1) Ifananimaldiesfromadiseaseorisabandonedonaccountofsicknessorweaknessatapublicplaceorpublicroadoronthelandofapersonwhoisnottheowneroftheanimal,theownerorthepersonwhofindstheanimalmustwithoutdelayreportthedeathorabandonmenttogetherwiththenameandaddressoftheowneroftheanimal,ifknown,toaveterinaryofficialorapoliceofficer.

(2) Apoliceofficerreceivingareportundersubregulation(1)mustnotifyaveterinaryofficial.

(3) Theownerofananimalwhichhasdiedfromadiseaseonapublicplace,publicroadoronlandofanotherperson,mustdisposeofthecarcassoftheanimalinaccordancewithregulation24,ataplaceintheimmediatevicinityoftheplacewheresuchanimaldiedorastheowneroftheplacemaydirectandinamannerwhichdoesnotcausenuisance.

(4) The owner of an animal referred to in subregulation (3)may at his or her ownexpenseenterintoanagreementwiththeowneroroccupieroftheplaceonwhichananimaldied,thattheowneroroccupierofthatlandcarryouttherequirementsofregulation24inrespectoftheanimal.

(5) Iftheownerofananimalreferredtoinsubregulation(3)hasnotdisposedofthecarcasswithinaperiodof24hoursafterthedeathoftheanimal,theowneroroccupierorapersoninchargeofthatlandmust,assoonaspossible,aftertheexpiryof24hours,disposeofthecarcassinaccordancewiththerequirementsofregulation24andapplytotheChiefVeterinaryOfficerforreimbursement.

(6) Theowneroroccupierorapersoninchargeoftheland,toappliesforreimbursementin terms of subregulation (5),must furnish the ChiefVeterinaryOfficerwith proof of expensesincurredindisposingacarcassinaccordancewithregulation24.

Vaccination of birds

31. (1) Apersonwhowishes toobtainavaccineregisteredunder theFertilizers,FarmFeeds,AgriculturalRemediesandStockRemediesAct,1947or theMedicinesandRelatedSubstancesControlAct, 2003 for use against newcastle disease and avian influenza,must applyintheapprovedformtotheChiefVeterinaryOfficerforaclearancepermittoobtaintherequiredvaccine.

(2) TheChiefVeterinaryOfficermay, on applicationmade under subregulation (1),issueaclearancepermitinwhichheorsheapprovesthetypeofvaccineandnumberofdosesofavaccine.

(3) Asupplierofthevaccinereferredtoinsubregulation(1)maynotsupplyavaccinetoapersonunlessthatpersonproducestothesupplieraclearancepermitreferredtoinsubregulation(2).

(4) Asupplierofthevaccinesreferredtoinsubregulation(1)mustuponthesupplyofavaccinetoapersonrecordtheparticularssetoutintheclearancepermitinquestioninaregistertobekeptbythesupplierforsuchpurpose.

(5) Aregisterreferredtoinsubregulation(4)mustatalltimeslieopenforinspectionbyaveterinaryofficial.

Movement of ostriches

32. Apersonmaynotmoveanostrichfromoneplacetoanotherplaceunlessamovementpermithasbeenissued.

Register to be kept

33. (1) Anownerofananimalwhoseanimalisinfectedorissuspectedofbeinginfectedwithanotifiablediseaseandanownerofananimalinanareainwhichthemovementofanimals is prohibited or restricted under theAct,mustmaintain a register in the approved formtorecordthenumberanddescriptionofanimalssusceptibletothenotifiablediseasewhichexistsamonghisorheranimalsoranimalswhosemovementisprohibitedorrestrictedundertheAct.

(2) Anownerreferredtoinsubregulation(1)mustrecordintheregistereverydaythe-

(a) descriptionofananimalwhichhasdiedorbeenslaughteredonthatday;

(b) descriptionofananimalbornthatday;

(c) numberanddescriptionofanimalsmovedonpermitfromoneplacetoanotherplaceonthatday;

(d) nameoftheplacetoorfromwhichtheanimalsweremoved;and

(e) numberanddateofthepermitupontheauthorityofwhichthemovementofanimalwaseffected.

(3) Aveterinaryofficialmayatallreasonabletimesinspectaregistermaintainedunderthisregulationandtakeextractsfromtheregister.

(4) EverypersonwhomovesananimalontheauthorityofapermitorotherauthorisationissuedundertheAct,mustendorseonthepermitoronthatauthorisation,thenumberanddescriptionoftheanimalsmoved,thedateonwhichtheanimalsweremoved,andthepersoninchargeoftheanimals to theirdestinationmustretain thepermituntilsuchtimethat ithasbeeninspectedbyaveterinaryofficial.

(5) Everyownerofanimalswhoisrequiredtomaintainaregisterunderthisregulationmustattheinspectionofhisorheranimalsbyaveterinaryofficialaccounttotheveterinaryofficialforanydifferencebetweenthenumberofanimalsproducedforinspectionandthenumberproducedatthelastpreviousinspection.

(6) Despiteanythingtothecontraryinthisregulation,aveterinaryofficialmayinstructanownerofananimaltomaintain aregisterreferredtoinsubregulation(1)inrespectofaspeciesofanimalspecifiedbytheveterinaryofficial.

Production of animals to veterinary officials

34. (1) A veterinary official may in writing direct a traditional authority or atraditionalleaderasdefinedintheTraditionalAuthoritiesAct,2000toproducetoaveterinaryofficialananimalspecifiedinthedirectiveandpresentinthecommunalareafallingunderthejurisdictionof that traditional authority for the purposes of examination, testing, inoculation, immunisation,muzzling,clipping,cleansing,disinfectedandtreatmentoftheanimal.

(2) Onreceiptofadirectiveundersubregulation(1),thetraditionalauthorityconcernedoranyofitsleadersmustordertheownersoftheanimalsspecifiedinthedirective-

(a) toproducetheanimalstoaveterinaryofficialattheplace,dateandtimefixedbytheveterinaryofficial;and

(b) torenderallreasonableassistancerequiredbytheveterinaryofficialinconnectionwith the examination, testing, inoculation, immunisation, muzzling, clipping,cleansing,disinfectingandtreatmentofsuchanimals.

(3) Despite anything contrary to subregulation (1) or (2), a veterinary official mayinwriting require the owner of an animal for the purposes of examination, testing, inoculation,immunisation,muzzling,clipping,cleansing,disinfectingandtreatmentofananimal-

(a) toproducetoaveterinaryofficialtheanimalsattheplace,dateandtimefixedbytheveterinaryofficial;and

(b) torenderallreasonableassistancerequiredbytheofficialorpersoninconnectionwith the examination, testing, inoculation, immunisation, muzzling, clipping,cleansing,disinfectingandtreatmentofsuchanimals.

Auctioneers to supply certain information

35. Aveterinaryofficialmayrequireanyauctioneerwhohasdisposedofanyanimalbypublicauctiontofurnishhimorherwithparticularsregarding-

(a) thenameandaddressofthepersononwhosebehalftheanimalwassold;and

(b) thenameandaddressofthepurchaseroftheanimal;and

(c) thedateofthesaleoftheanimal.

PART9DIPPINGANDSPRAYINGOFANIMALS

Requirements for dipping tanks

36. (1) EveryownerofadippingtankinanyareainwhichthedippingofanimalsiscompulsoryundertheAct,mustwithin60daysofreceivingawrittennoticesignedbytheChiefVeterinaryOfficer,equipthetankwithagaugeasdescribedinsubregulation(2),athisorherownexpense.

(2) Thegaugeincorporatedinadippingtankreferredtoinsubregulation(1)mustbeconstructedinawaythatshowsclearly,conspicuouslyandpermanently-

(a) thesurfacelevelofthedippingfluid,whenthetankhasbeenfilledwithsuchfluidtotheextentofone-thirdofitstotalcapacity;

(b) figuresinlitresindicatingthequantityofdippingfluidinthetankuptothatlevel;

(c) the levelssuccessivelyreachedby thesurfaceof thefluidfromtheone-thirdfullmarkontheadditionofeveryhundredlitresuptothetotalcapacityofthetank;and

(d) figures at each of the levels mentioned in paragraph (c) indicating in litres thequantityoffluidinthetankwhenitssurfacecoincideswiththelevel.

Register of dipping tanks

37. (1) Everyownerofadippingtank,inanareawherethedippingofananimaliscompulsoryundertheAct,mustmaintainaregisterintheapprovedform,inwhichtorecordoneachoccasionthetankusedforthedippingofanimals-

(a) thesurfacelevelofthedippingfluidinthetankimmediatelybeforeandaftersuchdipping;

(b) theincreaseinquantityofdipwashsincethepreviousdipping;

(c) theamountofdippingmaterialaddedoneachoccasion;and

(d) thenumberofanimaldipped.

(2) Aveterinary officialmay at all reasonable times inspect a register referred to insubregulation(1)andtakeextractsfromtheregisters.

Repairs and improvements of dipping tank and animal spray

38. Everyownerofadippingtankoranimalsprayinanareainwhichthedippingorsprayingofanimal iscompulsoryunder theAct,mustwithin60daysof receivingwrittennoticesignedbytheveterinaryofficial,effectathisorherownexpense,additions,repairsandimprovementstosuchtankorsprayandotheraccessoriesandappurtenancesasdescribedinthenotice.

Notice to dip animals

39. (1) Aveterinaryofficialmustinrespectofanareafixthedaysandtimesfortheregularperiodicalclipping,handdressing,dippingorsprayingofanimalsandmustgivewrittennoticeofthedaysandtimetotheownersofanimals,butincaseswherethetankorsprayinwhichananimalisdippedorsprayedissituatedinacommunalarea,anotice-

(a) mustbedisplayedatasuitableplaceatornearthetankorspray,crushorcollectingpen,and

(b) mustbegiventotheheadof thetraditionalauthorityof theareaor if thereisnotraditionalauthorityforthearea,tootherrepresentativeofthebodycontrollingthearea.

(2) It isthedutyofheadofthetraditionalauthorityorarepresentativereferredtoinsubregulation(1)tonotifyownersofanimalsintheareaconcernedofthecontentsofanotice,anditisthedutyoftheownersoftheanimalstoattendwiththeiranimalsonthedayandatthetimefixed.

(3) Ifowing to anycause it is impracticable to serveanoticeonownersof animalsreferredinsubregulation(1)bymeansofserviceprescribedbysubregulation(1)anoticemaybeservedontheownersoftheanimalsdirectly.

Suspension and postponement of dipping of animals

40. (1) If the regular periodical clipping, handdressing, dipping or spraying ofanimalsiscompulsoryundertheActanditisconsideredbyaveterinaryofficialtobeimpracticabletoclip,handdress,dipor sprayanimalsat theprescribed intervalsdue to the seasonof theyear,unsuitableweatherorthegeneralconditionofanimalsoranyothercause,aveterinaryofficialmaybywrittennoticegiveninaccordancewithregulation39-

(a) suspendtheclipping,handdressing,dippingorsprayingofanimalsforaperiodasheorshemayconsidernecessary;

(b) extendtheperiodandanimalsmustbeclipped,handdressed,dippedorsprayedattheextendedperiod;or

(c) postpone the clipping, handdressing, dipping or spraying of the animal until thefollowingdayorthefirstsuitabledayafterpostponement.

(2) Theveterinaryofficialmaycarryoutanactreferredtoinsubregulation(1)athisorherowninitiativeoronrequestinwritingbyownerofanimals.

(3) Theveterinaryofficialmayamendorcancelthesuspensionorextensiongivenunder

subregulation(1)ifheorsheconsidersitnecessarytodoso.

(4) A postponement, suspension or extension of clipping, handdressing, dipping orsprayingofanimalsallowedunder this regulationdoesnothave theeffectofchanging the timesfixedforsubsequentclippings,handdressings,dippingsorsprayingsofanimals,whichcontinuetobeinforce,asifapostponement,suspensionorextensionhasnotbeenallowed.

Exemption of animals from dipping

41. Iftheregularperiodicalclipping,handdressing,dippingorsprayingofanimalsiscompulsoryundertheActandanownerofsuchanimalsisoftheopinionthatanyofhisorheranimalscannotbyreasonofitsdebilityorsicknessbesafelyclipped,handdressed,dippedorsprayed,heorshemayapplytotheveterinaryofficialforexemptioninrespectofthatanimal,andtheveterinaryofficialmaygrantsuchexemptionforaperiodandsubjecttoconditionsasheorshemayconsidernecessary.

Maintenance of dipping tanks

42. InanyareainwhichthedippingofanimalsiscompulsoryundertheAct,aveterinaryofficialmayinstructtheownerofadippingtankinwhichtheanimalsaredippedortheowneroftheanimalsorbothowneroftheanimalsandownerofthedippingtanktocleanoutthetankandfillitwithafreshdippingfluidandtoaddanapproveddiporwater,asthecasemaybe,inordertomaintainitatthetanklevelandprescribedconcentration.

Prescribed concentrates for dipping fluid for animals

43. IfthedippingorsprayingofanimalsiscompulsoryundertheActapersonmaynotuseorcausetobeusedforthedippingofanimals,anydippingfluidobtainedfromanapproveddipifitisbelowtheprescribedconcentration.

Taking of samples from dipping tanks

44. Aveterinaryofficialmaytakesamplesofthedippingorsprayingwashinthedippingtankorspray,fortestsorexaminationtodeterminewhetherthewashcomplieswiththerequirementsoftheseregulations.

Manner of dipping and spraying of cattle

45. (1) IftheregularperiodicaldippingorsprayingofcattleiscompulsoryundertheAct,thecattlemustbe-

(a) dippedinatankwhichhasbeenapprovedbytheChiefVeterinaryOfficerandunlessothermethodsareprescribedintheAct,suchdippingmustbedoneinaccordancewiththemethoddescribedinsubregulation(2);or

(b) sprayedbymeansofanapprovedsprayingapplianceandunlesssomeothermethodsare prescribed in theAct, such sprayingmust be donewith an approved freshlyprepareddippingfluidthoroughlyandevenlymixedataprescribedconcentration.

(2) Dippingmustbecarriedoutbycausingthecattletoplungeintoandswimthrougha dipping fluid in which an approved dip is thoroughly and uniformly mixed at the prescribedconcentration.

Period for dipping or spraying of cattle

46. (1) Iftheregularperiodicaldippingorsprayingofcattleevery30,14,10,7,5or4daysiscompulsoryundertheAct,thecattlemustbedippedorsprayed,asthecasemaybe,onevery31st,15th,11th,8th,6th,or5thdayrespectively,countingfromandincludingthedayofthefirstdippingorsprayingorthelastpreviousdayofdippingorspraying,asthecasemaybe.

(2) Forpurposesofsubregulation(1),ifthefirstdippingofa7daydiptakesplaceonthe1March,theseconddippingmusttakeplaceonthe8March,thethirdonthe15March,thefourthonthe22Marchandsoon.

Clipping and handdressing of cattle

47. (1) IftheregularperiodicalclippingandhanddressingofcattleiscompulsoryundertheAct,thehairontheinsideoftheearsandonthebrushesofthetailsofthecattlemustbeclippedtoalengthofnotmorethanfivemillimetresfromtheskinandthehanddressingmustbeeffectedimmediatelyafterthecattlehasemergedfromthedippingtankorhavebeensprayed.

(2) Thehanddressingreferredtoinsubregulation(1)must,unlesssomeothermethodisprescribedintheActorbyadeclarationoranotice,consistofanapplicationtotheinsidesurfaceoftheearsandtothehairlessanalregionundertherootofthetailofapreparationcontaininganapproveddipthoroughlyandevenlymixedattheprescribedconcentration.

Movement of cattle and buffalo with ticks

48. SubjecttoconditionsimposedundertheActinrelationtothemovementofcattleorbuffalo,apersonmaynotmoveorcauseanycattleorbuffalotobemoved,whicharenotvisiblyfreefromliveticks,fromanylandonwhichthecattleorbuffaloarekepttoanyotherdestination,unless-

(a) thecattleorbuffaloconcernedhavebeendippedorsprayedwithanapproveddipinthemannersetoutinregulation45,withinaperiodofthreedayspriortothembeingmoved;or

(b) the cattle or buffalo concerned are being moved to a dipping tank or sprayingapplianceforpurposesofbeingdippedorsprayed.

Manner of dipping of sheep and goats

49. IfthedippingofsheeporgoatsiscompulsoryundertheAct,sheeporgoatsmustbedipped-

(a) inanapproveddippingtankandwhichisfilledtothenecessarytanklevelwithadippingfluidoftheprescribedconcentrationwhichisobtainedfromanapproveddip;and

(b) bykeepingeachsheeporgoatinadippingfluidforatleastoneminute,duringwhichperiodsuchsheeporgoatmustbecompletelysubmergedatleastthreetimes.

Division1Newcastledisease

Duties of poultry owners

51. (1) Ifnewcastlediseaseappearsorissuspectedonanyland,ownersofpoultryonsuchlandmust-

(a) immediately confine all their poultry in poultry-houses, pens, crates or enclosedruns;and

(b) wheninstructedbyaveterinaryofficial,disinfectallpoultry-houses,pens,cratesorenclosedrunsreferredtoinparagraph(a)andallfoodandwatercontainers,bagsandotherarticlesandthings,withwhichpoultryhavebeenorcouldpossiblyhavebeenincontact.

(2) Disinfection referred to in subregulation (1) must be carried out by saturationthroughsprayingwitha5percentaqueoussolutionofcarbolicacidora2percentaqueoussolutionofformalinorotherdisinfectantofequalefficacyorbytotalimmersionfor10minutesinwaterkeptboilingforthatperiodorinthesolutionofcarbolicacidorformalinorotherdisinfectantofequalefficacy.

Removal of poultry

52. (1) Apersonmaynotmoveorcausetobemovedanypoultryfromanylanduponwhichanypoultryhavebeeninoculatedwithalivevirusvaccineagainstnewcastledisease,unlessaperiodofatleast30dayshaselapsedsincethelatestdateonwhichsuchvaccinehasbeenusedonpoultryonsuchland.

(2) Ifwithintheperiodreferredtoinsubregulation(1),anysymptomsofillnessshowsamongthepoultryinoculatedascontemplatedinthatsubregulation,apersonmaynotmoveorcausetobemovedanypoultryfromthelandreferredtointhatsubregulation,unlessaperiodofatleast30dayshaselapsedsincethelastsymptomhavedisappeared.

Poultry at shows or exhibitions

53. Apersonmaynotmoveorcause tobemoved,poultryfromlandtoanyplaceatwhichpoultryareassembledforthepurposesofashow,exhibitionoranegg-layingcompetition,ifwithinaperiodof30dayspriortosuchremoval,symptomsofnewcastlediseaseshowsamongstthepoultryonthelandwherethepoultryistobemovedfrom.

Seizure and destruction of poultry

54. (1) IfapoultrywhichisrequiredtobeisolatedorconfinedundertheAct,straysorisunlawfullymovedfromthelandonwhichithasbeenrequiredtobeisolatedorconfinedandisfoundinapublicplaceoradifferentplace,aveterinaryofficialmayseizeorcausesuchpoultrytobeseized.

(2) Ifapoultryhasbeenseizedascontemplatedinsubregulation(1)itmustbedealtwithinaccordancewiththeprovisionsoftheAct.

Division2Rabies

Treatment of animals infected with rabies

55. Aperson,otherthanaveterinaryofficialorveterinarian,maynotinanymannertreatananimalinfectedorsuspectedofbeinginfectedwithrabiesorcauseittobetreated.

Duty to isolate or destroy animals infected with rabies

56. Theownerofananimalwhichisinfectedorsuspectedofbeinginfectedwithrabies,must-

(a) isolateandsecurelyconfinetheanimaltopreventitfromattackinghumanbeingsorotheranimals;or

(b) immediatelydestroyit.

Permit to move carnivore or ground-squirrel

57. (1) Apersonmaynotmoveorcause tobemovedfromoneplacetoanotherplaceacarnivoreoraground-squirrel,exceptontheauthorityofamovementpermit.

(2) Subjecttotheprovisionsofregulation60,theprohibitioninsubregulation(1)doesnotapplytothemovementof-

(a) catsanddogs,intoanareaorfromanareaintoorfromwhichthemovementofcatsanddogsisprohibitedorrestrictedintermsoftheAct;

(b) anycarnivoreorground-squirrel-

(i) whose owner is in possession of a licence issued under the PerformingAnimalsProtectionAct,1935;

(ii) movingfromoneplacetoanotherwithintheareaofjurisdictionofalocalauthority;or

(iii) movingfromoneplacetoanotherifbothsuchplacesarewithinthesamelandedproperty.

Disposal of carcass of animals infected with rabies

58. Ifananimalinfectedorsuspectedofbeinginfectedwithrabies,diesorisdestroyedandhasnotbeenexaminedor testedbyaveterinaryofficialprior to itsdeathordestruction, theowneroftheanimalorthepersonwhodestroyedtheanimal,mustisolateitscarcassandprotectitfromtheweatherandotheranimals,untiltheownerorsuchpersonhasobtainedinstructionsfromaveterinaryofficialregardingthedisposalofthecarcass.

Disposal of contact animals

59. (1) Theownerofananimal,whoseanimalhasbeenincontactwithananimalinfectedwithrabies,mustdestroytheanimalunlessaveterinaryofficial issatisfiedthateffectiveisolationandconfinementoftheanimalispracticable.

(2) Ifaveterinaryofficialissatisfiedthateffectiveisolationandconfinementofananimalreferredtoinsubregulation(1)ispracticable,theveterinaryofficialmayauthorisetheisolationandconfinementoftheanimalattheplaceandforaperiodandsubjecttoconditionsastheveterinaryofficialmayimpose.

Isolation of animals infected with rabies

60. (1) Ifadog,infectedorsuspectedofbeinginfectedwithrabies,isatlarge,andaveterinaryofficial isof theopinion that thedog is thesourceof infectionofotheranimals, theveterinaryofficialmaybyanoticeinanewspapercirculatingintheareaconcernedorbyawrittennoticeservedontheownersofanimals,ordertheownerstokeeptheiranimalsisolatedandsecurelyconfinedforaperiodfixedbyaveterinaryofficialinanotice.

(2) IftheowneroroccupieroflandfindonsuchlandananimalwhichisatlargeandwhichisinfectedorwhichtheowneroroccupieroflandsuspectsofbeinginfectedwithrabiesorwhichtheowneroroccupieroflandknowsorsuspectsmustbeisolatedandconfinedundertheAct,theowneroroccupieroflandmustseizetheanimalandplaceitinisolationandconfinementonsuchlandandreportthematterwithoutdelaytoaveterinaryofficial.

Compulsory vaccination of dogs

61. (1) Apersonwhoownorhascustody,control,chargeorcareofadog,mustcausesuchdogtobevaccinatedwithanapprovedrabiesvaccine-

(a) beforethedogattainstheageofsevenmonthsbutnotbeforeitisthreemonthsold;and

(b) withinaperiodof12monthsafterthevaccinationreferredtoinparagraph(a)andatleastonceeverythreeyears.

(2) Apersonwhotakesownership,custody,control,chargeorcareofadogwhichhasnotbeenvaccinatedascontemplatedinsubregulation(1)orinrespectofwhichnocertificatereferredtoinregulation62canbesubmitted,mustcausesuchadogtobevaccinatedwithinaperiodofthreemonthsafterheorshetakescustody,control,chargeorcareofthedog.

Certificate of vaccination

62. (1) Aveterinaryofficialoraveterinarianwhointermsoftheseregulationsorforanyotherpurposevaccinatesadogorcatwithanapproved rabiesvaccinemust issue to thepersonwhoowns,hasthecustody,control,chargeorcareofadogorcat,acertificateofvaccinationcontainingparticularsreferredtoinsubregulation(2).

(2) Acertificateofvaccinationreferredtoinsubregulation(1)must-

(a) indicatewhetherthedogorcatconcernedisamale,afemale,castratedorspayed;

(b) furnish the name, age, breed, colour and distinguishingmarks of the dog or catconcerned;

(c) includethenameandresidentialaddressofthepersonwho,atthevaccination,ownsorhasthecustody,charge,controlorcareofadogorcat;

(d) statethetypeandbatchnumberofthevaccineusedforthevaccinationconcerned;

(e) indicatewhetherthatvaccinationisthefirstvaccinationorare-vaccinationofthedogorcatconcerned;

(f) furnishthedateonwhichthedogorcatconcernedwasvaccinatedorre-vaccinated;and

(g) statethenameandaddressofthepersonwhoadministeredthevaccineconcerned.

(3) Provisionmaybemadeonacertificateofvaccinationreferredtoinsubregulation(1)forthefirstandsubsequentre-vaccinationsofthedogorcatdescribedonthecertificateaswellasthenamesandresidentialaddressesofsuccessivepersonswhomayownorhavethecustodyorcontrolofthedogorcat.

(4) Acertificateofvaccinationreferredtoinsubregulation(1)issuedinrespectof-

(a) adogorcatolderthanthreemonthswhichisvaccinatedforthefirsttimeisvalidfor10months,after60daysfromthedateonwhichthedogorcatconcernedwasvaccinated;

(b) adogwhichisre-vaccinated,isvalidforthreeyearsfromthedateonwhichthedogconcernedwasre-vaccinated;or

(c) acatwhichisre-vaccinated,isvalidfor12monthsfromthedateonwhichthecatwasre-vaccinated.

Veterinary official may issue notice of vaccination

63. Despiteregulation58,aveterinaryofficialmaybynoticeservedinthemannersetout in regulation12orbynotice inanewspapercirculating inNamibiaor inapartofNamibia,orderanowneroroccupieroflandinNamibiaoranyportionofNamibiaastheveterinaryofficialdetermines,thatalldogsandcatsonsuchlandmustbe-

(a) keptisolated,securedorconfinedforsuchaperiodastheveterinaryofficialmayspecifyinanotice;and

(b) producedtoaveterinaryofficialforinspectionandvaccinationataplace,dateandtimespecifiedinanotice.

Division3Sheepscab

Sheep scab

64. Forthepurposesofthisdivision“sheepscab”meansadiseasewhichiscausedbythesheepscabmitepsoroptes ovis, andischaracterisedinsheepbyoneormoresignsofdiscomfortanditchingsuchasscratching,fluffingandlossofwoolortheformingofserumscabsontheaffectedpartsoftheskin.

Importation of sheep or goats

65. (1) Apersonmaynot import a sheeporgoatoracause sheeporgoat tobeimportedintoNamibiaexcept-

(a) ontheauthorityofanimportpermitorimportandtransitpermit;and

(b) ifsuchsheeporgoatisfreefromsheepscabascontemplatedinsubregulation(2).

(2) Asheeporgoatisfreefromsheepscabifithasbeendippedinthepresenceandtothesatisfactionofaveterinaryofficialinaccordancewiththemannerprescribedunderregulation49withinaperiodoffourdaysbeforeimportationintoNamibia.

(3) Asheeporgoatwhichisfreefromsheepscabcontemplatedinsubregulation(2)mustbekeptinisolationfortheperiodfromitsbeingdippedundersubregulation(2)until ithasreachedNamibia.

Restriction on movement of sheep or goats

66. (1) ExceptundertheauthorityofapermitissuedunderPartVoftheAnimalIdentificationRegulations,apersonmaynotmoveasheeporgoatorcausesuchsheeporgoattobemovedfromonelandedpropertytoanother,ifthesheeporgoathaveduringtheprecedingsixweeksbeen-

(a) incontactorintermixedwithsheeporgoatsinfectedwithsheepscab;

(b) depasturedduringthatperiodonthesamepastureassheepandgoatsinfectedwithsheepscab;or

(c) keptorconfinedinanykraal,sleepingplaceorsimilarenclosureinwhichasheeporgoatinfectedhavebeenkeptandwhichaftertheremovaloftheinfectedsheeporgoatstheplaceorkraal isnotdeclaredbyaveterinaryofficial tobefreefrominfectionwithsheepscab.

(2) Theownerofsheeporgoatsata landedpropertyandwhichsuchsheeporgoatsunderthisregulationmaynotbemovedwithoutapermit,mustpreventsuchsheeporgoatsfromstrayingfromthelandedproperty.

Compulsory dipping of sheep

67. (1) EveryowneroroccupierofalandedpropertyinNamibiamustduringtheperiodspecifiedinwritingbyaveterinaryofficial,diporcausetobedippedallsheepwhicharekeptordepasturedatthelandedproperty.

(2) If,uponapplication,theveterinaryofficialisoftheopinionthatthecircumstancesandfacilitiesonalandedpropertyreferredtoinsubregulation(1)complywiththerequirementsforefficientisolation,theveterinaryofficialmay,issueawrittenauthorisationthatthesheeponsuchlandedproperty,bedippedbeforetheperiodreferredtoinsubregulation(1).

(3) Thedippingofsheepintermsofsubregulation(1)musttakeplaceonadateandtimewhichtheveterinaryofficialdeterminesafterconsultationwiththeowneroroccupieroflandedproperty.

(4) An owner or occupier of a landed property who has dipped sheep in terms ofsubregulation (1)orcausedsheep tobedippedmustafterhavingbeen requestedbyaveterinaryofficialprovideproofofsuchdippingbyproducingtheemptycontainersoftheapproveddipwhichwasused,aswellastheinvoicesconfirmingthepurchaseoftheapproveddip.

(5) Ifaveterinaryofficialissatisfiedthatsheepweredippedintermsofsubregulation(1),heorshemayissueacertificateconfirmingthatthesheephavebeendipped.

Movement permit not required in certain cases

68. (1) Despiteregulation66,apermitreferredtointhatregulationisnotrequiredforthemovingofsheepwhichhave-

(a) notbeendipped,toanabattoirtobeslaughteredattheabattoir,ifsheepismovedbyanenclosedconveyanceorotherenclosedtransportation;

(b) alreadybeendipped,fromonelandedpropertytoanotherlandedproperty.

(2) When sheep aremoved in termsof subregulation (1)(a), theperson in chargeofthesheepbeingmovedmustbeinpossessionofawrittenstatementbytheowner,containingthefollowings:

(a) thenameandaddressoftheownerofthesheepconcerned;

(b) thenameofthepersonsupervisingandinchargeofthesheep;

(c) thenameofthelandedpropertyfromwhichthesheepconcernedaremoved;

(d) thenameoftheabattoirtowhichthesheeparemoved;

(e) thebreedofthesheep;

(f) thenumberofsheepbeingmoved;

(g) thesexofthesheepconcernedandthenumberofeachsex;

(h) thecolourofthesheep;

(i) theidentificationmarkofthesheepprescribedintermsoftheAnimalIdentificationRegulations.

(3) Thewrittenstatementreferredtoinsubregulation(2)mustondemandbeproducedtoaveterinaryofficialorapoliceofficer.

(4) Whensheeparemovedintermsofsubregulation(1)(b),thepersoninchargeofthesheepbeingmovedmustbeinpossessionofacertificateissuedintermsofregulation67(5),andsuchcertificatemustondemandbeproducedtoaveterinaryofficialorapoliceofficer.

Sheep scab in driven sheep or goats

69. Ifanoutbreakofsheepscaboccursamongsheepandgoatswhile theyarebeingdrivenfromonelandedpropertytoanotherlandedproperty,theownerofthesheepandgoatsmust,inadditiontomakingthereportrequiredunderregulation16,immediatelyseekinstructionsfromtheveterinaryofficial,regardingtheisolation,treatmentandfurthermovementofthesheepandgoats.

Powers of veterinary officials regarding dipping of sheep or goats

70. (1) Whensheeporgoatsonalandedpropertyareinfectedorsuspectedofbeinginfectedwith sheepscab,aveterinaryofficialmay inwritingorder theowneroroccupierof thelandedproperty todip all the sheep andgoats on the landedpropertyon thedates and intervalsspecifiedintheorder.

(2) Thedatesandintervalsspecifiedintheorderreferredtoinsubregulation(1)mustprovideatleasteightdaysbutnotmorethan10days,topassbetweentheconsecutivedips.

(3) Theowneroroccupierofalandedpropertytowhomanorderhasbeenissuedintermsofsubregulation(1)mustdipallsheepandgoatsonthelandedpropertyorcausethemtobedippedonthedatesspecifiedintheorder,andthedippingmustbedoneunderthesupervisionofaveterinaryofficial.

(4) Despitesubregulation(3),aveterinaryofficialmayapprovethatthedippingofsheeporgoatsunderanorderintermsofsubregulation(1),bepostponed,uponapplicationbytheownerofthesheeporgoats,iftheveterinaryofficialissatisfiedthatthedippingofthesheeporgoatsisnotpractibleduetothepoorcondition,unsuitableweatherconditionorthesheeporgoatbeingheavyinlamborduetothelongwoolorhairwhichhastobeshearedpriortodipping.

(5) Ifthepostponementintermsofsubregulation(4)islikelytoresultintheintervalbetweentwoconsecutivedipsexceeding10days,thesheeporgoatsconcernedmustbedippedanewontwoconsecutivedatesdeterminedinaccordancewithsubregulations(1)and(2).

(6) Despitesubregulation(1)theowneroroccupierofalandedpropertymustdisinfectsheepandgoatsonthelandedpropertywhichareinfectedorsuspectedofbeinginfectedwithsheepscab,iftheowneroroccupierofalandedpropertyisforsomeotherreasonunabletodipthesheeporgoatunderthesupervisionofaveterinaryofficial,within10daysfromthedateofanorderreferredtoinsubregulation(1).

(7) Thedisinfectionofsheeporgoats in termsofsubregulation(6)mustbedonebythedailymanualapplicationofanapproveddiptoallscablesionsandpartsofthebodywherethe

sheepscabmite(psoroptes ovis)maybepresent,inamannerwhichdestroyallsuchmiteswhichareassociatedwiththelesionsconcerned.

When dipping of sheep or goats not compulsory under the Act

71. Exceptunderthewrittenauthorityissuedbyaveterinaryofficial,apersonmaynot,ifthedippingofsheeporgoatsisnotcompulsoryundertheAct,diporcausesheeporgoatstobedipped.

Use of other remedies to prevent sheep scab

72. (1) An owner of sheep or goats may, if he or she is required in terms ofregulation67,todipordisinfecthissheeporgoats,usearemedythatisregisteredasastockremedyintermsoftheFertilizers,FarmFeeds,AgriculturalRemediesandStockRemediesAct,1947foruseinconnectionwiththepreventionortreatmentofsheepscabandthatisapprovedbytheChiefVeterinaryOfficerforsuchuseinsteadofanapproveddip.

(2) Theprovisionsofregulations65(2)or70(2)to(5),applywithnecessarychanges,totheuseofaremedyreferredtoinsubregulation(1).

Division4Africanswinefever

Definitions for regulations on African swine fever

73. Forthepurposeofthisdivision-

(a) “cooked animal product”means any animal productwhich has been exposed toboilingwaterforatleast20minutes,orwhichhasbeensterilisedinanapprovedmannerandincludesafarmfeedregisteredintermsoftheFertilizers,FarmFeeds,AgriculturalRemediesandStockRemediesAct,1947;

(b) “infectious thing” means any infectious agent and includes any animal productderivedfromapig;

(c) “pig”includeabushpig,warthogorwildpig.

Restrictions on introduction of pigs in certain areas

74. (1) ApersonmaynotintroduceorcauseapigorinfectiousthingtobeintroducedintotheareaspecifiedinPartBofSchedule3ormoveorcauseapigorinfectiousthingtobemovedfromanylandedpropertyinthespecifiedareatoanyotherlandedpropertywhetherwithinoroutsidethespecifiedarea,exceptuponauthorityofanimportpermit,importandtransitpermitormovementpermit.

(2) Apermitreferredtoinsubregulation(1)isnotnecessaryforthemovementofaninfectiousthingwithintheareaofjurisdictionofalocalauthorityinthespecifiedarea.

(3) EveryownerofpigsintheareaspecifiedinPartBofSchedule3mustconfinesuchpigs,excludingbushpigs,warthogsandwildpigs,whichhavenotbeendomesticated,inpigproofcamps,sty’s,pensorruns.

Restrictions on feeding of pigs in certain areas

75. ApersonmaynotfeedorcausepigsintheareaspecifiedinPartBofSchedule3tobefedwith-

(a) anyanimalproductunlesssuchproduct-

(i) isacookedanimalproduct;or

(b) any garbage, refuse or swill obtained from another landed property unless suchgarbage,refuseorswilliscooked.

Division5Trypanosomiasis(Nagana)

Establishment of de-flying stations

76. (1) Forpurposesofthisdivision,theword“place”whenusedasanounmeansanygamereserve, forest, lake,bay, river,marshorother localitywhere tsetsefliesareknownorsuspectedtoexist.

(2) TheChiefVeterinaryOfficermayestablishde-flyingstationsonpublicroadsatsuchpointsanddistancesastheChiefVeterinaryOfficermaydetermineandcausegatestobeerectedatsuchpublicroadswherede-flyingstationareestablished,topreventthespreadofthediseasenagana bytsetse fliesinanyconveyanceorotherformoftransportation.

(3) Apersonmaynotopenorremoveorotherwiserenderineffectiveanygateacrossapublicroadatade-flyingstationreferredtoinsubregulation(2),exceptwiththepermissionofaveterinaryofficialorapersoninchargeofthestation.

(4) A veterinary official at a de-flying station referred to in subregulation (2) mayrequireanypersoninchargeofaconveyanceorothertransportationarrivingatsuchstationfromthedirectionoftheplace,tobringtheconveyanceortransportationtoastandstillatthestationandtorendertheassistanceintheinspectionandde-flyingoftheconveyanceorothertransportation.

(5) Aveterinaryofficial,ininspectingthepresenceoftsetsefliesonaconveyanceorothertransportationarrivingatade-flyingstationreferredtoinsubregulation(2)fromthedirectionoftheplace,maysprayorfumigatetheconveyanceorothertransportationwithpyrethrum-in-oilorotherapprovedinsecticide.

Authority required to spray tsetse flies

77. Aperson,otherthanaveterinaryofficial,maynotwiththeintentiontocombattsetseflies(glossina species),sprayaplace,orcauseaplacetobesprayed,exceptunderwrittenauthorityissuedbytheChiefVeterinaryOfficer.

79. (1) ApersonmaynotintroduceanybovineorcauseorpermitanybovinetobeintroducedintoNamibia,except-

(a) on theauthorityofand inaccordancewith theconditionscontained inan importpermitorimportandtransitpermit;and

(b) ifthebovineisfreefrombrucellosisascontemplatedinsubregulation(2).

(2) Abovineisfreefrombrucellosisif-

(a) abovineoriginatesfromaherdinrespectofwhichavalidcertificatedeclaringtheherdtobeanaccreditedbrucellosisfreeherdhasbeenissued;

(b) abovineisaheiferyoungerthan18monthsandinrespectofwhichproofcanbepresentedthattheheiferhasbeenvaccinatedbetweentheagesof3monthsand11monthswithanapprovedbrucellosisvaccine;

(c) acomplementfixationtestforbrucellosiscarriedoutonthebovinehasproducedanegativeresultforbrucellosis;or

(d) abovineisacastratedmalebovine.

(3) After the test referred to in subregulation (2)(c), abovine testedmustbekept inisolationfortheperiodfromthetimeitistesteduptoanduntilthearrivalofabovineonthelandedplaceinNamibiatowhichitisintroducedorpermittedtobeintroduced.

Compulsory vaccination of heifers

80. (1) EveryownerofcattleinNamibiamust-

(a) vaccinateorcauseallheiferstobevaccinatedwithanapprovedbrucellosisvaccinebefore the heifers have attained the age of 11months but not before they are 3monthsold;and

(b) presentproofthatallheifersbetweentheagesreferredtoinparagraph(a)havebeenvaccinatedwithanapprovedbrucellosisvaccine.

(2) Whenaveterinaryofficialconsidersitnecessary,heorshemayfixthedate,placeandtimeforvaccinationreferredtoinsubregulation(1)(a).

(3) Whenaveterinaryofficialhassupervisedavaccinationreferredtoinsubregulation(1),heorshemaymarksuchvaccinatedheiferswithanapprovedearmark.

(4) Apersonmaynotvaccinateanycattleofelevenmonthsofageandolderagainstbrucellosis,exceptwiththewrittenapprovalofaveterinaryofficial.

Division8BovineTuberculosis

Restriction on importation of bovines

81. (1) For the purposes of this division a “tuberculosis-free bovine” means abovine-

(a) originatingfromaherdforwhichavalidofficialcertificateoffreedomfrominfectionwithbovinetuberculosisexists;and

(b) whichhasshownnegativeresultsforbovinetuberculosisintwosuccessivetuberculintests,whichwereconductednotlessthan6weeksandnotmorethan3monthsapart,providedthatthebovinetestediskeptinisolationfortheperiodfromthefirsttestuptoanduntilthesecondtest.

(2) A person may not introduce or cause a bovine to be introduced into Namibia,exceptbyvirtueofanimportpermitorimportandtransitpermitandonlyifthebovineisfreefromtuberculosis.

(3) Atuberculosis-freebovinemust-

(a) bekeptinisolationuptoanduntilitsarrivalonthelandedpropertyinNamibia;

(b) bekeptinisolationfortheperiodfromthefirstnegativetuberculintestuptoanduntilthearrivalonthelandedpropertyinNamibia towhichitisintroduced;and

(c) beintroducedwithin14daysof thesecondnegativetuberculintestreferredtoinsubregulation(1)(b).

Division9FootandMouthDisease

Restrictions on importation of cloven-hoofed animal

82. (1) Apersonmaynotimportanycloven-hoofedanimalorcausecloven-hoofedanimaltobeimportintoNamibia,exceptontheauthorityofanimportpermitorimportandtransitpermit.

(2) A person may not move any cloven-hoofed animal or cause any cloven-hoofedanimaltobemovedfromanylandedpropertywithinNamibiatoanyotherlandedpropertywithinoroutsideNamibia,exceptontheauthorityofanimportpermit,importandtransitpermitormovementpermit.

(3) Apersonmaynotmoveananimalproductderivedfromacloven-hoofedanimal,aswellasgrass,grass-hay,straw,lucern,maizeandsorghumstalks,jutebags,riems,ropes,meatclothsorothermaterial,utensilorequipmentusedinconnectionwiththeslaughter,feeding,upkeep,movement or transportation of a cloven-hoofed animal from any landed property in the areasmentioned inPartCofSchedule3 toanyother landedpropertywithinoroutside thesaidareas,exceptontheauthorityofanimportpermit,importandtransitpermitormovementpermit.

(4) A permit is not required for the movement of animal products referred to insubregulation(3)withinlocalauthorityareaofalocalauthoritywithintheareasmentionedinPartCofSchedule3.

83. (1) Forthepurposesofthisregulation“bonttick”meansthelarval,nymphaloradultstageoftheticksoftheorderAcarina andthegenusAmblyomma andespeciallythespeciesamblyomma hebraeum andalltheotherspeciesofthisgenus.

(2) Apersonmaynotintroduceorcauseanybovine,equine,sheep,goatorwildanimalfromanylandedpropertyinthearealistedinPartDofSchedule3tobeintroducedintoanyotherareaorpartofNamibia,exceptonauthorityofthemovementpermitandprovidedthatthebovine,equine,sheep,goatoranywildanimalisfreefrombonttick.

PART11RESTRICTIONSONMOVEMENTOFANIMALS

Restrictions on movement of animals from certain abattoirs

84. (1) Subjecttosubregulation(2)apersonmaynotmoveorcausetobemoved,bovines, equines,goats,pigsor sheep fromanabattoir listed inPartAofSchedule3, exceptbymeansofwrittenauthorisationbyaveterinaryofficialandsubjecttotheconditionsspecifiedintheauthority.

(2) Subregulation (1) does not apply to equines harnessed to a conveyance or othertransportation,usedforthetransportationofgoodsinto,inorfromabattoirs.

Restrictions on movement of animals at harbours

85. (1) Subjecttosubregulation(2)apersonmaynotmoveorcauseananimaltobemovedoutoforthroughanyharbourlistedinPartEofSchedule3exceptbymeansofamovementpermitbyaveterinaryofficial.

(2) Subregulation (1) do not apply to equines originating from an area in Namibiaoutsidethedefinedharboursandwhichareharnessedtoaconveyanceorothertransportationusedfortheconveyanceortransportationofgoodsintoinorfromharbours.

Restrictions on movement of wild animals

86. (1) Forthepurposesofthisregulation“wildanimals”meansallanimalswhicharenotdogs,cats,cattle,horses,mules,donkeys,sheep,goats,pigs,amphibia,reptilesandbirds,butdoesnotincludeanimalsinrespectofwhichtheowneristheholderofalicenceissuedunderthePerformingAnimalsProtectionAct,1935.

(2) ApersonmaynotmoveorcauseawildanimaltobemovedfromalandedpropertyinNamibia toanyotherlandedpropertyinNamibia,exceptbymeansofamovementpermitissuedbytheveterinaryofficial.

(3) Apermitisnotrequiredforthemovementofwildanimalswithinalocalauthorityarea.

PART12PROVISIONSRELATINGTOASIANWATERBUFFALOINPROTECTEDAREAS

Duties of persons in relation to Asian water buffalo in protected area

87. AnypersonwhooccupiesalandinaprotectedareaonwhichthereoccursAsianwaterbuffalo(Bubalus bubalis),must–

(a) within3monthsafterthedateofcommencementoftheActandevery12monthsafterthatdate,notifytheChiefVeterinaryOfficerinanapprovedformof-

(i) thenumberofAsianwaterbuffaloinhisorherpossession;

(ii) thegenderofsuchAsianwaterbuffalo;and

(iii) the farm name and farm number and the magisterial district where thebuffaloarekept;

(b) within3monthsafterthedateofcommencementoftheActandevery12monthsafter thatdate, testorcause thebuffalo tobe testedunder the supervisionof theChiefVeterinaryOfficer for foot andmouthdisease, corridordiseaseandbovinetuberculosis,andsuchpersonmust-

(i) if a buffalo is infectedwith foot andmouth disease, corridor disease orbovine tuberculosisnotify theChiefVeterinaryOfficer immediatelyaftertheresultofthetestsareknowninanapprovedform;or

(ii) ifnobuffalo is infectedwith footandmouthdisease,corridordiseaseorbovine tuberculosis, provide theChiefVeterinaryOfficer in an approvedformwiththeresultsofthetestswithin14daysaftertheresultsofthetestsareknown;

(c) keepthebuffaloonthelandwheretheyoccurenclosedwithagame-prooffenceasdefinedinsection1oftheNatureConservationOrdinance,1975.

Keeping and maintaining of registers

88. (1) Apersonreferredtoinregulation87-

(a) mustkeepandmaintain a register in anapproved form inwhichheor shemustrecord–

(i) when he or she notifies the Chief Veterinary Officer of the particularsreferredtoinregulation87(1)(a);

(ii) descriptionofanybuffalowhichhasdiedorhasbeenbornonthatday;

(iii) particularsofanybuffaloonhisorherpossession infectedwithfootandmouthdisease,corridordiseaseorbovinetuberculosis;

(iv) particularsiftheresultsoftestshaveshownthatnobuffaloisinfectedwithfootandmouthdisease,corridordiseaseorbovinetuberculosis.

(2) A veterinary official may at all reasonable times inspect the register kept andmaintainedunderthisregulationandtakeextractsfromsuchregister.

(3) Anownerwhoisrequiredtokeepandmaintainaregisterunderthisregulationmust,ataninspectionoftheregisterreferredtoinsubregulation(2),accounttoaveterinaryofficialforanydifferencebetweenthenumberandgenderofbuffalothenproducedforinspectionandthenumberandgenderproducedatthelastpreviousinspection.

Aperson,whocontravenesorfailstocomplywithprovisionsoftheseregulations,orwhofailstocomlywithanyorder,directiveorinstruction,givenbyaveterinaryofficialcommitsanoffenceandisliableonconvictiontoafinenotexceedingN$100000ortoimprisonmentforatermnotexceedingfiveyearsortobothsuchfineandsuchimprisonmentandinthecaseofacontinuingoffence,toafurtherfinenotexceedingN$1000foreachdayduringwhichtheoffencecontinues.
