It represented for me the long hazy days of summer I remember when I was a lot younger. Were summers longer then? It reminded me that we have some lovely green spaces in Billericay, each with its own special character. There was one comment I read this week which connected with me. It was about the lag between development and infrastructure potentially resulting in years of misery before anything is in place. On a positive note we have yet to see whether the new Community Infrastructure Levy, CIL, which is based upon a fixed amount per property based upon floor area and is paid earlier in the development cycle will have a positive effect. Local Plan We are expecting news for our next edition and to put on our website which will give further details of a drop in day. You will see that two days have been provisionally booked – 15th and 29th September. Volunteers We attended the first Volunteers Network event with other local groups however to date we have not had any takers. We are looking for people to join us as we go to the next phase of the growth of the Association. If you are interested in being a Membership Secretary, Assistant Magazine Editor, Area Committee member or a road rep and would like further details then please contact us on [email protected] or visit us at the Summerfest on July 8th. Coach holiday After the very successful coach holiday this year there is another one planned for next March to Bournemouth. The next stage of the Local Plan hasbeen delayed. The Regulation 19 PublicConsultation is now unlikely to take place

before September.At its meeting on 7 JuneBasildon Council decided torefer the draft Plan to itsnew Strategic Planning andInfrastructure Committee toreview 5 specific areas ofconcern;

• the strategy for locatingsites for gipsy, travellerand travelling showmen’saccommodation

• the provision of the 300extra houses in Billericaywhich were part of the nowrejected TaylorWimpeyalternative relief road route

• proposals in the BowersGifford, Hovefields andHoniley and Noak Bridgeareas.

For Billericay, if the changesare made, the proposed 15traveller pitches and 300houses in the current draftPlan could be removed,although nothing else in thePlan would be changed.

The SP&I Committee willnow prepare a revisedtimetable to take account ofthe delay.

Whilst we welcome thepossible changes we areconsiderably disappointedthat the opportunity has notbeen taken to address thefurther concerns of Billericayresidents and BDRA/BAGwill continue to oppose

overdevelopment whichadversely affects the qualityof life of our town’s residentsand unjustifiably erodesirreplaceable Green Belt.We believe the current draftLocal Plan, even if amendedin the areas identified,remains fundamentally

unsound and we willcontinue to oppose itvigorously, through both theforthcoming Regulation 19Consultation and thesubsequent Examinationin Public before theGovernment’s PlanningInspector.

We are all getting older andmay not possess all themental acuity we had when

younger.

We had a visit recently from a young manwho wanted to know how much his father’smoney was now worth and how he could gethold of it. He advised us that his father wassuffering from some form of dementia andcould not handle his own affairs any longer.

“Do you have a Financial Power of Attorneyfor your father?” we asked. “No” he replied.“Then we are very sorry, but we cannot helpyou” we would be in breach of dataprotection regulation and clientconfidentiality, something which we simplycannot do”.

In another case we called on a client who didnot know who we were or why we were there.I must add that we had been seeing her

regularly for 20 years at that point, so it wasclear there was a problem.

We had a conversation with a young ladywho was in the house at that time whoinformed us that the client was sufferingmemory problems, in view of this she woulddeal with the client’s money. Again, we hadto ask for the Power of Attorney and weredelighted when it was produced but when weasked for photo ID to prove it was her namedon the POA her attitude changed and shebecame quite hostile.

She could have been anybody as far as weknew, and we could not reveal personalfinancial information without being certainwho we were dealing with.

Like me you are probably fed up with GDPR.(General Data Protection Regulation) In ourcase not a lot has changed, we must still notreveal client’s personal data without theirexpress permission, which is quite right andproper, but this can and does cause problems.

The recent statistics released by CAFCASS, the Children and FamilyCourt Advisory and Support Service, show that April 2018 was thehighest demand in April for 4 years regarding the amount of

applications in private law child cases. Below is an explanation of what youcan do if you find yourself in a similar situation with your children.

Child Arrangement Orders: Whatorders can I apply for in private lawchild cases if there is a dispute aboutmy children?If there is disagreement about how childrenshould divide their time between theirparents, an application for a ChildArrangements Order can be made and in myexperience this is the most commonapplication.

However here are other orders to assistparents, which are less well known.

Specific Issue Orders: What if I needhelp to determine a specific questionthat has arisen, or that may arise, inconnection with my children? For example, mum would like their child togo to one school but dad thinks that adifferent school would be a better option. Or,dad would like their child to be raised withthe beliefs of a religion but mum wouldprefer their child to be raised an atheist.

In cases where these issues arise, anyonewith parental responsibility, usually the

Prohibited Steps Orders: What if Ineed help to stop the other parentfrom doing something? For example, if a parent is concerned that theother parent could remove a child fromschool or nursery. Or, the parents were ableto agree arrangements generally, but nowone parent would like to take a child abroadand the other does not think that this isappropriate.

In cases where these issues arise, anyonewith parental responsibility, usually themum and dad, can make an application tothe court for a Prohibited Steps Order.

In both cases the client’s children wereupset to say the least but I hope you cansee the issues from our point of view. Thereare two messages I would like to getacross: -

Two, why not arrange for your adviser tomeet anybody you have nominated asyour POA especially if they are yourbeneficiaries. This will avoid lots ofpotential issues and make everybody’s lifemuch simpler.

It is an organisation that hasprovided a great deal of helpand advice to the Residentsof Billericay and District overthe years, the interests of thepeople and the area beingparamount. It is continuallyevolving and the recentmerger with BAG is clearevidence of this.

I would also welcome theviews from all Residents as tohow they see the Associationnow and what changes theywould like to see for thefuture.

I look fo rward to thechallenges in my new role asChairman of the BDRA. I dobelieve that following the

merger with BAG we nowhave an even stronger teamof talented people workingfor the people of Billericay.Having said that, there is stilla need for more people tobecome involved in thisorganisation, particularly inthe two Area Committees.This would then providethe seed corn leading tofuture positions on theExecutive Committee for thosepeople who wished to do so.

Young people are in myexperience involved in manyways within the Community,albeit now in areas where theBDRA may not be reachingthem, Youth Clubs, Guides,Scouts, and Sports Clubs etc.

I would like to encouragethem to consider involvementwith the BDRA adding theirvoice and ideas. I undertakemock Interviews with pupilsacross Essex and I am verypleased and encouraged tosee the variety of things thatyoung people are involved in.

New WebsiteIf anyone has put a websitetogether they will know thatdecisions about content,updates and relevance are key.It is planned to launch ourwebsite in the Summer so youcan see how well we havedone.

Local Plan Mike Andrews, Vice chair ofBDRA and Chairman of BAG,together with Andy Wilson,BAG Secretary, recently metwith the new leader of BasildonBorough Council, AndrewBaggot t . Andrew wasaccompanied by two of ourlocal councillors, RichardMoore, Chair of the StrategicPlanning and InfrastructureCommittee, responsible for thedevelopment of the Local Plan,and Andrew Schrader.

The meeting was constructiveand friendly and althoughfocussed on our concernsrelating to the Local PlanCouncillor Baggott expressedhis desire to work more closelyin future with the BDRA onmatters affecting the residentso f our town and i t senvironment.

Local Plan Regulation 19As we wait to hear the timelinefor Regulation 19 we continueto prepare for our responseto it. We have a planningconsultant and QC identifiedand briefed and have recentlyidentified a traffic consultant.

Two dates have been pencilledin the reading Rooms diary forthe next drop in day. They are15th and 29th September.Our challenge is to get thebiggest number of responsesever recorded for a Regulation19 consultation. We need thePlanning Inspector to see thestrength of our feelings.

Key AnniversaryMayflower 2020We feel that there should besomething to mark the 400thyear of the sailing of theMayflower. At this stage wewould like anyone to get intouch who is planning tocelebrate the event in someway. BDRA will be discussingtheir involvement. Usualcontact is [email protected].

Vision and strategyAs you know we have joinedwith BAG and feel that thecampaign we are puttingtogether to contest thesoundness of the Local Planwill be all the stronger forhaving them with us as part ofBDRA. In September we will belooking at our committeestructure to ensure that we arefocussed on the issues whichneed to be supported andfollowed through.

Brightside SchoolThe Chair of Governors hasreplied to the West areacommittee who voiced theconcerns of local residents rethe parking issues in theneighbouring streets. Heassures them that the schoolare proactive in remindingparents to consider thecommunity around the school.He adds that ECC are aware ofthe parking issues andimplications of the expansionof the school and arecommitted to consideringthem. He also offered to have ameeting with representativesfrom BDRA, Councillor Hedleyand a rep from ECC.

A separate reply fromCouncillor Hedley shows hisongoing awareness of theproblems and previousattempts to alleviate the issues.He goes on to say that

“I am however, keen to tryand make sure that as littleinconvenience is caused tores idents dur ing theconstruction phase and I willreview the plans to see if anyimprovements can be made, ifit were to be convenient I wouldwelcome the opportunity tomeet with your group todiscuss.”

Flood AlleviationScheme Great BursteadThere continues to be adialogue between residentsand Essex County Council,although there has been noupdate from Councillor Hedley.ECC are refusing to release

Baronlees WoodAl Daw came to the Eastand Burstead Committeemeeting and described theconstruction of a hard standingarea for parking by theSkirmish paintball operationwhich has destroyed a largearea of Baronlees Woodancient woodland. Al’sapproach to Basildon Council’sEnforcement Departmenthas been unproductive. TheCommittee gave its backing toa further formal approach by Alon behalf of the Committee.The response from BBC will bepublished in The Resident.
