Pursuant to section 273EA of the Customs Act 1901, I, Anita Catherine Langford,
delegate of the Minister for Home Affairs, hereby give notice that it is intended,
within seven sitting days of the House of Representatives after the date of publication
of this Notice in the Gazette, to propose in the Parliament alterations to the Customs
Tariff Act 1995 as set out in the Schedule to this Notice having effect on and after

Consultation RARMP for licence application DIR 112 from Commonwealth Scientific and Industrial Research Organisation: Limited and Controlled Release of Genetically Modified (GM) Wheat and Barley
Australia’s gene technology regulatory system is designed to protect the health and safety of people and the environment by identifying risks posed by, or as a result of, gene technology and managing those risks.
The Gene Technology Regulator is currently assessing Licence Application DIR 112 from the Commonwealth Scientific and Industrial Research Organisation (CSIRO) for a limited and controlled release of up to 118 lines of wheat that have been genetically modified for altered grain composition or enhanced nutrient utilisation efficiency, and 40 lines of barley that have been genetically modified for enhanced nutrient utilisation efficiency.
The primary purpose of the three year field trial is to assess the agronomic performance and grain properties of the GM wheat and barley lines grown under field conditions. The trial is proposed to take place at one site in the Shire of Merredin, Western Australia, on a maximum area of 1.0 ha per year, between May 2012 and June 2015. The GM wheat and barley would not be permitted in human food or animal feed.
A consultation Risk Assessment and Risk Management Plan (RARMP) has been prepared, which concludes that the proposed release would pose negligible risk to human health and safety or to the environment. A range of licence conditions are proposed, including measures to restrict the release to the size, location and duration requested by CSIRO.
The Regulator welcomes written submissions in order to finalise the RARMP, which will then form the basis of a decision on whether or not to issue the licence. Under paragraph 16(2)(a) of the Act, the Treasurer may, by written notice given to a person who holds an Approval under section 14, impose one or more conditions or further conditions to which the Approval is subject. Under paragraph 16(2)(b) of the Act, the Treasurer may revoke or vary any condition imposed under paragraph 16(2)(a) of the Act or specified in the Notice of Approval. The Treasurer’s power under subsection 16(2) of the Act may be exercised on the Treasurer’s own initiative or on application made to the Treasurer in accordance with the requirements of subsection 16(4) of the Act, by the person who holds the Approval (see subsection 16(3) of the Act).

A person who holds an Approval under section 14 may apply to the Treasurer under section 17(1) of the Act, to vary the percentage specified in the Approval.Note 2
Under subsection 17(6) of the Act, the Treasurer may, on the Treasurer’s own initiative, by written notice given to a person who holds an Approval under section 14, vary the percentage specified in the Approval if the Treasurer is satisfied that it is in the national interest to do so.

Section 19 of the Act provides for flow-on approvals. If an Approval has been granted for the holding of a stake in a financial sector company and the financial sector company is a holding company for an authorised deposit-taking institution or an authorised insurance company, then an approval is taken to exist for the holding of a stake of equal value in each financial sector company that is a 100% subsidiary of the holding company.

Under section 14 of the Act, the Treasurer must give written notice of this Approval to the applicant and financial sector company concerned, and must publish a copy of this Notice in the Gazette.Note 6
Under section 11 of the Act, a person or 2 or more persons under an arrangement are guilty of an offence if the person(s) acquires shares in a company and the acquisition has the result, in relation to a financial sector company, that:

(i) an unacceptable shareholding situation comes into existence; or (ii) if an unacceptable shareholding situation already exists in relation to the company and in relation to a
person – there is an increase in the stake held by the person in the company;
and the person(s) was reckless as to whether the acquisition would have that result. A maximum penalty of 400 penalty units applies or by virtue of subsection 4B(3) of the Crimes Act 1914, in the case of a body corporate, a penalty not exceeding 2,000 penalty units. By virtue of section 39 of the Act, an offence against section 11 is an indictable offence.
Under subsection 32(3) of the Act, if a person has engaged or is proposing to engage in any conduct in contravention of a condition to which an approval under section 14 is subject, the Federal Court may, on the application of the Treasurer, grant an injunction:

DETERMINATIONBY THE AUGMENTED ELECTORAL COMMISSION
FOR SOUTH AUSTRALIA
Pursuant to section 73 of the Commonwealth Electoral Act 1918, the augmented Electoral Commission for South Australia hereby determines that the names and boundaries of the electoral divisions into which South Australia is to be distributed are as shown on the maps certified by the members of the augmented Electoral Commission for South Australia and lodged in file number 2011/43 at the National Office of the Australian Electoral Commission in Canberra. RENAMING OF DEPARTMENTS OF STATE
The Prime Minister gives notice that on 14 December 2011, the Governor-General in Council, acting on the Prime Minister’s recommendation under section 64 of the Constitution, changed the name of each Department of State specified in Column 1 below to the name specified in Column 2 below opposite the first-mentioned name:

ADMINISTRATIVE ARRANGEMENTS ORDER
The Administrative Arrangements Order specifies the Departments of State, the principal matters they deal with and the legislation administered by each Minister of State.
On 14 December 2011, the Governor-General in Council revoked all administrative arrangements previously ordered and made a new Administrative Arrangements Order.
The new Administrative Arrangements Order is available on the Department of the Prime Minister and Cabinet website at: http://www.dpmc.gov.au/parliamentary/index.cfm.
