Disciplinary Cases – Daniel Brackett, Assistant Gen eral Counsel
Spiro Dhima Alpha Electrical Contractors, Inc. License #: EC 13005518 Case #: 2014-051807 Mr. Dhima was present with Attorney Douglas Ackerman. Mr. Dhima was charged with a violation of 489.533(1)(r), F.S., Proceeding on any job without obtaining applicable local building department permits and inspections and a violation of 455.227(1)(j), F.S., By performing any act which assists a person or entity in engaging in the prohibited uncertified and unregistered practice of contracting, if the certificate-holder or registrant knows or has reasonable grounds to know that the person or entity was uncertified and unregistered. MOTION: Mr. Botknecht made a motion to adopt the Findings of Fact as stated in the administrative complaint. SECOND: Mr. Bramlett. Motion passed unanimously. MOTION: Mr. Botknecht made a motion to adopt the Conclusions of Law and find that the conclusions of law constitute a violation of the practice act as alleged in the Administrative Complaint. SECOND: Mr. Bramlett. Motion passed unanimously. MOTION: Mr. Botknecht made a motion to suspend Mr. Fleming’s license until he pays the administrative fine of $3,000.00 and costs of $129.49. The suspension shall be stayed for a period of 180 days. Mr. Dhima must complete 2 hours of continuing education with emphasis on laws and rules within 1 year. SECOND: Mr. Bramlett. Mr. Neilinger was not present.
Mr. Neilinger submitted a Petition for Declaratory asking the following questions as an Alarm Contractor holding an EF license providing inspection service to commercial buildings for their Life Safety systems including fire alarms and low voltage emergency lighting. This would include the repair and replacement of these low voltage emergency/exit lights. These lights are existing with 120 volt feed with molex connectors. 1. Under my current EF license can I service these low voltage fixtures? 2. Under my EF license can I test and certify as operational?

3. Under my current EF license can I replace this existing fixture as long as no wiring is required for this repair?
4. Can the condominium use their maintenance employees to service/maintain these low voltage emergency lighting?
5. Can the condominium use their maintenance employees to replace defective low voltage emergency lights?
MOTION: Mr. Flaherty made a motion to answer questions 1, 2 & 3 by directing him to Chapter 489.505(7), F.S., and to decline to answer 4 & 5. SECOND: Mr. Cannava. Motion passed unanimously. MOTION: Mr. Flaherty made a motion to modify the Final Order to stay the license suspension for a period of one (1) year and if Mr. Reaves fails to complete the obligations imposed in the Final Order filed on August 23, 2013, the stay shall be lifted and his license shall be suspended until all obligations are satisfied.. Larissa Vaughn, Investigations Supervisor, Division of Regulation, provided the Board with an update on the unlicensed Activity enforcement efforts. Ms. Vaughn reported there were 661 sweeps and 30 stings completed in the 2015 – 2016 fiscal year.

Ms. Christie also informed the Board the Department has created a separate application form For Veterans to use as the bill changing their requirements also was signed by the Governor.

Old Business/New Business Mr. Hoffmann informed the Board this would be his last meeting. The Board Members thanked Mr. Hoffmann for his service. Mr. Hoffmann will continue to serve on the Probable Cause Panel.
Prosecuting Attorneys’ Report - Daniel Brackett, As sistant General Counsel Mr. Brackett directed the Board’s attention to the details of the report. The report included case information for all open cases as of March 8, 2016. MOTION: Mr. Botkneht made a motion to continue prosecuting year old cases SECOND: Mr. Flaherty. Motion passed unanimously.
Board Counsel’s Report – Deborah Loucks, Assistant Attorney General Ms. Loucks thanked the Board Members for their attendance and cooperation during the Anti- Trust Presentation.
