REPORT NARRATIVE SYNOPSIS: Trina Koistra was arrested during a search for a wanted felon, at her residence. Koistra is on probation and a 4th waiver. Koistra was a pre-violator of her probation with a pending warrant in the system for her arrest. During the search and after numerous loud verbal commands for anyone inside her residence to exit there was no response. Koistra was found by a Sheriff's canine squatting down, hiding under a blanket, behind clothing, in the far corner of a closet. was found by a Sheriff's canine hiding underneath a bed in a separate bedroom. was arrested for the outstanding felony warrant and Koistra was arrested and charged with 1203.2(a)PC (Violation of Probation), 32PC (Accessory) and

148PC (Delaying/Resisting). and Koistra were the only two that chose to stay inside her residence to avoid capture/arrest. Koistra assisted and aided in housing then hiding when the Sheriff's department made their presence known on scene. Both and Koistra were treated at the hospital then later booked into county jail. ORIGIN: On 01-09-16, at about 1100 hours, I assisted the Fugitive Task Force (FTF) in apprehending a wanted felon at 250 La Cresta Heights Rd. , El Cajon. (CAD#E3072594) INVESTIGATION: I was briefed by Sergeant Davis (TFS80) that the wanted felon was a I was advised had an active no bail felony warrant and was to be considered armed and dangerous. I was also advised that was a person of interest in a homicide.

I was also advised that Koistra was a pre-violator of her

probation and if found hiding inside would be arrested. A plan was devised and we headed towards the target residence at 250 La Crest Heights Rd. to make contact. When we arrived a perimeter was set with ASTREA up above assisting. Sergeant Davis, FTF deputy Enns and I staged in the immediate area of the front door. Sergeant Davis used a hand held Public Announcement (PA) system to announce our presence. Numerous announcements were made via the PA of: "Sheriff's department on a probation check exit the trailer now" "If anyone is inside you need to exit now" "Sheriff's department we have a canine if you do not come out you will be bit." After an extended period of time of making announcements and waiting outside the front door opened and a white male (unknown name) exited. The white male stated the only other person inside the trailer was an elderly female in a back room. We continued with more announcements using the PA until we received no other response. We devised a plan to make entry. We decided to stack and conduct a slow clear in the order of: FTF deputy Enns, FTF Deputy Perata, K-9 (Vail), FTF officer Benjamin and FTF deputy Bradley. We approached the front door that was in the open position and FTF Perata stopped at the opening. FTF Perata made loud verbal commands for anyone inside the trailer to exit and there was no response. FTF Perata then made loud verbal commands of "Sheriff's department with a canine come out or you will be bit" and again there was no response. After waiting some time at the front door we made entry. We methodically cleared as we moved forward with FTF Perata continually making announcements for anyone inside the trailer to come out. As we moved into the kitchen area, in front of me to my right I observed a bathroom and two bedrooms alongside it. The bedroom door to the right of the bathroom was open and the bedroom door to the left of the bathroom was closed. To my rear there was another bedroom that FTF officer Benjamin and FTF deputy Bradley broke away from us to clear.

I moved forward with FTF Perata and slowly cleared the small bathroom (door open) and then peered into the open bedroom door on the right. Inside I observed an elderly female standing with her walker in the middle of the room. She was surprised to see us and asked what was going on. FTF Perata yelled at her to exit the room but she was hard of hearing. FTF Perata yelled and motioned with his hand for her to exit. The elderly women slowly exited and again asked what was going on. FTF Perata told her we were looking for someone who was wanted and she said "Then use that dog that you have with you." The elderly woman was secured in a safe location and I decided to use my canine partner Hank to clear the bedroom. My intention was to have the canine available at the scene as a psychological deterrent to any aggressive acts might make against me, my partners and the public. Additionally, I wanted to prevent the use of a higher level of force. The totality of the circumstances heightened my awareness of the situation. I was searching for a wanted felon and a person of interest in a homicide. We had made numerous announcements for everyone to exit the trailer. I believed was hiding. Through my experience subjects that hide are under the influence of something and are unpredictable in their actions. The suspects the FTF Unit deals with are individuals that do not want to return to jail and will avoid capture by any means. These subjects are usually repeat offenders or gang members with a history of violence to include being armed. I made two loud verbal commands of: "Sheriff's department with a dog come out or you will be bit" and there was no response. I waited a bit, listened, heard nothing then gave Hank the command to search. Hank immediately went to the closet door (slider doors) and began intently sniffing about the area, stuck his head in a partially open door closest to us, attempted to enter but could not due to clutter inside. Hank exited then went to the furthest end of the closet door that was closed. I slid open the door and I observed Hank lunge inside. I looked and could see Hank's head buried behind a lot of clothing that was hanging up. I moved forward and pulled the clothing back and away from Hank. I then observed him making contact with someone that was squatted down, hiding under a blanket in the far rear corner of the closet. That someone was not making a noise and then all of a sudden I heard a female's voice say "ahhh." I removed the blanket and observed it was a female later identified as Trina Koistra. I removed Hank from his contact; Koistra was handcuffed and removed from the scene. FTF officer Bobbitt was on scene and violated Koistras' probation. All that was left of the trailer to clear was the bedroom to the left of the bathroom with the closed door. FTF Perata opened the door which was unlocked and I made two loud verbal commands of: "Sheriff's department with a dog come out or you will be bit" and there was no response. I waited a bit, listened, heard nothing then gave Hank the command to search. Hank entered the room and began running around a bed that was pushed up against a wall. Hank then jumped up on top of the bed and I began to slide the bed away from the wall. As I did this Hank immediately dove head first between the wall and the bed and made contact with a foot that was hanging out from underneath it. I heard nothing and could see Hank pulling on it. I immediately lifted the bed and frame up to observe underneath and noticed it was . I observed roll onto his left side then began kicking down with his right foot on top of Hank's head.

I immediately yelled "Stop fighting the dog" but refused. continued kicking down at Hank's head and then I observed him use his right hand to strike at Hanks' snout. While still holding the bed up to keep it from falling on us I used the bottom of my right foot to punch/push right upper shoulder to get him to roll onto his stomach. My foot glanced off his shoulder and struck him on the right side of his head. continued fighting with Hank and someone was able to take control of the bed. I immediately went to the aid of Hank and delivered a knee strike to the right side of body continually yelling "Stop fighting the dog." I then yelled at to "Lay on your stomach" but he refused. I then used all my body weight in a downward position with both my knees pushing on the right side of body forcing him to his stomach. FTF officer Benjamin moved in and was able to handcuff With now secure I was able to remove Hank from his contact without further incident. Medical treatment was requested for and Koistra. San Miguel Engine #7218 and Zone 2 Rural Medic #7296 arrived on scene to tend to them. Medic #7296 advised me and Koistra would need to be transported to Alvarado Hospital for further treatment and evaluation. was transported to Alvarado Hospital by Deputy Greene, #7131, and Koistra by Medic #7296. I contacted Sergeant Hout, #2284, and advised him of the canine contact. Sergeant Hout arrived at Alvarado Hospital to handle the investigation. FTF deputy Bradley and FTF officer Benjamin arrived at the hospital to take custody of

. Koistra was later transported to Scripps Mercy Hospital for further treatment. I stayed with Koistra at Scripps Mercy Hospital until relieved by Deputy Manire, #1355. While at Scripps Mercy Hospital, I was gathering Koistras' belongings when she began to cry. I walked over to Koistra and she told me she was sorry for hiding. Koistra told me when we arrived at her trailer she heard someone inside the trailer say the "cops" are here and she got scared and hid in the closet. She told me she had relapsed and was afraid to go back to jail. I asked her if she heard me yelling about the dog and she said yes but she did not think we had one. She knew we were inside the trailer searching. EVIDENCE: None. PROPERTY DAMAGE: None. INJURIES:

REPORT NARRATIVE

SYNOPSIS: Trina Koistra was arrested during a search for a wanted felon, , at her residence. Koistra is on probation and a 4th waiver. Koistra was a pre-violator of her probation with a pending warrant in the system for her arrest. During the search and after numerous loud verbal commands for anyone inside her residence to exit there was no response. Koistra was found by a Sheriff's canine squatting down, hiding under a blanket, behind clothing, in the far corner of a closet. was found by a Sheriff's canine hiding underneath a bed in a separate bedroom. was arrested for the outstanding felony warrant and Koistra was arrested and charged with 1203.2(a)PC (Violation of Probation), 32PC (Accessory) and 148PC (Delaying/Resisting). and Koistra were the only two that chose to stay inside her residence to avoid capture/arrest. Koistra assisted and aided in housing then hiding when the Sheriff's department made their presence known on scene. Both and Koistra were treated at the hospital then later booked into county jail. ORIGIN: On 01-09-16, at about 1100 hours, I assisted the Fugitive Task Force (FTF) in apprehending a wanted felon at 250 La Cresta Heights Rd. El Cajon. (CAD#E3072594) INVESTIGATION: I was briefed by Sergeant Davis (TFS80) that the wanted felon was a . I was advised had an active no bail felony warrant and was to be considered armed and dangerous. I was also advised that was a person of interest in a homicide.

I was also advised that Koistra was a pre-violator of her probation and if found hiding inside would be arrested. A plan was devised and we headed towards the target residence at 250 La Crest Heights Rd. to make contact. When we arrived a perimeter was set with ASTREA up above assisting. Sergeant Davis, FTF deputy Enns and I staged in the immediate area of the front door. Sergeant Davis used a hand held Public Announcement (PA) system to announce our presence. Numerous announcements were made via the PA of: "Sheriff's department on a probation check exit the trailer now" "If anyone is inside you need to exit now" "Sheriff's department we have a canine if you do not come out you will be bit."

After an extended period of time of making announcements and waiting outside the front door opened and a white male (unknown name) exited. The white male stated the only other person inside the trailer was an elderly female in a back room. We continued with more announcements using the PA until we received no other response. We devised a plan to make entry. We decided to stack and conduct a slow clear in the order of: FTF deputy Enns, FTF Deputy Perata, K-9 (Vail), FTF officer Benjamin and FTF deputy Bradley. We approached the front door that was in the open position and FTF Perata stopped at the opening. FTF Perata made loud verbal commands for anyone inside the trailer to exit and there was no response. FTF Perata then made loud verbal commands of "Sheriff's department with a canine come out or you will be bit" and again there was no response. After waiting some time at the front door we made entry. We methodically cleared as we moved forward with FTF Perata continually making announcements for anyone inside the trailer to come out. As we moved into the kitchen area, in front of me to my right I observed a bathroom and two bedrooms alongside it. The bedroom door to the right of the bathroom was open and the bedroom door to the left of the bathroom was closed. To my rear there was another bedroom that FTF officer Benjamin and FTF deputy Bradley broke away from us to clear. SUBJECT: Review ofCN# 16101369

CONFIDENTIAL:

On 01/09/16 at about 1100 hours, FTF units were attempting to serve a felony arrest warrant on at 250 La Cresta Heights Road in El Cajon. was also a suspect in a recent homicide. Deputy Vail deployed his canine inside the residence to locate and apprehend During the search, Deputy Vail's canine located and bit Trina Koistra, .

REVIEW:

On 01/09/16 at about 1100 hours, I was notified by Sheriffs Dispatch that Deputy Vail's canine had made contact with and Koistra. I was advised and Koistra had been transported to Alvarado Hospital located at 6655 Alvarado Rd. in the City of San Diego.

I met with Deputy Vail at Alvarado Hospital and completed this investigation.

I made all appropriate notifications to both the Emergency Services Lieutenant as well as the on call Division of Inspectional Services Sergeant Maryn.

Photos were taken of and Koistra's injuries and an interview was conducted with Koistra regarding the incident. declined to give a statement. The photographs of and Koistra and the audio recording were copied to a CD-R disc and attached to this investigation.

CONCLUSION:

Deputy Vail's decision to use his canine was based on the following factors:

was the suspect of a felony warrant and recent homicide.

refused to obey lawful commands to surrender during canine announcements.

Deputy Vail used his canine to locate and apprehend who was attempting to evade capture and hiding in an area where it was unsafe for deputies to proceed.

The use of the canine was within policy and deployed in an appropriate manner.

INJURIES:

sustained punctures to his lower left leg.

Koistra sustained punctures to her cheek and a fractured jaw. Koistra also sustained a laceration to her left forearm, punctures to both hands.

I met with Koistra on 01/11/16 at Mercy Hospital and obtained the following statement.

Statement of Koistra:

STATEMENT OF KOISTRA:

Koistra understood I was interviewing her regarding the use of the Sheriffs Canine and that the interview was being recorded.

Koistra indicated she suffers from mental illness but could not say what form.

Koistra has no problems with her eyes or ears.

Koistra said she was taking medication.

I asked Koistra if she heard the Sheriffs K9 announcement. Koistra said she did not. Koistra

said she was in the closet sitting on her butt and clothes were hanging in front of her. Koistra

was hiding from her probation officer and thought her probation officer was there for her. Koistra heard the announcements from outside and that's why she thought her probation officer was outside.

Koistra said the dog was biting her for about 30 seconds.

I concluded my interview of Koistra.

Photos were taken of Koistra's injuries and an interview was conducted regarding the incident. The photographs of Koistra and audio recording were copied to a CD-R disc and attached to this

investigation.
