We dont need this kind of development on the North Shore... The infastrucutr of the norht shore can not handle this load or burden.. The traffic is all ready way out of control and something need to be done about that beofre ay expansion plans.. i say no to the proposed turtle bay expansion plan

my family frequently visits Oahu from our home in Portland oregon. the reason the north shore is so beautiful is because it is not filled with resorts like other parts of the island. turtle bay is big enough as it is and should not be expanded any further. if they want to attract more tourist money they should work on improving the quality of their current site while protecting the small towns and coastline on the north shore.

Please do not develop on what is left of our paradise island for this is the last of the open beaches that is very important to us! As a ohana of islanders, we have enjoyed these same beaches for generations and wish to save them for the future generations yet to come. If we let this poorly planned development go on, then we have lost another part of our island paradise heritage and the right to be a good caretaker of this land that was always meant to be free and open to us all and not to just a few individuals for exploitation and profit!

Further expansion of Turtle Bay would be devastating to the North Shore. Aside from the environmental issues, there is quality of life for those of us who reside here, Over the past 20 years we have seen what had been 'weekend traffic' become daily traffic, worse each year. This is a small island; we have one Waikiki and do not need or want anything similar on the North Shore. Mainland investors have one goal -profit. Their expected earnings cannot be allowed to be more important than the quality of of our lives, the protection of our natural land.

I'll start with one word... Infrastructure. In which case the North Shore currently has "the lack of" to handle it's current population and visitors. The traffic year round has gotten so bad in the past 5 years and things will only get worse even if there is none of your buildings erected. The building plans from what I've seen you guys are proposing is crazy! Right now the turtle bay hotel and it's surroundings are like a retreat hidden in the middle of the country.

It would be a shame to ruin the natural environment. The run off, pollution, sewer, construction, foot and car traffic will ruin the beaches and wildlife. As of now people have the opportunity to enjoy untouched land and beaches but also experience a world class hotel that has been there for years. I'm all for growth... but very little at a time. The North Shore is in no means ready for the growth you guys want to do.

I'm sure if any of you guys live in the area you personally know so many things need to be down before a single additional hotel room, building or road gets made. Not to mention, the housing or buildings not associated with you along the North Shore.

And wouldn't it be better for you to keep as the size you are now and have the high occupancy rate?

PS: on 12/29/12... the traffic was backed up for 3.5 miles and took me 1 hour to go from the bypass in Haleiwa to Pupukea. This is a common theme and the summers can be worse.

This project, as currently outlined, would be a disaster for the North Shore. I have been visiting for over 15 years and stay up on the NS because it is rural, and country. North Shore cannot support development of this massive proportion. North shore is already crowded and traffic conjested enough. We do not need more development for profit. We need this land for agriculuture, what it was originally classified as. The negative cummulative impacts of theis project are too great and outweight the bnefits. Although this supplemental EIS is a reduction in size of the development, that is not good enough reasoning to allow this project to continue. Just becasue it is leess expansion than originally planned doesnt meean there should be expansion at all, and doesnt make it right. I belive the proposed expansion and arguments for development are invalid and incorrect reasoning. Please think about the irreversible and tremendous damage this expansion will cause the north shore community. Keep the country country please!!!

Visitors come to this part of Oahu to enjoy the natural beauty and get away. If they wanted to go to a big resort they would go to the west side or Waikiki. Locals live on this part of the island for it's more rural lifestyle. The area has already grown so much and will not support any of the proposed growth plans. The traffic is only one of the concerns. The plant and animal species, especially those that are endangered, that will be adversely impacted are also a major concern.

Please don't build more hotels or houses on the North Shore. It takes me 25-35 minutes to drive from Pupukea to Haleiwa mid day every day due to the already busy traffic. I have grown up on the North Shore my whole life and it makes me so sad of the idea that more hotels are wanting to be built. What we residents need is the stated to divert traffic in front of "turtle" beach or known as Lani a kea beach.

Submission 6 January 2013 Re: Turtle Bay Resorts Proposed Development and the Supplemental Environmental Impact Statement (SEIS)

A. Overview

1. The SEIS identifies matters said to be relevant to an application to make major changes to the intensity of usage of a culturally and environmentally significant area of northern Oahu (the subject land) by way of increased commercial and residential facilities (the proposed development). The subject land includes a four mile ocean frontage either side of Turtle Bay which is largely of pristine beauty and a habitat for numerous species of marine and terrestrial wildlife.

2. The scale of the proposed development to the subject land is large. It includes two new hotels with proposed accommodation of 600 rooms (the hotels development). This is in addition to the existing hotel of to the 500 units, plus 368 condominium units, which will continue to operate on the subject land. The proposed development also includes 750 new units of residential accommodation with the proposed construction of 590 new resort homes of heights up to either 50, or alternatively, 60 feet; plus 160 community housing units (the resort home and housing development).

3. The SEIS and related material is a substantial document containing a detailed analysis of the impact of the proposed development, including by environmental and other experts. The writer recognises and respects the great amount of time and effort which has gone into the preparation of the SEIS by the developer and others.

4. This submission suggest further consideration of matters regarding the proposed development under the following headings:

a. Relevant considerations for approval of proposed development & the SEIS

i. Impact of development on the subject land

ii. Impact of development beyond the subject land

b. The Precautionary Principle and the burden upon the proponent for change

c. The Law of Aloha

5. It is beyond dispute that Oahu (and the other islands comprising the State of Hawai‘i)

has a unique natural beauty plus a distinctive cultural heritage. An unusual feature of Oahu is the contrast between the urbanized south side, or Town, e.g. Honolulu/ Pearl Harbour region, as opposed to the rugged natural beauty of the North Shore, or Country, e.g. Kaena Point/ Kahuku region.

6. The natural beauty of the undeveloped Country remains a source of pleasure for both Hawaiians and overseas visitors as opposed to the attractions of Town. One of the special features of the Country is its marine wildlife such as turtles, seals and whales plus its ocean based sporting activities which pay homage to Native Hawaiian customs. The aesthetic and cultural value arising from the natural beauty of the Country has global appeal and also proven economic value to the island.

7. The SEIS frequently refers to the scale of a previous proposed development and the associated 1985 Kuilima EIS (1985 EIS), by way of support for a purported reduction in scale of usage change for the subject land.

8. Reference to the 1985 EIS distracts from taking into account relevant considerations to the change of the use of the subject land in 2013, by advancing a seemingly irrelevant consideration of what was not done in the 1980’s. There is no evidence that that larger 1985 development was appropriate or not flawed from a planning perspective for the subject land. Furthermore, over the last 28 years much has been learnt and embraced as to the need for the local and global conservation of the environment.

9. In any event the developer acknowledges the decision by the Hawai‘i State Supreme Court that the 1985 EIS was no longer valid. Furthermore it is reasonable to suspect that a cause of the inability to implement the development the subject of the 1985 EIS was that the larger development was assessed by the market to be not sustainable.

10. A more effective assessment of the SEIS requires comparison of the proposed change to the actual usage in 2013 of the subject land at Turtle Bay, and not comparison to the change which was proposed by the 1985 EIS and development.

Impact of development on the subject land

11. An effective environmental impact statement (EIS) must give adequate and proper consideration to the foreseeable impact of any development upon the subject land. This will usually involve key factors such as sustainability, land use, resource access, and impact upon the existing/future community.

12. Sustainability issues in the SEIS are considered at a high level of abstraction and by aspiration. Detail would assist. Consideration of the likely carbon footprint, audit and conservation measures including capture or offsets are also now appropriate.

13. The SEIS advances the use of part of the subject lands as agricultural lands to preserve traditional use, heritage and open space. Yet a potential change of usage is foreshadowed in regard to agricultural lands being converted to alternative energy generation which appears to negate such aims.

14. It is unclear whether the proposed public access to the ocean front mooted in the SEIS will be by dedicated public land and thus permanent, or rather at the discretion of the developer or its assigns or successors. This is a matter of significant community importance to ensure future equitable enjoyment of the ocean by all on the island.

Impact of development beyond the subject land

15. Further factors which properly ought to be included in an EIS will be the foreseeable impact of the proposed development beyond the subject land, including upon members of the existing/ future community. The inclusion of proposed mitigation measures for such impacts will allow an approving authority to take into account relevant considerations to reach its decision on a development application.

16. Also identification by specification of the likely size and accommodation/occupancy levels of the 590 homes which will be up to 50 or 60 feet in height, necessarily of a potentially large size, would allow a better assessment of the impact of the proposed development.

17. The traffic impact analysis advanced by the developer recognises the likely existence of traffic congestion in 2025 in any event. Necessarily the proposed development will exacerbate such congestion.

18. Consideration of the likely long term detriment to traffic movement on the Kam Highway arising from increased traffic due to the proposed development of the subject land in the context of other potential development in the region would assist. Thus the traffic analysis fails to consider proposed increases to vehicle use in the area from each of the currently proposed Envision La‘ie or the Haleiwa Hotel developments.

19. Furthermore, the adoption of an assumption of straight line growth pattern for traffic studies fails to recognise the potential for non-linear effects on journey time for a finite road system arising from an increased number of vehicle movements.

20. Additionally, the basis for assumptions and the reasoning process for the traffic impact analysis for the future are unclear, other than by reference to computer modelling. No ORTP analysis was provided for current weekend traffic as that was not available.

21. Other infrastructure likely to suffer overload from the proposed 650 new homes will include medical facilities, such as Kahuku Hospital, schooling and retail facilities such as food outlets.

22. Any consequent loss of amenity to the enjoyment of the North Shore for both residents and visitors due to the change to the intensiveness of use of the subject land arising from the proposed development including from traffic congestion and infrastructure demands generally may well sound in both unmeasurable loss of amenity and quantifiable economic loss.

C. The Precautionary Principle and the burden upon the proponent for change

23. The precautionary principle is a concept founded upon a common sense approach to decision making regarding unreplaceable resources, such as for the environment. It finds expression in the saying "First do no harm." It carries the sense of foresight and preparation—not merely “caution.†An ethical assumption behind the precautionary principle regarding the environment is that humans are responsible to protect, preserve, and restore the global ecosystems on which all

life, including our own, depends.

24. In applying the precautionary principle to the SEIS for the subject land a reasonable decision maker needs to be satisfied by the developer who is advancing the proposed development that there is a sound and sustainable basis for the change from the status quo to an area which has unique natural and cultural value to the people of Hawaii and the world.

25. Furthermore, given the unique nature of the subject land, and the potential impact upon both the local and broader community, a decision-maker needs to have a comfortable level of persuasion before approving change such as that advanced by the proposed development.

D. The Law of Aloha

26. The Hawaiʻi Revised Statutes includes § 5-7.5 "Aloha Spirit". That law emphasises the essence of relationships in which each person is important to every other person for collective existence. The Aloha Spirit also reinforces the uniqueness of Hawaiʻi.

27. The principles explained by § 5-7.5 "Aloha Spirit" appear to be a relevant consideration to the determination of the application for the proposed development based on the SEIS.

28. HRS § 5-7.5 "Aloha Spirit" also may provide guidance to a decision-maker to determine an outcome for the application which serves the greatest number for their greatest good, mindful of principles of sustainability to strike a balance between economic, social, community, and environmental priorities and to meet the needs of the present without compromising the ability of future generations to meet their own needs.
