AGENDA Dr. Weil submitted a motion, seconded by Ms. McGarity, to approve the agenda of the September 2014 meeting. The motion carried unanimously. MINUTES Dr. Gross submitted a motion, seconded by Dr. Antalis, to approve the minutes of the August 7, 2014 meeting with amendments. The motion carried unanimously. 1

CALL TO ORDER Dr. Retterbush called the meeting of the Georgia Composite Medical Board to order at 7:30 a.m. NEW BOARD MEMBER Dr. Retterbush introduced Keisha Callins, MD, new Board member to the Board. He and Ms. Hughes performed the swearing in ceremony. APPRECIATION Dr. Retterbush and Board Members expressed their thanks to Dr. William Butler for his years of faithful service to the Board. AGENDA Dr. Weil submitted a motion, seconded by Ms. McGarity, to approve the agenda of the September 2014 meeting. The motion carried unanimously. INTERNS Ms. Hughes introduced two new interns, Regina Brady medical student at Mercer University School of Medicine, and Ashley Slappey a volunteer intern and a member of the staff at Children’s Health Care of Atlanta at Scottish Rites. EXECUTIVE DIRECTOR’S REPORT LaSharn Hughes, Executive Director, presented the following information for the Board’s review. Dr. Deloach submitted a motion, seconded by Dr. Mohan, to accept the report. The motion carried unanimously. The Board took the following actions: 1. The Board welcomed Emmalie Kirkland as the new Director of Investigations. 2. Brian Looby, McGuire Woods Consulting asked if Rule 360-3-.07 as authorizes a prescription for dangerous drugs based on an electronic consultation. The Board responded that the licensee must treat patient relations like a face to face encounter. 3. Article by NCCPA entitled “Comprehensive Workforce Data on Certified Physician Assistants Now Available.” For information only 4. Arnold Sutton, II, MD asked if he be a medical director of and provide medical services as an employee in which he owns Class A Membership Units of an LLC. The Board responded that the entity must be 100% physician owned and physician must not be employed by PA or APRN. 5. The Federation of State Medical Boards emailed information concerning opportunities to serve on one of the Federation of State Medical Boards Committees. For information only. 6. Joel Anglin requested a medical card giving him permission to smoke medical marijuana for the bipolar aspects of schizoaffective disorder. The Board will referred Mr. Anglin to the laws and rules. 7. Jyoiti Manekar, MD requested state guidelines for use or medications including anorectics for treating obesity. The Board referred Dr. Manekar to Pharmacy Board and the Board’s Unprofessional Conduct Rule. 8. Article “Vigorous challenge of telemedicine ruling appropriate.” For information only. 9. Article “United States: Georgia Composite Medical Board issues New Telemedicine Rules. For information only.

10. Reviewed the final copy from the Federation of State Medical Boards Interstate Compact. For information only. 11. Article “Florida Heals from Pill Mill epidemic.” For information only. 12. Article “State Licensing Boards under Fire from Within.” For information only. 13. Article “Walmart opens first Georgia primary care clinics.” For information only. 14. Joseph T. Van Horn, Esq. requested an Advisory Opinion on Application of Regulation in Context of Telemedicine. The Board advised more information is needed before a determination can be made. 15. Information concerning DEA Rules to reschedule Hydrocodone to Schedule II. For information only. 16. Dr. Patel asked if peer review experts are confidential in a hospital setting. The Board responded that this issue is not regulated by the Medical Board hospital policy would govern this matter. 17. Dr. McGee asked if it is legal for hospitals to send patients to their own employer instead of making referrals to physicians that are not hospital employee. The Board responded that this may be a Federal issue, not a medical Board matter. Dr. Weil motioned to go into closed Session to discuss investigative matters. Dr. White seconded the motion, and it carried unanimously. Dr. Retterbush declared open session. APPEARANCE BEFORE THE BOARD Uchenna John Emenike, MD, requested an appearance before the Board. Melvin Goldstein PC accompanied him. Mr. Goldstein requested Executive Session for the appearance. Dr. White motioned to go into Executive Session. Dr. Gross seconded the motion and it carried unanimously. Dr. Retterbush declared Open Session. Dr. Gross motioned to table the application for Dr. Emenike, and to reconsider it after certain terms and conditions are met. Dr. Powell seconded the motion and it carried. Two Board Members opposed. RECONVENED 12:00 pm

Dr. Retterbush declared the meeting in Open Session PRESCRIPTION MONITORING PROGRAM UPDATE Mr. Rick Allen, Georgia Drugs and Narcotics, met with the Board to provide an update on the Prescription Monitoring Program. GEORGIA BOARD OF DENTAL Dr. Mark Bennett, Dental Board President, addressed the Board’s concerns regarding dentists injecting Botox and dermal fillers around the eyes and mouth. The Board thanked Dr. Bennett for attending. Both boards will work closely on this important matter. Dr. Gross moved to go into Closed Session to conduct Investigative Interviews. Dr. White seconded, the motion and it carried unanimously. Dr. Retterbush then declared the meeting would be open session upon completion of the investigative interviews for the purpose of holding committee meetings. RECONVENED

ACUPUNCTURE ADVISORY COMMITTEE Mr. Wallace presented the report of the Acupuncture Advisory Committee as a motion. Dr. Weil seconded the motion, and it carried unanimously. The Board took the following actions: Accepted the following quarterly reports:

1. The Board reviewed the list of limited licensees and supervisors. 2. The Board decided to abolish Form B (Authorization and Release of Records) as this

form is no longer accepted by the NCCAOM. 3. Rule 360-6-.11(5) is referred to the Rules Committee for amendment to reflect the

legal requirement of 40 hours biennially for license renewal. 4. The matter concerning the possible sanctioning of the license of KC for failure to

comply with the supervisory reporting requirements, as provided for in Rule 360-6-.05(4)(e) is referred to the Attorney General’s Office.

The Board will invite N.M. to meet with the Committee to discuss candidacy for a seat on the Acupuncture Advisory Committee.

INTERNATIONAL MEDICAL SCHOOLS ADVISORY COMMITTEE Dr. Antalis presented the International Medical Schools Advisory Committee as a motion. Dr. Deloach seconded the motion, and it carried unanimously.

Dr. Antalis presented the Board’s rationale for scheduling a follow up site visit at an international medical school. Dr. Cheeks and Mr. Dolce presented the recommendations and timeline for international medical school approval and reporting. A motion was made by Dr. Retterbush and seconded by Dr. Antalis to approve the University of Medicine and Health Sciences – St. Kitts program with a follow up site visit by Health Sciences Education Consultants (HSEC) and members of the Georgia Composite Medical Board; the motion carried. This follow up site visit will be scheduled during the next two months. The Board approved the Committee recommendation that HSEC begin reviewing the Trinity Medical School program. The Board and guests discussed clerkships and the limited number of residency slots available in Georgia. LASER ADVISORY COMMITTEE Dr. Gross presented the Laser Advisory Committee as a motion. Dr. White seconded the motion, and it carried unanimously. The Board took the following actions: The Board approved the Assistant Laser and Senior Laser Practitioner Checklists, Applications and Forms. The Committee reviewed correspondence and will develop Frequently Asked Questions (FAQ’S) Dr. DeLoach made a motion, seconded by Dr. White to go into closed session to discuss applications. The Board voted to forward Mr. Gardenhire a letter thanking him for his interest; however, there are no open positions at this time. The Board discussed inquiry from Delores Hensel. Ms. Hensel inquired whether or not licensure is required to practice in a DME (Durable Medical Equipment) setting. The Board concluded licensure is required if duties involve the practice of respiratory care. The Board discussed credentials identified on the work/ID badge of a licensed respiratory therapist. Kiley Hodge will draft a proposal to be presented to the Rules Committee requiring credentials to be displayed on ID badges. As an FYI, the Board discussed licensure for Sleep Study. Committee member Monique McCreary informed the Board that hospitals and employers are requesting respiratory therapists to submit copies of their diplomas in order to perform ABG’s (Arterial Blood Gas) CLOSED MEETING Dr. Deloach made a motion, seconded by Dr. Sightler, to go into closed session to discuss pending litigation, investigative, and Wellness Committee matters. LAW ENFORCEMENT ACTION REPORT Emmalie Kirkland, Director of Investigations, presented the Law Enforcement Action Report for the Board’s review.
