Voyce Pullin “To the Sale” signs will be erected on the A38 on the morning of Sale. From the South – Exit the M5 J14 (Thornbury) onto B4509 towards Dursley, continue on the B4509 to lights and turn right onto A38 heading north towards Gloucester. Continue on the A38 for 4.3 miles where the farm is located on the left, directly oof the A38 immediately after the Petrol Station at Berkeley Heath. From the North – Exit the M5 J13 (Stroud) and head west on the A419 to join the A38. At the A38 roundabout head south towards Berkeley, Bristol, continue south on the A38 for approx. 7 miles and the farm is located at Berkeley Heath on your right hand side just south of The Lorridge Farm Estate and about 1 mile south of the Prince of Wales Hotel. FOREWORD We moved to the Berkeley Vale in November 1978 to the old Puddleditch Farm, which is now under the Mole Valley Store, and moved to the current site in 1986 with our dairy herd and continued to milk until 2015, when we moved over to beef production. Both Lindsey and I have now decided it is time to retire from farming and hence our need to conduct today’s very Genuine Dispersal Sale. We have always aimed to maintain our equipment and hope that it will continue to provide good service for many more years to come. Thank you all for coming today to support us. We would also like to take this opportunity to thank all our family, good friends and neighbours for all the support and kindness they have given us over the years. Our thanks also go to the contractors and engineers that have assisted us with our farming needs. Finally we would like to take this opportunity to wish the new tenants Simon, Katherine, Fred and Percy Ball all the best on their new adventure at Puddleditch Farm. Purchasers are reminded that all lots become their responsibility from the fall of the hammer. (See Conditions of Sale).

COMMISSION BIDSThose not wishing to attend the sale may wish to leave a commission bid. The auctioneers will be pleased to execute commission bids on the understanding that the purchaser has inspected the items or has satisfied themselves that the catalogue description is sufficient or the verbal description given to them is sufficient. Forms are available on request.

ENGINE HOURSNeither the vendors nor the auctioneers make any warranty regarding engine hours or vehicle mileages. Any quoted tractor hours in the catalogue were recorded on Friday 10th July 2020, but may continue to be used up until sale day. The Auctioneers will update clock readings and announce at the point of sale.

ELECTRICAL ITEMSAll electrical items will be PAT tested prior to the date of sale as appropriate.

PAYMENT TERMSPurchasers wishing to pay by cheque who are not known to the Auctioneers are asked to contact Mr Anthony Pritchard on 01291 680068 or Jon Pullin on 07736 800760 to discuss references. We accept debit cards in settlement of your purchase but not credit card. Purchasers can make arrangements to pay via BACS automatic bank credit transfers. Arrangements should be made for this prior to sale. Due to the requirements of the Money Laundering Regulation 2017 we regret that we are unable to accept payments for goods in cash where the total transaction (including VAT) exceeds £7,500, as a single or multiple item payment.

SETTLEMENT AND CLEARANCE OF ITEMSSettlement in full is due to the Auctioneers immediately at the conclusion of the sale, no machinery or asset may leave from the Sale Premises without an official PASS obtainable only from the Auctioneers upon settlement and all stock should be cleared from the sale premises on the day of the sale, except where additional time to remove has been specified. Transfer of ownership does not pass to the buyer until payment is cleared but becomes the risk of the buyer at the fall of the hammer. We reserve the right to hold back any item sold until clearance of any payment.

VIEWINGStrictly from 9.00 am on day of sale and between 2pm and 4pm on the day prior. Please contact Jon Pullin for any further information required prior to the sale. Any persons attending the farm without permission prior to viewing or sale day will not be entertained and will then not be allowed to attend on sale day.

LOADINGA Teleporter will be available to assist with loading on day of sale only. No loading of items will commence (unless by hand) until completion of sale. Purchasers wishing to return after the sale to collect items must leave clear instructions, dates and times with the auctioneer to assist the vendor. Any item not removed within 2 weeks of the close of sale will be resold and payment refunded to the purchaser less reasonable costs of that sale.

IMPORTANTThe Auctioneers and their clients accept no liability for any damage or injury to persons or plant and all attend the sale at their own risk.

HEALTH & SAFETY ON SITEHealth and Safety on site prior to, during and after the sale is of utmost importance to the Vendors and Auctioneers for the safety of all involved. Vehicles should only be started with the Auctioneers consent and any vehicles entering or leaving the sale field should do so travelling at no greater than 5mph. The Auctioneers will not hesitate to warn and remove those who do not comply with these strict conditions of sale.

EXPORT OF GOODSAll goods purchased at Voyce Pullin auctions that are to be exported or removed from the United Kingdom will:

1. Be dealt with under the requirements set out of HM Customers and Excise publications: a. VAT Notice 703 dated April 2014 – Export of goods from the United Kingdom. b. VAT Notice 712 dated January 2014 – The Single Market. c. VAT Information Sheet 2/00 dated May 2000 – Exports and Removals; Conditions for zero rating.

2. Be ZERO RATED for VAT purposes subject to the following conditions being met; a. The buyer provides Voyce Pullin with their VAT/ FISCAL NUMBER (which will be verified with UK Customers & Excise) at the time of purchase. b. The goods are removed from the United Kingdom within three months from the time of supply (the date of auction). c. Voyce Pullin are provided with valid commercial documentary evidence that the goods have been removed from the United Kingdom.

Unless and until the above requirements are fulfilled Buyers will be charged VAT at the United Kingdom standard rate (currently 20%). This will only be refunded if all requirements within the regulations are met within the specified time limits.

CONDITIONS OF SALE

1 The Auctioneers sell as agents for the Vendor (except where they are stated wholly or partly to own any lot as principal) and as such are not personally responsible for any default by the Vendor or Purchaser.

2 Subject to the reserve price (if any) being reached, the highest bidder for any lots shall be the Purchaser, and if any dispute arises, the Auctioneers may determine the same, or the lot may be put up again and resold at their discretion.

3 The bidding at all times to be at the discretion of the Auctioneers, who reserve the right to refuse any bidding or to withdraw any lot or lots from the sale, and to sell in such order and combine lots as they think fit. No bidding shall be retracted.

4 At the fall of the hammer, each Purchaser shall upon request give to the Auctioneers his or her name and address, and pay for any lots purchased at the close of the sale.

5 No lot or lots shall be removed from the premises until paid for, but each and every lot shall, at the fall of the hammer, be considered as delivered and at the risk of the Purchaser and shall be removed from the sale field at the Purchaser’s expense and taken with all faults and errors, save as hereinafter provided.

6 The Auctioneers describe each lot with care from information supplied by the Vendor or from their inspection when cataloguing but no allowance will be made for errors of description or misstatement contained in advertisements, catalogues or given verbally at or before the sale. Buyers should satisfy themselves prior to the sale of the condition of each lot.

7 Purchasers paying by cheque must be prepared, if required, to produce a letter of credit from their bankers.

8 The Auctioneers will, at the Purchaser’s request, transfer lots to another Purchaser, but the original Purchaser shall not cease to be responsible for the purchase money and, in the event of default may be sued for the same.

9 No lot of any description is sold with a ‘warranty’ or ‘condition’, unless specifically mentioned at the time of sale.

10 If a Purchaser shall fail to comply with any or all of these conditions any money deposited will be forfeited and any lot which remain uncleared after the times and date specified in the General Remarks will be sold by public auction or private sale, without notice to the Purchaser, and the deficiency (if any) arising upon the resale together with interest thereon (at a rate of 15% per annum) and all costs, charges and expenses incurred shall be due as a debt by the Purchaser in default upon the first sale and be recoverable as for liquidated damages.

11 Accidents – Every person attending the sale shall be deemed to be there at their own risk and neither the Vendor nor Auctioneers will be responsible for any damage to life or limb or property, prior to or during the progress of the sale, or at any time during the removal of lots. Cars are parked entirely at the Owner’s risk.

12 We hope that you do not have cause to complain about the services we provide, however we are now legally obliged to provide you with the following information: We regard client care and the standard of service delivered as a top priority. If, however, you do have cause for concern, please initially contact of one of the Directors, either Jon Pullin or Chris Voyce FLAA. The complaints handling procedure of the Royal Institution of Chartered Surveyors is complied with and a copy of the firm’s procedure is available for inspection at any Office.

13 These conditions and all transactions shall be governed by and construed in accordance with English law.
